here in the bay area. i'll have a timeline of how long before you get a break coming up, always live abc seven news starts right now. transforming san francisco's ocean beach. a big project with a big price tag. just received unanimous approval. good evening. i'm ama daetz and i'm larry beil. >> thanks for joining us. the california coastal commission this afternoon approved a plan to build a massive seawall to protect san francisco's ocean beach against erosion. >> it is a massive project in addition to the seawall, there would be a seaside trail parking lot and other features. it would all happen right by the great highway, which voters recently agreed to permanently close to cars to create a recreational area. >> abc seven news reporter suzanne phan with the lates. >> late this afternoon, a vote by the california coastal commission. this motion is approved. supporters say it's a critical plan that would transform san francisco's ocean beach and protect thea from erosion and rising sea thea

levels. the $175 million project would shore up a wastewater treatment plant and a sewage tunnel on the southern end of ocean beach. >> it's the lake merced tunnel that is large enough. you could drive a truck through it. it's 14 foot diameter tunnel. it carries stormwater and sewage from that side of the city to the ocean side treatment plant. >> the s.f. public utilities commission says that really critical infrastructure is at risk of failing, and their plan would protect it. >> if it fails, that means that we could be spilling sewage onto the beach and hundreds of thousands of residents in that area would not be able to flush their toilets. >> many people agree it's important to protect the city's aging infrastructure, but they don't think a large seawall is the way to do it. >> it's huge. it's huge. >> the surfrider foundation says it would be the biggest seawall they've ever seen along the california coast. >> it's like 3000ft long. and then. and then. yeah, up to 120ft wide and 35ft deep. >> as part of the city's plan,

the seawall would be covered with tons of sand. opponents argue that sand would be washed away with time and would need to be replenished. the surfrider foundation says there's another solution you could have a lower seawall. >> you could have a more complete dune ecosystem. >> chase davenport is a coastal scientist and a surfer. abc seven news originally talked to him about proposition k, which permanently closes the great highway to vehicle traffic. davenport supports that, but he doesn't agree with a big seawall going up. >> as a surfer, i'm opposed to it, and as a scientist, i'm opposed to it. it's going to eliminate a lot of our beach. and even if the plan works as they say it would, it's going to require an unbelievable amount of sand to cover the seawall. and if we don't have that sand, our beach starts to disappear. >> late today, the sfpuc reacted to their plan passing. >> i'm super excited because we've been working on this for a long time, and i think it's the

right move for san francisco. >> in san francisco, suzanne phan, abc seven news. >> we are still on the storm impact scale today with a light level one storm wet day in the bay area. at times, you can check out the conditions for travelers flying out of. okay, rain really didn't last that long. in total, only about a dozen. okay, flights were delayed today. i'll listen to the rain in san francisco. a brief downpour near ghirardelli square. >> big waves in pacifica today. look at this. there is a high surf advisory in effect, in effect today and into the weekend. so let's bring in abc seven news meteorologist sandhya patel. she has the details on that advisory, as well as what else to watch out for in our weather. sandhya. yeah. and larry, we're basically going to be dealing with still some more showers. instability is there. so let's take a look at live doppler seven. i'm going to get you into street level radar where we are seeing some light to moderate showers. this has just been sitting across parts of the altamont right now. if

you're heading out across 205, it may be slow going for you. so keep that in mind. widening the picture here. we do have thunderstorms off the coastline. they're not actually hitting the coast, but you will notice some lightning strikes showing up just to our southwest. we've had some strikes last couple of hours, so we're keeping this level one storm in the forecast with the thunderstorm possibility as we go hour by hour. notice those showers at 8 p.m. they're very spotty. they're not widespread, but at 1130 could even see some thunderstorm activity around the san mateo coast heading into the santa cruz mountains early tomorrow morning. and isolated shower can't be ruled out. the entire bay area is at risk today of a thunderstorm or two. it's a level one on our storm impact scale. scattered downpours, chance of thunder, large and rough surf. as you just heard, ama mention that high surf advisory going until saturday morning. i'm going to be back with that advisory plus a number of other advisories and a freeze warning coming right u, larry. >> all right, sandy, see you in

