to be another beautiful afternoon. not quite as chilly today as we were this time yesterday, but still. we have numerous cities in the 40s like santa rosa, concord, right now, at 49 degrees, you're down to 46. in palo alto, 58. that current temperature in san francisco. so looking at the forecast today, inland, another beautiful day, sunny skies this afternoon. we'll have those temperatures hovering around 80 degrees once again around the bay shoreline. beautiful a light breeze this afternoon. daytime highs looking very pleasant. we'll get you into the mid 70s later on today. and even along the coast. we'll keep those clear skies this afternoon for one more day. and highs in the mid and upper 60s. let's check in with frances. see the commute this morning. >> all right drew, we have a problem right now for folks heading towards richmond san rafael bridge. we have green everywhere else on the map, but there is a big rig that is blocking a lane right now. if you're heading westbound towards san rafael and san quentin and traffic is slow right as you

approach the scene. but as we show you live shot of the richmond bridge toll plaza, you'll see really, there's not much of a wait right now at this point. and also we'll check out some drive times for you. it's green on the westbound 80 right. highway four to the may 17th minutes. emeryville to san francisco ten minutes and then delay free towards sfo. and here you can see it is a little bit more crowded. but you know, that ride is delayed for you right now. heading towards the bay bridge. >> reggie aqui a stunning turn of events in the menendez brothers case. after spending more than three decades in prison for murdering their parents, they could soon be free. l.a. county district attorney george gascon has filed paperwork to start the process of resentencing. gascon made the announcement about that decision during a news conference yesterday afternoon. >> we're very sure not only that, the brothers have rehabilitated and that they will be saved to be reintegrated in our society, but that they have paid their dues not only for the crimes that they committed, but because of all the other things

they have done to improve the lives of so many others. >> the brothers are currently serving life without the possibility of parole for the 1989 murders. gascon is recommending 50 years to life, with the possibility of parole. that would mean eric and lyle menendez would be immediately eligible for parole. their attorney believes there's a chance they could be free by thanksgiving. today's recommendation is just the first step in the case. if the judge agrees to gascon's request, the brothers would go to the state board of parole hearings. if the parole board agrees to their release, governor newsom still has the power to accept or reject it. >> key in this resentencing push is the brothers history of sexual abuse by their father, a history that was excluded from their second trial. it speaks to shifting understandings of abuse, something the d.a. acknowledged in his press conference. abc seven news reporter tara campbell spoke with a legal expert about the impact the case could have for other abuse survivors convicted

of crimes. new evidence and a new chapter in the case of eric and lyle menendez. >> i do believe that the brothers were subjected to a tremendous amount of dysfunction in the home and molestation. >> the brothers, who from the get go, said they were sexually abused by their father, could be freed from prison. >> there is also a important to have some introspection today, thursday, l.a. district attorney george gascon putting into question whether enough was done for the victims of sexual abuse. because i think that often, for cultural reasons, we don't believe victims of sexual assault, whether they're women or whether they're men. >> this decision by the da today to resentence the menendez brothers speaks a lot to the change that we have in society. recognizing that persistent sexual and physical abuse can greatly affect how someone

reacts to a situation and what they do in response to that. >> prosecutors in 1993 said the abuse defense was fabricated, even saying at one point, men can't be raped. people's position. >> first of all, that men cannot be raped since they lack the necessary equipment to actually be raped. >> the jury in that case deadlocked, and in a second trial, a judge limited evidence of abuse. thursday, the d.a, pointing to new evidence when they receive corroboration to the menendez brothers, claims that they were physically and sexually abused, particularly by their father. >> that then was the game changer. that said, these young men did not deserve life without the possibility of parole. >> the question now is, will this case set a precedent for other abuse victims who've been sent to prison after claiming self-defense? >> they were high profile. they had a lot of high profile support. but do other people reap the same benefits who are

