advisory continues. it's been trimmed back a bit. the south bay and the santa cruz mountains no longer in the heat advisory but area wide. it is going to feel warm for this time of the year, so we'll start inland. yesterday, our hottest areas hit 101 102. we're close to that once again today. look at all that sunshine. those temperatures warm very fast back into the 90s for daytime highs around the bay shoreline. sunny from the start. we're not expecting any fog out there this morning. it's a warm one later on this afternoon around the bay shoreline back into the 80s and along the coast today we'll keep it mild. upper 60s to the lower 70s for daytime highs. amanda. >> all right, drew. thank you. happening tonight. students, parents and teachers, they're planning to rally at san francisco unified school district headquarters. the district is holding a school board meeting around the same time. the big question, which schools will close and when? abc seven news reporter gloria rodriguez is here live and, gloria, tonight's meeting comes after the mayor assigned a team to help the troubled district. it does. >> amanda, the mayor, announced that she's stepping in to help the school district avoid a state takeover. the district

needs to provide a clear plan and balanced budget to the state by the end of the year. the san francisco unified school district is facing a $400 million budget deficit over a three year period as it discusses staffing cuts and school closures, and the state is threatening to take over. on sunday, mayor london breeds office announced the creation of a team of top city leaders to help advise the district on ways to tackle the crisis. she's calling it the school stabilization team. the seven member team includes the executive director of the department of children, youth and their families. >> the school district is facing some serious financial challenges and our plan is to go in and to make sure that by the end of this year that we help them with a balanced budget, that we help them make the right decisions based on facts. >> the announcement follows an emergency sunday meeting where the district board of education spoke about terminating

superintendent matt wayne. instead, they reached out to the mayor's office for help. last week, the superintendent was set to announce a list of school closures, but that announcement was postponed. and tonight, parents are planning to urge the district to pause those school closures. they're planning to speak at tonight's school board meeting at 630 in the evening at district headquarters. and they're going to start rallying an hour before that meeting. live in the studio. gloria rodriguez, abc seven news. >> thanks, gloria. the latest bill signed by governor newsom aims at limiting or flat out banning student cell phone use. it's called the phone free school act, and it requires school districts, charter schools and county education offices to come up with the plan by july of 2026 to limit or ban cell phone use by students. a bipartisan group of lawmakers backed the bill. supporters say limiting cell phone use in class will help students, academics and mental health, and four other bills signed by the governor aim to crack down on sideshows. videos of these dangerous and often destructive

events are nothing new to us here in the bay area sideshow. this sideshow took place over the bay bridge in april. as many as 100 cars blocking the lanes. one of these new laws allows officers to remove cars that are blocking areas for sideshows, without having to actually make an arrest. another law expands the ability to impound cars in sideshows that take place in parking lots, not just on highways. another expands the penalties for sideshows to include impounding cars for 30 days and requiring restitution for victims, and a final law increases the penalties for both participants and organizers of sideshows that endanger children and cause property damage. >> the vta employee accused of shooting and killing a coworker over the weekend, is expected in court tomorrow to answer to charges in the case. it's the second deadly incident of gun violence at vta in three years.

33 year old duck bowie is accused of shooting and killing 45 year old regulus teotico, seen here in this linkedin photo. the santa clara county sheriff's office says the suspect knew the victim and the two took part in many of the same activities outside of work. >> although this investigation is still ongoing, we believe the motive had to do with money owed between the two from their betting activities, which had nothing to do with their employment. >> teotico isn't the only vta employee killed on vta property in recent years. in 2021, a disgruntled vta mechanic shot and killed nine coworkers before he died by suicide. the sheriff's office is increasing security across vta, and the agency is offering grief counselors for employees. >> new developments in the shooting of 40 niners. rookie ricky pearsall in san francisco's union square. the gun the teen suspect allegedly used in the shooting was reportedly bought legally in phoenix in february. according to the chronicle, a person

