airlines flight out of san francisco. good evening. >> i'm ama daetz, and i'm dan ashley. thanks for joining us here. one passenger turned on another in a bloody beating. and now under federal investigation tonight, a traveler tells us the victim is deaf and nonverbal. >> abc seven news reporter j.r. stone has the details in this case. and a warning for you. the descriptions here are intense. >> the next thing i know, i just hear the this just these sort of bloodcurdling screams. >> sandhya gupta is describing the moment she woke up two hours into her united airlines flight from sfo to washington dulles airport on monday. in the row in front of her, she could see one passenger attacking another. >> he was just very violently and very aggressively just pummeling the guy who was in the window seat in front of me. it was it was vicious. this wasn't like a barroom. i'm going to throw a couple of punches

around. i mean, this was this was vicious. >> the fbi says the suspect, everett chad nelson, had just gone the bathroom and was walking back to his seat when he attacked the victim, who was sound asleep in a random row, not his. another passenger jumped in to help. >> basically kind of like wrapped this guy and sort of like a hug. and the assailant just. it was the weirdest thing. he just went limp. this doctor is basically just, like, trying to, like, stop the bleeding. i mean, his face was just a mess. it was awful. there was blood spatter on the on the window shade and all that kind of stuff. >> it was then that gupta says they learned that the victim couldn't hear or speak when he was trying to communicate with us in sign language. >> that's when we realized that he was deaf and nonverbal. >> that victim was communicating with the united flight crew by phone messages, according to sandhya. >> he also just kept texting. i'm so scared. it was just

awful. >> gupta says some of those texts describe flight attendants saying that the suspect had claimed the victim attacked him in the street earlier, but that victim wrote that he had never seen the man before in his life. a suspect was arrested shortly after the plane landed at dulles and is still in jail. at last check. the victim, who was being treated by the doctor on board, was okay, but physically and mentally shaken over what happened. j.r. stone abc seven news. >> all right. let's turn now to your forecast with showers moving into the bay area tonight. but the good news for the trick or treaters is these showers are not sticking around for very long. >> abc seven news meteorologist andy patel is tracking the wet weather and has your halloween forecast. hi, sandhya. hi, there. >> yeah, it's going to be a splash and dash kind of situation, which is obviously welcome. any time. but let's take a look at live doppler seven and we'll talk about what is happening right now. those showers are moving in exactly as we had predicted. as we take you into street level radar, right

into the north bay across highway 101, we are seeing some damp roadways. also seeing some wet weather around oakland and emeryville. street level radar tracking. the showers on the peninsula heading towards the burlingame foster city area next. so watch out if you are going to be stepping out this evening. it is a level one on our exclusive abc7 news storm impact scale. that front is going to get in and out before you know it. so as we time it out for you right now, we have those showers going into the wee hours of the morning crossing parts of the peninsula, the south bay, and then just an isolated shower at 9 a.m. in the north bay. so here's a look at the halloween forecast. 7:00 in the morning we'll have 40s and 50s that isolated shower. partly cloudy in the afternoon, a cauldron of clouds at 4 p.m. they'll be creepy, but it's going to be all treats. no tricks, not go to sleep. chilly, that's for sure. but it is going to be spooky. cool. ama and dan. all right. >> thank you. sandhya. >> well, sorry. giants loyalists

fans are filling the streets in los angeles right now, celebrating the dodgers world series victory over the new york yankees. they've been setting off fireworks, waving flags as you see here. some taking part in sideshows. police did order the crowd to disperse near dodger stadium. they're trying to keep people out of the downtown area as well. we'll have the highlights of the game later in sports. >> now to your voice, your vote and a sprint to the finish in the race for the white house. vice president kamala harris and former president trump are focusing on battleground states. trump took aim at president biden's garbage comment during a stop in green bay, wisconsin, getting in a garbage truck before the rally. >> joe biden finally said what he and kamala really think of our supporters. he called them garbage. and they mean >> harris visited three states today. she tried to reach out to independents and republicans during an event in pennsylvania. >> unlike donald trump, i don't

an embattled san jose city council member accused of sexual misconduct. the san jose city council has rejected a request by omar torres for a 30 day leave of absence. torres made the request citing mental health issues tied to an ongoing investigation. he's accused of sending sexually explicit text messages to a minor. today, the santa clara county democratic party joined the growing calls for his resignation. their statement reads, in part, quote, council member torres admitted conduct has rendered him unable to represent and serve his constituents and disqualifies him from continued service on the city council. we reached out to torres attorney, but we did not hear back. local news >> police arrested more than 80 people tonight following a march by striking hotel workers in san francisco. they ended up right outside the westin saint francis, which is one of the hotels where workers have walked out. hundreds of people took

part in a march that went through downtown that ended with a sit in on the street. roughly 2000 hotel workers in san francisco are currently on strike. they're demanding higher wages, better staffing and fair workloads. a partial levee collapse in san joaquin county has officials scrambling to prevent disaster and massive flooding. victoria island, southeast of discovery bay, is under threat if one levee holding back the water from the victoria canal fails on october 21st, a partial collapse of the levee sent water just gushing out. a civil engineering firm is partnering with the county to prevent the worst case scenario. >> just easy to say. complete failure and complete failure would put 6200 acres into my foreground here, under 18ft of water. >> in addition to drowning thousands of acres of farmland, officials say a levee failure would also flood highway four between the bay area and stockton, with ten feet of water in 12 hours. emergency services have turned to the state for

