right now. >> drama in a san francisco courtroom. today, prosecutors trying to discredit and even impeach testimony from their own star witness. we are talking about the murder trial of tech executive bob lee. good evening.

i'm ama daetz and i'm dan ashley. >> thanks for joining us. lee is the founder of cash app, who was killed in the early morning hours of april, the fourth of last year. tech consultant nima momeni is accused of stabbing and killing lee. and tonight that trial is taking an interesting turn involving hussar momeni, who was supposed to be a star witness for the prosecution. >> abc seven news reporter melanie woodrow has been following the story since the beginning and joins us live from the hall of justice with the latest. melanie. >> ama and dan. prosecutors spent much of the day attempting to discredit hazaar momeni their own witness by calling into question discrepancies between her answers to them versus her answers to nima. his defense attorney. example after example. the prosecuting attorney gave hazaar questions he had previously asked her, where she responded, i don't know during direct examination, but during cross-examination, when nima mckinney's attorneys asked her the same or a similar leading question, she would respond yes.

one example involved text that hazaar had sent her brother, nima momeni after bob lee's murder, in which she called her brother psychotic, a lunatic, and texted him, you scare me. when the prosecution asked about those texts, she said she couldn't remember them. when her brother's defense attorneys asked her on cross if those same texts weren't about bob lee's murder, but rather about jeremy boivin, who allegedly sexually assaulted her. she responded ye, that's what those texts were about. prosecutors also called into question his credibility by digging into her testimony from yesterday. during cross-examination, when she told nima defense attorneys that bob lee's family had threatened her. prosecutors introduced into evidence the text that she was referring to, and after much back and forth, hazar concurred that the text sent by bob lee's ex-wife krista wasn't sent directly to her. the text was asking for help in playing detective to find hazar, so that

she could be served with a subpoena to testify in court. it also referred to her with a derogatory word. it was not directed towards her at all. >> so. and we'll let the. we'll let them do what they have to do. and we can. >> what do you think about how the government is doing? >> my husband was murdered. she has no right to take her. she has no right to make herself a victim in this. when our family was the one that got murdered. so she can go herself. >> this afternoon, bob lee's family returned to court without krista lee, who told me that the judge barred her from being in court for the remainder of hussars testimony. and that testimony did wrap this afternoon, with other witnesses now starting to take the stand. reporting live in san francisco outside of the hall of justice. melanie woodrow, abc seven news. >> all right, mel, thank you. >> the mother of a 14 year old florida boy is suing a silicon valley ai company, saying their chat bot is connected to his death by suicide. sewell seltzer, the third, has been

chatting for months with a chat bot he called daenerys targaryen after the game of thrones character. his mother says that although he knew he was not chatting with a real person, he became emotionally attached to the bot and sank into an isolation and depression before taking his own life. his mother is suing menlo park based character technologies incorporated, which created the custom chat bot service character bot ai. the lawsuit claims character technologies was reckless by offering minors access to lifelike companions without proper safeguards. character i issued a statement saying, as a company, we take the safety of our users very seriously and our trust and safety team has implemented numerous new safety measures over the past six months, including a pop up directing users to the national suicide prevention lifeline that is triggered by terms of self-harm or suicidal ideation. >> now to your voice, your vote.

and today, former alameda county district attorney nancy o'malley spoke out in support of the recall of current d.a. pamela price. abc seven news reporter anser hassan heard from both sides of the argument today. >> for over 22 months, pamela price has been the district attorney and she is not qualified nor competent to hold that position. >> former alameda county district attorney nancy o'malley announced she's backing the recall against the current d.a, pamela price. she made the announcement during an event hosted by the group safe, which is leading the recall effort under pamela price's regime. >> she ignores the rights of victims. >> o'malley served as da from 2009 to 2023. price lost to o'malley in the 2018 election, but then won in 2022 after o'malley retired. price says she walked into an office that was dysfunctional. o'malley accuses price of using the office improperly, ignoring the law, and intimidating and discriminating against people who oppose her. >> she has undermined all of

these programs that we put together, and basically she has taken this district attorney's office to a place where it cannot function. >> o'malley claims price canceled restorative justice programs, which da price campaigned on simply because those programs were started by o'malley. >> some of those grants have gone away, and some of those grants did not get renewed. some of them she just from what i from what i understand, she just didn't have an interest in it. and because it was a program that i started. >> one such program o'malley named is care's community assessment response and engagement. >> i have no idea what she's talking about. other than the cares navigation center is the program that we rescued in 2023. >> da price fired back, refuting many of o'malley's claims. taking questions at a press conference held to update an ongoing prosecutorial misconduct case. price says the cares program just got a $6 million

