11:03 pm
on right across the street in this volkswagen van. >> that's surreal. i mean, you know, the dead were getting old and so, you know, if i was just telling him, i'd figured this day was coming, but not so soon. >> the band, a symbol of the counterculture movement of the 60s. if you look at that house and you think about the people that have gone up and down those steps and those special years, that was a very special moment in time. >> it's a whole community of misfits in a way. uh- and it's home for a lot of people who who don't feel they have a home. >> their music defining a generation and inspiring generations of fans to follow. >> the energy from that time is still here. you feel it. i mean, we're sitting in an old van. there's people walking up and down the street who know and love this music. it just never stops. >> rest in peace, phil. we'll miss you. thanks for all the good times.

11:07 pm
six months from now, we're not saying we should have done this six months ago. so now is the time to get the process started. >> torres has requested a month long medical leave, saying the allegations have impacted his well-being. with a little more than a week left until election day, both kamala harris and donald trump have turned their attention to texas tonight. harris got some star studded support in houston. >> i'm not here as a celebrity. i'm not here as a politician. i'm here as a mother. a mother who cares deeply about the world. my children and all of our children living. >> houston native beyonce was among the celebrities who attended harris's rally. she didn't perform, but the legendary 91 year old willie nelson did. the vice president's campaign says 30,000 people were in attendance as the vp addressed reproductive rights. former president trump held his own rally in austin, focused on immigration. >> we're here today in the great
11:08 pm
state of texas, which under kamala harris has been turned into ground zero for the largest border invasion. >> the new york times, siena college poll before the election, released today, shows trump and harris are now tied among likely voters. each has 48% of the vote. new at 11, a san jose man is looking to rent out a magical space. and we do mean magical. his ad calls it a harry potter cubby. it's inside his apartment and inspired by the wizard. abc seven news reporter lauren martinez went and checked it out. >> this harry potter style space under the stairs is available to rent. not in the wizarding world, but in san jose. >> i wish i could find some other name for him because i don't actually care about harry potter that much. i'm much more of a lord of the rings guy. but you know, it's just a place to sleep. >> jason doesn't want to be identified. he's not allowed to sublet his one bedroom, one bathroom unit. he said rent
11:09 pm
increased in august to nearly $1,800. >> i paid the first increased rent month and realized with a little bit of math that in about 11 months i would be down to a tent or my car because my savings would be gone. >> now he's resorting to finding a roommate. jason posted this ad on craigslist $250. harry potter cubby for very cheap plus light chores. >> it's about what i need to be able to afford. the rent, you know, and i'm not blackstone. i don't want to charge people for profit. i just want to be able to live in not a tent. >> the craigslist ad has been posted for a month, and on november 1st, his first potential roommate will visit. jason says you won't just have access to the harry potter cupboard, but there's no restrictions on cooking, internet, kitchen, bathroom or gaming space. >> one of the places i looked at on craigslist for $600 was someone's partitioned off living room with sheets, and they had restrictions on bathroom usage. like you can only go between 6
11:10 pm
and 7 a.m. or eight and 9 p.m. >> jason sad also mentions he liked to rent it out to a nice nerdy gamer. >> it's just sort of a culturally shared experience that, you know, goes between race and creed and religion. it could be rock collecting or digging up dinosaur bones. as long as there's some sort of nerd or geek, i'm okay. >> and if our video doesn't quite capture the magic of what could fit here, the area is roughly three by ten feet in san jose. lauren martinez, abc seven news. >> all right. how soon could the menendez brothers get out of prison? we are getting a better idea tonight of the timing. if a judge sentences them and crab season is being delayed again in the bay area by humpback whales. scientists explain what's behind it. plus, an important call to one particular group of people to help in the fight against breast cancer. first, a look at what's coming up tonight on jimmy kimmel live! right after abc seven news at 11, jimmy. >> tonight we are at the very

