>> abc seven news reporter zach fuentes explains how quickly they could rise. >> bay area bridges are iconic landmarks recognized around the world, but they're expensive to maintain. >> many of those bridges are now, again, to put it in human terms, they are now senior citizens and to pay for the maintenance, preservation and operation of the bridges. >> the metropolitan transportation commission and bay area toll authority are looking to increase tolls. >> the thinking is that rather than uh- a one time, $2 and 50 cent increase uh- to roll it out, introduce it over five years in smaller chunks that the pain would be felt less acutely. >> tolls are already set to rise from their current $7 to $8 in january. that's the last increase under voter approved regional measure three. the new hikes would start in 2026, adding $0.50 a year for five years. tolls for fast track users would hit $10 in the year 2029. paying by registered plate

or invoice would cost more. many bay area commuters have strong opinions about the proposal. >> it's going to make it too expensive for me to get to work. it's already too expensive to pay to park here. >> on the one hand, they want return to work on the other hand, they want to raise the price so that it's almost prohibitively expensive for people to come to work. they've got to pick one of the two. this is outrageous. is what i think. >> goodwin says public input is part of the process moving forward, including a public webinar on november 13th. he says he expects this to be the last price hike drivers will see. >> for now, the long term modeling does not include another toll increase. >> the bay area toll authority is also considering changes for carpool lanes on the bridges, offering discounts for three or more people during peak times. the bay area toll authority plans to take action on the proposal at its december meeting in san francisco. zach fuentes, abc seven news. >> there really is no free way across the bay. bart from west oakland to embarcadero and back

is $7.50 total. san francisco bay ferry charges 940 round trip to trans bay fares on ac transit busses cost $12. drivers can avoid bridge tolls if they drive via san jose. that's nearly 80 miles. for comparison, the bay bridge is about eight miles long. >> former alameda county district attorney nancy o'malley is backing the recall effort now of current d.a. pamela price. nancy o'malley says price is using the office to intimidate and discriminate against people who oppose her. and o'malley says price is not doing enough to help victims. o'malley also claims price canceled restorative justice programs simply because she started them. >> she has undermined all of these programs that we put together, and basically she has taken this district attorney's office to a place where it cannot function. >> o'malley served as da from 2009 to 2023. price lost to o'malley in the 2018 election,

then won in 2022 after o'malley retired. price says she took over an office rife with dysfunction. the future of school closures in san francisco is in limbo, at least for now, with the appointment of a new superintendent. the closure plan is halted for at least a year, but the district needs a balanced budget soon to avoid a state takeover. the debt is really significant. abc seven news reporter monica madden pressed leaders about the possibility of future closures at yick wo elementary. >> you'll find handmade signs of protest from students who don't want to see their school closed. >> a lot of people in a city that's very transient are looking for community. >> parent christy sampson has two young daughters at the school. >> it's been a whirlwind, to say the least. it's we kind of felt blindsided at first. >> she's hoping new leadership will mean different approaches to the district's multimillion dollar budget deficit. >> to get rid of small schools, you're getting rid of communities inside san

francisco. there needs to be solutions. and with maria su coming in, i'm actually very hopeful that we can see some change in the district and that i believe in her. >> understandably, students, family and faculty have had a lot of questions about the future of their schools. that's why we decided to come along with the mayor and the new superintendent to hear exactly what questions the students had for their leaders. >> oh, goodness. >> mayor london breed and new superintendent doctor maria su, touring on wednesday after announcing the district is pausing its closure plans, taking questions from those most impacted. >> we're not closing and explaining complex school finance questions on a fifth grade level. >> for example, when you're doing decimals, you don't know what the answer is. you have to go through the problem to help solve it to get to the correct answer. >> we asked su if she's found that answer yet. can you feasibly promise to them that this school isn't going to close or merge? >> going forward, i need to have more data and more information, as well as to make sure that

we're having deep and honest conversations with our school community before we move forward with anything. >> for parents like sampson, need to make sure that we have the stability. she's still looking for signs of certainty about the future of the community. her family loves. in san francisco, monica madden, abc seven news. >> drama in a san francisco courtroom today in the bob lee murder trial. lee is the founder of cash app, who was killed in april of last year. tech consultant nima momeni is accused of stabbing and killing lee. the trial took a turn with the defendant's sister, hasar. momeni was called as a witness for the prosecution. abc seven news reporter melanie woodrow has been following the story since the beginning, and tells us what unfolded. >> prosecutors spent much of the day attempting to discredit hasar momeni, their own witness, by questioning discrepancies in her answers to them versus her answers to nima mckinney's defense attorneys. the prosecuting attorney gave hasar