served if congressman swalwell focused less on trying to overturn the will of the voters and more on defending our democracy. >> new developments with embattled san jose city council member omar torres. he's now requesting a 30 day medical leave of absence. torres cited the investigation into the allegations he sent sexually explicit text messages to a minor. he says it's affected his mental health and he needs time to recover. at least one city council member appears to be ready to reject torres's request and wants him to resign immediately. >> if we don't do anything, then shame on us. this is not about council member torres. this is about our constituents. this is about our city. this is about our pride and our moral fortitude to do the right thing. >> earlier this week, the city council removed torres from all the committees he serves on 11 days to go until election day, and it's going to be a race to

the finish line today. >> former president donald trump sits down with podcaster joe rogan and vice president kamala harris will campaign in houston with beyonce and willie nelson. harris's campaign has been working to negotiate an appearance with beyonce since it received permission to use her song freedom as its national anthem. beyonce has a history of endorsing democratic candidates. the editorial editor of the los angeles times has resigned. it comes after the newspaper's owner blocked the editorial board from endorsing kamala harris for president. the owner says that he instead asked the board to do a factual analysis of harris and trump's policies, despite the board's intention to make an endorsement. the editor told the columbia journalism review that she was not okay with the paper remaining silent and, quote, dangerous times. >> most californians vote by mail, but what happens if you make a mistake on that ballot? kim alexander from california voter foundation explains what to do. >> let's say you wanted to vote yes on a proposition, but you

the bank right next door to ignacio valley high school, around 230 wednesday afternoon. >> i saw people running and i went to go follow them. and then i just saw a kid getting jumped. >> that from a student who witnessed what happened but chose to protect her identity. we received video from an anonymous member of the school community. look closely in the back and you can see someone in a ski mask throwing a punch, joining others in masks during an assault. officers say they broke up what they call a fight involving several teens. security and property management told me this was a, quote, straight up ambush of a male and female student by several individuals. end quote. you can see one of those people dressed in all black in this shot while police didn't locate a knife. witness video shows a knife just lying on the ground in an area near the crowd. >> i think for every parent that hears this, it's very concerning. especially you would think that in this area that's kind of a more of a higher end upsetting that, you know, it's

going to happen around here. >> i did ask police if this attack was gang related. they tell me motivation here is part of their ongoing investigation. >> they're saying it was over a girl. really? yeah. and like, he got mad that the other guy went with the girl. so he called his friends. i'm pretty sure they had ski mask on, because i don't know. that's just what the boys be doing over here. i guess when they be fighting, they just be wearing skis. >> police say six juveniles were arrested. four of the six were released to their parents. the other two were taken to juvenile hall and will face assault charges. the district has not yet commented on what happened as of broadcast time in concord. j.r stone, abc seven news. >> bart police say they've arrested a man they believe caused $500,000 worth of damage at three san francisco bart stations. bart police say the 28 year old is responsible for shattering at least 29 large glass panels earlier this month at the entrances of the embarcadero, montgomery and

powell stations. the suspect was spotted riding a train this week and was detained. >> a big state grant will help the san francisco bay ferry go electric. ferry officials say they're set to receive $12.5 million from the state transportation agency. it's part of a program to meet california's greenhouse gas reduction goals. the money will go toward electrifying ferry service on the harbor. bay harbor, bay route in alameda. the ferry system has carried nearly 270,000 passengers on that route over the past year, and more than 2.5 million over its history. >> a new place for kids in oakland to play. east oakland's brookfield elementary is celebrating the opening of a new soccer field, and last night the school held a ribbon cutting for their new pitch, built on their old blacktop. it's part of a bigger project to turn asphalt spaces into turf fields. brookfield's field of dreams will serve the school also. oakland, unified's after school and summer sports programs. >> basketball is back in the bay

children endured physical, sexual and emotional abuse. more than 950 died while attending those schools. >> tesla could find itself in trouble for a chemical spill in palo alto. it happened last thursday at a facility on page mill road. 12 gallons of sodium hydroxide ended up going into a storm drain that flowed into a creek. sodium hydroxide is used as a coolant. the city says it's not hazardous to people's health. the cleanup is still going on a week later. palo alto says tesla did not have a permit for storing the chemical. this means it could face a fine and have to pay up, pay for the cleanup costs. >> we are following the story of a project that's bringing affordable housing for farmworkers to half moon bay. the city planning commission got a progress report on construction in their meeting last night. things are moving along, but it looks like the earliest that people may be able to move in is march or april. and that's because things still need to be worked out with pg and e. the goal was originally to have things ready in january.

