patel tracking the chill tonight. and rain for later on this week. i'll have the timeline coming up. >> always live. abc seven news starts right now. >> a nationwide manhunt is finally over, thanks to an eagle eyed diner at a mcdonald's and a rookie officer in the suspect has ties to the bay area. good evening. >> i'm ama daetz, and i'm dan ashley. thanks for joining us. police say they got him. we're learning new details tonight about the arrest of a suspect in last week's killing of unitedhealthcare ceo brian thompson in new york city. >> we are sharing luigi mangione's mugshot because of the intense nationwide interest in this case. he was taken into custody today in altoona, pennsylvania. that's nearly 300 miles from new york. >> and tonight we obtained this video of him in police custody. you can watch as he's taken out of the back seat of the car and escorted into the courthouse by a number of officers. mangione remains in the custody of the pennsylvania department of corrections, pending hisof

extradition to new york. we've yet to receive an update on the timing of that extradition. >> the nypd has filed second degree murder charges and other charges against him. that's according to an online court docket. the docket shows he's also charged with possession of a loaded firearm, possession of a forged instrument, and criminal possession of a weapon. the forged instrument is the fake new jersey driver's license. he allegedly used to check into a hostel in new york city. >> police believe he left new york on a bus and traveled to pennsylvania. the 26 year old was eating at a mcdonald's today when a fellow customer recognized him from pictures released by the nypd. an employee called 911 and altoona police officer tyler fry. six months on the job. that's it made the arrest of a career really new york city mayor eric adams called fryer. >> you know, i just wanted to call and just tell you. thank you. new york is appreciate your heads up policing and doesn't matter what side your patch is on

or what color your uniform is. we have one job, and les make sure americans in new york is safe. >> oh, yeah, and the mangione family released a brief statement that reads in part, quote, our family is shocked and devastated by luigi's arrest. we offer our prayers to the family of brian thompson, and we ask people to pray for all involved. >> so who is this guy, luigi mangione? he does have ties to the bay area. >> abc seven news i-team reporter dan noyes has been looking into his background and shares what he's learned. >> much of the day for law enforcement and for us, has been delving into the background ofen the 26 year old suspected killer, luigi mangione. >> he was born and raised in maryland. we know he has. he has ties to san francisco,as. he has california, and his last known address was honolulu, hawaii. he has no prior arrest. history. in new york. >> mangione has an ample online presence. he grew up in baltimore, graduated from the exclusive all boys high school gilman as 2016 valedictorian. >> luigi nicolas mangione. >> nothing out of the

ordinary as he spoke at a founder's day celebration. >> it's been an incredible journey, and i simply can't imagine the last few years with any other group of guys. >> gilman sent us a statement today. luigi mangione suspected involvement in this case is deeply distressing. news on top of an already awful situation. our hearts go out to everyone affected. mangione went on to the university of pennsylvania for bachelor's and master's degrees in engineering and computer science, and for four months in the summer of 2019, stanford university confirms mangione worked there as a head counselor in the pre-collegiate studies program, writing on his linkedin that he taught artificial intelligence to gifted high school students. his facebook page included several photos of him enjoying the sights around the bay area since 2020. mangione wrote that he worked at truecar, the used car app based out of santa monica, but the company tells me he stopped working there in 2023. there are clues on his social media

that he may have suffered a catastrophic medical emergency. an x ray of a spine with four screws on his x or twitter page. mangione carried other potential evidence when arrested. a ghost gun, a fake id. >> he's also in possession of several items that we believe will connect him to this incident. >> police also found a two page document when they detained mangione, and cnn is reporting some of what he allegedly wrote, citing law enforcement sources. these parasites had it coming, and i do apologize for any strife and trauma, but it had to be done. and this may be another clue. this is my backpack, but it's the same brand and color of the one found in central park after the killing. it'seak design, a san francisco company. each of these contain a serial number where the company can trace the purchase. history. the owner of that company, pete deering, contacted authorities but texted me today. he decided not to give interviews to the media, but he is talking to authorities for the i-team. dan

noyes, abc seven news. >> it's been less than a week since the shooting, and certainly a lot has happened very quickly with today's arrests, particularly, you can see a visual timeline of the case with images of the suspect that helped investigators track him down. it's part of our coverage on abc seven news.com. >> the man on trial for a subway killing in new york city walked out of court a free man today. a jury acquitted daniel penny of criminally negligent homicide after previously deadlocking on a more serious charge of manslaughter. penny faced charges in the death of jordan neely. neely died last year after penny grabbed him and put him in a choke hold. after neely began acting erratically and was yelling at passengers. penny's attorneys said he was acting to protect others from a threat following the verdict. neely's father said the system is rigged. there is still no verdict for penny. he's accused of killing cash app founder bob lee back in april of last year in san francisco. but many testified he acted in self-defense. he faces first degree murder charges, but

