and a level two storm. >> that also means a chance of flooding in the north bay where some areas could get. listen to this a month's worth of rain in just a few days. >> yeah, this is a live look outside, right now where you can see it is not raining yet, but it's already cold and gray outside. >> spencer christian here with our first look at the forecast. hi, spencer. okay. >> larry and kristen. yes. we have some stormy weather coming our way. it's going to last several days. let's take a look at what's going on right now. here's the satellite radar composite image. you see that strong storm just off the pacific northwest coast, tapping into that long plume of moisture that atmospheric river which is flowing right into our area right now, already producing rain, substantial rain in the northernmost part of california. and we are going to get some of that rain here in the bay area very shortly. this is a level two storm on the exclusive abc seven storm impact scale for tomorrow. it's expected to produce heavy rain and flooding in the north bay with powerful gusty wind. light to moderate rainfall in other areas. and here's the forecast animation starting 11:00 tonight. by 6:00 tomorrow

morning, we'll see that first wave of rain pushing through the north bay. it's going to blanket the entire north bay by about midday with some of the rain reaching southward south of the golden gate into san francisco and oakland down into the peninsula. then it's going to lift the main body of that rain later in the day and into the evening hours, mainly in north bay. event for the next couple of days, you can see why we have a flood watch in effect for the north bay. rainfall totals will range anywhere from three to over six inches in parts of the north bay. and again, flood warning in effect, flood watch in effect there, along with wind advisories. i'll give you a look at a closer look at those advisories and our seven day forecast a little bit later. larry. >> all right, spencer, see you with that in a few minutes. as spencer mentioned, the storm is goio hit the north bay the hardest. but other cities in the bay area are still preparing. abc seven news reporter dion lim live in san francisco with a look ahead at the preparations leading up to this storm. dion. >> san francisco is expected to get about half an inch of rain on wednesday, which doesn't seem like a lot in the grand scheme of things. however, it is the

consecutive days of rain that has city agencies concerned. they are keeping their eyes peeled for sites like this in order to be prepared. at the pacifica pier tuesday, there were plenty of people taking in the waves. >> i try to enjoy the last of the sunshine. >> those elevated wave heights, perhaps a harbinger of impending rain. >> my husband owns a water damage restoration company, so he's getting all his equipment ready. all of his his employees notified to be on call. >> the pier had been partially reopened after closing due to storm damage earlier in the year. the department of public works warns the pier may close once again if the rough surf persists to the north. at the san francisco public works operations yard, we found a steady stream of residents loading up their trunks with sandbags and getting ready for the expected half inch of rainfall wednesday. >> we just moved into our place so we're not sure if there's going to be flooding or not, so we're just trying to be prepared.

>> 12,000 sandbags are available to residents with a ten per person limit. >> the water doesn't drain fast enough and it starts to creep into the garage. >> in parts of the city prone to flooding, like the area around 17th and folsom streets, these signs are posted alerting people that flood barriers will be installed by the public utilities commission tuesday night. stable cafe has seen its share of flooding in years past, even closing for over a week in january. they are now on high alert. >> within like ten minutes, it was just like a completely flooded. it was like people were trapped inside for a little bit. >> in addition to clearing storm drains, san francisco's dpw is also ready for high winds to avoid scenes like this downed tree branches across the city, including near dolores park. following storms in early january and february. we're going to have our tree crews on duty on call. >> we do see at the beginning of storm season that more trees might come down and as as it goes forward into the winter, so heavy rains, saturated grounds

means that trees can come down. >> the department of public works really wanted me to hammer home the importance of keeping storm drains like this clear of debris and leaves. they also are encouraging the public to call 3-1-1. if you see downed branches or downed trees. if you're interested in those sandbags, the department of public works has them available at their operations center from 8 a.m. to 2 p.m. until saturday in san francisco. dion lim abc seven news. >> all right, dion, thank you. work was underway in san leandro today to trim some trees ahead of tomorrow's storm. sky seven captured video of the eucalyptus trees along san leandro creek. crews evaluated the health of the trees and then used a low flying helicopter to take away branches from those at risk of falling in the north bay. >> sonoma water officials began lowering the inflatable dam near forestville, releasing water ahead of the storm. it will take another 24 hours for the dam to completely deflate. now stay