a few minutes with the seven day forecast. now let's get to the latest on san mateo county's embattled sheriff and the pressure for her to resign. abc seven news reporter monica madden following the story and looks at what is next after the board of supervisors unanimously passed a vote of no confidence, we felt at the time she was the best candidate. >> jim lawrence and his organization, fix in san mateo county was dedicated to getting sheriff cristina corpus elected in 2022. >> her motto was transparency, openness, work with the community, empathy. >> i bring tenacity, she said. >> some of the same things to abc seven in an interview after winning the election two years later, lawrence and many others now calling for her resignation. >> diligence, respect, you know, honor, honor with yourself. where did all that go? >> it comes after a months long investigation prompted by internal complaints in corpus's office. the 400 page report found a culture of intimidation and retaliation. other

allegations include abuse of power, having an inappropriate relationship with her chief of staff, as well as using racist and homophobic language. >> we cannot trust this sheriff anymore. >> the san mateo board of supervisors demanding corpus resigns. if not, they have other options. >> we know that in los angeles county, a couple of years ago, they they faced a similar situation and they were able to bring an amendment to their county charter on the ballot to the voters to be given that power in very specific instances. we are looking at that as a recent model of how to lead our community out of this difficult situation. >> and after corpus announced wednesday, she promoted her chief of staff to assistant sheriff. the board is looking into if that's even legal. >> he's not a law enforcement officer. he's not qualified to be in that position. >> it all comes as a disappointment to caruso, who previously campaigned for corpus further concerning san mateo. she's passionate about improving

community police relations, safety, security, the feeling that in san mateo county, we're all in this together. >> that took a hit. >> if a charter amendment is unsuccessful, lawrence says, his group would work toward getting a recall on the ballot. we reached out to the sheriff's office to see if sheriff corpus was available for further comment, but did not hear back. in san mateo county, monica madden, abc seven news. >> new at six cruz has admitted to submitting a false report to influence a federal investigation and will pay a half million dollar fine in october of 2023. one of the san francisco based companies, driverless cars was involved in an accident at fifth and market streets in the city. a woman was hit by a regular vehicle. the impact threw her into the path of a cruise car, and she ended up pinned underneath and dragged more than 20ft. the justice department says cruz omitted the fact that the woman was dragged in its report to federal investigators. the woman was hospitalized for serious injuries. for the first time since people in alameda county

voted to recall their district attorney, pamela price spoke publicly today, but she refused to answer any questions about the recall. instead, she focused solely on the criminal charges filed against nine deputies and two employees at santa rita jail for the death of an inmate from three years ago. abc seven news reporter anser hassan has more. >> i am here to officially confirm that the charges are now filed, and that they are now entity alameda county district attorney pamela price filed criminal charges for the in-custody death of maurice monk at the santa rita jail. >> the charges are against seven current alameda county sheriff's deputies, two former sheriff's deputies and two santa rita jail medical staff, including a doctor. >> i have informed kept the alameda county sheriff informed of the progress of the case, and will continue to do so. regarding the charges filed, which were formally approved by the court yesterday. >> monk, who struggled with mental health issues, was

arrested in october 2021 for disorderly conduct after refusing to get off an ac transit bus. he couldn't afford bail and spent over a month in the santa rita jail. last year, deputy d.a. zachary linowitz told abc seven news monk may have been dead for several days before being found unresponsive inside his cell. >> it appears that he may have been dead upwards of 72 hours before he was finally observed by deputies. >> price says her predecessor, da nancy o'malley, opened an investigation which didn't lead to any conclusive results. linowitz says under his investigation, the sheriff's department agreed to hand over a police reports and jail logs. if convicted, each defendant faces up to four years in state prison. three of the deputies are also charged with felony falsification of documents. they face a five year sentence if convicted of both crimes. >> having care and custody of mr. monk willfully cause and permitted him to be placed in a situation in with his in which his health was

it was back on the stand today. lee was stabbed in april of last year. this occurred right by main and harrison streets in the neighborhood known as the east cut. the man charged with killing him is nima momeni. yesterday, momeni testified that the two got in an argument over a bad joke that he told and that he acted in self defense when a knife was pulled on him. abc seven news reporter melanie woodrow with what happened in court today. >> nima doubled down today on testimony that it was a bad joke that set bob lee off. and he also added some new, surprising testimony that he believed it was possible somebody else had stabbed and killed bob lee. after the interaction they had involving a knife, momeni said that when bob lee walked away from him in the early morning hours of april 4th, he looked fine. prosecutor amir talai demanded, the way you made this deadly joke, tell it to