grant data, which is publicly available. she spoke of hiring experts to oversee various departments, such as those to help victims. >> there's no public secret that my predecessor was not helpful to us in our transition. what the public should know is that nancy o'malley represents the last desperate attempt to go back to a time when police officers, police unions, controlled this office. >> in oakland, anser hassan abc seven news. >> in the south bay, a san jose police sergeant who is running for city council is under investigation for fraud and wage theft. because of that, one group of voters is calling on him to drop out of the race altogether. abc seven news reporter dustin dorsey questions of trust around city hall. >> the community wants dependable city leaders who hold themselves to high ethical standards, not those surrounded with legal troubles and residents who represent various unions, coalitions and associations are speaking out

against san jose city council candidate tam truong. >> we collectively call upon tam truong, a candidate for san jose city council in district eight, to publicly end his candidacy. >> truong is a sergeant with the san jose police department, but has been on administrative leave and has had his officer certification temporarily suspended. truong is charged with grand theft for allegedly using his position as a cop to defraud mortgage companies of more than half $1 million. the private security firm was also sued over alleged wage theft. >> how can we let someone with this disgraceful history seek a position of power? >> his pending criminal case will make it impossible for him to effectively represent his 100,000 constituents in district eight. >> truong's campaign office sent us a statement saying this is just a political ploy. quote, it is clear to the people in our district that these political operatives are targeting me because of my strong stand on

safety and because i am demanding greater accountability on homeless spending. despite the allegations and loss of key endorsements like that of mayor matt mehan, truong is remaining in the race. the santa clara county registrar of voters office says more than 100,000 ballots are already being processed, and truong remains a candidate. at this point, it's too late to have him removed from the ballot. >> the election still happens. we still certify there's a winner. write the winner. if they want to resign, they can. if somebody wants to recall them, that's a different process. but the ballots still count and we still certify the election as is with the ballots that already went out. >> so at this point, the future of san jose's district eight rests in the hands of voters in san jose. dustin dorsey, abc seven news. >> a new report from microsoft shows foreign adversaries will likely ramp up their efforts to influence next month's election. as we get closer to election day. the company's threat intelligence arm says russian operatives are doubling down on fake videos to smear vice president kamala harris's campaign. the report also found

chinese linked social media campaigns are maligning down ballot candidates who are critical of china, among other tactics. >> the united states has confirmed that north korea has sent thousands of troops to russia for training and the possibility of fighting in ukraine. north korea has provided arms for russia, and this move would be the next step in their military alliance. secretary of defense lloyd austin is warning there could be direct consequences if north korean troops join the combat. >> what exactly? they're doing left to be seen if they're co-belligerents, their intention is to participate in this war on russia's behalf. that is a very, very serious issue. >> it remains to be seen what north korea could gain from this partnership. south korea is worried that russia could send sophisticated weapons and technology to the north in return. >> coming up, the warriors new

>> yeah. so what can we expect for the season ahead? abc seven sports director larry beil is here. optimism. high. >> playoffs. playoffs is good because they didn't make the playoffs last year. yeah that's true. when you're spending a zillion dollars on payroll, you better make the playoffs. so we mentioned the warriors and blazers tonight. it will be interesting to see the rotations that steve kerr uses. he basically just has too many good players to use. it's hard to play 12 or 13 guys outside of steph curry and draymond green. we don't know what the starting lineup is really going to look like. and steve doesn't like to tell us until just before tipoff. jonathan kuminga moses moody buddy hield. they figure to get good minutes. the goal remains maximizing the final few years of steph curry's career to contend for another championship. >> i truly believe we can be championship relevant in the sense of we're not. probably not going to be the favorite in any conversation. to add to that would be amazing. i think it's realistic to build towards that. i think for me, that's literally the only thing i'm playing for at this point. >> number one being the playoffs. like that's that's our

but it wasn't cause for concern. they were all part of planned and deliberately set fires by various fire departments as part of wildfire mitigation efforts. fire officials say today was a good day to conduct the prescribed burns with favorable weather conditions, helping ensure safe execution and minimal smoke impacts on the community. >> and fire officials in the east bay cities of orinda and moraga are considering new

