>> yes, we've reached out to both oakland police and fire. neither has confirmed what caused tonight's delay. it caused a major traffic backup outside the arena and on the footbridge from bart. as hundreds of concert goers arrived to see legendary composer hans zimmer perform. police responded to the call around 730, delaying the start of the show for more than an hour. >> got here in line and right when we got up to the front gate, they quickly shut the gates on us and told us that there was a security situation that they needed to handle before they would open it, and people already inside the show were forced to wait while the investigation unfolded. >> some told us it wasn't made clear to them what was going on. the gates were reopened around nine. we also reached out to oakland arena but did not hear back. >> and more breaking news tonight. our partners at the bay area news group report san jose city council member omar torres is the target of a child sexual misconduct probe. abc seven news reporter lauren martinez is live in our san jose bureau. lauren, this is developing quickly. >> it is. dan, we have limited

information, but this is what we know. the bay area news group reports the case involves sexually explicit material and an alleged relationship. now, officers served torres with a warrant earlier today. san jose police would only confirm to us that an investigation is underway involving a member of the council, but did not say whether it's torres or reveal any details about the case. they called the investigation active and ongoing. torres was elected in 2022 as the first openly gay latino member of the city council. abc seven news has tried to reach torres, but we have not heard back. we asked san jose mayor matt mehan about the investigation, and he declined to comment about the case. at this time. reporting live from san jose, lauren martinez, abc seven news. >> obviously, a lot more coming on this. lauren, thank you very much. >> we turn now to the brutal heat wave that will not let up

as we look out live at san francisco. heat warnings extended through saturday and we may be waiting a while to cool off. abc seven news meteorologist frances frances dinglasan has a look at the dangerous temperatures. frances. >> yeah, that's right. we have more heat and an on the way in fact, san jose broke a record today. a high of 101, beating a record of 97 degrees set in 1917 and tied again in 1985. that is the third straight day of record breaking highs in san jose. fourth, if you count the tie set on monday. salinas also had a high today of 99 degrees set in 1985. so the heat excessive heat warning has been extended through saturday. temperatures in the hot pink that could reach up to 105, and then the areas in the orange. that's the heat advisory where temperatures could be in the mid 90s, even up to 98 degrees. and that goes tomorrow. and into saturday.

with that, the heat risk is still extreme in the purple areas for the east bay and parts of the south bay, and also still major in many areas around the bay area. here's a quick look at the three day forecast. so tomorrow will be a little bit cooler, but temperatures actually come up this weekend saturday and sunday. triple digits, maybe even above. we could see some more record breaking heat and we'll keep an eye on that. dan. >> all right. thank you. franci. and you can track the heat wave with the abc7 bay area app. you can follow the forecast with the same live doppler seven tools. our weather team uses and track the temperatures hour by hour. >> homelessness, as you know, is a major challenge for building a better bay area. but tomorrow, governor newsom is promising a big announcement. the governor's office says its new funding to tackle encampments. as abc seven news reporter tara campbell explains, it comes as people in berkeley, those who have homes and those who don't, are forming

an encampment outside city hall to protest. >> so this is my tent. >> andrea hanson is calling this tent in front of berkeley city hall home. for now. she's the executive director and legal counsel for where do we go? the nonprofit has set up this encampment in protest in wake of governor gavin newsom's executive order. >> our governor has told all state agencies to sweep camps across the state, as well as local governments to follow, and there's nowhere for people to go. and so we're standing up for them. >> the tents started going up saturday and have since been growing in number. >> a lot of unhoused people out here in downtown berkeley came by. they were looking for a place that was safe to sleep. we told them that they would be safe if they were with us. >> well, i'm glad that there's a place like this where people feel safe. >> gordon gilmore is unhoused. he's also the co-founder of the berkeley homeless union. >> not have to fear or have the constant fear of having their possessions thrown away and their home and needing to