example after example of questions he had previously asked her, where she responded, i don't remember during direct examination, but during cross-examination, when nima, mommy's attorneys, asked her the same or a similar leading question, she would respond yes. one example involved texts azar had sent her brother nima, after bob lee's murder, in which she called him psychotic. a lunatic, and texted him, you scare me. when the prosecution asked about those texts, she said she couldn't remember them. when her brother's defense attorneys asked her on cross if those same texts weren't about bob lee's murder, but rather about jeremy boivin, who allegedly sexually assaulted her. she responded, yes, that's what those texts were about. prosecutors also called into question his credibility by digging into her testimony from yesterday. during cross-examination, when she told nima moments defense attorneys that bob lee's family had threatened her. prosecutors introduced into evidence the texts she was referring to, and

after much back and forth, hazar concurred. the text sent by bob lee's ex-wife krista, wasn't sent directly to her. the text was asking for help in playing detective to find hazar, so that she could be served with a subpoena to testify in court. it also referred to her with a derogatory word. >> it was not directed towards her at all. so. and we'll let the. we'll let them do what they have to do. >> and what do you think about how the government is doing? >> my husband was murdered. she has no right to take her. she has no right to make herself a victim in this. when our family was the one that got murdered. so she can go herself. >> this afternoon, bob lee's family returned to court without krista, who told me the judge barred her from being in court for the remainder of hussars testimony, and that testimony did wrap this afternoon with other witnesses now beginning to take the stand. reporting in san francisco outside of the hall of justice melanie woodrow abc

seven news. >> all right, melanie, thank you. fire officials in the east bay cities of orinda and moraga are considering new defensible space rules. that would be some of the strictest anywhere in the country. and they say it's part of an effort to convince insurance providers to come back into their communities and provide coverage. but as abc seven news reporter tim johns explains, there is pushback. >> homeowners in moraga and orinda could soon be subject to some of the most stringent, defensible space rules in the country. the rules are being proposed by the moraga orinda fire protection district and would require homeowners to uproot plants, take down wood fencing and remove all other combustible materials within five feet of structures. >> there are many ways to prevent fire hazard. i don't know why they're wasting time to pass this kind of policy. it's ridiculous. >> outside her home in moraga, karen cheng told us she strongly opposes the new proposals. cheng says if they're enacted, she worries about how much money it might cost her family. >> and not only money, also time. who has the time? unless

retired people retire, people doesn't have enough strength. >> just to get an idea of what five feet actually looks like. i got my handy tape measure here. we're going to measure against karen's house. and if that five foot proposal becomes the new rule, this is the amount of space that folks would be dealing with. the fire district says they're anticipating pushback from some members of the community. however, chief dave whitaker says keeping the status quo is not an option. >> even a home that is fully compliant with our current standards continues to have potentially a significant amount of combustible material. >> whitaker says beyond keeping homes and people safe from potential fires, the district's new proposals are also aimed at trying to convince homeowners insurance carriers to come back into the community. orinda mayor darlene gee says this area has been one of the hardest hit amid the ongoing crisis, and insurers dropping coverage. >> it was a huge impact, probably at least a third, if not slightly more, of our residents lost their homeowners insurance. >> whitaker says if passed by

tried to pay his taxes, but his check never made it to the irs. >> and that's when i realized something is seriously wrong. >> how did it happen? it's raising questions about security protocols at wells fargo bank. >> seven on your side anchor stephanie sierra is getting some answers tonight. steph. >> yeah, so many things went wrong here. and the frustrating part is it could happen to any of us. we all have to pay taxes and many of us write checks to do it. the problem with this story is how the fraud occurred and the lack of accountability

that followed. >> so this is the check that i wrote. >> like any law abiding citizen, jeff yates paid his taxes with a check addressed to the internal revenue service for $3,268. it was mailed in an envelope with proper postage in april of 2022, but unfortunately this time around, unbeknownst to me, the irs never received my check. according to his wells fargo bank statement, it had been cashed, but it wasn't until a year later during the next tax season, that he realized it ended up in the wrong hands. yates was eligible for a refund, but the irs told him, well, sorry, you're not getting your money because we never received the check. >> where is this money? >> yates first called wells fargo to figure out where his funds went, but he says the bank refused to help him, stating too much time had passed to inquire or file a claim. how many times did you reach out to wells fargo? >> at least three times that i escalated it or had it escalated to an executive level complaint,

