the announcement later today. advocates in the east bay are already saying it's the wrong move and all eyes on uc berkeley this weekend. >> the campus is getting hyped to host espn's college game day ahead of the big game between the golden bears and miami. what to expect if you plan on getting to campus for the show. >> good morning. it is friday, october 4th. >> yeah, but we're going to start with a check of the weather. >> drew, another day of the heat wave. so it continues today through the weekend. we get a little bit of relief right now. the sea breeze kicked in across the city. so you may have been able to open your windows late last night. let some of this cooler air in in the valleys of the north bay, right now. we're in the upper 40s, so this will be the coolest part of your day. we still have heat advisories, excessive heat warnings in effect through saturday. they have been extended in our hills right now. still pretty warm mid 70s to the lower 80s. right now, currently 80, in the oakland hills. so here's the alert. we still have them until saturday. these are almost going to be extended until sunday. i can guarantee you that because sunday is going to be hot as

well. so today is day five of our heat wave. so inland today looking at temperatures we're going into the 90s. so today is not the hottest day of the heat wave, but temperatures are still very warm for this time of year. above average around the bay shoreline. find those numbers mainly in the mid and upper 80s with full sunshine and along the coast. today half moon bay right now is reporting a little bit of cloud cover, but it will be warm later today. we'll have temperatures mainly in the 70s as we head into the weekend. those temperatures get even hotter once again. we'll preview that in eight minutes. let's check in with gloria and see those drive times. this morning. >> happy friday to you, drew, and to everyone at home. so far we have no major issues out there. this is a live look at our golden gate bridge camera. you can see there is no issue with fog this morning. traffic also very light. here we are hearing about a stall in the middle lane at the tolls. this is on southbound 101 but nothing major that's really impacting traffic at this time. and taking a live look at our san jose 101 880 camera. you can also see it's pretty quiet in the south bay right now. we are seeing a little bit more vehicles heading

on northbound 101 towards the city, but no delays in this area. and you can see our overall map mostly green, which is what we like to see. so no major issues at this time of the morning. reggie. >> gloria. thank you. today, governor newsom is promising a major announcement about new funding to address encampments across the state. even before we know all the details, there's already pushback from advocates in the bay area. abc seven news reporter tara campbell went to berkeley, where an encampment has formed outside city hall to protest. >> so this is my tent. >> andrea hanson is calling this tent in front of berkeley city hall home. for now, she's the executive director and legal counsel for where do we go? the nonprofit has set up this encampment in protest in wake of governor gavin newsom's executive order. our governor has told all state agencies to sweep camps across the state, as well as local governments to follow and there's nowhere for people to go. >> and so we're standing up for them. >> the tents started going up

saturday and have since been growing in number. >> a lot of unhoused people out here in downtown berkeley came by. they were looking for a place that was safe to sleep. we told them that they would be safe if they were with us. >> well, i'm glad that there's a place like this where people feel safe. >> gordon gilmore is unhoused. he's also the co-founder of the berkeley homeless union. >> not have to fear or have the constant fear of having their possessions thrown away and their home and needing to relocate. >> hanging over their head, things like bread and baked goods, providing everything from food to connecting services. >> i'm going to put a table here. >> the idea is to create a space where she can meet with people because there's so many people all night long. >> what we found here throughout the night, so many people have come that have been hungry. so we're giving them tents, we're giving them food, we're giving them sleeping bags, and then they feel safe here with us. >> and they say they're ready to weather the heat. >> the community has really been reaching out, been really good to us, and bringing water and food, ice and any attempts by

law enforcement to remove them if they come and sweep. this will set up another one. there's no there's nowhere for people to go. they can sweep. this will be across the street. they can sweep across the street. we'll be back here. >> we did reach out to the mayor of berkeley for comment on the protest and on the sweeps, and are waiting to hear back. tara campbell, abc seven news. >> developing news this morning in the south bay, san jose police say a city council member is the target of a child sexual misconduct investigation. and gloria police have not revealed any details about the case or identified the council member. but we know one has released a statement to our media partners at the bay area news group. >> amanda san jose police would only confirm to abc seven news that an investigation is underway involving a member of the council. they would not release any other details. however, multiple sources tell our media partners at the bay area news group that police served a search warrant on a council member, omar torres, and detained him yesterday. the investigation is related to alleged sexual misconduct involving a minor. torres issued