regardless, the commissioners recognize the significance of that project. >> it would be great if we could turn the page on this sad chapter of half moon bay and have a new beginning here. i think it's important for us to it's an important opportunity. >> when complete, there will be dozens of manufactured homes for farm workers. 19 of the homes will be for families displaced by the 2023 mass shooting. >> demolition is underway at a beloved santa cruz restaurant. the dolphin restaurant has been open since 1963. it closed permanently in december of 2023 after storms destroyed some of the poles located directly underneath the restaurant. the city is working to fully restore the wharf, with plans to design new boat and fish landings, but officials say the rest will be up to the community. >> it all depends on what the public desires most. it could be a mix of retail, restaurants, recreation, public access. so

for abc seven mornings adventure. our way of highlighting some things happening in the day ahead here in the bay area. >> first, the family of a man killed by alameda police officers will protest outside a court hearing this morning. one of the three officers charged in connection with the 21 2021 death of mario gonzalez will appear in an oakland courtroom. gonzalez died after officers pinned him down for at least four minutes until he became unconscious. earlier this month, a judge dismissed charges against the other two officers. the judge ruled that the da's office did not properly file the charges within the statute of limitations. that third officer still faces manslaughter charges because his statute of limitations was paused while he was out of the country. >> today is the second day of the mushroom festival at san francisco's ferry building. the four day event features cooking, demos and food specials. and tonight the marketplace will be transformed into a mushroom masquerade and people will be dressed up in mushroom costumes. what is that? >> get out of your mushroom costume, everyone.

is 36 minutes reggie aqui. >> thanks, francis. are elephants people? a colorado court is set to answer that question. the case is the latest in a long running legal battle to help get elephants out of captivity. activists with the nonhuman rights project are suing the cheyenne mountain zoo. they claim elephants in captivity are being unlawfully imprisoned and should be protected by habeas corpus, meaning they should not be held

captive without legal justification. one has to make the argument in order for the argument to win, to ever win. and i think that we are making that progress. the zoo is fighting back, saying one requirement of habeas corpus is that the benefiting party will go free. they go on to say, our elephants cannot go free because they cannot survive without human care at their ages and with their various age related ailments. a move like this would be cruel. >> tony la russa is getting back into the animal rescue game. the legendary former a's manager is teaming up with the penfed foundation, which helps raise service dogs for veterans. la russa started the walnut creek based animal rescue foundation back in the 1990s, but split from it last year. it is now joy bound people and pets, labrousse says, planning to raise money for penfed next month, that is, annual leaders and legends event. >> basketball fans, the warriors are back in the bay this

coli outbreak linked to mcdonald's quarter pounders. that comes as a monterey county farm is the source of the onions that caused a sickness. and even one death. federal food experts say the onions were grown in salinas and sent to a taylor farms facility in colorado. taylor farms has recalled peeled and diced yellow onions for potential e coli contamination. >> and now, with more and more vegetables being implicated, you know, we have to think about other things and have new strategies like thinking about the irrigation system to try to keep our food supply as safe as possible. >> a colorado man has filed the first lawsuit against mcdonald's. that lawsuit accuses mcdonald's of product liability, negligence and breach of implied warranties. the plaintiff claims to have tested positive for e coli after eating a quarter pounder burger, then suffering days of pain. mcdonald's pulled the quarter pounder off the menu at 20% of its stores across the country. now, other fast food restaurants are pulling onions