us. momeni repeated what he said yesterday that if it were his last night in towne would have spent it with his family instead of expletive around at strip clubs. as talai demanded to know what bob lee said and did next. momeni said lee said, are you calling me a bad expletive, dad? expletive. i'm going to expletive you up. you don't think i can expletive you up right here, he said. lee circled him and got in his face and pushed him. momeni said lee pulled a knife out and that momeni was afraid and had to control it over and over again to lie. asked how much time between the dumb joke and the knife coming out, momeni could not say for certain. he also couldn't say why he ultimately threw the knife over the caltrans fence. testifying at the time, it made sense because he was walking away while he testified earlier in the day. he thought maybe somebody else had killed bob lee. april 4th. he also testified later he contacted attorneys after he learned of lee's death on the fifth, saying, i wanted to be protected. i knew who he was.

several times during testimony today, momeni sparred with talai, at times asking the prosecutor questions or saying things like, i'm sorry, my answer doesn't satisfy your expectations. bob lee's brother oliver had this to say. >> you have seen as you see nima be aggressive on the stand. you've seen him. just try and take control of this room like he is. his arrogance and his entitlement are on full display here. >> directing cross-examination of nima momeni concluded today, jurors began handing in their questions, and there were sor many that the judge excused jurors until monday, when she will decide which of those questions can be asked. both sides will have a chance to ask nemo many more questions once the jurors questions have been answered. reporting in san francisco outside of the hall of justice melanie woodrow abc seven news. >> public transit leaders in san francisco are considering drastic action to deal with a looming fiscal crisis, and cable cars could be on the chopping block. three of the city's iconic cable car lines could be

suspended the california mason and hyde lines. also at risk the f market street car line. the sfmta faces a $300 million budget deficit in the next few years, and everything is on the table to close the gap. >> as all of you know, the lingering effects of covid, and particularly work from home has had a devastating impact on the sfmta budget. >> voters recently rejected prop l, which would have generated $25 million for transit. federal help is not likely under the incoming trump administration. all right. checking on our weather. more rain today. yeah. >> more rain. sunshine. we've got a mixed bag and a massive moon. >> right? yeah, we have a full moon coming up tomorrow, larry. >> and let's take a look at the rainfall totals so far. it hasn't been a whole lot, but we got 2/10 of an inch in santa rosa. three hundredths in san rafael, five hundredths in oakland. a trace in san jose. you will notice about a third in ukiah and a couple hundredths concord brentwood. half moon bay. san francisco looking at live doppler seven, we are

still tracking some showers off the coastline here. there have been some lightning strikes and so we're going to keep that in the forecast. although the sun has gone down, one of the destabilizing factors is the sun. we are still tracking showers though. you will notice right around the tracy area 205. so finally moving out of the altamont area. but if you are traveling in that direction, keep it in mind as we take you back in time. yes, we had some downpours earlier today. san francisco, if you're caught under this, you know exactly what i'm talking about. here's a look at the wider perspective. so the front came through yesterday. now the trough is pushing in. and so the cold unstable air associated with it is what we're dealing with. and that's going to continue. the sierra is seeing snow by the way in the mountains. wave heights right now anywhere from 7 to 18ft. the surf is up. it is rough until 11 a.m. saturday. high surf advisory is in effect. breakers 12 to 18ft. watch out if you're

going to be out swimming or surfing. coastal flood advisory in effect due to the king tides until monday afternoon. tomorrow morning, if you're walking right around the shoreline, 6.95ft is the high tide at 1004. so watch out for the low lying flooding 40s and 50s on your temperatures right now. anda beautiful view from exploratorium tonight. showers. possible thunderstorms. next few days we have dangerous surf and king tides and then saturday morning freeze warning for some parts of the bay area. it's a level one on our storm impact scale tonight. scattered downpours, chance of thunder, large and rough hail is expected. so we're going to go hour by hour here. 7:00 tonight. just a few pop-up showers coming into the picture. 11 p.m. could even see an isolated thunderstorm early tomorrow morning. even though most of the activity is off the coast as it's moving out of here. can't rule out an isolated shower or two going into the early morning hours. after that, you can put the umbrellas away, at least for a couple of days. winter weather advisory until 10 p.m. tomorrow. additional 4 to 10in of snow

