[ laughter ] >> whit: my poor 49ers. it was rough out there. >> rebecca: it was rough but kind of fun to see the whole thing go down. the buffalo bills stadium was packed with snow and fans had to dig their way out to watch the game. we're gonna get more on that game and the winter weather emergency. trevor ault and ginger are standing by. >> whit: just tell me when it's over. i'll open my eyes. lot to cover this morning. also ahead after a busy holiday travel weekend we have new details on the woman who snuck onto a delta flight from new york to paris. >> george: you wonder how that is even possible. first president biden's decision to issue a blanket pardon for hunter a reversal from promises he made during the campaign. chief white house correspondent mary bruce starts us off.

good morning, mary. >> reporter: good morning, george. this is something president biden and this white house were adamant that he would not do, but this morning with just weeks left in office the president is now protecting his only living son with a sweeping pardon. overnight a sudden reversal. president biden issuing a full and unconditional pardon of his son hunter, ending a legal saga that the president now says was politically motivated. biden had long promised he would not interfere with his son's cases, telling our david muir in june such a pardon was not an option. >> will you accept the jury's outcome, no matter what it is? >> yes. >> have you ruled out a pardon for your son? >> yes. >> reporter: but now biden said he believes his son was unfairly and selectively prosecuted writing in a statement no reasonable person who looks at the facts of hunter's cases can reach any other conclusion than hunter was singled out only because he is my son, and that is wrong. the president accusing his

political opponents of trying to break hunter who has been sober now for over five years saying in trying to break hunter they tried to break me, and there's no reason to believe it will stop here. enough is enough. >> i'm extremely proud of my son hunter. has overcome an addiction. he's one of the brightest, most decent men i know. >> reporter: hunter biden was convicted in june on federal gun charges for lying on a federal form about his drug addiction when he bought this colt revolver in 2018. in september he pleaded guilty in a last minute deal to nine tax related charges accused of avoiding paying $1.4 million in taxes while living lavishly. taxes he has since paid back. he was scheduled to be sentenced this month potentially facing more than a decade in prison. but now hunter, seen with his father over this past holiday weekend, will face none of that. the president's pardon is sweeping covering not just those charges but any uncharged crimes

between 2014 and 2024. for months the president intentionally avoided commenting on the specifics of his son's cases not wanting to give the appearance of interfering. instead stressing his support for hunter as a father. >> i love him and he's on a straight and narrow and has been for a couple years now. i'm just so proud of him. >> reporter: at the white house aides were emphatic that the white house would not step in on his son's behalf. >> we've been asked that question multiple times. our answer stands, which is no. >> reporter: but now the president said, here's the truth. i believe in the justice system. but as i have wrestled with this, i also believe raw politics has infected this process and it led to a miscarriage of justice. adding i hope americans will understand why a father and a president would come to this decision. the about face comes just weeks before president-elect trump is set to take office. trump has vowed retribution against his political opponents and has repeatedly bashed hunter

and the biden family, accusing them, without evidence, of corruption. president biden clearly did not want to leave his son's fate in the hands of trump's justice department, now in a statement and a post trump said the pardon is the miscarriage of justice here. in a statement his spokesman argues the president's move underscores trump's claim that the justice department has been weaponized saying, quote, that must be fixed and saying that is what trump intends to do when he returns to the white house. >> george: let's bring in dan abrams. saw the president's words there called it a miscarriage of justice saying hunter was selectively prosecuted. is that a good argument? >> he has an argument, but he certainly has an argument with regard to the gun charge, right? there has never been another federal charge of someone charged under this set of facts. meaning the gun wasn't used in more than one crime. the person had no criminal record. the gun wasn't used in a crime. >> george: that's the definition

of selective prosecution. >> correct. you can argue with regard to the gun charge. now, the issue is the that the gun charge got passed on in connection with the plea agreement that initially fell through. the tax cases is a little tougher. yes, it's true, that in a lot of cases when someone doesn't pay their taxes, they're allowed to pay them back. at worse they get a fine. it's also true people get prosecuted for not paying their taxes. so it's a little squishier with regard to the tax charge as to whether this was clearly selective prosecution. >> george: how about the idea this was a blanket pardon, protecting his son for anything that might have happened since 2014? >> that is certainly as sweeping as you can make. there's an argument he could have done something much more limited, meaning granting clemency. that would have meant the convictions stand but with regard to sentence, he doesn't get any jail time, there is no sentence. that's what clemency could have done. he didn't do that.

