mendez's home, more work crews are trying to deal with a broken sewage pipe. she had absolutely no idea what was going on. nancy katasha del prado didn't have a clue either. >> oh my gosh. i don't think the people around here know about it. we haven't received any notice. >> the del diablo sanitation district says it found the break on monday. >> we basically identified a local corrosion hotspot in that pipeline. so that caused the failures. >> the pipe carries wastewater to the treatment plant. about 1 million gallons of raw sewage per day has flowed into the surrounding marshland between port chicago and pittsburgh. >> it's on private property owned by the navy. it is actually not running into streets. it's actually going into the adjacent marshland, which is about a quarter of a mile from the edge of the delta. >> delta, diablo says. so far, there isn't any sign of damage to the environment. >> there's not any direct evidence of, you know, fish kills. >> the delta diablo sanitation district says the leak isn't impacting the residents around

here, but we can definitely smell something in the air. what does it smell like to you? >> it's really strong. it's like decompose or like a lot of waste. it smells really bad now. >> delta diablo says crews have been working around the clock to repair the sewer line. as for the trucks in front of gallinas home, we've had 8 to 9 trucks sucking wastewater out of our sewers for the last 24 hours to mitigate the continuing overflow volume. the sanitation district is also installing a pipe aboveground. it's a mile long backup line that will give us the opportunity to opportunity to inspect the remainder of the pipeline to see if there are other sections that need to be rehabilitated in contra costa county. suzanne phan abc seven news. >> bit of a hazy day around the bay area today. >> it was, but not enough to warrant a spare. the air alert. meteorologist sandhya patel is here with a look at the conditions. sandhya. >> yeah. and dan. and let's take a look at a live picture. right now from our east bay hills camera. good evening everyone.

look at this. this is priceless. i mean, you can see for miles not so priceless as our air quality. it is moderate uh- indicated by the yellow dots across many parts of the bay area. as we do have a stagnant air mass. the winds are not helping. they're pry light right now, 15 at most for hood mountain. so the air quality will suffer again as high pressure is overhead. moderate the next couple of days for most of you. south central bay will go to good on friday. here's a live view from golden gate bridge camera visibility is good. oakland downtown. another record high day, 70 degrees. it was in the 60s, from santa rosa to san francisco to concord, but above average. 72. redwood city 70. in san jose. looking at those temperatures right now, 62 in san jose, upper 50s san francisco, concord, oakland, 52 degrees. right now in calistoga. it's not going to cool off much. as a matter of fact, look at the hourly temperatures. they're barely dropping into the 40s and 50s at 10 p.m. tomorrow morning starts out cloudier with some patchy fog, and tomorrow afternoon we'll

brighten it up. another mild one is on tap. i do have rain chances in the forecast. i'll be back with that in a few minutes. >> dan, we need that. sandhya. thank you. developing just in the last hour, officials now say two boys, one five. the other six were shot at a small religious school in butte county this afternoon. the shooting happened around 1 p.m. at the feather river adventist school. it's a private school where, with fewer than three dozen students in grades k through eight. deputies arrived to find the gunman dead near the playground after apparently shooting himself. the sheriff says the man had met with the principal earlier in the day to talk about enrolling a student. a few minutes later, screams and shots were heard. >> we have received some information that he may have targeted this school because of its affiliation with the seventh day adventist church. >> the fbi is on the scene, of course, investigating. as for the two boys who were shot, their conditions are unknown. we will continue to follow the story and bring you updates just

as soon as they come in. >> investigators are searching for an attacker who left a woman tied to a tree on a hiking trail in pebble beach. a hiker found the woman tied up on the trail near hall road. that's about a mile and a half north of sun ridge road. it was this morning. the victim told investigators she saw the suspect earlier in the morning and warned another female hiker, telling her te man seemed suspicious. deputies say after the two women parted ways, the suspect approached the victim. >> the female victim noticed that the male, suspicious male got a little close to her. she attempted to let him pass by and as he got close to her, he produced a handgun and basically walked her over to a tree and proceeded to tie her up to that tree. >> and the victim described him as being in his 30s, with a unique tattoo on his neck that began with the letter z. >> the jury now has the case in the bob lee murder trial. deliberations wrapped up this afternoon without a verdict. they will be back at it again