a statement through his attorney to the bay area news group late last night. he said the investigation is based on misinformation and was an act of, quote, retaliation from someone that he asked police to investigate for extorting and stalking him. and the statement went on to say, quote, i want to be clear that i am the victim in this matter. it's heartbreaking that my family, my partner, my team and myself have to respond to such unfounded and defamatory allegations. torres was elected to the council in 2022. he represents district three, which includes much of the downtown area. abc seven news has reached out to him directly, but we have not yet received a statement and we also asked san jose mayor matt mehan about the investigation, but he declined to comment on this case. reggie. >> gloria. thank you. happening today, santa clara county leaders and parents will protest the termination of board of education superintendent mary ann dewan. dewan was fired without cause and a 4 to 2 vote

in a closed session wednesday night. she held that position for over six years after joining the board in 2013. dewan will receive severance pay. the group protesting is condemning the lack of transparency in this decision. a news conference and protest will be held at 10:00 this morning at the office of education. this morning, oakland police and officials from the oakland arena have still not said what caused an hours long delay at a hans zimmer concert last night around 730, as people were arriving for the much anticipated show. the venue was put on lockdown entry and exit gates got shut down. traffic in and out of the venue stopped and this caused a huge backup outside the area and on the footbridge from bart. as hundreds of concert goers were trying to get inside. now, some told us it wasn't made clear what was going on. >> got here in line and right when we got up to the front gate, they quickly shut the gates on us and told us that there was a security situation that they needed to handle before they would open it. >> people already inside the

show were forced to wait while that investigation unfolded. the gates were reopened around 9:00 and the concert did finally go on after that. hans zimmer has another show at the oakland arena on wednesday. happening tomorrow, cal fans will be getting up really early for the first time ever. espn's college game day is coming to berkeley. the popular pregame show starts at 6 a.m. tomorrow, and a lot of people are going to be showing up if you're planning on going. abc seven news reporter zach fuentes is here with what you need to know. hi, zach. hey, reggie. >> good morning. you know, cal was one of only six power conference teams that had never hosted an espn college game day. so it's overdue. and the excitement on and off campus is already being felt, both for the game itself and the espn college gameday pre-show. we got to be there. as crews constructed the stage for saturday morning's live show at memorial glade in front of doe library, and students and fans get to surround that set and be part of the show. it airs tomorrow morning from 6 to 9 a.m. the pit is opening at 330 tomorrow morning, and fans are encouraged

to arrive early and bart is helping them do just that. the trains are going to be starting at 4:00 tomorrow morning and are arriving at the downtown berkeley station at five. >> we're going to have five early trains that will stop at a dozen stations to get people to downtown berkeley, which is our closest station to cal, in time for the big pregame show. one of the things we really want to emphasize, though, is that we're only opening 12 stations in addition to downtown berkeley, so you can't just show up at any of our 50 stations and expect to see a train there early. >> yeah. remember, to bart, parking is free on saturdays at stations that do have parking, so the first 400 fans to get there will get to stand directly behind the stage. you can line up no earlier than 12 a.m. saturday morning, arriving before that does not mean you're going to be first in line or guaranteed access to the pit. so sleep in if you can. the first 1000 fans are going to get free donuts and coffee. there's also chances to get free breakfast burritos, t shirts, hurricanes and golden bears. play saturday

night at 730 on our sister network espn. >> thank you zach. i've been to college game day at penn state and it is a wild time, so i hope a lot of you are going there. it is going to be hot tomorrow in berkeley. the morning temperatures by 9 a.m. we're already into the 70s. look at this by five. it's hot sunshine. we're closing in on 90 degrees tomorrow. and even later on in the evening. it is warm with clear skies. so our heat wave does continue through the upcoming weekend. that's the headline. another hot day today. a hot weekend is on the way and then heat relief is coming tuesday. but we still have several days of these heat advisories and excessive heat warnings today. if you're keeping score for this terrible game we're playing, it's day five of our heat wave. so the forecast today we're mainly in the 80s and 90s. today we'll have a couple of locations hit about 100 degrees. but underneath this heat wave, this is certainly not the most extreme day we've had. but again these temperatures are above average. and we've had several days of hot weather that it just compounds itself when it comes to the effects of heat on your