with abc seven and abc seven news.com for the latest on the upcoming storm. you can track the rain with the same doppler our weather team uses and see the forecast anytime on our abc seven streaming channels. >> now to the controversy surrounding the san mateo county sheriff. county leaders have made a unanimous decision today on how the sheriff can be removed from her job. >> abc seven news reporter zach fuentes was at the meeting today and that decision was made. and zach is joining us live right now with the latest. hi, zach. >> hey there. yeah, that decision was unanimous. it's going to let voters decide on whether or not the board cann fire sheriff cristina corpus. the board introduced that ordinance today, and it will eventually give the voters that decision in march. now, we spoke with officials and people who support sheriff corpus about today's decision. >> our sheriff was elected by the people, and the people will make the ultimate decision here. >> emotions ran high from both the public and officials at tuesday's board of supervisors meeting. all of the comments leading to the board's unanimous

decision to introduce an ordinance that would send a ballot measure to voters to go ahead and put a charter amendment in front of the voters of san mateo county to go ahead and ask them if they'll give the board authority to remove a sheriff under specific circumstances, as delineated in the charter. all of this, coming after an independent audit, found the sheriff had an inappropriate relationship with an employee and created a culture of intimidation and retaliation within her department. allegations, the sheriff says are not true. we reached out to the sheriff's office for comment and did not hear back. in an exclusive interview with dan noyes monday, she had this to say. >> i have done nothing wrong. this is an attack. it's a coup that has been in place for a while by the county executives and the board of supervisors. >> several people in public comment spoke in the sheriff's favor, including redwood city native brian howell, who said he believes details in the report still need to be verified. >> who knows what's real? who's not, what's not real? and i just know sheriff cristina as a

person and she is a good person. >> several in public comments said that the report initially did not take in interviews from people who would have supported corpus. supervisor ray mueller said it was an independent human resources report that investigated allegations from those who complained. he said that people who want to come forward to speak can, but that it doesn't undo the allegations and evidence found against corpus. it's kind of like saying we have someone who's presenting evidence of wrongdoing, and someone else is upset because they weren't able to provide a reference check that she's a nice person. >> it still doesn't undo the wrongdoing. >> mueller said one person who did not speak under sworn deposition was corpus herself, something he's still asking her to do. >> we want her to come in under penalty of perjury, respond to the allegations and be held accountable to the words which which she which which she responds to them. >> now, the charter amendment that the board approved would sunset in 2028. so it wouldn't necessarily be applied or could be applied to future sheriff's

administrations. now, we did get a letter this afternoon from the california sheriffs association, one that it shared with the board of supervisors. it said in part that this decision by the board dilutes the voice of voters and could alter how future sheriffs undertake obligations. now that this order has been introduced, this charter amendment has been introduced. the board would officially adopt it in two weeks. right now, live in san mateo county. zach fuentes, abc seven news zach, thank you. >> would the resignation of omar torres, the san jose city council needs to decide whether it will appoint a replacement, hold a special election or name a temporary replacement and hold an election. the issue sparked a lengthy debate that is still happening right now. an election could be held at the beginning of april and then a runoff would take place at the end of june. >> in the east bay. new details about a bart police shooting that sent a union city woman to the hospital. the transit police say officers responded to a report of reckless driving in the union city bart parking lot last night. during a traffic stop, one of the people involved

is accused of attacking a responding officer. the officer shot the 32 year old woman in the upper body. >> once medically cleared, she will be charged with assaulthe with a deadly weapon on police. reckless evading, failure to follow a court order and resisting arrest with an enhancement of committing a felony while out on her own recognizance. she also had two outstanding arrest warrants. >> the department is reviewing footage from the officer's body cameras that captured the incident. in court, the defense rested today in the bob lee murder trial. nima momeni, accused of stabbing and killing the cash app founder back in april of 2023. he testified that he was acting in self defense. a use of force expert said he could have redirected the knife that he says bob lee pulled on him based on his martial arts training. prosecutors are expected to call rebuttal witnesses to that. >> oakland budget cuts are coming, but as of today, still not sure where or when the city is facing a $93 million deficit.