their spot in the ncaa tournament. the university of nevada, reno is now the fifth team to forfeit a match against sdsu. it comes after unconfirmed claims by a spartans volleyball player that one of her own teammates is transgender. nevada players say they forfeited because the match quote, advances in justice against female athletes. an lgbtq plus advocate says the situation is about more than one athlete.
11:14 pm
>> this is not what america is supposed to be, but it is very dangerous right now. >> the spartans have to play 19 matches to participate in the ncaa tournament. they are at 14. there are eight games left in the regular season. a tribute is set up in lewiston, maine, marking one year since a tragic mass shooting on this day. a gunman opened fire at both a bowling alley and a bar and grill. this was the deadliest shooting in the state's history, with 18 people killed, 13 injured. a nonprofit is taking over the former bar and grill to turn it into a free resource center and food pantry. they set up 18 warming center rest spots in the parking lot in honor of the 18 lives lost. it could be up to a month and a half before a judge reviews the case of the menendez brothers, who were convicted of killing their parents. more than 30 years ago. prosecutors are asking the court
11:15 pm
to resentence them, recommending life without the possibility of parole be removed. but the process could be long because after review, it could go to a parole board, which could take six months or longer. and then there is a possibility the governor could later weigh in on the decision. >> all of these family members will uniformly ask one thing, which is bring them home, bring them home. >> the los angeles district attorney says he recommended the resentencing after weighing new evidence showing the brothers were abused. the number of cases of e.coli tied to mcdonald's quarter pounders has risen to 75 people across 13 states. that's up from the previous report earlier this week of 49 people across ten states. it's believed these infections are caused by the fresh onions used on the burgers sourced from california based taylor farms. one person has died and 22 are hospitalized. at least one affected customer has filed a lawsuit against mcdonald's. the american cancer society is urging black women to use their
11:16 pm
voice to help fight breast cancer. october is breast cancer awareness month, and the push to get black women to join a new study is for good reason. >> african-american women are doing worse in any ethnic group. they have about 40% higher risk of dying from breast cancer compared to white women overall. regardless of what stage they present with, they still have the lowest survival rate amongst all ethnic groups. >> and then this voices study could help narrow down why they have worse outcomes. and then we can. exactly. >> exactly. >> doctor patients. o'daly is a breast surgical oncologist with kaiser san rafael. she says multiple factors likely play into this disparity. access to care. barriers to getting treatment, as well as social, environmental and lifestyle factors. kaiser is working to improve outcomes for black women by providing education, support and screening. the american cancer society is also working to achieve better health equity for this group, which is why it's looking for 100,000 black
11:17 pm
women without cancer for its new voices study. >> we know that even though black women are likely to get screened for breast cancer, the quality of the screening and the care that they get the timeliness to the care is not at a point where it needs to be. >> doctor fullam is an associate professor of medicine at ucla and a voices ambassador. >> unfortunately, there's been a bias in medical research and that we are less likely to study black and brown populations and science, which is why this study is so important. >> it will follow participants for years to come, and what researchers discover can help improve the quality of care for future generations. i know being part of a study can sound a little scary, but doctor o'daly says it's mostly answering questions. >> i think it's just filling out a bunch of surveys every so often, you know, sort of identifying if you do get diagnosed with a breast cancer, we're sort of finding out what's happening afterwards and then tracking things in the future as well. and what your experience has been through that journey.
11:18 pm
>> it can be incredibly helpful and signing up for the study is simple. all you have to do is head online to voices dot cancer.org. humpback whales are putting crab season on hold. the commercial dungeness crab fishery south of the sonoma mendocino county line was scheduled to open november 15th, but the state department of fish and wildlife has pushed back the opening because of the large number of humpback whales and recent entanglements in the area. >> we're already seeing a high number of whales entangled in gear from may to october. we've seen four entangled in dungeness crab gear confirmed entangled, and we've seen an additional ten humpback whales entangled in unknown fishing gear that hasn't been able to be identified, and there's also currently several whales entangled in monterey bay. so i think we'll be seeing some numbers rolling in that are really uncomfortable as we continue to delay the season due to high whale risk. >> the group oceana has been working with both fishers and the state on testing ropeless traps, which limit the risk of
11:19 pm
whales becoming entangled. they say they're hopeful that upgrading the traps will allow fishers to extend the crab fishing season this spring, to help make up for some of the lost revenue from the delayed opening. dia de los muertos is almost here. tomorrow on abc seven, localish is celebrating the traditions that make the holiday so special. from building home altars to street festivals filled with music and dance, there are so many wonderful ways to honor loved ones. >> i like to honor my roots, my culture, my heritage through my art. >> for dia de los muertos, you have to have your dia de los muertos bread. >> oh yeah, let's get some of that. plus, how the holiday is growing more popular from movies to shopping malls, even big league ballparks and the disneyland resort. don't miss localish celebrates dia de los muertos sunday at 8:30 p.m. right here on abc seven. all right, so let's get a check on our weather. pleasant for today. a lot of halloween activities

11:21 pm
have the high clouds just kind of filtering our sunshine for the first half of the day. those clouds are gone, but they'll be replaced by more clouds tomorrow. your morning numbers will drop off, but not much because we are expecting a little bit of insulation. 50s and 60s right now, and a lovely view from our pier 39 camera tomorrow. mild mix of fog and clouds. sunday we're looking at drizzle and spotty showers, and next week we have crisp fall weather coming your way. east bay walk to end alzheimer's is happening tomorrow in san ramon. 9:00 in the morning, 57 degrees. pretty calm in terms of the winds. cool with cloud cover. the walk starts at ten. temperature will come up into the 60s and really it's going to be mild at noontime. so good idea to dress in layers. leslie brinkley will be there to emcee this event. morning temperatures in the 40s and 50s. we'll have the fog at the coast partly to mostly cloudy skies. otherwise, tomorrow afternoon it's going to be another mild one. low 80s inland, mid 60s coast, not quite as warm as it was today. today we had mid 60s to mid 80s. now
11:22 pm
we're going to show you what's going to happen with the timeline. tomorrow. the clouds increase as we head into the afternoon sunday morning. while many of us hopefully are sleeping, you're going to be seeing some damp roadways out there 4:00 in the morning, some drizzle, some showers at 7 a.m. best chance for those showers will be in the north bay, but you can see they're very spotty, very light. and this continues into the early afternoon before this system winds down. now rainfall totals will be anywhere from a few hundredths of an inch all the way to about 1800 ukiah, 12 hundredths in santa rosa. this does turn from showers in the sierra to snow showers as we head towards monday. this is welcome. it continues monday evening going into tuesday, but really only a couple of inches is expected up in the mountains. the accuweather seven day forecast, mild with fog and clouds tomorrow. it's a cooler day on sunday and some drizzle and a few showers. nothing major. isolated chance lingers on monday. but notice those temperatures. i mean, they're only in the low 60s to low 70s. they drop off even more midweek upper 50s to upper 60s below
11:23 pm
average. and now i am putting in a slight chance of a few morning showers on halloween. okay, okay. but i don't think it's going to be a washout right now for the parades at school in the evening. hopefully things will clear out enough for the kids to get outside in their costumes, and november 1st will be cool. >> we won't worry about it just