relocate. >> hanging over their head, things like bread and baked goods, providing everything from food to connecting services. >> i'm going to put a table here. >> the idea is to create a space where she can meet with people, because there's so many people all night long. >> what we found here throughout the night, so many people have come that have been hungry. so we're giving them tents, we're giving them food, we're giving them sleeping bags, and then they feel safe here with us. >> and they say they're ready to weather the heat. >> the community has really been reaching out, been really good to us. and bringing water and food, ice and any attempts by law enforcement to remove them. if they come and sweep. this will set up another one. there's no there's nowhere for people to go. they can sweep. this will be across the street. they can sweep across the street. we'll be back here. >> we did reach out to the mayor of berkeley for comment on the protest and on the sweeps, and are waiting to hear back. tara campbell, abc seven news. >> now to new developments in a crime that made national headlines and is now back in the spotlight. los angeles district

attorney george gascon is revisiting the case of eric and lyle menendez, convicted in the murders of their parents. gascon, the former da in san francisco, says his office is looking into new evidence that's come to light. reporter michelle fisher with our sister station in los angeles, explains this latest twist. >> back when this case was first tried, they were mocked in the media and the culture at large. i don't think you'd ever see that reaction today. >> 35 years after eric and lyle menendez murdered their parents after enduring alleged sexual abuse, new cultural norms and new evidence could mean freedom for the convicted brothers. >> you factor in also the idea of these years of abuse, and back then we didn't have the ability to understand that as a culture and as a society. >> attorney mark geragos filed a habeas petition in may of last year with new abuse evidence in the menendez case, which the district attorney's office is now reviewing. >> we have a moral and an

ethical obligation to review what is being presented to us. >> after numerous denied appeals, geragos says he's optimistic. >> we've also been on the parallel track of resentencing, meaning putting this back in front of a judge, letting giving the judge the opportunity to recall the murder sentence. >> a resentencing on manslaughter would see lyle and eric released on time served. the best case scenario for the brothers, now 56 and 53. >> worst case scenario is that the courts find that the evidence, even that they presented in the habeas, is not convincing enough to overturn their conviction. >> michelle fisher abc seven news. >> new tonight the california department of public health says at least two people in california are sick with bird flu. both of them are people in the central valley who had contact with infected cattle. now there is no known connection between the two cases and no human to human spread has been recorded. both patients have reported mild symptoms and

neither has been hospitalized. the state health department says the risk to the general public is low. >> antioch residents are being warned tonight about two mountain lions that are believed to be on the prowl in parts of the city. last night, police responded to a call about a prowler in someone's backyard. take a look. their drone captured a night vision image of a juvenile mountain lion in the area. there have been several reported sightings at four different locations in the last few weeks. >> all right. the college football spotlight will shine on berkeley ahead of the golden bears huge game against eighth ranked miami at memorial stadium on saturday night. >> and today, crews constructed the set for saturday morning's espn college game day, which will be on the cal campus for the first time. and it was announced this morning that former golden bear great and raiders running back marshawn lynch will be the guest picker. >> students and fans are expected to get up early for the live show that starts at 6 a.m. they'll get free t shirts and breakfast, and cal players say it's going to be a great experience. >> college game day is sweet.

officers identified themselves as san francisco police or what led up to the shooting. but we're on the story. >> a san francisco tourist hotspot is shutting down. >> madame tussauds wax museum on fisherman's wharf closed suddenly, and it certainly comes at a tough time for the wharf, which is facing a number of longtime businesses. >> leaving abc7 news reporter j.r stone talked to tourists and businesses. >> fisherman's wharf looked simply spectacular thursday night, but it's not all happy times. madame tussauds san francisco, a well-known wax museum here recently closed, ending a 60 year history of wax museums in the wharf. and while there may be questions about modern day excitement over something like wax figures. would you ever go to a wax museum? no. >> probably not. >> i think once you go to one, you don't necessarily need to go to another one.