>> abc seven news reporter anser hassan looks at the numbers and you compare revenues to expenditures. >> we expect there to be a budgetary shortfall of $93.8 million. we don't expect to land this budget. >> oakland's finance department presented city council with new numbers based on the latest fiscal quarter. the situation is not bad in oakland. it's dire, says bradley johnson. the budget administrator. >> the fiscal circumstances in the current fiscal year are dire. the highlight here is we have already reached into our emergency reserve. this is the first time we have ever seen this occur since we've had this policy. >> the finance department says revenue is on target. the problem is increased in spendin, mostly overtime, by oakland police. the report says the police and fire department combined for overspending by $80 million. >> your deficit over the next biennial is $280 million. there is no long term rescue coming

for us. >> a contingency budget was triggered september first. some cuts are already in effect, such as job freezes and cuts to travel. but now deeper cuts are required. the sale of the oakland coliseum won't be enough to resolve the current deficit. department heads have been instructed to come up with more cuts by friday. >> we set a schedule so that we can look at some additional reductions on december 3rd. >> oakland city council president nikki bass knows tough decisions have to be made, but suggests the situation may not be as dire as discussed. unions have called for stronger tax and revenue collection. the city is looking to convert restricted funds to unrestricted funds, freeing upwards of $10 million. and there is a proposal to move upwards of $30 million, set aside for lawsuits and put it towards the general fund, because we don't have, you know, big litigation that we are currently in the middle of that we will be able to manage that. cuts to police and fire are still likely. those action items have to be decided on by the end

of this year. in oakland, anser hassan abc seven news. >> san francisco's mta board is poised to give final approval to replacing the controversial valencia street bike lane. the board, in fact, is meeting right now. the center running bike lane down valencia has been credited with reducing collisions between bikes and cars, but storefronts along that corridor say the lane has been hurting their businesses. even now, public opinion is as divided as ever. >> it would be a real loss to the community if we overreacted. based on those initial impressions, and got rid of the best bike lane in the city. >> we don't even have the medium range or the long range studies back yet for that, so we don't really know exactly how safe it is and how well that's worked. and now we're making a new plan. >> i get the point that a lot of the bicyclists have made, but i don't think that valencia but i accommodates a center lane. >> so here now is the replacement design. bike lanes that run next to the sidewalk. this design will eliminate 79 parking and loading spots.

to county. they say that child has been treated and is now recovering at home. the positive test showed low level detection of the virus. health officials say that indicates the child was likely not infectious. there was no known contact with any infected animal, but officials are investigating a possible exposure to wild birds. now to reporter mindy gaither with a closer look at this viral respiratory disease and what you can doo prevent it. >> the latest cdc data confirming 52 cases of bird flu in people since april. >> as we think about a virus that might move from animals into humans and potentially cause the next pandemic, it certainly has everyone's guard up. >> ohio state epidemiologist andrew bowman says this latest strain of the virus came over to the u.s. in 2021 and has spread through wild birds in north america. so far in the u.s, those who have tested positive have had mild symptoms like eye redness or discharge and mild upper respiratory symptoms. the

anytime soon, if that's what you're thinking about. all right, so obviously we got the weather situation here before the newscast. spencer was giving me the definition and the difference between bomb cyclone and atmospheric river and my takeaway was a lot of rain. >> so that's why spencer is the one. exactly. >> not you. yeah. >> well the bomb cyclone to which you refer is tapping into the atmospheric river and making it flow in our direction. so that's the quick explanation of how these two are working together. here's the satellite radar composite image. and you can see that storm circulation circulating there right off the pacific northwest coast and is producing heavy rain in many coastal areas of washington, oregon and down into northern california as well. and here comes that flow, that plume of moisture that will generate a lot of rain into the bay area over the next few days. right now, we're looking at really calm conditions. wind speeds are under ten miles per hour over most of the bay area. skies are cloudy, though, and the wind is not far away. here's the view from mount tam 54 degrees in san francisco right now. mid to