tomorrow. lee was the founder of cash app. he died after being of stabbed last april in san francisco. abc seven news reporter melanie woodrow has been in court throughout the trial every day, and has the latest. >> defense attorneys are hoping that video they played for jurors of bob lee allegedly doing drugs off of a knife. hours before his murder, will introduce enough doubt into jurors minds about the origin of the murder weapon for them to find nima momeni not guilty. those 12 jurors must unanimously find momeni guilty or not guilty of first degree murder before they can potentially consider a lesser charge of second degree murder. similarly, they must unanimously find many guilty or not guilty of second degree murder before they can consider the lesser charges of voluntary or involuntary manslaughter. if they can't come to a unanimous decision on a higher charge, they must inform the judge. jurors may not use the internet during deliberations, but they can examine all of the exhibits. in this case. >> i've got nothing but the

of a 90 minute lunch break. the judge also telling them she has the utmost faith in them. reporting outside of the hall of justice in san francisco melanie woodrow, abc seven news. >> thank you for the latest on that. now to new developments. oakland city leaders are laying out the timeline of replacing recalled mayor sheng tao. she is the first mayor in oakland's history to be recalled by voters. the alameda county registrar of voters should certify election results tomorrow. about two weeks later, the oakland city council will formally accept the results. then current city council president nikki fortunato bass will become interim mayor, but she just won the race for a seat on the alameda county board of supervisors. so next month, she's moving on in january. a new city council will be sworn in, and they will pick the next city council president, who will become the new interim mayor. it's a lot to follow. a special election won't be held until mid-april. the interim mayor will serve until the winner of that special election is sworn in. all of this unfolds as oakland faces a historic budget deficit. >> i also want to say very

84 page report finds gun violence is the leading cause of death for kids in the county. according to the findings, an average of three. alameda county residents were killed by guns every week between 2019 and 2023. the county board of supervisors voted to declare gun violence a public health emergency in 2021. >> another politician potentially facing a recall is san francisco supervisor joel engardio. some people living in his district are upset. he supported proposition k. it permanently closes the upper great highway to cars between lincoln way and sloat boulevard. it was a close race. the votes were 55% in favor, 45% against. abc seven news reporter tim johns is following the story. >> like many residents in san francisco's sunset neighborhood, albert chow is upset after city voters passed proposition k,ity shutting down a two mile stretch of the great highway. chow worries it will have a negative impact on both his neighborhood and his business. >> you close a vital artery like the great highway that does anywhere between 14 to 20,000

commuters. a day, and put them onto the other two north south lanes, or when they get frustrated with those two north south lanes, they end up going through our streets. >> chow, like many residents in this area, places a lot of the blame on his district four supervisor, joel engardio. the frustration culminating on tuesday when several residents launched an effort to formally have engardio recalled over his support in shutting down the great highway. >> i'm focused on finding traffic solutions given the situation that we're in today and making sure people can get where they need to go. >> engardio says while he supports residents right to organize a recall, he wants voters to consider his stances on a variety of issues and not just prop k. he also tells me he wants to have conversations with recall supporters and hear their concerns over traffic and other issues. >> city supervisors have to represent our districts, but we also need to represent the city as a whole, and it's impossible for one city supervisor to be in agreement 100% of the time on every issue, just to give you an idea of why so many people in

monica madden is here with us. and you were there for bonta's announcement today? yes. >> and this is all really setting the stage for a fight between blue states and the federal government. and that isn't necessarily welcomed by everyone in the golden state. historically, the courts do side with the federal government on matters of immigration enforcement. but bonta says california has ways to resist. legally, the incoming trump administration vowing mass deportations of undocumented immigrants. >> i got a message to the millions of illegal aliens that joe biden's released in our country, in violation of federal law. you better start packing now. >> with promises of retaliation against states that don't comply, you will say, gavin, if you don't do it, we're not giving you any of that fire money that we send you all the time for all the fire forest fires that you have. california attorney general rob bonta punching back. >> we're not going to spend our time, our money or resources going backward, pointing to a 2018 sanctuary state law that instructs local officials not to cooperate with ice agents in