he granted him pardon on the two charges, plus on anything he could conceivably be prosecuted for. >> george: out of here he might be prosecuted. >> there are a lot of people, on the right in particular, who have been talking about crimes they wish hunter biden had been charged with, that he should have been charged with, etc. and i think that's the reason that that one happened. it's interesting when you hear the president's team, president-elect's team talk about the department of justice and weaponization. little tough to say that because this department of justice is the department that went after hunter biden. it's now the president stepping in to protect hunter biden from his department of justice. i think it's an important point to remember in this context. >> george: it is. dan abrams, thanks very much. >> rebecca: thank you. speaking of the president-elect trump's team, we have new information about his plan to choose kash patel to lead the fbi. it's an organization he has fiercely criticized. rachel scott's in washington with more. good morning, rachel.

>> reporter: rebecca, good morning to you. this is another controversial pick coming from president-elect trump. kash patel is a loyal trump ally. he has vowed to shut down the fbi headquarters here in washington and nomination to lead the agency already setting the stage for a bruising confirmation battle. this morning president-elect trump making good on his campaign pledge, calling for radical changes at the fbi, selecting one of his fearest loyalists kash patel to lead the agency. >> he's tough, he's smart, he loves this country and he is a warrior, kash patel. >> reporter: he served as a public defender and department of justice prosecutor has been an ally to trump for year, appearing at his criminal trial in new york. he's known as a hard liner who's called for shutting down the fbi headquarters in washington and in his book writing, drastic measures need to be taken and democrats should be very afraid. patel has spread false claims about voter fraud, january 6th and accused the so called deep

state for targeting trump. >> i want them vanquished from washington, d.c. and government service forever. >> reporter: and he has vowed to go after trump's adversaries in the federal government and the media, too. >> we will go out and find the conspiracies not just in government but in the media. we're going to come after you. whether it's criminally or civilly, yeah. we're putting you on notice. >> reporter: he was a vocal critic of the investigation into trump's ties to russia. during trump's first term, he served on the national security counsel before roles as the deputy director of national intelligence and pentagon chief of staff where he tried to push false conspiracy theories about the 2020 election. trump even talked about making him deputy fbi director in 2020 and then attorney general bill barr opposed the move so much, said it would only happen, quote, over my dead body. he could face a challenging confirmation process. first trump would have to fire the current director of the fbi, christopher wray, who he appointed to serve a ten year term. the fbi said wray remains focused on the work.

>> rebecca: all right, rachel. there are also questions about trump choosing two in-laws for influential post. >> reporter: over the weekend he appointed family members to key positions including the father-in-law of his daughter tiffany to serve as an adviser to the middle east. he also selected the father-in-law of his daughter ivanka to serve as the next ambassador to france. trump, of course, pardoned charles kushner after he plead guilty to tax evasion. >> rebecca: rachel, thank you. whit? >> whit: now the heavy snow in the midwest and northeast coming just as millions are driving home after thanksgiving weekend. three to five feet of lake effect snow falling in parts of the midwest and western new york. trevor ault is in watertown, new york, where, trevor, the impact of that storm clear all around you there. >> reporter: yeah, absolutely, whit. we've been watching them digging out this morning. look how much is piled up. this is the streets of downtown water town. just to our east in some areas