body. so future weather, lots of sunshine. today we're warming up fast again. the summer wardrobe. your best friend. lots of 80s around the bay shoreline. the coast is going to stay relatively comfortable today in the 60s and 70s, but inland we're back into the 90s near 100 for daytime highs. so 98 in concord today, 100 in livermore, 86 in oakland for a high hit, about 81 in the city. that's pretty close to where we were yesterday. 96 in santa rosa, 97 in san jose, 70 for the high in half moon bay. you look at the three day forecast heading into the weekend. temperatures actually get even hotter here. we're talking saturday and sunday, 102 104 inland. widespread mid 90s around the bay shoreline and along the coast. it gets hotter in the mid 80s. reggie will show you that break in the heat wave on the seven-day forecast coming up in a few minutes. >> thanks, drew. new developments. port workers agree to end their strike. the tentative deal. getting them back on the job today. >> and allegations of overpricing in the bay area. the multi-million dollar settlement just approved with safeway. how it could lead to some extra money in your pocket. >> a fictional food come to life

east coast have agreed to return to work. the strike threatened to disrupt the supply chain and have a big impact on our economy. abc news reporter andrew dymburt explains the tentative deal between workers and the ports union. >> this morning, the dockworkers strike suspended work, resuming immediately after an uncertain three days that saw ports from maine to texas shut down. the disruption could have potentially crippled the u.s. economy, leading to supply shortages and higher retail prices ahead of the holiday shopping season. dock workers are going back to work, and the next 90 days are going to sell everything. the international longshoremen's association, representing 45,000 workers at east and gulf coast ports, reached a deal thursday to suspend the work stoppage. the tentative agreement with the u.s. maritime alliance, which represents the ports and shipping companies, will pause the strike until january 15th. dock workers are demanding a 77%

pay raise over the next six years, and a total ban on certain forms of automation. the maritime alliance has offered a 62% raise, tripled contributions to benefits and pledged to limit automation. ila members current base salary is $81,000 annually, but some can earn 200,000 with overtime. this raise will increase top dock workers hourly pay from $39 to 63. the ceo of the national retail federation, celebrating the suspension, writing the sooner they reach a deal, the better for all american families. consumers were already on edge after the strike was announced. >> i came in at 930. i was waiting online because i know people panic every time they hear something. >> panic buying, clearing toilet paper from shelves at big box stores. despite the fact that the disruption would not have affected domestically produced tissue paper. andrew dymburt, abc news, new york. >> california health care workers are getting some good news this month. a long awaited minimum wage increase will take effect. the san francisco chronicle reports that it was

delayed because of budget concerns. the law promised health care workers wages would go up to $25 an hour over the course of several years. some employees may see that full increase sooner than others, depending on where they work. the law is expected to cost the state $1.4 billion in the first six months. >> the california department of public health says at least two people in california are sick with bird flu. both of them are people in the central valley who had contact with infected cattle. there is no known connection between the two cases and no human to human spread has been recorded. both patients have reported mild symptoms and neither was hospitalized. the state health department says the risk to the general public is low. >> safeway, albertsons and vons have agreed to pay nearly $4 million to settle allegations over overcharging. across california, seven counties, including several from the bay area, accused the brands of charging people more than the lowest advertised price. so as a part of the settlement, the

grocers will have to implement what they're calling a price accuracy program. that means if you are overcharged, the store is going to have to pay you $5 as soon as they discover it. >> spongebob fans will soon be able to get a krabby patty in real life. wendy's is celebrating the cartoon's 25th anniversary with some new menu items. fans can pick up a krabby patty crab and a pineapple under the sea. frosty, which is a vanilla, pineapple, and mango flavored milkshake. wendy's says the anniversary food will be available starting october 8th. >> i don't know what a krabby patty is. >> yeah, i wonder if it's is it fish or is it meat? >> i think on that it's probably some sort of just sauce, because it looked like it was just a hamburger with cheese. oh. >> oh, it's just being called. >> it's just called a krabby patty. but it's a regular hamburger. >> well, i didn't watch spongebob, so i don't know anything about i don't know a thing. he's like, i know he's a sponge, a sponge. >> yeah, i know there's a

tuesday cannot come fast enough. all right, so the forecast today inland we have a lot of sunshine. we're back above 90 after lunchtime. and then closing in on triple digits later on today around the bay shoreline. it is warm. it is sunny. we're back into the 80s so it will be another warm to hot day for a lot of us. and then along the coast we'll go into the 70s for daytime highs. so the heat risk today continues to be major to extreme. again, the extreme heat risk is in our hills like the santa cruz mountains, part of the east bay hills, because in the overnight we don't even get out of the 80s here. so there's no nighttime relief. there's no way to cool off. and then we get hot again in the afternoon. and that's why there's that extreme heat risk there. so highs today we'll go into the 80s and 90s around the bay shoreline from 81 in the city to 86 in oakland, hotter in fremont at 92, palo alto going in at 89, 97 in san jose. and the north bay, it's another hot afternoon. 96 in santa rosa, 92 in napa and then inland from concord to livermore to antioch and fairfield. temperatures

