minutes late, but bart and caltrain are on time, and look e 87 camera. and youbad there. traffic is flowing in both directions of 87 at this time, and we want to switch gears to the live desk. i'mindeveloents n jose city council member omar torres. he is in jail this morning facing felony charges after being accused of molesting a child. and the accusation is different from the sexual misconduct investigation that led to tourists being absent from monday to say he was a survivor of sexual abuse by torres, 20 years ago. a policivor and torres were minors and continued after torres became an adult. but while the survivor was still a minor, torres submitted his

resignation from the his first t appearance yesterday and he is expected to be back in court for a bail hearing on november 14th, and will remain in custody until then. torres faces 24 years in prison if convicted. live in the studio gloria rodriguez abc seven news. gloria. >> thank you. more now on this omar torres had been facing weeks of public pressure part f downtown san jose with roughly 85,000 residents. now, those residents are concerned they don't have a city council representative that they can bring issues to. finding a replacement is going to take time. mayor matt mehan said the city council will decide whether to appoint someone or to hold a special election. officials also say tha >> i personally prefer a special election, even though it takes a little more time and costs a

around 157,000 ballots before a final winneranked choice voting adds another layer of complication in tabulating results. >> i mean, ranked choice voting in general takes some time just because of the way in which it's calculated. it's not a straight count. so you add on top of that that folks are mailing in their ballots, and that's definitely going to going to take some lag time. >> incumbent mayor breed telling supporters election night she's not going out without a fight, urging supporters to be patient while ballots are being counted. we are expecting the next batch of results at 4:00 this afternoon, but the department of elections tells voters finalizing results could take up to three weeks. today's results are critical if mayor breed closes the gap, voters can expect this process to take much longer. but if lowry's lead increases, it could be game

over. live in studio lena howland, abc seven news. >> lena. thank you. one of the closest races in the bay area has been called. it's for district 16, in the u.s. house. the seat left vacant by anna eshoo. the ap called the race for former san jose mayor sam liccardo. it's been a contentious race since the primary election in march. liccardo won first place by a wide margin, but assemblymember evan low and santa clara county supervisor joe simitian tied for second place. all three were going to go to the general election, but then a recount was called by a former staffer of liccardo's. low accused liccardo of being behind the recount, which liccardo has denied. >> the stakes were high and i think both of these candidates, you know, really gave it their all. >> liccardo released a statement yesterday saying he's already getting to work putting together a congressional staff, both here at home and in d.c. this morning, president biden will address the nation about the election. he's scheduled to speak at 8 a.m. and will bring that live to you wherever you

us in the 30s and 40s to start out the day. so invigorating air as you step out the door. let's call it that will bounce back into the 60s after 10 a.m, and later today will max out in the 70s away from the coast. here's a look at the coastal forecast. lots of sunshine coming our way. mid 60s for daytime highs with diminishing winds throughout the afternoon. a similar story around the bay shoreline. it's a sunny looking forecast. we'll have daytime highs mainly in the low 70s later today, and we'll find those temperatures very pleasant this afternoon inland as well. it is chilly right now. 30s and 40s gets you into the low 70s. that's the payoff. later today we are tracking red flag warnings one here locally. this will expire at 7 a.m. a more dangerous situation unfolding in southern california. their red flag warning is in effect until early tomorrow morning. but encouraging news. watch the winds. watch the bright colors throughout the afternoon. they diminish. the winds will start to weaken, and firefighters will have favorable conditions later on today to fight the mountain fire in ventura county. back here at home, we're looking at

from the bay area have joined the fight against a dangerous wildfire burning in ventura

county. the mountain fire started yesterday morning and quickly exploded in size due to fierce santa ana winds. it's grown to more than 14,000 acres and is 0% contained. thousands of people in the cities of camarillo, moorpark and somis have been forced to leave their neighborhoods. our sister station in los angeles estimates at least 40 to 50 homes have burned. a man and his son tried to save homes in their moorpark neighborhood with a garden hose and a shovel, but it was enough to give us to stop the fire from. >> well, it's so windy. it's blowing the fire like crazy. >> the homes have been lost up here. >> there's 15 on fire, they say on this side of the street. >> another fire broke out in malibu, but was quickly contained. ventura county fire officials will give an update at 10:00 this morning. today, electricity is expected to be restored for some p-g-and-e's customers who have been in the dark because of power safety shutoffs. the shutoffs were scheduled are scheduled to prevent fires. more than 16,000

can see the hip hop 101 from new york to the bay event is canceled on the oakland arena's website. the one day festival was set to feature artists like flavor flav and bay area natives too short and mistah fab. no word on why the concert has been canceled. ticketmaster says refunds will be issued within 2 to 3 weeks. >> the oakland alameda water shuttle will be making more frequent service launches just three months after it began. the shuttle runs between jack london square and alameda landing, so it's a short little ride, but it's cute. operators added 52 trips per week. the boat, named woodstock, operates wednesday through sunday. rides are free and they take about ten minutes. >> it's the return of the rink. the holiday ice rink is officially open at san francisco's union square. there was a decent sized crowd out there last night with a lot of people with some talent. they were checking out some of the special performances. it will be open every day from 10 a.m. until 11 p.m. through january 20th. tickets can be bought online and the price includes