they saw 58 inches of snow. particularly lake effect snow which we've seen coming off multiple great lakes fueled by the fact that the water in those lakes is the warmest they've been on record. >> looks like they split off this ramp. >> reporter: over the weekend, millions of americans hammered by lake effect snow. snow alerts issued in seven different states, with three to almost 5 feet of snow blanketing towns in new york and pennsylvania. >> wow, look at that. >> reporter: in watertown, new york, off lake ontario, more than three feet of snow fell, with drivers stranded along i-le 1. we're in the midst of one of those lake effect snow bands in watertown. there is already several feet of snow here. you can see why it piles up so quickly because of how thick these snow flakes are. plows working to keep road conditions safe. the buffalo bills stadium packed with snow. fans digging out their seats and plows working to clear the field before kickoff. in pennsylvania, governor josh

shapiro signing a disaster emergency proclamation as parts of erie county were slammed by more than two feet of snow. roads and vehicles left buried. >> stay home, stay home, stay home. >> reporter: the national guard assisting with evacuations and rescues of trapped drivers, also performing transportation for essential health workers. >> my doors will not open. >> reporter: kim is snowed in and said conditions are posing major challenges. >> they did bring a plow down the road but the plow got stuck at the end of the road. >> reporter: and with all this snow on the ground, the temperatures this morning are very cold, only about 10 degrees right now, which means this snow will stick around for quite sometime. the region may be in for another blast of lake effect snow coming up later this week, george. >> george: trevor, thanks. ginger, what's going on here? >> ginger: as our climate warms we will be seeing in the short term more lake effect snow because there will be less ice on the great lakes because that shuts it down. so the season will be longer. we also have the warmer

temperatures. so the difference in temperature between the cold air coming over and the warm lake will make more snow, in the short term again. long term is gonna change. look at this. winter storm warnings still up for all of the west coast there of michigan into, say, erie, where one to two feet south and east of erie. syracuse is getting one of those heavy bands. most of this is for the next 24 hours. then we'll take a break and get back to it by the end of the week. lot of the cold air goes down south. ocala, florida, in a freeze warning. jacksonville around 32. these are not record lows but they are certainly cold. we'll get another chance of getting chilly by the time the next storm comes through midweek into thursday morning. >> rebecca: get those shovels ready. okay, ginger. thank you. we turn to news breaking overnight. a missing 21-year-old american israeli soldier has been confirmed dead. our chief global affairs correspondent martha raddatz has the latest and new calls for a hostage deal.

good morning, martha. >> reporter: good morning. his family has spent more than a year hoping, believing that their son might still be alive but overnight getting the official word. omer neutra was a native of long island, new york, serving in the israeli defense force, a tank commander, when he was captured and dragged into gaza during the hamas terrorist attack of october 7, 2023. but this morning the idf confirming the young soldier was killed on that day. the news comes just days after the release of a new hostage video of an american israeli. a 20-year-old former new jersey resident. adan alexander, now held hostage for more than 400 days. >> i am an american-israeli citizen currently being held captive in the gaza strip. >> reporter: speaking under duress in the heavy edited footage, alexander calling on the people of israel to pressure israeli prime minister benjamin

netanyahu and president-elect trump to negotiate a hostage deal. his father speaking at a rally in new york echoing his son's plea. >> i stand here after seeing my son alive for the first time in over a year. president biden, president trump, prime minister netanyahu, i call on all of you to act. >> reporter: there are seven israeli americans still held by hamas, three including alexander believed to be still alive in gaza. national security adviser jake sullivan said the white house has been continuously working on a hostage and cease fire deal. >> we are determined to try to move rapidly to get those hostages home, get a cease fire in place. >> reporter: with the cease fire now in place between israel and hezbollah, the white house is more hopeful that a deal could be made with hamas but they have had hopes dashed many times before. whit? >> whit: that's right.

still some optimism there. martha raddatz, thank you. we move now to a new round of food recalls, this time over salmonella fears in eggs and cucumbers. eva pilgrim is here with details on that. good morning. >> reporter: good morning, whit. two major salmonella recalls affecting two different types of food. one eggs, the other cucumbers. the eggs from costco sold under the kirkland band organic raised 24 count. they were sold at 25 locations. in total more than 10,000 packages have been recalled. to see if your eggs are affected just look at the side of the carton. those with the code327 are under recall. the second recall, cucumbers. these are from sun fed. these are whole american cucumbers sold between october 12 and november 26. so far 68 people have gotten sick across 19 states, 18 people hospitalized. they have a sticker that says sun fed mexico.