mainly between 98 and about 100 today, even along the coast. ye, relatively cooler, but still warm for this time of year in the 70s and 80s from half moon bay to santa cruz. overnight tonight we'll get a little bit of cool down near the coast where we're in the 50s, but away from the coast, or mainly in the 60s and 70s. and then again in our hills. we are staying in the 80s overnight tonight. so here's a look at saturday future tracker. it just gets hot around here once again. mid 90s for oakland. back into the triple digits for san jose 101 102. in the north bay 102 104 in the inland east bay in the 80s along the coast. it's a similar story here. even into sunday. monday is hot and then tuesday will finally cool these temperatures off. so here's the accuweather seven day forecast, keeping count at home. we have four more days of this heat wave. it will likely end by monday evening, but the weekend is very hot. please continue to find ways to stay cool. stay hydrated. but relief finally arrives tuesday. widespread fog is back and the cooling continues wednesday and thursday. guys.

these temperatures are still pretty elevated for this time of the year. mid and upper 90s today, inland, our hottest areas hitting about 100 this afternoon around the bay shoreline it is hot again. we're back into the mid and upper seconds with full sunshine and then along the coast we have a little bit of cloud cover this morning around half moon bay. otherwise it will be sunny this afternoon and warm in the 70s. we'll show you that hot weekend forecast in eight minutes. let's check in with gloria though. you can see the drive times. >> good morning to everybody. so we do have a commuter alert for you this morning. if you take bart, we are seeing a little bit of a delay. this is at 19th street, oakland and macarthur. this is in the berryessa sfo and millbrae directions because of an equipment problem on the track. but caltrain and ace are on time right now. and looking live at our emeryville camera, you can see we are starting to see more traffic westbound of the eastshore freeway and from highway four to san francisco will take you 31 minutes. looking live at the bay bridge, you can see traffic is flowing nicely here. no major delays in this area. >> all right, gloria, thank you. developing news. more than three

decades after the menendez brothers were convicted and sentenced to life in prison for killing their parents, there is a chance the pair could be freed. the la county district attorney's office has announced a review of the case. attorney mark geragos filed a petition in may of last year, submitting new evidence on the case. the evidence involves a letter purportedly written by erik menendez months before the killings, that detail alleged sexual abuse committed by their father, jose menendez. also, a separate alleged victim of jose. la county da george gascon, who used to be the san francisco da, says there has also been a shift in the public perception of sexual abuse from a moral and an ethical obligation to review what is being presented to us. for the menendez brothers and their supporters, specifically, the best case scenario here would be that they get released. the review could also determine no need for resentencing, and

today. so today is certainly not the hottest day we've had with this current heat wave. but we're still quite warm. and we keep talking about how it's day after day of this heat that can really take its toll. but please don't let your guard down because the weekend is trending even hotter. we're back into that dangerous heat territory, both saturday and sunday and then tuesday. finally cannot come fast enough. cooler weather is finally moving in here. so today, lots of sunshine inland quickly into the 90s by lunchtime. closing in on 100 this afternoon. bay shoreline. it's warm again. sunny into the 80s. we go. and then along the coast. we'll see temperatures in the 70s. so the heat risk today is major to extreme. it hasn't really changed over the past couple of days. the extreme heat risk is in our hills. we're in the overnight hours. we can't cool off and temperatures mainly stay in the 80s. so today it is going to be warm 80s and 90s around the bay shoreline between 98 and 100, in our hottest cities inland. 96 in santa rosa, 97 in san jose. hit about 90 in vallejo overnight tonight, right along the immediate coast. i'm talking within a mile or two.

beloved plant nursery in the east bay shut down suddenly as of 2 p.m. yesterday. annie's annuals and perennials in east richmond permanently closed its doors. the owner explained health issues and business related challenges contributed to the closure. it came as a complete surprise to gardeners in the east bay and beyond, who relied on the nursery for their supplies. there are ongoing discussions with potential buyers who may continue the business. >> governor newsom has announced plans to transform an outdated san francisco dmv into hundreds of affordable housing units. the dmv office that fell on baker street has been there since 1960, and it needs some repairs. the state owned building will be turned into a multi-use complex with 370 homes, including a modernized dmv. the chronicle reports the dmv office is scheduled for completion in 2029, and the first phase of housing in 2030. nippy the beaver will be allowed to stay at a wildlife rescue facility in