help to reinforce the levee. >> some education news facing a growing budget deficit. the oakland unified school district is again looking at potentially having to close schools. the superintendent is going to present options to the board of education at a meeting two weeks from today. right now, the district says it is dealing with a $79 million deficit with enrollment expected to drop in the coming years. the district is weighing closures as well as mergers to try to make ends meet. palo alto residents will get a chance to sound off on that slimy spill tied to a tesla facility that we've been talking about here. a public meeting is set for friday. on october 17th, residents noticed a neon green liquid outside a tesla facility, but then they had to wait five days for information about it from the city. officials now say hundreds of gallons of coolant for a supercomputer were accidentally released into a storm drain, gutter and creek. they say it does not pose a health risk. friday's hearing will be at 5 p.m. at the ventura community center.

for the content of this advertising. we're learning more about the 17 year old injured by a navy parachutist during a fleet week air show. mia de guzman was taking in the october event from san francisco's marina green when the parachutist she saw there landed on her. she has now hired a lawyer, but she doesn't want to sue. >> they contacted an attorney because they really didn't know how to get in touch with the navy. step two is to make sure that this young woman has her medical bills covered and isn't starting her adult life in debt. >> de guzman had fractures in her pelvis that required surgery. in a statement, the navy says in part the navy is conducting several investigations into the incident and taking the necessary steps to ensure the highest levels of safety at future events. the

navy parachute team paused scheduled demonstrations to conduct this review of procedures, end quote. >> philadelphia's district attorney says he's facing an avalanche of hateful attacks on x, primarily by elon musk's supporters. it comes after da larry krasner filed a lawsuit over a daily million dollar giveaway to registered voters, orchestrated by elon musk's superpac. prosecutors say it's an illegal lottery. a judge has ordered musk to appear in a philadelphia courtroom tomorrow for an emergency hearing. the judge also asked for enhanced security for the proceedings. >> the attorney for the menendez brothers is trying a new tactic to get them out of prison tonight. governor gavin newsom's office is considering a push for clemency in the murder of their parents. los angeles district attorney george gascon sent the governor a letter supporting a reduced sentence or a pardon. the former san francisco da is also asking a judge to give the menendez brothers a new sentence because of new evidence of abuse

me. i think it's an insult to the great tradition of san francisco. you might as well just say frisco. if you were going to go that way. >> in fact, that's one of the state senator's suggestions, listing some alternatives for the dmv, including sf, the city, the city by the bay, and the best city in the world. >> trying to make a little bit of light of it and have some fun with it, while also conveying that this needs to be corrected and uh-, and i'm confident it will be corrected. >> in a statement, the dmv saying, quote, we're aware that a city abbreviation issue occurred recently for a relatively small number of customers during a short time frame. we have already made a fix, and those who received a card with the incorrect abbreviation can visit a dmv office for a no charge replacement. meanwhile, the state senator is calling it a teachable moment. >> a lot of people who do not live in san francisco do call it san fran. san franciscans hate that that phrase, phrasing uh-

showers in the north bay, three hundredths of an inch in the past few minutes. in santa rosa, so it's coming down pretty quick though moving. so it's not going to be here very long. sierra is picking up some snow showers and so are the mountains up in northern california there. so this is good news. of course we'll take any moisture we can get. here's a look at the wider perspective. there is the front. and once the front passes through we'll be dealing with just some residual isolated showers in the early morning hours. temperatures right now, seconds and 50s. here's a look at your halloween forecast. so first thing tomorrow morning, as the kids are getting to school 8:00 in the morning, you're looking at 40s and 50s 9:00 when they're parading around school, 40s and 50s. and then as we head towards noontime, temperatures will be in the 50s and 60s. if you have little ones and you're taking them out trick or treating earlier in the day. a look at the 355 temperatures in the 50s and 60s. and then later on at night, the sun goes down

shortly after six. it is still going to be comfortable. you will notice the temperatures will begin to fall for you. late night adults going out partying, 40s and 50s. a live view from our golden gate bridge camera. it is a little damp out there. some raindrops on the lens overnight tonight into tomorrow morning. showers spreading, halloween. no tricks, all treats and friday night into saturday morning is our next round of rain. that one looks like it's going to bring us heavier rain overnight into early morning. it's a level one light level one system. scattered showers, slippery roads, breezy conditions and light accumulations. so here we go. 2:00 in the morning. it's in the east bay. the peninsula, 4 a.m. still looking at those scattered showers, especially for parts of the bay area. and then at 9:00, an isolated shower in the north bay can't be ruled out. the rest of the day is just going to be a mix of clouds and a few peeks of sun. rainfall totals will be anywhere from a few hundredths of an inch to about 15 hundredths of an inch. some areas may not measure in the sierra. it's certainly going to
