will be increasing. and then at the beaches 60s mid 60s throughout most of the day. so increasing clouds and then we're tracking the chance of sprinkles tomorrow. i'll let you know how much you can expect with the accuweather seven day forecast. >> zach francis thank you. new overnight uc berkeley students received an alert about a shooting on telegraph avenue. the warn me alert went out at 1:00 this morning saying there were shots fired in multiple locations. it's said to avoid the areas of haste and telegraph and the blocks surrounding the athletics building on campus. an hour and a half later, the system gave an all clear saying that there were no injuries at any of the scenes. the berkeley police department is now investigating the shootings. we're a little over a week away from election day and happening today. early voting centers open up across 29 california counties. that includes several right here in the bay area. you can vote in person before election day at those centers, and you're also able to drop off a mail in ballot to see if there's one in your county. head

to the secretary of state's website. former president donald trump and vice president kamala harris will both campaign in michigan today. both harris and trump turned their attention to texas friday night, and harris got some star studded support in houston. >> i'm not here as a celebrity. i'm not here as a politician. i'm here as a mother. a mother who cares deeply about the world. my children and all of our children live in houston. >> native beyonce was among the celebrities who attended harris's rally. she didn't perform at the legendary 91 year old willie nelson did. the vice president's campaign says 30,000 people were in attendance as the vp addressed reproductive rights, and trump held his own rally in austin focused on immigration. after sitting down for a podcast with joe rogan. >> we're here today in the great state of texas, which, under kamala harris has been turned into ground zero for the largest

time her volunteers were attacked. professor nolan higdon says it's hard to quantify the level of political violence. but he says americans have become increasingly polarized over the past two decades. >> when we talk about polarization, it's not just who you prefer to be in office or what party you align with. it's also that you think you can't live with the other party, or that the other party threatens your way of life. >> professor higdon says mainstream media often reduces stories to team red versus team blue, and social media amplifies what violence may be happening. but he says the u.s. also has a history of racism. >> this is the united states of america. there's a long history of racism and violence around politics, so it's not out of character for the united states. unfortunately, to see things like this. >> in milpitas, bill quan is running for city council this week. one of his campaign posters was defaced, tagged no asians. >> and when i first saw it, i was like, i was in disbelief, you know, because of all places in the bay area, milpitas is

first image of israeli aircraft that conducted the hours long nighttime mission. israel hitting back at iran for that massive ballistic missile attack earlier this month. israeli prime minister netanyahu, huddling with his national security team in israel's situation room, watching the attack unfold, with israel's air force saying it unleashed several waves of strikes hitting military targets deep inside iran. >> we conducted targeted and precise strikes on military targets in iran, thwarting immediate threats to the state of israel. >> overnight, the idf saying the targets included iranian air defense systems and missile and drone storage and production sites. this morning, the iranian regime downplaying the attack. iranian officials, echoing a claim on iranian state tv that it caused limited damage. but iran saying two of its soldiers were killed in the attacks on military bases in three regions. israeli officials confirming iran's highly valuable oil and

nuclear infrastructure was not targeted, amid fear that could spark a wider war. the u.s. deploying more f-16s into the middle east just ahead of israel's attack just last week, sending an advanced thad air defense system to israel, placing 100 american troops to operate it here on israeli soil. the idf, saying it is now at peak readiness for offensive and defensive action. >> tom swease reporting there. now, back here at home in the south bay, a criminal charge against a candidate for san jose city council was dismissed. tam truong was accused of grand theft and fraud involving a real estate scheme. he was also facing allegations of wage theft. now truong put out a statement declaring his innocence, but he is still involved in a civil case and is on leave from his job as a police sergeant. meanwhile, an effort is underway to remove a current san jose city council member from office. neighbors