chance of widespread rain coming with a level one storm on the abc seven storm impact scale. temperatures this morning will take you around the bay shoreline. good morning, hayward 49. we're down to a chilly 41 in palo alto. even colder as you head towards danville at 39. a similar story in napa right now 55. that current temperature in san rafael. so it is chilly this morning. the payoff is the afternoon sunshine, the mild air for the most part will go into the mid 60s and mid 70s for daytime highs today. so it's bright out there. a little breezy this morning. those winds relaxing this afternoon. daytime highs will go into the low 70s. and a lot of cities from san rafael to oakland to palo alto 70 that high and antioch overnight tonight we'll have clear skies for the most part. another chilly night on the way. 30s and 40s heading into friday. friday is looking fantastic. then over the weekend we have that chance of some drizzle. look at those rain chances. a bit of a bump here over the weekend. you can see just a low chance of some drizzle. you can clearly see it's monday during

the $10 billion bond for public schools. prop 34, the revenge initiative, which targeted the

aids foundation, is likely to pass. these three props are likely to fail. prop five, which would lower the approval threshold for issuing some local bonds from two thirds to 55%. prop 32 to raise the minimum wage and prop six to ban forced inmate labor. now that prop has drawn more than 5 million, no votes. if it does fail, forced labor in state prisons as punishment for a crime will continue. those who refuse to work can be disciplined. the push to remove the forced labor clause from california's constitution was recommended by the state's reparation task force, which was created to address inequities that harm black californians. now, let's talk about the propositions that have passed. there are four of them. they include prop three, which is about marriage rights protections. prop four has passed. that's the $10 billion climate bond. prop 35, which provides permanent funding to medi-cal. and by the widest margin. prop 36, it increased sentencing for certain drugs and

yesterday, vice president harris spoke to trump to congratulate him. then she addressed the nation to publicly concede. >> i also told him that we will help him and his team with their transition, and that we will engage in a peaceful transfer of power. >> president biden has spoken to both vice president harris and president elect trump, and the president is going to address the nation today. that's scheduled to happen at 8 a.m. abc news will have live coverage. you can see it wherever you watch abc seven news. governor newsom issued a statement following vice president harris's speech, writing, though this is not the outcome we wanted, our fight for freedom and opportunity endures. california will seek to work with the incoming president, but let there be no mistake. we intend to stand with states across our nation to defend our constitution and uphold the rule of law. >> today, organizations serving the lgbtq plus community in san francisco are gathering for what they're calling a healing

circle. organizers say it's to show support for one another after the presidential election. san francisco pride executive director suzanne ford says many trans people are afraid of what's to come in a second donald trump term. the group held a board meeting last night to plan their next steps. >> we've got to find a way to develop a fund that will allow us to bring people out of red states to states like california. we absolutely have to. >> san francisco's office of transgender initiatives also released a statement to reassure its commitment to providing a safe haven for trans people in trump's first term. california fillled more than 100 lawsuits against his policies. >> this morning, the race for san francisco mayor is still undecided. the last update from elections officials was yesterday, and it showed daniel lurie leading incumbent london breed. we're expecting another update this afternoon. abc seven news reporter lena howland has been tracking the race this week, and she's in the studio with where things stand. lena. >> reggie. good morning. there are still many more votes to be

counted in order to call a winner in the mayor's race, the city's department of elections tells us they are still processing around 157,000 ballots. this includes provisional ballots and absentee ballots sent in the day before and on election day. so far, daniel lurie is pulling ahead of incumbent mayor london breed by more than 24,000 votes. lurie is a philanthropist and the founder of a san francisco nonprofit. while ranked choice voting always leaves room for the unexpected. former mayor willie brown says it's a tough showing for an incumbent. >> there is no question that once you get as high non-incumbent in the numbers, as lurie has gotten, there's no question he can't win. >> if mayor breed closes the gap in the next batch of results, voters can expect this process to take much longer. but if lurie's lead increases, it could

be game over. the department of elections says they will be putting out results of ballots counted over the past two days. this afternoon at 4:00, but they say finalizing those results could take up to three weeks. live in studio lena howland, abc seven news. >> thanks, lena. despite not being named the official winner yet. abc seven insider phil matier says lurie will face a challenge but also have an advantage if he takes on the role of mayor. >> he is going to continue to try to manage the homeless situation in in san francisco. i don't know if he can solve it, so he'll be another mayor who's faced that same dilemma. public safety, same situation again. where everybody's talked about doing something. but has it really had an impact? he will, however, benefit from the fact that things have been getting better in san francisco visually and how people feel just not good enough for mayor. london breed. so he's going to take the direction that city has already

changed and run with that. so he he's basically he picks he he comes in at an advantage. he doesn't have to turn the battleship so much as just make it move faster. >> phil says due to the tight race and ranked choice voting, lurie was really relying on being a lot of people's second choice in the election. although, as we saw he won the first round all the way through the 14th. >> now the official results are not in, but the recall election against oakland mayor shang tao is passing by a wide margin. and, gloria, some voters say that new leadership will help lead oakland down a new path. >> that's certainly what we're hearing. amanda mayor xing tao's team says she will not be commenting on the recall until the final results are in, and if those results hold, mayor tao will be recalled with 65% of voters saying they want her gone. prominent oakland attorney walter riley was part of alameda county district attorney pamela price's transition team. he strongly opposed the recalls of d.a. price and mayor tao. he says the recalls are just another attack on progressive