bought the semi-automatic gun from a store in downtown phoenix. the gun is popular among police agencies. it's unclear how the weapon traveled across state lines and here to the bay area. the 17 year old boy accused of shooting pearsall is charged with attempted murder. the da's office has not decided if it is going to try to have this case moved to adult court. in the east bay, the city of antioch is dealing with a surge in violence, and there may not be enough officers to handle it. now, the mayor is considering asking outside agencies for help. since the start of september, antioch has had over a dozen shootings and two homicides, three of them just happened over this past weekend. business owners in the area are asking for more law enforcement. >> talk to the city. nothing. talk to the police department. nothing counsel? nothing. so it's really frustrating as a business owner. >> police say some of the shootings may be gang related, but they do not believe all the incidents are connected. antioch mayor sent a statement to abc

seven saying he is working with the police department to continue increasing police presence in the area where most of the violence has happened. he's also considering requesting mutual aid from neighboring cities and is working with local leaders to try and come up with community led solutions. >> i'm at the live desk tracking some high profile hearings happening today on capitol hill. first, a hearing to examine the high cost of weight loss medications in the u.s. the ceo of novo nordisk, which manufactures ozempic and wegovy, will appear before a senate committee. senator bernie sanders is accusing the ceo of, quote, ripping off americans with the high cost of the weight loss drugs. a second hearing today will focus on abortion care. this will examine how former president trump's overturning of roe v wade and subsequent state abortion bans have threatened access to lifesaving medical care for women across the country. this hearing will be the first time in history the senate finance

committee convenes a hearing on the topic of women's reproductive health care. a third hearing will focus on the faa's oversight into boeing. the faa administrator is expected to appear before a house panel today to ensure boeing is building safe airplanes and revamping its safety management program. it comes after several scary incidents, including that door plug blowout in january. all three hearings start at 10:00 this morning, and in the next half hour, i'll dive into additional high profile hearings expected today. that's at 630. now, let's check in with drew. >> hey, amanda. yesterday was a very hot afternoon. look at some of these highs yesterday afternoon, 102 in san rafael, 89 in san francisco. in fact, that is the hottest day in the city in nearly two years. oakland, san jose, livermore, redwood city, all in the 80s and 90s. and we have another warm afternoon on the way. high pressure in control for one more day, supplying us with that summerlike heat. and then finally, this low will win out tomorrow, and this will bring back a return of fall like

last minute, so all lanes are now open, heading into san francisco off the bay bridge. but look at what it's done because of the closure it has caused, caused long big traffic delays on the incline section. in fact, a stall has just been reported to heading into treasure island and that means metering lights were turned on and the drive time from the maze into san francisco is 50 minutes. so it's just been a slow ride this morning. you'll want to avoid this if you can, although it is starting to improve, the san mateo bridge is a better option for you that is moving at 70mph. and then also better news this earlier crash in dublin has been cleared to the right hand side, so hopefully traffic will start recovering on westbound 580 approaching 680. reggie. >> new details into the investigation into the second apparent attempt to kill donald trump. the justice department says it will seek to add an attempted assassination charge against the man accused of staking out trump at his golf course. the accused had written a note detailing his plans to kill the former president. the

note was found in his car, included a list of dates and venues where trump was set to appear. during a hearing yesterday, he was determined to. he was determined to be a flight risk and ordered to remain in custody without bail. this afternoon, the a's begin their final homestand in oakland. they'll play at the coliseum three days in a row, saying goodbye to the city they have called home for the better part of a century. so here's a live look at the coliseum property from our camera along interstate 80. a's fans are blasting team owner john fisher on social media. fisher shared a letter finally addressing the team's departure and apologizing for it. he writes, quote, i know there is great disappointment even bitterness, though i wish i could speak to each one of you individually. i can tell you this from the heart. we tried staying in oakland was our goal. it was our mission and we failed to achieve it. and for that, i am genuinely sorry. on abc seven news at 4:00 yesterday, sports director larry beil shared his take on the apology and larry

