238 two 880, blocking a lane. but once you get on 880, here's a live camera shot by the coliseum. no problems at all for taillights moving northbound towards the maze right now and just a slow drive. time for you. westbound 580 tracy to dublin. 34 minutes, but southbound, 680 dublin to mission boulevard. 16 minutes. that's green. it's also green on northbound 85 from 101 to cupertino. also at 16 minutes. bay bridge toll plaza with metering lights on. not much of a wait. highway four to san francisco, 36 minutes right now. and ace train number one. just reporting 15 minute delays. >> gloria francis, thank you so much. developing news, east bay congressman eric swalwell is threatening to sue alameda county district attorney pamela price for defamation. at issue is a facebook post that price made earlier this month. it aligns swalwell with republicans and implies that he supported the recall of price to protect himself from a discovery price made earlier this year. she found that under past district attorneys, prosecutors were purposefully eliminating black

and jewish jurors from death penalty cases. according to the chronicle, swalwell believes price made the comments because he endorsed the recall. price's campaign responded saying, quote, our constituents would be better served if congressman swalwell focused less on trying to overturn the will of the voters and more on defending our democracy. >> new developments with embattled san jose city council member omar torres. he's now requesting a 30 day medical leave of absence. torres cited the investigation into the allegations he sent sexually explicit text messages to a minor. he says it has affected his mental health and he needs time to recover. at least one city council member appears to be ready to reject torres request and wants him to resign immediately. >> if we don't do anything, then shame on us. this is not about council member torres. this is about our constituents. this is about our city. this is about our pride and our moral fortitude to do the right thing. >> earlier this week, the city council removed torres from all

the committees he serves on. >> in a stunning turn of events in the menendez brothers case, after spending more than three decades in prison for murdering their parents, they could soon be free. l.a. county district attorney george gascon has filed paperwork to start the process of resentencing. gascon made the announcement about his decision during a news conference yesterday afternoon. >> we're very sure not only that, the brothers have rehabilitated and that they will be saved to be reintegrated in our society, but that they have paid their dues not only for the crimes that they committed, but because of all the other things they have done to improve the lives of so many others. >> the brothers are currently serving life without the possibility of parole for the 1989 murders. gascon is recommending 50 years to life with the possibility of parole and that would mean eric and lyle menendez would be immediately eligible for parole. their attorney believes there is

a chance they could even be free by thanksgiving. >> my goal is to have them home for thanksgiving. this now allows a judge to sentence them, to take a look at all the good work that they've done while being imprisoned, and while having absolutely no ability or thought or any hope whatsoever to ever get out. >> and you can watch the full interview on gma at 7:00, right after abc seven mornings. >> key in this resentencing push is the brothers history of sexual abuse by their father, a history that was excluded from their second trial. it speaks to shifting understandings of abuse, something the da acknowledged in his news conference yesterday. thursday, the da put into question whether enough was done for the victims of sexual abuse. prosecutors in 1993 said the abuse defense was fabricated even saying at one point the untruthful statement that men can't be raped. >> this decision by the da today to resentence the menendez brothers speaks a lot to the

and willie nelson. harris's campaign has been working to negotiate an appearance with beyonce since it received her permission to use her song, freedom as its national and official excuse me, official anthem of the campaign. beyonce has a history of endorsing democratic candidates. the editorial's editor of the los angeles times has resigned. this comes after the newspaper's owner blocked the editorial board from endorsing kamala harris for president. the owner says that he instead asked the board to do a factual analysis of harris and trump's policies, despite the board's intentions to make an endorsement. the editor told the columbia journalism review that she was not okay with the paper remaining silent and, quote, dangerous times. >> many californians vote by mail, but what happens if you make a mistake on your ballot? kim alexander from california voter foundation explains what you should do. >> let's say you wanted to vote yes on a proposition, but you voted no. what you can do is cross out the choice that you

months ago, but their return was delayed due to technical problems with their capsule. they were delayed again over weather concerns from hurricane milton. in total, the astronauts were in space for eight months. the warriors got good news without even playing a game. the nba corrected a scoring error and gave the warriors an additional point. that happened during wednesday's season opener against the blazers. the league erroneously missed a free throw from warrior de'anthony melton during the game. statisticians recorded melton as missing both free throws. after checking the tape, the league found that melton actually made one of them, but the scoreboard never changed. yesterday, the league gave the warriors that additional point. it didn't make a big difference since the warriors won by 36. but you know, every point counts still. the warriors are back in action tonight in utah and they'll finally return to chase center for the home opener sunday. abc seven news reporter lena howland is inside the arena to find out what's new at the games this season. good morning lena. >> good morning reggie. the wait

is finally over. chase center will finally be filled with warriors fans once again for their home opener on sunday night. the warriors are kicking off their sixth season playing right here at chase center. the 2022 champions are hoping for a bit of redemption this season. fan favorites steph curry and draymond green will be here. of course, fans will also notice some new faces on the team this year, including nba veteran buddy hield, who had the most points in the season opener wednesday night with 22 for the dubs. it's momentum they hung on to after being the only team in the nba to go undefeated pre season. the warriors won in portland against the trail blazers by a record setting margin for the team, 140 to 104. >> the largest season opening victory in warriors history. and i believe fifth largest in the history of the nba. all time. so the team is deep. the team is exciting. we're excited to have them back in front of home fans

minutes. let's check in with frances. see those drive times. >> all right drew we're going to start to see some slowing on bay area roads this morning with a few accidents also that have been reported westbound 80 from highway four to the maze is 18 minutes. and then from emeryville to san francisco, it's another 18 minutes. but a crash has just been reported approaching the tolls. however, there is a sig alert, a traffic alert for a serious accident. there's an overturned car crash in walnut creek northbound 680 before olympic boulevard. traffic is jammed from lavorgna, and it looks like it's even slowing traffic in the southbound direction. as folks approach that crash. here's a live look at the richmond bridge traffic is heavy from castro street to about mid-span and an earlier big rig stall has been cleared from the richmond bridge. and if you're headed to the bay bridge toll plaza. a new crash just reported approaching the tolls. i don't see it in this live shot, but traffic is slow from at least the west grand overcrossing to the toll. metering lights. >> reggie francis. thank you.