above 5500ft. up to 12in for the peaks. with those gusty winds, you're going to need those chains and you're going to need some patience. 30s and 40s on those temperatures. a few showers in the morning can't be ruled out. as i mentioned, high temperatures tomorrow, 50s and 60s. the sun will be out, but the chill will be with us and even colder weather is ahead. so the north bay valleys. midnight saturday until 8 a.m. saturday will go under a freeze warning. temperatures are going to be subfreezing, dropping to subfreezing levels, so it is going to get very cold. you'll have to cover up any sensitive plants that you have, and don't forget to drain your pipes or to wrap them. accuweather seven day forecast isolated early morning chance of showers. after that, we're going to go with sun and that sun continues saturday. but that cold frosty start in the morning. level one for sunday. a chance of scattered showers i should say. that's not a big syste. after that, anna and larry, we're going to go dry and warmer temperatures coming up into the mid 60s.

>> okay, i wrapped my strawberries for the squirr. didn't work. they ate it anyway. >> can you bring it inside? >> maybe. maybe we'll try that. thanks. >> they outsmarted you. they did. knocking the san jose state volleyball player is suing the mountain west conference, demanding her own teammate be declared ineligible to play. and she also wants her own team to be ineligible for the conference tournament. this all stems from claims that one member of that team is transgender. abc seven news south bay reporter dustin dorsey digging through court documents and has more on the lawsuit. >> the san jose state women's volleyball court sits empty and it will remain that way. thursday because the university of wyoming forfeited its second match against the spartans this season. it's the sixth match this season that opponents have forfeited, contributing to 11 total conference wins for sdsu. so far. the forfeiture stemmed from unconfirmed claims by a spartans volleyball player that one of her own teammates is

transgender, and now that player co-captain brooke slosser, along with suspended associate head coach melissa beatty and ten other college volleyball players, are suing over title nine and first amendment violations. slosser spoke about the controversy exclusively on fox news, saying the university is allowing one player to cause issues. >> i mean, it's sad that the school still chooses to prioritize one man's needs over an entire team and be willing to get rid of half of our season because of it. so it's amazing that other teams in the conference can stand up and just say, no, we're not doing this. >> the mountain west conference commissioner, gloria nevarez, the csu board of trustees. sdsu head volleyball coach todd kress and other sdsu officials are the defendants in the case. court documents allege that the sdsu athlete is getting preferential treatment and that the concerns and feelings of others on the team are not being heard. the lawsuit claims that during an april meeting, sdsu officials told team members to not speak about the situation or, quote, it will go badly for team members. the suit contends

that the volleyball player plaintiffs claim is transgender should not be eligible for the team, and they are calling on the conference to ban that athlete from the upcoming mountain west conference tournament to reverse the losses for teams that forfeited, and to strip all wins from sdsu's record. slosser is also part of another lawsuit against the ncaa related to this issue. menlo college political scientist melissa michaelson expects the results of the presidential election will only embolden more action of this kind, because it was such a big issue in the campaign, and because trump and his allies have been so vocal about their opposition to transgender people being allowed to live their lives openly, i think we're going to see more and more of this kind of activity. sdsu told us they have not been served with a lawsuit and have no comment at this time in san jose. dustin dorsey, abc seven news. >> coming up next, another chance to dream for san francisco

again in san francisco, october 14th through 16th, 2025. it's the biggest business conference in the city, with roughly 45,000 attendees, and generates about $95 million worth of economic activity. >> the old westfield mall in san francisco went up for auction today. the value of the san francisco center has really plummeted. the owners gave up control last year. they owe hundreds of millions of dollars to the lenders. deutsche bank and jp morgan chase. while it is possible that somebody snapped it up, experts say the more likely scenario is that the lenders end up keeping the property. the satirical news website the onion is taking control of conspiracy theorist alex jones website. infowars was up for auction to pay off the more than $1 billion that jones owes to the families of theones sandy hook school shooting victims. the families won a defamation suit against alex jones in 2022 after he said the shooting, which killed 20 children and six adults, was a hoax. the onion said it will use the website to advertise a gun