bay bridge. what is going on? >> oh my gosh, it is a mess. reggie. amanda. drew, we have been tracking this problem heading into san francisco because of earlier roadwork. so it's a crawl right now. here's some drive times for you. westbound 80, highway four to the maze. it's over an hour, 62 minutes, and then westbound 80 as you continue the drive from emeryville into san francisco. 42 minutes. traffic has just been jammed. you can see it is starting to recover across the upper deck into san francisco because of roadwork that has been cleared, but the bay bridge toll plaza is backed up well through the maze and beyond that onto westbound 80. as an option, you may want to consider the san mateo bridge, but it is slow getting there on southbound 880 and then the richmond-san rafael bridge, also under the speed limit. as you make your way across. a new crash just reported two in the north bay, two cars westbound 37 at mare island, causing delays from highway 29. hi, drew. hi, francis. >> man, it is busy on the roads on this tuesday and we are in store for another warm afternoon. it's a lovely picture

thank you. >> we're learning more about a police shooting near the powell street bart station in san francisco. it happened earlier this month. san francisco police presented body cam video of the incident in a virtual town hall yesterday. officers say they confronted a man with a gun on september 13th. he was inside a vehicle that had been reported stolen. they boxed in the car before instructing him to get out, but police say he then took off with the revolver that was in the front seat. there went into a liquor store on fifth and eddie streets, and then hid behind the counter. he came back out and was pursued down the street. police say they attempted to lasso his legs multiple times, but then say the man continued to try and get away. heading toward the transit station. officers chased him into the bart station. they fired after they say the suspect raised his arm, pointing the gun towards officers. >> the officers involved used time, distance, less lethal devices, and their training to attempt to arrest this individual without using force,

but he refused all commands and continued to flee from them, ultimately ending in an officer involved shooting inside the powell street station. >> the suspect had non-life threatening injuries. it is unclear when he will appear in court. the district attorney's office will also investigate the shooting. >> oakland mayor shengtao says the city is ramping up efforts to clear homeless encampments. tao says the city will move to shut down encampments that pose the most danger or pose the most pressing public safety hazards. in a video announcement posted on social media yesterday, she introduced the bullet points of the new executive order. >> departments are directed to ticket tow or remove to preserve access. if an encampment is creating fire hazards like blocking hydrants, burning fires within 30ft of structures, or illegally tapping into electrical wires. we must clear it, tao says. >> the city will shut down sites with compassion, offering

alternative housing to people who need a safe space to stay. >> california's attorney general is suing exxonmobil, but the landmark lawsuit isn't about oil and gas. it's about plastic. exxon is one of the world's largest producers of polymers, which are the building blocks of plastic. for decades, exxon has promised that recycling would address the global plastic pollution crisis. california attorney general rob bonta says in reality, less than 5% of plastic is recycled. he claims exxon has been lying to the public to make money. >> i as much as you want, no problem. it will be recycled. they say lies. it's time exxonmobil pays the price for its deceit. it's time. exxonmobil is held accountable. >> several environmental groups have also filed a lawsuit against exxon. also claiming that exxon has damaged california's waterways. exxon responded to the suit with this statement, saying for decades, california officials have known their recycling system isn't

effective. they failed to act, and now they seek to blame others. to date, we've processed more than 60 million pounds of plastic waste into usable raw materials, keeping it out of landfills. we're bringing real solutions for recycling plastic waste that couldn't be recycled by traditional methods. >> election day is now just six weeks away. vice president kamala harris reportedly making a move to convince americans she is serious about border security. the new york times reports the vice president will make a visit to the southern border in arizona on friday. it would be her first trip there since becoming the democratic nominee for president. this trip comes after a new poll shows former president trump leads by five points in arizona. it's also where the harris campaign has been hitting trump hard with new ads depicting trump in a chicken suit with the caption there's no debate. donald trump's a chicken. >> let's be clear we are the underdog in this race, and we have some hard work ahead of us.