identifying undocumented immigrants. >> it also prevents law enforcement officers from asking about a detained person's immigration status. federal law requires officers to share that information if asked by ice agents how to prohibit the unauthorized collection or disclosure of information that might indicate an individual's or family's citizenship or immigration status, saying non-disclosure of intel about immigrants does not violate federal law and will allow immigrants to keep using california's public spaces like libraries, hospitals, courthouses, and schools should be available for all without fear of civil immigration enforcement. >> not everyone agrees they can come into the country legally. if they're true asylees they go to a port of entry and declare you make a declaration of asylu. but unfortunately, many of them are going to have to go back. >> sf gop chairman john dennis chalking it up to politics. >> immigration. naturalization is completely in the purview of the federal government, and this

oakland set a record today at 70 degrees. it was pretty mild to warm. no matter where you look to the city, 6572 redwood city, 70 livermore, san jose 69, santa rosa 68. in san rafael, these temperatures running above where they should be for this time of year. so let's take a look at the santa rosa almanac. the airport came in at 69 degrees. average is 59. so a good ten degrees above average. same thing with livermore. livermore is average is 59 degrees. you were 11 degrees above where you should be for this day in december. today, coming in at 70 degrees, this dry pattern is going to continue. we've got this blocking high that is sending that storm track up into canada. and that ridge isn't going to budge immediately. in the meantime, we do have some hh clouds that have been streaming in. we'll continue to see those increase as the night goes on. a live view from our okay camera. and it's looking good right now. oakland 59, san francisco 58, san jose 62.

$800 million budget deficit. late today, we learned san francisco's budget committee agreed to a partial funding increase of $3.7 million. that is less than half of the 7.8 million the mid-market tenderloin community based safety program was hoping to receive to keep programs running through the end of june. the full board of supervisors still has to weigh in on the funding. now to a story that's capturing headlines across the country today, the ceo of the major insurance group, unitedhealthcare, was killed in what new york city police are calling a brazen, targeted attack. so far, no one has been arrested and officers are working feverishly to track down the gunman. abc news reporter reena roy has the latest on this developing story. >> an urgent investigation underway in the heart of midtown manhattan, where police say unitedhealthcare ceo briany thompson was shot and killed wednesday morning. new surveillance video shows the moments the violence unfolded. police now reviewing the footage as the search for the suspect intensifies. >> i want to be clear at this

time, every indication is that this was a premeditated, pre-planned, targeted attack. >> investigators say the suspect wearing all black and a ski mask, waited until the 50 year old showed up at the hilton hotel for an investor's conference. >> the suspect approached from behind and fired several rounds, striking the victim at least once in the back and at least once in the right calf. many people passed the suspect, but he appeared to wait for his intended target. >> three shell casings found at the crime scene, along with live rounds from a nine millimeter gun. at one point, police say the gun appeared to jam, and when the shooter cleared it, he began shooting again. the murder happening not far from tonight's tree lighting at rockefeller center. they're also conducting interviews in thompson's home state of minnesota. >> we're reaching out to law enforcement in minnesota, and we're also interviewing his coworkers and family members to see if there have been any

specific threats against him in the past. >> unitedhealthcare is the health insurance wing of unitedhealth group, the largest health insurer in the world. the company releasing a statement saying they are deeply saddened and shocked, saying brian was a highly respected colleague and a friend to all who worked with him. there's still no word on a motive. thompson's wife tells abc her husband was a loving father to two sons, and their family is shattered. they're requesting their privacy be respected during this difficult time. reena roy, abc news, new york hard to believe it, but tomorrow is a month since election day. >> california will certify its final results next friday. in the bay area's nine counties, turnout of registered voters averaged almost 77%. statewide, turnout was about 71%. it hasn't actually been that low for a presidential election since the year 2000. that was the year george w bush narrowly beat al gore. nationwide, all 435 races for the u.s. house have now been projected. the final abc news estimate is 220 republicans, 215

