evening. thank you for joining us. i'm dan ashley and i'm ama daetz. >> it's the latest development in the drama that has followed the team all season. and it stems from claims that one member of the team is transgender. >> abc seven news reporter dustin dorsey is digging through the court documents and has more on this lawsuit. >> the san jose state women's volleyball court sits empty, and it will remain that way thursday because the university of wyoming forfeited its second match against the spartans this season. it's the sixth match this season that opponents have forfeited, contributing to 11 total conference wins for sdsu so far. the forfeiture stemmed from unconfirmed claims by a spartans volleyball player that one of her own teammates is transgender, and now that player co-captain brooke slosser, along with suspended associate head coach melissa beatty and ten other college volleyball players, are suing over title nine and first amendment violations. slosser spoke about the controversy exclusively on fox news, saying the university is allowing one player to cause issues. >> i mean, it's sad that the school still chooses to

prioritize one man's needs over an entire team and be willing to get rid of half of our season because of it. so it's amazing that other teams in the conference can stand up and just say, no, we're not doing this. >> the mountain west conference commissioner gloria nevarez, the csu board of trustees. csu head volleyball coach todd kress and other sdsu officials are the defendants in the case. court documents allege that the sdsu athlete is getting preferential treatment, and that the concerns and feelings of others on the team are not being heard. the lawsuit claims that during an april meeting, csu officials told team members to not speak about the situation or, quote, it will go badly for team members. the suit contends that the volleyball player plaintiff's claim is transgender should not be eligible for the team, and they are calling on the conference to ban that athlete from the upcoming mountain west conference tournament to reverse the losses for teams that forfeited, and to strip all wins from sdsu's record. slosser is also part of another lawsuit against the ncaa related to this issue. menlo college political scientist

melissa michaelson expects the results of the presidential election will only embolden more action of this kind, because it was such a big issue in the campaign, and because trump and his allies have been so vocal about their opposition to transgender people being allowed to live their lives openly, i think we're going to see more and more of this kind of activity. sdsu told us they have not been served with a lawsuit and have no comment at this time. in san jose, dustin dorsey, abc seven news. >> a judge denied bail today for disgraced san jose city council member omar torres. torres is facing felony charges for lewd acts with a child. police arrested him last week after a relative came forward to say he was victimized by torres 20 years ago. he had already been under investigation for a different case involving a minor. the prosecution and the defense both spoke about today's decision. >> obviously, i'm pleased that the court agreed with the arguments that we laid out in our moving papers. we believe, given the entire record of the available evidence right now for the court, that it was

appropriate, certainly understand the court's ruling. >> disappointed. of course i do think that mr. torres has been, as an adult, a model citizen, and has given back a tremendous amount to this community. >> if convicted, torres faces 24 years in prison in san francisco. >> the man accused of killing tech executive and cash app founder bob lee was back on the stand today. the prosecution cross-examined nima momeni about his last encounter with lee back in april of last year. yesterday, testifying that the two got into an argument over a bad joke that he told and that he acted in self defense when a knife was pulled on him. abc seven news reporter melanie woodrow has been following the crime from the very beginning and joins us live from court with the very latest, mel. >> reporter dan nima momeni doubled down on that testimony today that it was a bad joke that set bob lee off, and he added some surprising new testimony today saying that he believed it was possible that bob lee had been stabbed and

killed by somebody else after their interaction involving a knife. nima, he testified that when bob lee walked away from him in the early morning hours of april 4th, he appeared fine. prosecutor amir talai demanded the way you made this deadly joke, tell it to us. momeni repeated what he said yesterday that if it were his last night in town, he would have spent it with his family instead of expletive around at strip clubs. as talai demanded to know what bob lee said and did next. momeni said lee said, are you calling me a bad expletive, dad? expletive i'm going to expletive you up. you don't think i can expletive you up right here? he said lee circled him, then got in his face and pushed him. he said lee pulled a knife out and that he was afraid and had to control it over and over again to lie. asked how much time between that dumb joke and the knife coming out? momeni could not say for certain. he also couldn't say why he ultimately

threw the knife over the caltrans fence. testifying at the time, it made sense because he was walking away while he testified earlier in the day. he thought maybe somebody else had killed bob lee. april fourth. he also testified later this afternoon, he contacted attorneys after he learned of lee's death on the fifth, saying, i wanted to be protected. i knew who he was. several times during testimony today, momeni sparred with tala, at times asking the prosecutor questions or saying things like, i'm sorry if my answer doesn't satisfy your expectations. bob lee's brother oliver, had this to say. >> you have seen him be aggressive on the stand. you've seen him. just try and take control of this room like he is. his arrogance and his entitlement are on full display here. >> direct and cross-examination of nemo momeni concluded today, and the jurors began submitting their questions. there were so many questions that the judge decided it made more sense to

