the maze, we're looking at 16 minutes. emeryville to san francisco, ten minutes. san francisco to sfo nine minutes. all in the green. this early in the morning. and we're goin nowg developments with former san jose city council member omar torres. he is in jail this morning facing felony charges after being accused of molesting a child. now, this accusation is different from the sexual misconduct investigation that led to tourists being absent from the city council for the past month. the new investigation came about after a relative contacted police on monday to say he was a survivor of sexual assault by torres, 20 years ago. a police report details a conversation in which torres apologized for assaulting the relativelleged assaults stad when both the survivor and torres were minors and continued after torres became an adult. but while the survivor was still a minor, torres submitted his resignation from the san jose city council on tuesday, before he was arrested.

>> he made his first court appearance yesterday. he is expected bail hearing on november 14th, and will remain in custody until then. torres faces 24 years in prison if convicted. amanda. gloria. thank you. >> torres had been facing weeks of public pressure to resign due to the original sexual misconduct investigation. he represented a part of downtown san jose with roughly 85,000 residents. now, residents are concerned they don't have a city council representative they can bring issues to. finding a replacement for torres will take time. mayor matt mehan said. the city council will decide whether to appoint someone or to hold a special election. officials also say that special election could cost the city up to $2 million. >> i personally prefer a special election, even though it takes a little more time and costs a little more money, because i think that the public, the community, the voters should decide on who their representatives are and that decision will ultimately come

down to a council vote. >> one race that still hasn't been called yet is the race for san francisco mayor. political newcomer daniel lurie is still in the lead ahead of incumbent london breed, with more than 56% of the vote. but that could change with the next batch of results that's expected later today. abc seven news reporter lena howland has been tracking this race for each step of the way. she joins us live in the studio. and lena, what's at stake? >> reggie san francisco has struggled in the past several years with post pandemic recovery, homelessness and public safety. the next leader will have a lot of responsibility in the direction of the city and its global reputation. political outsider daniel lurie pulling ahead of incumbent london breed by more than 24,000 votes as of yesterday, but not officially calling it a victory. that's because the san francisco department of elections is still processing around 157,000 ballots before a final winner can emerge. this includes provisional ballots and absentee

ballots sent in the day before and on election day. political science professor nolan higdon says ranked choice voting adds another layer layer of complication in tabulating results. >> ranked choice voting in general takes some time just because of the way in which it's calculated. it's not a straight count. so you add on top of that that folks are mailing in their ballots, and that's definitely going to going to take some lag time. >> incumbent mayor breed telling supporters election night she's not going out without a fight and urging supporters to be patient while ballots are being counted. we are expecting the next batch of results at 4:00 this afternoon, but the department of elections tells voters finalizing these results could take up to three weeks now. today's results are critical. if mayor breed closes the gap, voters can expect this process to take much longer. but if lurie's lead increases, it could be game over. live in studio lena howland, abc

seven news. >> all right, lena, thank you. and one of the closest races in the bay area has been called. it's for district 16, in the u.s. house. the seat left vacant by anna eshoo. the ap called the race for former san jose mayor sam liccardo. it's been a contentious race since the primary election in march. liccardo won first place by a wide margin, but assemblymember evan low and santa clara county supervisor joe simitian tied for second place. all three were to go to the general election, but a recount was called for by a former staffer of liccardo's. low accused liccardo of being behind the recount, which liccardo has denied. >> the stakes were high and i think both of these candidates, you know, really gave it their all. >> liccardo released a statement yesterday saying he's already getting to work putting together a congressional staff, both here at home and in washington, dc. >> this morning, president biden will address the nation about the election. he's scheduled to speak at 8 a.m. and will bring that to you live wherever youg

morning around half moon bay, but we're expecting lots of sunshine along the coast today. we'll get those temperatures in the mid 60s with diminishing winds throughout the day. it's a similar story with those winds. a little breezy right now around the bay shoreline, but those winds will weaken throughout the afternoon sunshine later today. it's going to feel nice out there. low 70s around the bay shoreline and inland. it's a similar story. clear skies right now. some chilly temperatures to kick off our morning 40s and 50s and then later today with that sunshine, we'll get you into the low 70s for daytime highs. looking at current red flag warnings, you see a cluster here in northern california encompassing parts of the bay area. for those offshore winds. but the winds are even stronger in southern california, where we are watching that fire in ventura county, right now, some of the peak wind gusts in the canyons in the passes in southern california have been in excess of 60mph. but there is encouraging news for southern california. we will find those winds strong right now. they will weaken throughout the afternoon. so the red flag warnings will expire later today. here locally, that red