motor vehicles. turns out it was really a private company selling dmv services with extra fees. >> the dmv authorizes these companies. but why let companies profit from consumers paying their dmv bills? seven on your side stephanie sierra has the story. we've seen hundreds of complaints about one company in particular need tags.com consumers say the site looks and functions like the dmv website, but ads on these hidden fees. >> now remember, the state has a ban on junk fees. so we're looking into is this in violation? >> i went to google, typed in

california dmv. >> alan peterson went to the dmv website to renew his car registration, or so he thought. >> there's an extra $70. and it's like, what is this? >> his dmv registration fee was $231. so why was he charged $303? >> we feel that we're being if you will, ripped off. >> it turns out he'd mistakenly clicked on a third party website. need tags. dot com, which provides dmv services, but tacks on extra fees at checkout when he realized his mistake, he called to cancel the order. he was shocked at the response. >> if you dispute this transaction, we will take legal action. it's not what i would expect from a reputable company. >> but what upset him more? alan found out need tags was not some rogue company, but a dmv partner. the dmv authorizes need tags and other vendors to sell dmv services and tack on as much as they want in extra fees.

>> they're trying to make money. my problem is, why is our government enabling them? why is it officially sanctioned by the government? i don't understand the government doing it to their own citizens. >> it ought to be clearer and much more conspicuous. you are not on the government dmv website. >> consumer advocate robert harrell says the state should require companies like need tags to post prominent disclaimers. >> we're not the dmv website and if we're being honest with you, you're going to pay a heck of a lot more. >> scores of californians posted complaints online and to seven on your side saying need tags led them to believe it's the dmv for one need. tags pays google to appear at the top of search results for the dmv. also, the need tags website says california dmv registration renewal in large type. it's not until checkout that consumers see the extra fees tacked onto their bills. >> the department of motor vehicles offers the same

functions for nothing. why is there a need? >> tags need tags. owner eddie marion could not be reached, but he has told us the company is committed to transparency and the website shows fees before payment. we asked dmv director steve gordon about the surge of complaints about the dmv partner. gordon did not respond directly, but in emails to seven on your side, a dmv spokesperson said the need tags website states it is not the dmv, but where there is some fine print there, but it's written in a font size that is considerably smaller than everything else on that page, and the page is designed to draw your eye to the other elements. as for hidden fees, the dmv said need tags does list them. but even if they knew about fees, consumers would have to scroll to the bottom of the website and click this button. it shows they will pay an extra $49 per car, or $100 for commercial plates and an array of smaller charges on top

of the dmv fee. >> i would argue that's a violation of california's upfront anti-drip pricing law. >> we asked the dmv, is any tags violating the state's own ban on hidden fees? the dmv told us to contact the department of justice. >> that is pretty unconscionable. and the state of california ought not be encouraging the very type of behavior that if we see it in the private sector, we would want to crack down on. >> the dmv tells us these partnerships began back when there were long lines, and these companies were used to help alleviate the burden. but we, of course, live in a different era now. there's no need for an in-person visit. you can go straight to the website, they'll process your transaction, and most importantly, it's free. so bottom line here, the dmv is urging you not to use any tags. go directly to their home page for seven. on your side investigates. i'm stephanie sierra. >> to be clear, the dmv's website is dmv ca.gov. you can

also go to our website abc seven news.com/7 on your side for help with issues like this and any other consumer problems. >> tackling the fentanyl epidemic and stopping deadly overdoses are a priority statewide. now, more bay area prosecutors are building the skills to go after dealers and charge them with murder. abc seven news reporter tara campbell looks at the process and how bay area district attorneys are working together. >> reporter that fentanyl is everywhere and it's deadly. >> that's placer county district attorney last year warning that dealers could face murder charges for deaths related to fentanyl sales. later that year, a dealer was convicted of murder in connection with the overdose of a 15 year od girl. the first such conviction in the state and now other counties are following suit for the first time in our county, we had an individual named philip ng, who we have charged with the crime of murder for providing fentanyl to a victim, and it killed her, and she did not know she was getting fentanyl. steve