release jurors for the weekend, bring them back on monday morning, with which questions she determined will be able to be asked of nemo momeni. both sides will then have a chance to ask more questions. once the jurors questions have been answered. reporting live in san francisco. outside of the hall of justice melanie woodrow, abc seven news. >> melanie, thank you for the latest update on that. for the first time since. people in alameda county voted to recall their district attorney. pamela price spoke publicly today, but she refused any questions about the recall and instead focused solely on the criminal charges filed against nine deputies and two employees at santa rita jail. abc seven news reporter anser hassan was there and has the latest. >> i am here to officially confirm that the charges are now filed and that they are now pending, alameda county district attorney pamela price filed criminal charges for the in-custody death of maurice monk at the santa rita jail. >> the charges are against seven current alameda county sheriff's deputies, two former sheriff's deputies and two santa rita jail medical staff, including a

doctor. >> i have informed and kept the alameda county sheriff informed of the progress of the case and will continue to do so regarding the charges filed, which were formally approved by the court yesterday. >> monk, who struggled with mental health issues, was arrested in october 2021 for disorderly conduct after refusing to get off an ac transit bus. he couldn't afford bail and spent over a month in the santa rita jail. last year, deputy d.a. zachary linowitz told abc seven news monk may have been dead for several days before being found unresponsive inside his cell. >> it appears that he may have been dead upwards of 72 hours before he was finally observed by deputies. >> price says her predecessor, da nancy o'malley, opened an investigation which didn't lead to any conclusive results. linowitz says under his investigation, the sheriff's department agreed to hand over police reports and jail logs. if convicted, each defendant faces up to four years in state

prison. three of the deputies are also charged with felony falsification of documents. they face a five year sentence if convicted of both crimes. >> having care and custody of mr. monk willfully caused and permitted him to be placed in a situation in with his in which his health was endangered. >> we reached out to the alameda county sheriff's department to ask the current status of the deputies involved. they did not return requests for comment. d.a. price says this is an ongoing investigation that could produce additional charges in the east bay. anser hassan abc seven news. >> let's move to the latest on the weather. and as you can see, there was some rain around parts of the bay area today. maybe where you live this is video from ghirardelli square in san francisco. came down pretty solidly for a while. and as we take a live look outside, you can see the conditions right now. for details, let's go to abc7 news meteorologist sandhya patel. sandhya. yeah. >> dan, you know, if you're out and about today, you probably

officials say a recent count found more than 900 oversize and lived in vehicles around san jose. starting next year, the city would establish ten permanent and 30 temporary towaway zones in neighborhoods the city considers rv hotspots. vehicles that don't voluntarily leave those areas could be towed and impounded. a map will let

tourists. >> this is the conversation that's been a little, frankly, terrifying to me. >> sfmta director jeffrey tumlin says with a looming deficit of nearly 300 million by fiscal year 2026 2027, everything is on the table for possible cuts, including the suspension of three cable car lines california mason and hyde and the f-market streetcars, which could save an estimated $33 million annually. tumlin says the stakes are real, as all of you know, the lingering effects of covid and particularly work from home has had a devastating impact on the sfmta budget. he says the failure of prop l, which could have generated 25 million for transit and the new trump administration, could make identifying new revenue sources challenging those who work on the cable cars. can't believe suspending service is even being suggested. >> it's sad that they're even thinking about shutting down this iconic and is the only national moving national monument. >> former mayor willie brown, who helped dianne feinstein save

now from our kgo roof camera. amazing view. you can see the craters of the moon. all right, let's talk about the rain. yes, we still have some showers on live doppler seven. i'm going to get you into street level radar. livermore across tesla road. we are seeing some pockets of moderate rain right now. really? some areas across 580, you're looking at only 100th of an inch, but you look at this area and you're seeing about 3000/900 of an inch per hour, scattered showers right around discovery bay, brentwood. very light in nature, but don't be surprised if you do get caught under one of these. it will come down pretty hard at times, and it did today in san francisco and parts of the bay area. as we look, you take you back in time. we even had a lightning strike early this morning off the north bay coast. now, there have been lightning strikes offshore here throughout the afternoon. so we're going to keep the potential for that in the forecast. looking at the wider picture here, you can see those strikes off the coast that's unstable air some over northern california. certainly seeing some snow in the mountains a high surf advisory in effect