grown to more than 14,000 acres and is 0% contained. thousands of people in the cities of camarillo, moorpark and somers have been forced to leave their neighborhoods. our sister station in los angeles estimates at least 40 to 50 homes have been burned. a man and his son tried to save homes in their moorpark neighborhood with a garden hose and a shovel, but it was enough to give us to stop the fire from. >> well, it's so windy. blowing the fire like crazy. >> the homes have been lost up here. >> there's 15 on fire, they say on this side of the street. >> wow. another fire broke out in malibu, but was quickly contained. ventura county fire officials will give an update at 10:00 this morning. >> today, electricity is expected to be restored for some p-g-and-e's customers who've been in the dark because of power safety shutoffs. the shutoffs are scheduled to prevent fires. more than 16,000 people are without electricity. napa and sonoma counties are the hardest hit, but the shutoffs extend into the east bay. abc

california who approved proposition 36 on tuesday's ballot. i'm not surprised the measure would bring back harsher penalties for theft and certain drug crimes issues that have plagued the bay area and the state in recent years. >> they were really looking for relief from so many people allegedly committing redefined petty crimes and being able to get away with it. >> it's a reversal of prop 47, which passed in 2014, reducing some felonies to misdemeanors. reclassification meant crimes such as repeat shoplifting merchandise under $950 carried a much lighter sentence on a felony. >> you can get up to a year in the county jail, and you or you could actually go to prison if the circumstances warranted it on a misdemeanor. it's misdemeanors are not going to jail, or they're going from very minimal time a weekend or something like that. >> drug crimes under prop 36, such as fentanyl trafficking, would become felonies. >> it was not in the category of cocaine, methamphetamine, or heroin at all, or pcp. it was

walter riley was part of alameda county district attorney pamela price's transition team. he strongly opposed the recalls of d.a. price. mayor tao he says the recalls are just another attack on progressive politicians led by business interests. the oakland police officers association backed the tao recall, saying she could not meet the moment. >> the issue is that her inability to work with other unions, other cities and entities to make sure that we can sustain and survive in the challenging environment. >> oakland city council president nikki fortunato bass says the registrar of voters has 30 days to certify the election. after that, the city council must declare the result at its next meeting. that likely will be on december 17th. and that's when tao would have to step down, and city council president bass would become the interim mayor. a special election would have to be held within 120 days from tao leaving office. amanda. all right. >> gloria. thank you. alameda

county district attorney pamela price is urging patience as the vote for her recall is counted. so far, 65% of the ballots in want her out of office. abc seven news reporter tim johns spoke with both sides of this recall. >> the results so far indicate alameda county voters are set to recall district attorney pamela price by a nearly 2 to 1 margin. carl chan, one of the organizers who helped lead the recall price effort, says voters in the county are celebrating the preliminary results. >> they are saying that, you know, they have enough of this, you know, district attorney who has a failed policies and not able to perform her job. >> chan believes the da was too soft on crime and didn't seek harsh enough punishments for those who broke the law. while celebratory wednesday, chan says the next step is getting a good candidate to replace price. >> they want to see real change. they want to see this attorney to be replaced by someone who is capable to rebuild the office, rebuild the trust of the people.

>> there are some who are also unhappy with tuesday night's tentative results. while price herself didn't return our request for comment. we spoke with activist cat brooks. brooks leads the anti-police terror project and believes price never got a chance to really do her job. >> they started calling for the recalls as the ballots were still being counted. you can go back and look on social media. you can go back and look at interviews. >> brooks says the da was also a victim of false narratives surrounding her policies, especially those perpetuated on social media. she says the recalling of the county's first black female district attorney is painful for people to say that the da was not sending people to jail is just false. >> it's just not true. she sent plenty of people to jail for long periods of time. >> if price's recalled the board of supervisors will appoint an interim district attorney. that person will serve until thethat elections in 2026. in alameda county. tim johns, abc seven news. >> the oakland police officers association says both recalls send a clear message. the association released a statement that reads in part voters

francisco to discuss how the san state is getting ready for a second trump administration. bonta told politico earlier this week his team has been preparing arguments on, quote, almost every issue that could possibly arise during trump's presidency. the issues range from abortion to gun control. he'll outline those plans at crissy field at 10:15 a.m. today. >> the defense in the bob lee murder trial could call their witnesses to the stand, including defendant nima mamani. mamani is accused of stabbing and killing cashapp founder bob lee in april of last year. prosecutors rested their case yesterday. defense attorneys made a motion for a mistrial. the judge denied it. the judge also denied a defense motion to acquit mamani. the judge said there's not enough evidence to send the case to the jury. the district attorney of la voted out. up next, what that means for the menendez brothers case. but first, a check on the weather with drew. >> hey, reggie. 541 this morning, we're looking at your morning planner. get used to this image. a lot of sunshine coming our way today. looks very nice out there. it is cold this morning. our
