handcuffs. good evening. thank you for joining us. i'm dan ashley and i'm ama daetz. >> these new accusations involve a different child, separate from the case that has sparked calls for the council member to resign. >> abc seven news reporter dustin dorsey was in court today and heard from attorneys and police about the investigation. >> in a brown santa clara county jail jumpsuit, omar torres is seen in public for the first time in a month just his hand handcuffed and hiding behind a courtroom wall. torres now faces felony charges after being arrested tuesday for lewd acts with a child, oral copulation of a minor and of a child. >> these allegations are every parent's worst nightmare. but you don't have to be a parent to be sickened by the charges against omar torres, which are some of the most serious charges imaginable. >> the charges stem from a practically overnight investigation after a relative of torres contacted police monday to say he was a survivor

of sexual assault by the san jose council member around 20 years ago. the victim came forward as torres was being investigated for sexual misconduct involving a minor in a different case. a police report details a conversation in which torres apologized for his relative, who was just 13 years old, at the time. according to the police report, torres said he was when he was 7 or 8 years old himself and blamed that experience for compelling him to become abusive. >> the alleged assaults started when both the survivor and torres were minors and continued after torres became an adult. but while the survivor was still a minor. >> torres lawyer, nelson mchenry, told us torres his arrest was surprising and he said he's working through the evidence. after his client's first court appearance wednesday, chief assistant district attorney jay boyarski applauds the survivor for coming forward to ensure torres never hurts anyone, ever again, even all these years later. >> the courthouse doors will not be slammed in their faces that we can take their case to court in front of jurors. and the facts of this particular case

allow us to charge the case notwithstanding, whatever the statute of limitations would have been back at that time. >> before being arrested, torres submitted his letter of resignation to the san jose city council as of november 27th. mayor matt mehan says a new council representative for district three will be temporarily appointed or voted in by a special election. torres will make his next court appearance for a bail hearing on november 14th, and will remain in custody until then. he faces 24 years in prison if convicted in san jose. dustin dorsey, abc seven news. >> now to breaking news out of southern california, where a wildfire has destroyed several homes in ventura county and has forced people to evacuate. the mountain fire started around nine this morning and just exploded in size, fueled by santa ana winds. i mean, look at the destruction there. so far, the flames have burned more than 10,000 acres and several people have been hurt. firefighters did rescue numerous people as those

flames closed in. >> i don't think i can quantify for you what the intensity is, but it's intense as it gets the hair on the back of the firefighters neck. i'm sure was standing up. this is a day where you're truly prepared to do every part of your job and to risk everything to save everything. >> and it's so risky because it is so windy, and cal fire can't even put up its planes to help the firefighters. however, helicopters are doing water and retardant drops, and as southern california deals with extreme fire danger, we are seeing similar conditions here in the bay area. >> we are. here's a live look outside right now for details. let's go to abc seven meteorologist sandhya patel. sandhya. >> yeah, dan and ama, let's first take a look at southern california red flag warnings are in effect until 6 p.m. tomorrow as they are facing extreme fire danger near that wildfire down south. it is dry 11% the humidity. winds are out of the east northeast, gusting to 22. that's what's making it problematic for the firefighters

and why that fire has exploded in size. winds have been clocked well over 60 to 70 miles an hour right now. live view from our mount tam cam. the winds are backing off, but it is still gusty. 30 at spring valley, 36 at hawkeye. you'll notice at the lower elevations, 21 in concord and san jose, relative humidity values are still low. 16% in napa. with these dry conditions, red flag warnings remain in effect until tomorrow morning, with gusts up to 40 miles an hour, humidity down to 12%. any fires that develop will rapidly grow. we have a wind advisory for lake county and solano county until 6 p.m. tonight. with those gusty winds, 35 to 45 miles an hour, i'll be back with the hourly look at the wind forecast and how long the fire danger will remain high. coming up ama. all right, we will check back. thank you, sandhya, and let's take a live look at the current power outages from p-g-and-e's. there are a lot of them. and the purple triangles on the map indicate public safety, power shut offs. customers in just about every bay area county are affected by