and business owners have launched a recall campaign against omar torres. he is facing accusations of sexual misconduct involving a minor. the mayor and city council have all called on torres to resign, but he's refused recall. organizers hope to have the issue on the ballot early next year. >> what i'm hopeful for is that six months from now, we're not saying we should have done this six months ago. so now is the time to get the process started. >> torres has requested a month long medical leave. he says the allegations have impacted his well-being. controversy over transgender athletes may cost the san jose state university's women's volleyball team their spot in the ncaa tournament. the university of nevada, reno, is now the fifth team to forfeit a match against csu. it comes after unconfirmed claims by a spartans volleyball player that one of her own teammates is transgender. nevada players say they forfeited because the match quote advances injustice against female athletes. an lgbtq plus

san francisco. what a gorgeous start to our day. we're having so far. a lot of people are going to be celebrating halloween this weekend, so we'll follow up with frances later for the forecast. for all of that and all the fun people will be having. but right now, we want to get you to some more news and an alameda police officer has pleaded not guilty in the death of mario gonzalez. three years ago, eric mckinley is charged with involuntary manslaughter for the deadly encounter at an alameda park. gonzalez died as officers pinned him to the ground while responding to a call of a man behaving strangely. gonzalez was not armed. family members are upset. a judge dropped the case against two other officers because the district attorney missed the deadline to file charges. >> mario gonzalez was murdered in the same manner as george floyd. the fundamental difference is that we now have a

different political climate. but justice delayed is justice denied. >> officer mckinley returns to court next month for a preliminary hearing. it could be up to a month and a half before a judge reviews the case of the menendez brothers, who were convicted of killing their parents more than 30 years ago. prosecutors are asking the court to resentence them. they recommend a life sentence without the possibility of parole be removed, but the process could be long because after review, it could go to a parole board, which could take six months or longer. and then there's a possibility that the governor could later weigh in on the decision. >> all of these family members will uniformly ask one thing, which is bring them home. bring them home. >> the los angeles district attorney says he recommended the resentencing after weighing new evidence showing the brothers were abused. you can watch in-depth coverage of this case with the abc news documentary menendez brothers, monsters or victims on hulu. disney is the parent company of hulu and abc

seven. october is breast cancer awareness month, and the american cancer society is urging black women to use their voice to help fight breast cancer. abc seven news anchor ama daetz has more on the push to get black women to join a new study, for good reason. >> african-american women are doing worse in any ethnic group. they have about 40% higher risk of dying from a breast cancer compared to white women overall. regardless of what stage they present with, they still have the lowest survival rate amongst all ethnic groups. >> and then this voices study could help narrow down why they have worse outcomes. and then we can. exactly. >> exactly. doctor. >> patience o'daly is a breast surgical oncologist with kaiser san rafael. she says multiple factors likely play into this disparity. access to care. barriers to getting treatment as well as social, environmental and lifestyle factors. kaiser is working to improve outcomes for black women by providing education, support and screening. the american cancer

society is also working to achieve better health equity for this group, which is why it's looking for 100,000 black women without cancer for its new voices study. >> we know that even though black women are likely to get screened for breast cancer, the quality of the screening and the care that they get, the timeliness to the care is not at a point where it needs to be. >> doctor fullam is an associate professor of medicine at ucla and a voices ambassador. >> unfortunately, there's been a bias in medical research and that we are less likely to study black and brown populations and science, which is why this study is so important. >> it will follow participants for years to come, and what researchers discover can help improve the quality of care for future generations. i know being part of a study can sound a little scary, but doctor o'daly says it's mostly answering questions. >> i think it's just filling out a bunch of surveys every so often, you know, sort of identifying if you do get diagnosed with a breast cancer,

with sort of finding out what's happening afterwards and then tracking things in the future as well, and what your experience has been through that journey. >> ama daetz abc seven news. >> happening today, survivors and advocates will be making strides against breast. breast cancer in santa clara. the american cancer society will put on the annual 3 to 5 mile walk at california's great america. the walk raises money and funds research that helps develop life saving programs. gates opened earlier at eight, and the walk starts in a little bit at 830. parking is free for all riders who get there before 10 a.m. the number of cases of e.coli tied to mcdonald's quarter pounders has risen to 75 people across 13 states. that is up from the previous report earlier this week of 49 people across ten states. no cases have been reported in california, but it's believed these infections are caused by the fresh onions used on the burgers, sourced from salinas based taylor farms. one person is died in 22. are