and all three times they denied my complaint. >> meantime, he tried getting answers from the irs after being on hold for hours, getting transferred and disconnected again and again. he says he showed up to the irs field office in san jose twice to explain his situation. >> and that guy said, sorry, i can't help you. >> unfortunately for yates, wells fargo could only provide a blurry copy of the cash check, and the irs could not make out the locator number on it to help. and to make matters worse, there is no signature. >> like usually. i thought you were supposed to write your signature when you cashed a check. >> yes. in fact, wells fargo requires that consumers depositing checks in store or via their mobile app must sign the back of the check before cashing in, according to the consumer financial protection bureau. generally, banks or credit unions will not accept a check that's not signed or at least return it to you. but that did not happen here. >> somebody just dropped the ball. >> we brought this to thomas tarter, a 50 year veteran of the

banking industry who's been retained in more than 2000 cases involving big and small banks, including some about wells farg. >> wells fargo internally would have a system to locate it, give details necessary for the consumer to give to the irs. >> jeff mailed the check at the local post office on april 6th of 2022. 12 days later, it was cashed. yet his statement didn't show by whom or where. after getting no help from wells fargo, yates filed a report with the san jose police department. a search warrant uncovered his check was cashed in anaheim through a wells fargo atm, and was quickly transferred out of the account. police say the individual had a criminal record. when you have the search warrant with evidence of what actually happened, and you share that with wells fargo, and they say what they didn't really address the fact that this money was stolen from their atm machine. >> somebody made a mistake. >> tarter says in yates case, wells fargo is at fault.

>> wells fargo should have taken immediate steps to refund the money to the customer. >> but again, that didn't happen. on october 8th this year, yates received a letter from wells fargo stating his third claim was denied because it was, quote, untimely reporte. could you please call me back? seven on your side investigates reached out to wells fargo for an interview, but the bank was unavailable to go on camera. >> i really felt that wells fargo was complicit in this theft of my money. it's money that, you know, goes to feed our family, and we just can't lose 3000 plus dollars. >> now, wells fargo did send us a statement saying they empathize with the customer's situation and never want to see anyone fall victim to fraud. yet the bank did absolutely nothing to help jeff here, and never even admitted to the fact that their atm was used as a part of this fraud. the bank just added customers must file timely claims for any fraudulent transactions on their account. as for jeff, the only thing he can do now is take this up in

24 million americans have already voted in the election. that's according to election lab at the university of florida. for perspective, the 2020 election had a record turnout with more than 154 million votes. >> california voters have ten state propositions to decide on. prop two is about bonds for public, school and community college facilities. as reporter gabe ferris from our sister station in fresno explains, it's worth $10 million as voters cast their ballots, they'll decide whether the state should borrow $10 billion to build and repair public schools and community colleges. >> every student in the state deserves to be in a in a classroom that's worthy of being educated in. >> yuri calderon is the executive director of the small school districts association. proposition two would directly impact the campuses, calderon represents those with less than 2500 students. >> the vast majority of school districts in the state of california. there are over 65% are small. >> calderon says those schools

are often overlooked and underrepresented in state funding and grants because urban schools are better equipped to apply for the money. >> that's why these provisions are in this bond measure to ensure that at least a portion of those funds end up in our rural and small communities. >> the state would distribute proposition two money through matching grants, requiring districts to contribute from local funds. the prop wouldn't automatically raise taxes, but the state will need to find about $500 million a year to repay the loan. >> it's just that these school boards are not living within their means. >> critics like francisco alaniz with the libertarian party point out the bond measure will cost taxpayers much more than the proposed $10 billion interest will cost $8 billion over 35 years to repay this this bond, it's going to increase property taxes. >> and i'm not just talking about homeowners renters as well. >> proposition two goes before voters. as calderon says. some school facilities are in poor shape. >> when you see places that don't have clean drinking water that they don't have a sewer

than ever before. abc seven news anchor julian glover explains how it works. >> for years, first responders have relied on the drug naloxone also known as narcan, to prevent overdose deaths from heroin and fentanyl. it works by blocking opioid receptors from absorbing the drug. but now, researchers at the lawrence livermore lab say they've developed an effective treatment that works differently. >> our molecule is different in a way that it goes into your bloodstream, and what it does is like a pacman molecule. it catches fentanyl before it reaches the target. >> chemist carlos valdes and biologist mike malfatti were part of the team that developed the drug, called subutex. rather than blocking receptors, they say it actually binds directly to the opioid itself, effectively neutralizing it and allowing it to be flushed out of the body more quickly. in non-human testing, they say it cuts specific recovery times in half from a little over 35 minutes to about 17 minutes for