upper 50s at oakland, hayward, redwood city san jose stands at 6352 at half moon bay. it's cloudy at the golden gate, and we're looking northward here. of course, that's the direction from which the storm will flow. 55 right now in santa rosa. 52 petaluma, mid-fifties at napa, fairfield and livermore, and 58 at concord. and let's take a look at our forecast headlines. tomorrow. the atmospheric river arrives. the strongest impact of this period of stormy weather, especially tomorrow, will be in the north bay and through the weekend we expect a series of rainy days. so here's the storm impact scale, the exclusive abc seven storm impact scale. this storm for tomorrow is a level two storm of moderate intensity, producing heavy rain and possibly flooding in the north bay, mainly gusty wind and light to moderate rainfall in other areas outside the north bay. forecast animation starting at 11:00 tonight shows the arrival of that first wave of rain by about 7:00 tomorrow morning. it will be wet all across the north bay by then, and the rain will reach south and east to other areas, but it will be

mainly a north bay event. you'll see it lifting back into the north bay later tomorrow and for much of thursday, rainfall totals will generally be under an inch in locations south and east of the golden gate. but look at the north bay, where we expect rainfall totals by 4:00 thursday to range anywhere from about just over three inches at santa rosa to nearly seven inches at clear lake. as a result, you can see why we have flood watch in effect for the entire north bay from 4 a.m. tomorrow to 4 a.m. saturday. flooding is possible, and creeks, streams and roads and we have a wind advisory in effect from 10:00 tonight to 6 a.m. thursday for all of the north bay and the bay shoreline. and the coast winds will generally be out of the south at 20 to 30mph, with gusts to 45mph. and in the sierra, a winter storm warning in effect from 10:00 until 10:00 tomorrow, i should say tomorrow night above 4500ft. we expect about 10 to 12in. at 10 to 20in of snow, 2 to 4ft in the higher peaks. and of course, the gusts. wind gusts up to 55mph. overnight

melendez. joining us now with one example of how our current laws and lack of treatment facilities affect not only the individuals, but housed residents as well in these scenarios. you're right. >> and it's so frustrating because i think everybody in san francisco, most people want these people who have mental health issues to get some kind of help, right. but what happens right when you do everything right and the system fails? we found some neighbors who have been caught in the middle of a struggle to get one person the help they need. these neighbors often feel like they are the ones paying a price. few of us will ever understand what goes on in the minds of someone with a mental illness. but most of us would agree that living on san francisco streets in these conditions should be categorized as inhumane. and so we call attention to 39 year old william eaton. we've never met him. >> he's just an aggressive person. he'll, you know, he would camp out in people's front yards.

>> eaton goes by the name sapphire. >> and sapphire is an unhoused individual who spends a lot of time in the castro. a lot of time in a triangle and dolores heights. >> eaton claims to be a shaman. he has been in court several times for burglary, destruction of property and setting things on fire. >> he just runs through and destroys tons of plants. it's just a lot of vandalism for years and years, most of those charges have been misdemeanors. >> eaton is not unlike other unhoused people in san francisco, living on the street with severe mental issues, except that things began to escalate with neighbors. >> what happened with me was i was out one morning early, one morning, and he tried to get into my house and luckily the door was locked and my wife called me and she said, what do i do? i said, call 911. by the time i got back here, the cops had him in handcuffs and so on, and i said, well, that's it. that was in december, late