hospitalized. at least one affected customer has filed a lawsuit against mcdonald's. humpback whales are putting crab season on hold. the commercial dungeness crab fishery south of the sonoma, mendocino county line was scheduled to open on november 15th, but the state department of fish and wildlife has pushed back the opening. it's because of the large number of humpback whales in recent entanglements in the area. >> we're already seeing a high number of whales entangled in gear from may to october. we've seen four entangled in dungeness crab gear confirmed entangled, and we've seen an additional ten humpback whales entangled in unknown fishing gear that hasn't been able to be identified. and there's also currently several whales entangled in monterey bay. so i think we'll be seeing some numbers rolling in that are really uncomfortable as we continue to delay the season due to high whale risk. >> the group oceana has been working with both fishers and the state on testing ropeless traps. the traps limit the risk of whales becoming entangled, and the group hopes upgrading those traps will allow fishers

to extend the crab fishing season this spring. and it might also help make up for some of the lost revenue from the delayed opening. happening today in san francisco, you can kick off halloween weekend with a spooktacular experience at thrive city. it's called thrill. when kids are going to be able to trick or treat. there's going to be a pumpkin patch, photo booth, a costume contest, and a screening of despicable me four. and this is free. so the fun starts at noon. the movie starts at 3 p.m, so there is just a whole lot going on this weekend. i know halloween is still a few days away, but a lot of people celebrating the weekend this weekend. so francis, what do we need to know? do we need to accessorize our costumes with a coat or anything? >> i think you'll be okay for the afternoon, depending on how late you stay out tonight and what type of costume you have. you might want to grab a light layer. i know a lot of folks are heading to the castro this weekend as well, so overall it's going to be a pleasant day, but you will start to notice a change in the weather pattern. and we'll show you that with live doppler seven, the

satellite radar image. so we have a system to our south that is going to bring us some high clouds starting later on this afternoon, and then a system to our north that is going to drop in from the gulf of alaska and bring us the chance of sprinkles tomorrow. but it's not going to amount to much. mostly cooler temperatures for now. most of us under clear conditions, we will start to see the changes in the cloud cover though in the next few hours. but it's a really pretty view from our exploratorium camera in san francisco. it's 54 degrees right now. oakland 49, hayward 52, san jose 51. and then still cool in redwood city at 46. half moon bay, 43 degrees, this time from the east bay. we're looking out towards the west and the bay, santa rosa and petaluma and napa. those have been the coolest spots all morning. still in the low 40s. fairfield 44, concord 49 degrees and livermore 46 degrees. and from emeryville. notice how glassy it looks on the bay. you can tell winds are very light. so for today we're going to have mild temperatures with a mix of fog at the coast and some clouds increasing throughout the day. and tonight

preview week nine matchups from the gameday set at indiana university in bloomington, indiana. >> the final weekend in october and what a tripleheader there is on abc notre dame and navy meeting as ranked opponents. just the 11th time that happened. second time in the last 45 years. >> midshipmen undefeated, undefeated and have a lot of people fired up blake horvath. their quarterbacks doing a really good job. this isn't just a cute navy quarterback. this guy is running and throwing just feels different. what's great is they're going up against a notre dame defense. other than the louisville game, since they lost to northern illinois, they've locked people down. now it's a different challenge against this navy offense. >> irish are having to overcome some injuries on the defensive side. that ought to be a really great game at noon. then at 330 eastern time, missouri and alabama. both teams a little bit desperate right now to salvage the goals they have for the season. >> do you have any answers on brady cook? the quarterback from missouri? is he able to play? >> it seems like he's unlikely it'll go right up to game time.

