>> yes. a stunning turn of events today that could lead to erik and lyle menendez being released from prison. los angeles county district attorney george gascon announced he is going to recommend the brothers be resentenced. >> we're very sure not only that, the brothers have rehabilitated and that they will be safe to be reintegrated into society, but that they have paid their dues not only for the crimes that they committed, but because of all the other things they have done to improve the lives of so many others. >> the former san francisco da, who now does that job in los angeles, fillled his recommendation today, the brothers are currently serving life without parole for the 1989 murders of their parents. gascon is recommending 50 years to life with the possibility of parole. >> now, today's announcement is a huge development, but it's by no means the end of this case. gascon will bring his recommendation to a judge if the judge agrees. the brothers would go to the state board of parole hearings, which would decide

whether they can be paroled. and even if the parole board agrees to their release. governor newsom has the power to accept or reject it. >> now, key in this resentencing effort is the brothers history of sexual abuse by their father, a history that was excluded from their second trial. it really does in so many ways speak to the shifting understanding of abuse, something the da acknowledged in his news conference today. abc seven news reporter tara campbell spoke with a legal expert about the impact this case could have for other abuse survivors convicted of crimes. >> new evidence and a new chapter in the case of eric and lyle menendez. >> i do believe that the brothers were subjected to a tremendous amount of dysfunction in the home and molestation. >> the brothers, who from the get go said they were sexually abused by their father, could be freed from prison. >> there is also important to have some introspection today. >> thursday, l.a. district attorney george gascon putting

into question whether enough was done for the victims of sexual abuse. >> because i think that often, for cultural reasons, we don't believe victims of sexual assault, whether they're women or whether they're men. >> this decision by the da today to resentence the menendez brothers speaks a lot to the change that we have in society, recognizing that persistent sexual and physical abuse can greatly affect how someone reacts to a situation and what they do in response to that. >> prosecutors in 1993 said the abuse defense was fabricated, even saying at one point, men can't be raped. the people's position. >> first of all, that men cannot be raped since they lack the necessary equipment to actually be raped. >> the jury in that case deadlocked. and in a second trial, a judge limited evidence of abuse. thursday, the da, pointing to new evidence when

seriously hurt. the fight is raising concern for families at ignacio valley high school in concord. abc seven news reporter j.r stone looks at the questions from parents and police. >> dozens of students surrounding what appeared to be either a fight or an attack at the bank right next door to ignacio valley high school, around 230 wednesday afternoon. >> i saw people running and i went to go follow them, and then i just saw a kid getting jumped. >> that from a student who witnessed what happened but chose to protect her identity. we received video from an anonymous member of the school community. look closely in the back and you can see someone in a ski mask throwing a punch, joining others in masks during an assault. officers say they broke up what they call a fight involving several teens. security and property management told me this was a, quote, straight up ambush of a male and female student by several individuals. end quote. you can see one of those people dressed in all black in this shot while police didn't locate a knife. witness video shows a knife just

lying on the ground in an area near the crowd. >> i think for every parent that hears this, it's very concernin. especially you would think that in this area that's kind of a more of a higher end. >> upsetting that, you know, it's going to happen around here. >> i did ask police if this attack was gang related. they tell me motivation here is part of their ongoing investigation. >> they're saying it was over a girl. really? yeah. and like, he got mad that the other guy went with the girl, so he called his friends. i'm pretty sure they had ski mask on, because i don't know, that's just what the boys be doing over here. i guess when they be fighting, they just be wearing skis. >> police say six juveniles were arrested. four of the six were released to their parents. the other two were taken to juvenile hall and will face assault charges. the district has not yet commented on what happened as of broadcast time. in concor, j.r. stone, abc seven news. >> new developments with embattled san jose city council member omar torres. he's asking

there. yeah. temperatures will be primarily in the 40s and 50s at 7 a.m, peeks of sun at noontime. still a lot of cloud cover. 4 p.m. it's going to be sunnier and certainly mild mid 60s to low 80s. turning partly cloudy later on in the evening. i do want to show you the temperature trend. san jose's average is 74 degrees. tomorrow you make it up to 82. but notice those numbers going down for several days. and right after that, we even have the possibility of showers. i'll let you know exactly which day this weekend coming up. >> all right. thank you so much, sandhya. we'll check back. tesla could find itself in trouble for a chemical spill in palo alto. happened last thursday at a facility on page mill road. 12 gallons of sodium hydroxide ended up going into a storm drain that flowed into a creek. sodium hydroxide is used as a coolant, but the city says it is not hazardous to people's health. the cleanup is still going on a week later, and there's this palo alto says tesla didn't have a permit for storing the chemical. this means it could face a fine and have to

pay for the cleanup costs. >> we're following the story of a project that's bringing affordable housing for farmworkers to half moon bay. the city planning commission got a progress report on construction in their meeting tonight. things are moving along, but it looks like the earliest people may be able to move in is on in march or maybe april. that's because things need to be worked out with p-g-and-e's. the goal was originally to have things ready in january. regardless, the commissioners recognize the significance of this project. >> it would be great if we could turn the page on this sad chapter of half moon bay and have a new beginning here. i think it's important for us to it's an important opportunity. >> when complete, there will be dozens of manufactured homes for farm workers. 19 of the homes will be for families displaced by the 2023 mass shooting. >> a positive update tonight in a story that rocked the south bay this summer, the san jose police community service officer, who survived a crash with a suspected drunk driver, is back on the job. san jose

police shared this picture of cso veronica bear back at work two months after the crash. that killed her partner. she and cso long pham were doing traffic control when a driver smashed into a parked car, sending it flying into the officers. 34 year old pham died. bear had serious injuries. san jose police say she is still on the mend, but couldn't wait to return to work. >> food safety investigators are tracking the path of that deadly e coli outbreak tonight with mcdonald's now saying it all comes back to a salinas based company. two days after taking the quarter pounder off the menu in hundreds of restaurants. tonight, mcdonald's says they found the source of the onions linked to the deadly e coli outbreak. >> it made me think twice about my afternoon snack. >> salinas based taylor farms is issuing a recall of onions tied to a facility in colorado. other restaurants are taking action, too. yum! brands announcing they're proactively taking fresh onions off the menu at select, taco bell, pizza hut and kfc