defensible space rules. that would be some of the strictest in the nation. they say it's part of an effort to convince insurance providers to come back into communities amid this ongoing crisis, with homeowners who can't get insurance. but as abc seven news reporter tim johns tells us, and as you can imagine, the proposal is already getting pushback. >> reporter homeowners in moraga and orinda could soon be subject to some of the most stringent, defensible space rules in the country. the rules are being proposed by the moraga, orinda fire protection district, and would require homeowners to uproot plants, take down wood fencing and remove all other combustible materials within five feet of structures. >> there are many ways to prevent fire hazard. i don't know why they're wasting time to pass this kind of policy. it's ridiculous. >> outside her home in moraga, karen cheng told us she strongly opposes the new proposals. cheng says if they're enacted, she worries about how much money it might cost her family. >> not only money, also time. who has the time? unless retired

people retire. people doesn't have enough strength just to get an idea of what five feet actually looks like. >> i got my handy tape measure here. we're going to measure against karen's house. and if that five foot proposal becomes the new rule, this is the amount of space that folks would be dealing with. the fire district says they're anticipating pushback from some members of the community. however, chief dave whitaker says keeping the status quo is not an option. >> even a home that is fully compliant with our current standards continues to have potentially a significant amount of combustible material. >> whitaker says beyond keeping homes and people safe from potential fires, the district's new proposals are also aimed at trying to convince homeowners insurance carriers to come back into the community. orinda mayor darlene gee says this area has been one of the hardest hit amid the ongoing crisis and insurers dropping coverage. >> it was a huge impact, probably at least a third, if not slightly more, of our residents lost their homeowners insurance. >> whitaker says if passed by

the fire district, the new rules would be implemented in stages, probably beginning next june. in the meantime, he says, he and his colleagues remain open to listening to all concerns residents may have in moraga. tim johns, abc seven news. >> it is time of year. we're paying close attention to that. >> we are because october is a prime fire danger, weather and meteorologist sandhya patel is here with conditions out there tonight. sandhya. >> yeah. and dan and the concern that we have is later on tonight, the fire danger will be increasing. let's take a look at the winds. right now they are onshore blowing from the ocean towards the land, which means higher humidity. 21 miles an hour at sfo. this is going to be changing as we head towards later tonight. not so much. at 6:00. they're still on shore over 30 miles an hour. but watch what happens at 11 p.m. that northerly northeasterly wind begins to develop and kick up 36 there at fairfield, 22 at calistoga. very drying wind. 3 a.m. in the morning. we are looking at over 30 mile an hour

winds there. so with this drying wind, the humidity will go down and the fire danger will go up as we go, hour by hour. here you will notice moderate to high fire danger for parts of the north bay as we head into late tonight. and then tomorrow morning, north and east bay hills, along with the santa cruz mountains. moderate to high fire danger. so i would stay aware if i were you, especially, as dan mentioned around this time of year in ama. it is really concerning. temperatures are up today. you felt it. you probably noticed it. eight degrees warmer in san francisco, up seven, livermore, san jose, santa rosa. as we check out a view from our golden gate bridge camera. just beautiful blue skies. 80 in santa rosa, 70 for napa. petaluma. low 80s for our warmer spots like concord and livermore, which is above average for this time of year. a clear view as we look from emeryville right now. 65 in the city, you got up into the 70s, believe it or not, 71 in oakland, 80 in san jose and 75 in redwood city. cold front went through the pacific northwest, far northern california, where they had a little bit of

precipitation. now we're basically looking at behind that system, the winds picking up. lovely view from santa cruz late tonight into early tomorrow morning. breezy high fire danger tomorrow. a little cooler still pretty sunny. and then sunday we have a chance of drizzle and showers tonight if you're stepping out. 620 it's still pretty mild, but at 915 those temperatures come down as we head towards tomorrow morning. it will be a cool to chilly start. a lot like today. today we even had some upper 30s in our wind sheltered valleys 4:00 in the afternoon. many of you will be in the 60s and 70s, so those temperatures coming down a little bit. and speaking of coming down tomorrow morning, upper 30s in ukiah all the way to low 50s in san francisco tomorrow afternoon, mid 60s to upper 70s for most of you, as we look ahead to friday, that system is not going to do much for us. but sunday is when we see the drizzle chance going into sunday afternoon. some rain and it's a rain snow mix for the sierra. computer models are coming into agreement that we're going to get a few hundredths of