intentional and grossly negligent acts that caused the global i.t. outage on july 19th. the airline said it had to cancel 7000 flights over five days, and the tech troubles cost delta $500 million, as well as harm to its reputation. crowdstrike said delta's claims are based on misinformation, and that the airline is trying to shift the blame for its slow recovery from the outage. san francisco based lyft has agreed to a $2 million settlement with the ftc for misleading drivers about their pay. the ftc claims lyft made deceptive claims about how much drivers could expect to make per hour. however, lyft did not disclose that the amounts were based on earnings of the top 20% of drivers and not on an average driver. the settlement is part of its ongoing efforts to protect gig economy workers. new. this morning, santa clara based nvidia surpassed apple as the most valuable company in the world. the company had a record breaking day in the stock market friday, with demand for its specialized artificial intelligence chips. at one

developed a sound that helped define san francisco's 1960s hippie movement. good morning to you. let's start this half hour first, though, with a quick look at weather before we get to that, here's meteorologist frances dinglasan. >> yeah, zack, it's going to be pleasant and comfortable this afternoon with temperatures that are really mild, but we will start to see increasing cloud cover throughout the day right now. temperatures are in the 40s and 50s, and in the next hour we'll see more 50s. and then by lunchtime you notice that we'll see the 70s. for some inland neighborhoods. this afternoon, we'll see upper 70s in some of our warmest spots around the bay. look for near 70. and then if you're heading out this evening, once the sun sets during 7:00 tonight, temperatures will start to drop into the 50s along the coast and then around the bay. we'll see some low 60s, but then what you'll notice is with the increasing cloud cover, we're not going to cool down too much. so even at midnight, we'll be near 60 degrees around the bay. and that's good news for folks who are planning to stay out and

celebrate some of the halloween festivities early. zach. >> absolutely, frances. thank you so much. well, the co-founder of arguably one of the biggest bands to come out of the bay area has died. phil lesh, the bass player, helped craft some of the grateful dead's most memorable songs. rolling stone called the berkeley native one of the greatest bass players of all time. here's abc seven news anchor karina nova. >> if there was ever a band that represented the spirit of san francisco, it is the grateful dead. the band is a symbol of the counterculture movement of the 60s. their sound defined a generation and inspired a devoted legion of fans named deadheads. >> people, when they think of the grateful dead, they think of jerry garcia. but the reason that he got to where he was as a musician was phil lesh. >> fans still remember they left flowers at the haight-ashbury house, where the dead lived at in the 60s. >> music brings people together. and phil lesh, he was just that guy that played bass and hung around and wanted everybody to

just be happy. >> lesh and jerry garcia founded the grateful dead in 1964. >> he didn't play bass until he joined the grateful dead and inside six months he was playing it as well as anybody could play it. >> it was his love of jazz musician john coltrane and improvization that created the grateful dead sound. >> grateful dead music was is about a conversation and one of the most interesting conversations ever was always the one between garcia and lesh. he created this completely unique approach to bass. >> lesh did not write many songs, but the few he did. pen became iconic. after jerry garcia died, lesh retired from music but found he could not stay away. he established his own band. later, he founded terrapin crossroads in san rafael. it was a place where musicians came and went, hung out, exchanged ideas. >> it was a laboratory that he could experiment in. >> but it's his legacy with the

grateful dead that will live forever. >> deadheads. what they loved was grateful music. it was not a cult of personality. 30 years after jerry died, there's more deadheads than ever. >> lesh had survived cancer and a liver transplant. a post on lesh's instagram says he passed peacefully, surrounded by his family and full of love. phil lesh was 84 years old. in san francisco karina nova, abc, seven news and deadheads descended on the haight-ashbury house that the band called home in the 60s. >> all of them there to remember phil lesh. many fans revisiting memories, including a couple from atlanta. those two deadheads actually met at a concert, and it just so happens that they were visiting san francisco yesterday when we heard the news that phil had died. >> we decided we wanted to come down here and just pay our respects. >> it's like watching a bunch of your friends get older and everybody gets older. and so people die. but the music goes on. >> anddefined a generation, ands