her is overcapacity and it's leading to an increase in stays for animals as well as poor living conditions. a city audit made 39 recommendations on ways the shelter can make improvements or changes to get animals adopted. and abc seven news south bay reporter dustin dorsey takes us to a new center that will help do just that. this holiday season, as many are finalizing their wish list this holiday season, there's an easy top choice at the san jose animal care and services shelter. >> we're going to get you a home. >> we are bringing a gift home this holiday season. i'm telling you, it's not going to just change their life. it's going to change yours. >> and this year, it's never a y friend thanks to this new pop up shop. about a dozen animals will

be available here this month every friday, saturday, and sunday from noon to six with no adoption fees. >> we have a lot of foot traffic here. a lot of people who live in or pass through downtown. and so being more present, being more accessible and just making it easier for people to consider adopting a pet is really the spirit of this better community access and a path to adoption is one of the 39 recommendations for improvements from a city audit that highlighted poor care for the animals. >> another is lowering stress levels, which director of public works matt lesh says this center will help with as well. >> get them out into more open space where less dogs are barking so it's a quieter place, and so they can help lower down, some of their stress. and that would also then provide the advantage by bringing them here. they're distressed, but then also provides more space and capacity at the shelter for them to decompress. >> there's a lot of stress at the shelter, both for the animals, which are well over capacity, according to the audit and for the staff having to manage various issues, including an investigation into the death

of a dog tuesday night after a neutering surgery. mayor matt mehan says the city has invested money and resources, but the audit shows them what else needs to change. >> we will need to see the management team at the center step up and deliver on the 39 recommendations that the auditor outlined. we'll be looking at that very closely. and in may of 2025, we'll have an update at our neighborhood services committee. >> there's hope for an improvement in conditions at the shelter and plenty of adoptions at this center this holiday season. you're getting adopted, i can tell. in san jose. dustin dorsey, abc seven news. >> so sweet. we hope they all get home well. some deserving south bay students got to take part in a big holiday shopping spree this morning, all thanks to the san jose earthquakes and the shop with a cop foundation. every year, the program takes kids ages 5 to 12 from under-resourced neighborhoods on a shopping trip to pick out christmas gifts. accompanying them are peace officers from the local community, a way to forge

after the mountain fire destroyed her home, the meager resources she's been provided to survive will not prevent her from ending up on the street. candace and her partner david, visiting the conference center in camarillo, hoping to get a disaster relief loan from the federal small business administration, or sba, which set up inside of the building to help victims. yet they've learned bad news. the sba has run out of money and needs congress to appropriate more. >> i mean, we're so thankful that we're okay and we know we're going to be okay. you know, and we you know, we make sure his mom knows the three of us are going to be okay. but it's very scary. >> even if we end up in a tent or in the car, we'll be together. we'll be all right. >> sba officials telling eyewitness news with disasters devastating communities throughout america this year alone, from hurricanes to fires, federal money for disasters has been strained, leaving the sba looking to congress to appropriate more funding, hopefully sooner than later. david frustrated, saying when americans need help following a

disaster, it should be there. how does that make you feel? how are you going to survive now? what? >> i'm not surprised. i'm not surprised. what does that mean? it's a funding. it's a place. other places where i think it should be more in house kind of deal. >> you know, where hard working people who just want to know that we're okay and help others, too. you know, we're both people who love, you know, give back. and we always have. and we just are just shell shocked that to realize that we are not okay. >> mary bradfield with the sba encouraging victims to apply for a loan. and if approved, they'll get the funding when congress hopefully appropriates more money. >> sba is continuing to take the applications. we're continuing to process the loans, and we're getting them as far as they can go so that when the funds are available, we want to be ready immediately. but it is first come, first serve. so i encourage everybody to get their applicants