december of last year. and i said, that's it for me. that's it. i've been involved with the neighborhood. >> you said, that's it for me. >> that was it. i'm going to i'm going to take action and i'm going to start the restraining order process. >> rob cox says eaton is not allowed within 100 yards of his property in the castro. another neighbor who lives in nearby dolores heights, also took out a second restraining order against eaton. has he violated the restraining order? >> at least four times? really? at least four times. i've had him rearrested at least four times. >> police say eaton is one of many people with mental health and drug issues caught in the courts revolving door. last may, after he violated the restraining order, the judge told him he had to attend anger management classes and comply with the treatment plan. that never happened. >> its most recent arrest was at the randall museum on an arson charge. >> that was october 23rd, and eaton now faces felony charges. the district attorney's office asked the judge to keep him in

custody. the judge, kenneth win, agreed, but one week later, eaton was released on his own recognizance and ordered to report to assertive case management. five days a week to start treatment. here's what the district attorney told us. quote, we objected to the release because of te public safety risk the defendant poses. he has been ordered to assertive case management not once, but several times. yes, that's pretty standard. yeah. okay. but here we are. he's still not getting the help he needs. well, he's he's he's refusing the help that he needs. >> we can't we can't we can't force him into mental health treatment. right. >> so the last one, the assertive case management, the judge in that case said, okay, you have to report five times a week. he's not going to report five times a week. >> i mean, that's the court's side of it, which i'm not really a part of in terms of the checking in. >> absurd to think that he's going to show up. yeah. the

intention of the legal system is not to punish those like eaton, but to offer help. except that the city is not set up to address this complicated problem. no one knows that better than the executive director of the department of emergency management, whose job is to coordinate operations to address encampments and offer people services. how difficult is this problem? >> yeah, well, i mean, we don't have an ability to just force people into treatment. and even when we should, we i mean, i think that we should have know, i wish that we had stronger laws to help people to get to a better place. we don't have the beds. enough of those locked beds to take them to, and we don't have state resources for that either. >> eaton was arrested again and

back in court on november 12th for violating his restraining order. this time, another judge, brian stretch, agreed to keep him in custody, but eaton was accidentally released from jail due to a snafu by the court. when we asked what happened, the spokesperson for the superior court told us, quote, no comment. now, back out on the streets. eaton was expected to report to court on monday. we waited to see if he would appear. he didn't. >> and i feel bad for sfpd. i'm very close with the beat cops in the neighborhood. you know, they do their job and it's like, okay, this is this is who's not doing their job. i just think the courts aren't doing their job, but i think it's hard for them to do their job because there's no there's nowhere to put these people. so where do you put them? yeah. and that's the big question. >> that's a big question. now william eaton failed to show up in court. you saw that there, right there. and then the judge

is selling homes for $1. the island has been trying to persuade people to move there. after decades of depopulation. now the dollar homes are admittedly run down, but there are some move in ready homes as well, and those cost about $105,000. who's who's ready to plunk down their dollar? >> i mean, that's a great deal, considering i'm sure you saw the news about that $300,000 home that was beat down here in san francisco. so for a dollar, you know, maybe a vacation home, you know, really don't want to move to italy, but then how much would you have to invest in it to make it worth traveling to for a vacation? >> but i love italy, though. like, yes, yes, all things italian. >> if spencer is saying no to $1 italy home, you know the upkeep is probably too much and

is ready, says spencer christian. >> a lot going on here in the weather department. it's a level two storm for tomorrow. a storm of moderate intensity bringing heavy rainfall, possibly some flooding in the north bay. gusty wind. light to moderate rain elsewhere. you can see that most. well, all parts of the bay area will get some rain from the storm tomorrow, but the north bay will be hardest hit by 4 p.m. thursday. we're looking at over six inches of rain, possibly in the northernmost part of our viewing area as a result. a flood advisory in effect for the entire north bay from 4 a.m. tomorrow to 4 a.m. saturday, and we have a wind advisory, also in effect for the entire north bay. and the bay shoreline and the coast. that's from 10:00 tonight to 6 a.m. thursday. gusts may reach or exceed 45mph, and a winter storm warning for the sierra. i should add that as