still inspiring generations of fans to follow. local grateful dead fans also got to cherish opportunities to connect with lesh right here in the bay area. health care public relations executive jim weiss presented a check to lesh's unbroken chain foundation at terrapin crossroads. that's lesh's former music venue and restaurant in san rafael. the foundation supports several local charitie. more bay area sideshows overnight, this time in san jose. one happened just before 1 a.m. on murphy avenue in oakland road. you can see a crowd of people surrounding the intersection and fireworks going off in the center at points as cars do. donuts in the middle. witnesses say they saw multiple san jose police officers responding, as well as saying they spotted a helicopter overhead. it's not clear right now if any arrests were made. so let's talk about a new way. law enforcement is cracking down on

illegal sideshows around the bay area. police would use artificial intelligence to help identify the sound of tire screeches. abc seven news reporter suzanne phan has more on how it would work. reporter. >> we've seen the spinning cars and flying sparks from dangerous sideshows like this one caught on camera in vallejo. police are trying to crack down on the problem. >> we were able to identify numerous vehicles that were involved in these sideshows. >> flock safety cameras and license plate readers recently installed on the bay bridge are helping that crackdown. just this week, local law enforcement agencies seized 16 cars. the chp says they were involved in two different sideshows. the weekend after labor day. >> sideshows in vallejo is a constant problem that requires a lot of resources. >> vallejo police say license plate readers are a help. >> we do have flock safety cameras in vallejo, and they do work really well. right now, we're only using flock for license plate readers and single

and multiple gunshot detection, but the technology could soon be put to greater use. >> this week, flock safety launched a first of its kind sideshow detection tool to help communities combat illegal sideshows. it uses ai and machine learning technology to identify certain sounds, specifically the screeching of tires, and send law enforcement agencies real time alerts that a sideshow is happening. the ceo of flock safety calls it, quote, a groundbreaking tool that enables agencies to act faster and prevent these dangerous events before they escalate. police and the chp say even without it, the audio the tech is making a difference. >> i know technology is improving and it's and it's the wave of the future. and it's causing officers to detect and improve our strategies better. so i don't see how it could hurt as we continue to see innovative technologies coming out that allow law enforcement to, you know, identify issues that we're

43, petaluma already 46. fairfield 44, concord 49 and livermore 46 degrees. and this time from emeryville. still glassy on the water. so what you need to know for the forecast. today's headlines today it will be mild. the temperatures and we'll see a mix of clouds and some fog at the coast. and then tomorrow is when we are going to be tracking that drizzle and some spotty showers. but it's not looking like much right now. next week, crisp fall weather, sweater weather and temperatures will be on the cooler side. so as we show you the futurecast, we'll show you that right now we'll see clouds increasing throughout the day, and then this system that could bring us some spotty showers there. you see there with the pops of green doesn't look like much. in fact, these later models show less and less. so it amounts to maybe a hundredths of an inch in some locations. many locations will be dry. what you'll just notice tomorrow is increased cloud cover and the cooler temperatures we could get near a

10th of an inch in ukiah, so today's highs will be just a little bit cooler. getting closer to average. in san francisco, it's a high of 69. oakland 73, san jose 80. and we could see near 80. in some inland areas like concord, antioch, livermore and fairfield. and then in the north bay, napa will be perfect at 74 degrees. santa rosa and san rafael at 78 cooler and half moon bay, 64 degrees. with that fog, we'll see fog develop, especially overnight along the coast, and then will spread inland. but with the extra cloud cover, it means temperatures will be mild. if you're heading out tonight, this evening, temperatures will hover in the upper 50s and will stay there through tomorrow morning really quickly. i just want to show you what thursday morning looks like for halloween. we see another system drop, but it breaks up pretty quickly, so thursday night should be dry for trick or treaters, so we'll keep that in mind with the accuweather seven day forecast. so mild temperatures today with some fog and clouds increasing throughout