mateo, county's district attorney and he estimates about 100 charges like this have been made across the state. many settled outside of court, two going to trial the placer county case. and in riverside county, another guilty verdict. >> we've already connected together with their prosecutors to say, how were you successful? how can we best present this to a jury? so it will be persuasive, impactful and just as flow. >> and he says working across jurisdictions will be key. >> there is very little fentanyl dealing in our county. and you'd sit there and say why? and you know what the reason is? they go to san francisco to get it, but they know they can get up there to the tenderloin. >> and it's pretty easy marketing if they were to get it in san francisco. overdose here. can you charge the dealer in san francisco is that fire sale occurred up there? >> that belongs to san francisco da's office. >> would you ever work collaboratively, collaboratively with the da there. >> and today, about 100% of the

waste. >> president elect donald trump is busy building his cabinet. his latest move selecting robert f kennedy jr to head the department of health and human services. now, this is a promise mr. trump made when he was out on the campaign trail. kennedy is a known critic of vaccines. he's also floated the idea of removing fluoride from drinking water, claiming it could cause physical harm and iq loss. abc seven news contributor doctor alok patel had this to say about that. >> i like everyone to be empowered and to really understand what's happening. what i want people to be is realistic about this very small amount of fluoride that is in our drinking water, that has been shown to protect our teeth. the layers of our teeth and decrease the risk of cavities, which is especially important in rural areas where people may not have access to dental services or fluoridated toothpaste. now, you can have too much fluoride if your drinking water exceeds that recommended amount, which ours in the bay area does not. about seven micrograms per 7mg/l. >> now we should point out water fluoridation and vaccine

requirements are often decided by local governments. today's announcement comes a day after a flurry of other nominations, including florida congressman matt gaetz as attorney general. abc news reporter rachel bade has a closer look at reaction to that announcement. >> today, donald trump's pick for attorney general, raising fresh questions about whether he'll be confirmed. matt gaetz, a longtime trump ally nominated to be the top law enforcement officer in the land. >> he's great, and he loves this state. congressman matt gaetz where the hell is matt gaetz? >> gaetz has long called for an end of all trump investigations, what he calls witch hunts. he also wants to clean house at the justice department, and we ride or die with donald john trump to the end. gaetz himself has been probed by the justice department for alleged sex trafficking. he denied the allegations, and the doj declined to bring charges after being nominated, gaetz immediately resigned from congress. >> i hereby resign as a united states representative for florida's first congressional district, effective immediately.

for tailback christian mccaffrey. he missed the first half of the season with achilles tendinitis and quickly learned everybody had an opinion about his injury. mccaffrey says he's actually feeling pretty good after his first game of the season. he had 107 total yards of offense. incredible catch right there. and while the road to recovery was long, there was another challenge that mccaffrey did not see coming. >> you get a lot of instagram doctors out there. you know some guys that you know i had guys diagnosing my injury. some doctors talking about my injury on the tv. i couldn't believe it. i never talked to him in my life. he's never seen, you know, imaging, talk to me, diagnose m. it's just kind of the world we live in now. >> obviously extremely happy to have him back for everything that he does for us. but more than anything, we just got so much respect for, you know, how he goes about his business and being such a great teammate that he is. >> so if you have an injury, go straight to instagram, right.

the warriors unveiled their new city connect uniforms. you'll notice the red stripes on the jerseys and shorts inspired by the golden gate bridge. and a good thing the warriors have a deep roster because de'anthony melton suffered a sprained acl in the dubs tuesday night game with the mavs. melton was limping late in the second quarter, but somehow he was able to fight through the pain. he hit a huge three late in the comeback. a sprain of the acl means there's some degree of tearing, not a full tear. that would require surgery. best case scenario for melt is probably out 2 to 4 weeks, and the dubs do have some other options. >> it was a great fit and that's why we targeted him. and so the fact that he's going to be out the next game is a bummer. we were, you know, finding some momentum. and we'll see how this unfolds. so we'll we've got options. we've got a lot of depth. and we were very capable of filling in. but it's very disappointing for him and for us. >> some baseball news. the giants named randy winn the vice president of player development today. winn played for the giants. he's been a tv analyst for them since 2013, in addition to a 13 year major league career