transportation correspondent gio benitez here with the story. >> reporter: it is just a stunning story. the woman somehow skipping the i.d. check, actually going through security and bypassing the gate agent flying to france, only discovered because she kept going to the lavratory without going to a seat. this morning as the tsa is expected to have screened more than 18 million people during record breaking holiday travel, we're learning new details about the woman who snuck onto a delta international flight. french officials telling abc news the suspected passenger is a russian national who did not have valid travel documents to enter the country. officials attempting to send her back to the united states on another delta flight but according to sources she was removed from the plane after becoming unruly. she remains in france. authorities say the woman is a legal resident of the u.s. cnn reporting she's between 55 and 60 years old and had applied for asylum in france a few years before. >> i think the investigation has to take into account her

background, a russian passport. it rings bells but doesn't have any answer to the central question. how did she pull this off and what was her motivation? >> reporter: it was last tuesday when pilots from the delta flight made this startling announcement after crew members realized there was an illegal person on board. >> folks this is the captain. we're just waiting for the police to board. >> reporter: she completed security screening later slipping past a delta gate agent to board the plane for paris. rob jackson, who was on the flight, said he overheard crew members discussing the stoweaway. >> assumption was made that she must have been hiding in one of the lavratories when he departed and during a flight she was seen moving from one lavratory to another. not ever going to a seat. >> reporter: delta is conducting an exhaustive investigation into this major security breach. this morning we still don't know

while living lavishly, taxes he has since paid back. he was scheduled to be sentenced later this month in each case, potentially facing more than a decade in prison. but now hunter, seen with his father over this past holiday weekend, will face none of that. the president's pardon is sweeping, covering not just those charges, but any uncharged crimes between 2014 and 2024. now president biden comes just weeks before donald trump is set to take office. the president clearly didn't want to leave his son's fate in the hands of trump's justice department. trump has vowed political retribution against his political enemies and has repeatedly attacked hunter and the biden family. over night in a post donald trump saying it was the pardon was the abuse and miscarriage of justice. rebecca? >> rebecca: thank you. now the subway choke hold case. closing arguments are expected this morning in the manslaughter trial of daniel penny, the marine veteran, accused of

killing an unruly passenger last year. senior investigative correspondent aaron katersky is here with more. >> reporter: this trial raises questions of race, mental illness, homelessness and safety in the subway. but for the jury, there is only one question. did daniel penny go too far? the marine veteran's fighting manslaughter and negligent homicide charges in the death of jordan kneely. he was a homeless man making threats on the subway last year. penny did not testify, but the jury heard him on video saying he jumped in to deescalate the situation because neely was frightening passengers. prosecutors conceded penny may have had lawedable intentions but said his actions became criminal when he held his neck for way too long. nearly six minutes. defense argued neely died from a genetic condition and drug use. it's all a lot for jurors. they all ride the subway regularly. if penny is convicted of manslaughter, he could face up to 15 years in prison.

whit? >> whit: aaron katersky, thank you. now a big change for passengers on southwest airlines, which says crews will start wrapping up in flight service earlier in an attempt to prevent injuries. our transportation correspondent gio benitez is back on that. got to finish your drinks and snacks early. >> so we've all seen videos of passengers and flight attendants injured in turbulence. now southwest will begin preparing for landing earlier starting wednesday. that means buckling up about ten minutes earlier than before including putting away tray tables and electron eubgs. on southwest, this will begin at 18,000 feet instead of 10,000. southwest said this is part of a collaboration between labor partners and safety teams. overnight we spoke with united airlines which told us they made a similar change a year ago preparing for landing at 10,000 feet instead of 8,000. the faa telling us it has a long history of working to prevent turbulence history. it was an airline change. we don't know if other airlines will be following southwest in