yesterday. we have a lot of sunshine and it's going to warm very quickly. it's already mild this morning in the 60s. we're already into the 70s by 9 a.m, the 80s by 10 a.m. and our hottest spots already flirting with 90 degree heat by noon. so high pressure is still in control for one more day. acting like a heat pump. but tomorrow this area of low pressure will win out and bring a fall-like feel to the day by wednesday afternoon for one day. speaking of low pressure, i just want to get you updated on the system. we are tracking in the caribbean. you're going to hear a lot about what will eventually become tropical storm helene. this will move its way north over the coming days, and it will strengthen, likely becoming a tropical storm later today and then going into the warm waters of the gulf of mexico and becoming a major category three hurricane by thursday, with its sights set on the panhandle and the gulf coast of florida, where hurricane watches are posted. so we'll keep you updated on the storm. but many big impacts in terms of rain and wind coming to florida by the end of the week.

francisco. it's recovering because of earlier road work, but that caused a big jam at the bay bridge toll plaza with metering lights on. there was even an earlier problem on the upper deck of the bay bridge, so traffic is jammed all the way through the maze. you can see these headlights are crawling and stacked approaching the maze on westbound 80, and it's even bad before you get there, if you want to take an alternate route, the richmond-san rafael bridge is an option or the san mateo bridge, but it is crowded getting there and there's also a problem in richmond. it's a new four car accident blocking the two left lanes. westbound 80 after central avenue. so check out the is these very slow drive times westbound 80 from highway four to the maze is now about an hour and ten minutes. it's only about 20 minutes when there's no traffic. so it gives you an idea how bad it is. and then from emeryville into san francisco, 41 minutes. so bart, also a great option. reggie aqui. thanks, francis. >> this morning we're tracking hurricane john. the storm slammed into mexico's pacific coast overnight as the category three hurricane before being

downgraded to a category two. people are being warned of life threatening flooding and mudslides in some areas. the storm is expected to produce up to a foot of rain through thursday. thousands of people in san francisco are in for a big water bill. that's because of a glitch with their meters. many haven't received a bill in months, and soon they're going to have to make up for it. the city's public utilities commission says the meters for more than 8000 customers just stopped sending out data, so the agency never charged them. some didn't get billed for more than a year. the city is going to tack all those months of charges onto future bills. there are payment plans to residents don't have to pay all of this at one time. >> i'm at the live desk tracking more high profile hearings today on capitol hill. this morning, retired nfl quarterback brett favre will testify before a republican led congressional committee. the hearing will focus on how states are falling short on using welfare to help families. favre has repaid more

than $1 million in speaking fees funded by a welfare program in mississippi, but it's unclear how much he might say, because in 2023, a mississippi judge put a gag order on him and others being sued by the state. house republicans have said that a welfare misspending scandal involving favre points to the need for serious reform. another hearing today will focus on the supreme court's controversial ruling giving former president trump special immunity for official actions. the senate judiciary committee will discuss the fallout of the decision. committee chair senator dick durbin says the hearing will, quote, highlight the blaring dangers of this far right ruling for the american people. >> the 40 niners are looking toward europe to figure out some of their injury woes. christian mccaffrey visited a specialist in germany about his achilles. mccaffrey got injured in the beginning part of training camp and hasn't played this season. he's not eligible to return until week six against seattle, but that seems unlikely. the

niners next game is on sunday at levi's against the patriots. now it's your morning money report. kmart is officially closing the doors on its last full scale store next month. kmart used to have thousands of stores across the u.s, but that number has slowly dwindled as the company has struggled over the past couple of decades. the last full scale kmart store is in a small town east of new york city called bridgehampton. that's in the hamptons, by the way, which is interesting. once that closes october 20th, that will leave only one small kmart in miami, florida, and a handful of stores in guam and the u.s. virgin islands. the department of justice is on the verge of suing visa. according to bloomberg, the lawsuit will accuse the company of illegally monopolizing the county's debit card market. the lawsuit could be filed as soon as today. and taking a live look at the new york stock exchange as trading gets underway this morning, you can see that we're up about 61 points. okay. of course, we've heard the saying sun's out, guns