the planned outages. the majority are in napa and solano counties. >> so what's it like for those folks who are affected by these power shut offs? abc seven news reporter luz pena talked with some of them and joins us live in walnut creek tonight. loose. >> well, dan, fire season is not over. and that massive fire in southern california is an example of that. here in the bay area, thousands of people don't have power in the northeast and south bay, and many are gearing up to potentially evacuate as winds intensify throughout the bay area. approximately 16,000 p-g-and-e's customers are without power. a planned strategy by the utility to prevent fires. >> this psps is due to the very powerful winds combined with dry conditions, conditions and other factors that we take into accountability. >> we saw gusts of 88mph in the north bay, so we certainly are seeing these elements coming

together. and that's why we call it psps. it's for the safety of our customers. >> in the east bay, fire crews are ready for deployment. what are those problematic areas that you guys are focused on right now? >> well, in the county, the hill areas have wind speeds up to up above 60 miles an hour. we have gusts going like crazy. we're we're everywhere as an equal concern. wildland urban interface areas are concerned almost three weeks ago, nearly 33 years after the oakland hills firestorm, a vegetation fire broke out in the oakland hills, damaging two homes. >> with 500 residents evacuated. we caught up with one of those residents today as fire danger looms. >> it's unbelievable. i mean, just the fact that our house caught on fire, we still have to think about it catching on fire again. it's like unimaginable. >> this is a reality that many in the east bay live with. we captured the weekly emergency siren warning system. >> my father and his wife in

>> vice president kamala harris has conceded the shortest presidential campaign in american history. former president donald trump won another term in decisive fashion. and tonight, harris addressed a deeply divided country from her ama mater, howard howard university. abc seven news anchor julian glover is in washington with harris's message to her supporters. and really, julian, the country. >> hey there ama. you know, this was not the speech that vice president kamala harris wanted to deliver, but it was the one that she had to. it was a relatively short message, only about 11 minutes in total, and it was filled with messages of moving the country forward, of unifying the nation and her belief in a peaceful transfer of power, a message that her supporters that packed the yard here are holding on to. at a message that the nation needs to hear. tonight, vice president kamala harris walked out to a supportive yet solemn crowd at her ama mater, howard university. >> addressing the nation the

glimmers of hope, some waving american flags, others capturing a slice of history on their phone as the vice president challenged everyone listening to get to work. >> so to everyone who is watching, do not despair. this is not a time to throw up our hands. this is a time to roll up our sleeves. >> a message that resonated with the crowd of supporters, lifelong friends and howard alumni like jory fortson. >> she ended with a call for us to also think about how we live our everyday lives. and at the end, she said. and in truth and service, which is the motto of howard university. and so as an alumna, it really filled me with a sense of pride for longtime friend and supporter chuck collins. >> i had to wake up and think about what life my grandchildren. >> it was a tough pill to swallow. >> it's emotionally hard for us to absorb the enormity of this loss, but we can't stop at our grief. we have to move through our grief into action. >> reporter as for what's next for vice president kamala harris, abc news has obtained an

p has declared former san jose mayor sam liccardo as the winner in the race for district 16. in the u.s. house, he defeats assemblymember evan low. liccardo will fill the seat of anna eshoo, who is retiring. >> the official results are not in yet, but in oakland. the recall election against mayor shengtao looks like it will pass. >> it does. right now you can see that 65% of voters, or nearly 32,000, are in favor of recalling the mayor. some of them hope that new leadership will help lead oakland down a new path. here's abc seven news