>> young people still love them. >> i've only been to one years ago, but i would totally go again. i've been when i was younger and i think people still go. i think they're fun and they're really cool. all the details and stuff, which makes you wonder if madame tussauds couldn't survive. >> how are others doing? everything is $10 or less. mcdonald's, which is on the same block, closed last year. nearby fisherman's grotto and tarantino's remain closed. to get an idea of how businesses here on the wharf, i talked with more than half a dozen business owners, managers and employees at numerous locations here at the chocolate store. they say business has been stagnant. an employee here told me people are closely watching how much money they spend. the owner of this chicken restaurant says people are coming in. they just aren't spending a lot of money. for instance, a family of four will come in order. one individual meal for all four people. the owner of this tourist shop tells me that business here has been slow, and oftentimes he has problems even opening this gate, because he says there are often homeless people lined up here

statement. torres says he was wrongfully detained and that the sexual misconduct claim against him is baseless. we also reached out to torres tonight, but did not hear back. >> fascinating story tonight. the wreck of a world war two destroyer known as the ghost ship of the pacific has been found near point reyes. the uss stewart served both american and japanese forces before it was deliberately sunk in a training exercise. three unmanned submersibles spent 24 hours gathering data on august 1st, researchers identified the sunken ship from sonar scans. it remains largely intact, apparently 30 500ft below the surface of the pacific ocean, 78 years after it sank. >> well, football fashion in the spotlight at levi's stadium tonight with a unique event for fans. >> yeah, it really is cool. they spent the night designing jackets with a viral star. now wearing them to sunday's game might not be the best idea given the heat, but that did not take the sparkle off the event.

but then it is still in the 70s through fairfield, concord and livermore. they're going to have those aches running. here's a look at live doppler seven. notice not a cloud in the sky. and as we pull out you'll see high pressure really keeping the clouds away. and that's going to stay for the next few days. and as we show you another live view from sutro, here's what you can expect for the weather headlines. so tomorrow is going to be slightly cooler, but still hot. many areas still near 100 degrees. and then this weekend the heat wave continues. in fact, it gets even warmer on saturday. really? we have to wait until next week for some more significant heat relief, and that starts to arrive on monday. but we'll feel it on tuesday. so an excessive heat warning all the way through saturday night for the areas in pink. it could be extended to sunday, and then the areas in orange. that's the heat advisory with temperatures also still near 100 through at least saturday. so for tomorrow, the heat risk still major to extreme. the major and the areas

of red. that's a level three purple there. that's the extreme heat risk. so try to avoid being outside. stay cool. stay hydrated. continue to do the things because there can be cumulative effects of all this really extreme heat. so tonight with temperatures dropping into the 50s and 60s, of course it's still milder and warmer for the interior locations, but it's a good time to open up some of those windows and let that cool air in, because tomorrow, still near 100, in morgan hill and gilroy, san jose, possibly 97, san mateo, 86 at the beaches in the mid 70s, san francisco downtown 81 degrees and then in the north bay. we're going to see lots of low 90s through petaluma, sonoma, napa, 92 100 and clover lake, san rafael, 93 degrees. also in the east bay. we'll see some mid 80s to low 90s oakland 86, union city and fremont at 92 interior areas coming down a little bit. so livermore only 100 walnut creek

98 degrees. and we're going to jump ahead to saturday. what you'll notice is that temperatures are actually going to be even warmer. take a look at san rafael. we're expecting upper 90s will probably break a record in san rafael on saturday. and even on sunday, because the records are in the mid 90s and it will be close to 100 for both days. but sunday does start to cool down just a touch again. and then here's the accuweather seven day forecast. so still hot tomorrow. the heat wave continues and a hot again on sunday. but you notice it starts to ease on monday where we start to see the mid 90s for the inland areas around the bay. mid 80s and then low 70s at the beaches. more significant cooling on tuesday before we start to get closer to average start to get closer to average i love that my daughter still needs me. but sometimes i can't help due to burning and stabbing pain in my hands, so i use nervive. nervive's clinical dose of ala reduces nerve discomfort