there's now just 11 days until election day. a brand new abc news poll shows that almost half of registered voters say donald trump is a fascist. 22% say the same about vice president kamala harris. of course, this has been a big topic this week since trump's former chief of staff, john kelly, made that accusation yesterday. former president barack obama appeared at a harris rally in georgia and addressed trump's behavior. >> some men who who seem to think trump's behavior is a sign of strength, that macho. you know, i'm going to i'm going to own these folks. i'm going to put them down. i am here to tell you that is not what real strength is. >> donald trump was in nevada and arizona. he said that he would fire the special counsel investigating his handling of classified documents and his role in the january 6th attack. he also had a new way to describe our country's immigration. >> we're a dumping ground. we're like a garbage can for the world. you know, it's the first time i've ever said that.

to mcdonald's quarter pounders. it comes as a monterey county farm is a source of the onions that caused the sicknesses and even one death. federal food experts say that the onions were grown in salinas and sent to a taylor farms facility in colorado. taylor farms has recalled peeled and diced yellow onions for potential e coli contamination. >> now, with more and more vegetables being implicated, you know we have to think about other things and have new strategies like thinking about the irrigation system to try to keep our food supply as safe as possible. >> a colorado man has filed a first lawsuit against mcdonald's. the lawsuit accuses mcdonald's of product liability, negligence and breach of implied warranties. the plaintiff claims

to have tested positive for e coli after eating a quarter pounder burger, and then suffered days of pain. mcdonald's pulled the quarter pounder off the menu at 20% of its stores across the country, and now other fast food restaurants are pulling onions from their menu. coming up on gma, we hear from a colorado resident who says she tested positive for e coli after eating at mcdonald's. >> i actually felt like i was dying at first, but i was really bad sick for about four days. it was almost like mirroring labor pains. that's that's about as close as i can get to that. you know, explaining what it felt like. >> and you could see more of that interview on gma at 7:00 right after abc seven mornings. >> now it's your morning money report. spirit airlines is cutting jobs and selling more than 20 of its aircraft, while the company faces financial pressure. the airline is expected to take more cost cutting measures early next year, which could save them $80 million. spirit is selling some of the planes to an aircraft

is just some drizzle, mainly in the north bay for a lot of us, you'll just notice an increase in cloud cover for the back half of the weekend and cooler air moving in here the next week. behind that front, sunshine is back in full force. it feels a lot more like fall with temperatures in the 60s and in the 70s warm today. inland, upper 70s to the lower 80s for daytime highs around the bay shoreline will be in the mid 60s, just looking very nice this afternoon and we'll keep it sunny along the coast. and those temperatures in the mid and upper 60s. so we are going to see another day of warm sunshine. just the pattern we have been for much of this week. we'll go to 80 santa rosa, san rafael, 82, in san jose, 72 in the city, 75, in oakland, 80. the high in concord overnight tonight we will have some cool temperatures in the 40s and in the 50s. but tomorrow temperatures still remain a bit above average. future tracker to start the weekend off under sun and clouds, we'll find temperatures mainly in the 70s and in the 80s, but by sunday you'll feel that cooler air will drop about ten degrees in our

report, he was also a 2020 correspondent over his career, gerald covered martin luther king jr. s assassination, he was the chief white house correspondent covering presidents nixon and ford. he won six emmys for his work. tom gerald was 89. >> if you can't beat them, join them. that's what one east bay school district is doing with school meals. the san lorenzo school district rolled out its very own food truck, a colonial acres elementary school. the mobile kitchen will travel to different schools to give kids the fun experience of eating out of a food truck, and also compete against regular food trucks in high schools. >> i'm in competition at the high schools with the food trucks that are there already, and the kids have to pay for the food. so i'm going to be taking to the high schools where they can get free food, and i'm going to serve the wings and have them come out to me. >> the district will also use the mobile kitchen at community events, and in case of emergencies, to serve hot food to first responders. >> tony la russa is getting back in the animal rescue game. the

legendary former a's manager is teaming up with the penfed foundation, which helps raise service dogs for veterans. la russa started the walnut creek based animal rescue foundation back in the 1990s. he split from it last year. it's now joy bound people and pets. la russa is planning to raise money for penfed next month at his annual leaders and legends event, before creators have the opportunity to present their product, an item featured on this week's shark tank is already going viral. >> it's a not fried chicken ice cream. so okay, you could see right there it looks like a bucket of chicken. but actually each of those, you know, chicken pieces will look like chicken is ice cream. so it's a brainchild of life raft treats. and they'll have to pitch their idea to todd graves, who's the founder of raising cane's. >> look, when i came in, though, all the sharks, this was this was the best part for me. all the sharks were so welcoming and helpful, giving me tips along the way and in between breaks. so i settled in pretty quick