reporter anser hassan. >> oakland mayor sheng tao's team says she won't comment on the recall until the final results are in, but on election night, she spoke of her accomplishments. >> the coliseum, we're going to be able to actually invest money into east oakland. we have the most miles paved in a year in oakland's history. and so we know that the work that we have done was actually great. and it's positive. >> but if the results hold, mayor tao will be recalled with 65% of the vote. joshua spivak, a senior fellow at wagner college, says that should not be a surprise. >> recalls are astonishingly successful as a weapon in california. it's been 79% since 2011 to now. >> it's not about her performance on the job. they have focused on crime. crime is a dog whistle all over the country. >> prominent oakland attorney walter riley was part of alameda county district attorney pamela price's transition team. he strongly opposes the recall of

d.a. price and mayor tao. he says the recalls are just another attack on progressive politicians led by business interests. the oakland police officers association backed the tao recall, saying she couldn't meet the moment. >> the issue is that her inability to work with other unions, other cities and entities to make sure that we can sustain and survive in the challenging environment. >> it's my duty again, as council president to ensure a process that is responsible, orderly and transparent in terms of selecting our next leadership. >> oakland city council president nikki bass says the registrar of voters has 30 days to certify the election after that, city council must declare the result at its next meeting, most likely december 17th. mayor tao would step down. president bass becomes interim mayor. a special election must be held 120 days from when tao steps down in oakland, anser hassan. abc seven news. >> and for more election results

risk of fire danger. right now, a red flag warning is in effect for really for most of the bay area. >> yeah, it looks beautiful in this shot, but there is cause for concern. abc seven news meteorologist andy patel has been tracking the wind and is back with those details. sandhya. yeah. ama and dan. don't be fooled by the bright skies that you're seeing outside. let me show you a live view right now from our golden gate bridge camera. the flag is blowing around in the wind. obviously not nearly as windy as it was in the last 24 hours. so let's check out the winds. mount saint helena peak gusts close to 90 miles an hour early this morning, 57 at oakland hills, 54 los vaqueros. and you will notice many 40 plus mile an hour wind gusts. here's a setup and why we're seeing the windy conditions. high pressure has been pushing in closer to our coastline. there's a trough to our east and we're just caught in between with that north northeasterly wind. so that is resulting in the mild weather we've been experiencing the last

couple of days and the clear skies, but also the low humidity. kgo roof cameras seeing the breezy conditions right now. upper 60s san francisco, oakland. hayward. right now you're at 70 in san jose and 64 and half moon bay. taking a look at san jose camera. clear skies right now. santa rosa 68 upper 60s around napa, petaluma, concord, mid 60s along with livermore and fairfield. and there's that gorgeous view from our emeryville camera as the sun is setting high fire danger through tomorrow morning. our windy pattern will continue with those dry, gusty offshore winds until tomorrow morning and then saturday through monday. we do have cooler weather with shower chances coming our way. let's talk about the fire danger index that accounts for the humidity, accounts for the wind, and obviously the fuel conditions. so we're looking at the oranges and the reds in some parts of the north bay, which is high to very high fire danger at 620 this evening, that fire danger remains elevated at 930. but notice as we head towards tomorrow morning, fire danger does come down as the winds

start to back off after 7 a.m, so we're taking a look at the hourly wind reports. 6:00 still over 34 miles. 30 miles an hour in calistoga. gusty winds continue around fairfield and napa at 8:00 and even into 10 p.m. before those winds really drop off. as we head towards tomorrow morning. so your morning temperatures, 30s to 50s, it is going to be breezy around some of our hilltops tomorrow afternoon. you are looking at sunshine with temperatures ranging from the 60s to the 70s across the board. now over the weekend we will see some changes. here's a look at saturday evening. there's a front coming in to our north. ahead of it, we may get just enough moisture to squeeze out a few showers or drizzle between saturday night and sunday morning, and then better opportunity for widespread rain on monday. certainly snow rain mix in the sierra. here's a look at the accuweather seven day forecast. so we'll keep that fire danger elevated tomorrow morning with the gusty winds after that. humidity levels will rise as the fog returns on