jurors can potentially consider lesser charges, including second degree murder or voluntary or involuntary manslaughter. the jury got the case last wednesday. >> all right. we're going to turn now to the weather for a few moments because it is cold out there tonight and some rain is in the forecast in the next few days. >> abc seven news meteorologist sandhya patel is looking ahead for us. sandhya. >> yeah, and ama and dan, bundle up tonight and get your umbrellas out in a couple of days. let me show you the temperatures right now it is 41 degrees in brentwood. you're feeling that chill at this hour? 43 in fremont, looking at the north bay. these are some of the coldest locations. 33 novato, 40, and santa rosa. and in napa, a frost advisory goes up from midnight until 9 a.m. tomorrow. inland valleys and hills covered by this temperatures as low as 32 degrees means frost will form. so as we go, hour by hour, notice those temperatures dropping as we head towards tomorrow morning. below freezing in santa rosa, 31 degrees down near freezing in fairfield and livermore, and looking at live doppler seven starting to look like

an active pattern is ahead. certainly we'll be seeing some rain by wednesday night in the north bay, and then by 10 p.m, spreading across the entire bay area. this is just the start of some more wet weather to come. dan, i'll be back with a full look at the forecast coming right up. >> all right. very good. thank you sandhya. there is new leadership at the alameda county district attorney's office tonight. former da pamela price is gone after being recalled by voters in november. price's chief assistant royal roberts, is now interim da. while it's unclear how long he'll be on the job. abc seven news reporter cornell bernard found roberts is making changes already in the name of public safety. >> as we come in monday morning, i think the page is turning. >> the page has turned royal roberts says it's a new day in the alameda county da's office, just days after the former da left the building for good. >> i'm not pamela price, i'm royal roberts, and i think that there are going to be changes in the way the office moves

forward. >> roberts served as price's chief assistant for two years, although he's got limited experience as a prosecutor, he's appointing those who do. >> i've already appointed three chiefs of prosecution to help with the continuity of prosecution within the office. >> former da price was recalled by voters in november who believe she was soft on crime and insensitive to crime victims. a mandate not lost on roberts. >> i think that the goal is safety, public safety and, you know, what the public should know is that if a person commits a crime and is charged in alameda county, they will be prosecuted. >> families are just they're excited. you know, that there will be a change, hopefully with the next administration. >> brenda grisham led the recall of price, and she hopes the new guard will hold violent crime offenders accountable. >> the da's department, they have a lot of good prosecutors that are there, and we just need him to work with them and get

things done. >> it's unclear how long roberts will be in charge. the alameda county board of supervisors could finalize a process to appoint price's temporary replacement. this week. whoever the board selects as interim da will serve until the county's next scheduled election in 2026. are you running? >> i am not running. >> roberts says he'll fill in as long as he's needed. we asked if price left him with any advice. >> she just said it's your. it's your shop now. i think she realizes that the voters had spoken and we turned the page in oakland. >> cornell, bernard abc seven news. >> things got heated in oakland today during a special city council meeting to discuss the $129 million budget deficit. layoffs are on the horizon and service cuts are looming. listen to the oakland police union vice president. >> the city has become a model city to what not to do. we have businesses leaving on a daily basis. we've lost in and out starbucks, black bear. >> oakland police are being

asked to cut overtime spending by 25 million. there's also the prospect of canceling future police academies and cutting 17 non-sworn officer positions. the oakland fire department may have six fire stations browned out or closed, impacting emergency response arts programs and parks and rec allocations are threatened. $38 million could be moved into the general fund from unrestricted emergency fund dollars. affordable housing self-insurance and soda tax funds. but that's less than a third of the overall deficit. the council will vote on cuts at its next meeting one week from today. >> coming up next, the rescue involved in this fire at an east bay apartment complex. >> plus, a new chapter in te u.s. senate involving the seat belonging to the late

with the honey baked ham company. is what's left after an apartment fire in livermore today. that burned two units. flames sparked in this complex on pacific avenue around 2:00 this afternoon. sky seven was overhead. it captured firefighters, as you see working. they are clearing part of the roof, which was gone. you see there. the livermore fire department says two firefighters had minor injuries. no one living there was hurt and one cat was rescued. the cause of the fire is still under investigation. >> did you feel it? an earthquake hit nevada today, but some in the bay area did feel the shaking. a 5.8 earthquake struck near lake tahoe just after 3 p.m. the epicenter was near yerington, nevada.

that's just east of carson city. as you can see on the map. the usgs has reports from people who say they felt it as far west as san francisco. this earthquake comes less than a week after a major 7.0 quake hit off the coast of humboldt county, causing some minor damage and an earthquake hit near lake county this evening. it's marked by thad dot on this map from the usgs. it measured 3.9 in magnitude. >> all right, let's get a check on our weather. it has been quite chilly, although it was pleasant out today. we've got some sunshine. >> it was lovely with the sun. actually, it was a little cool, but some rain is coming in. meteorologist sandhya patel is here. >> yeah, and we definitely need the rain, that's for sure. so let's take a look at a live picture right now from our exploratorium camera. a beautiful view right now. enjoy this view because it's going to look different come midweek as the rain starts to move in. let's talk about what's ahead overnight tonight. cold night with patchy morning frost. tomorrow we're looking at increasing clouds and wednesday night

going into thursday morning the rain's back. we're going to see breezy conditions here in the bay area a start of an unsettled pattern that is ahead. a live view from santa cruz camera right now. and here's a look at the temperatures. 40 in santa rosa and napa, 34 already in petaluma. fairfield. you're at 38, by the way. fairfield. you started out in the 20s this morning, so it was very cold, no doubt about it. mid 40s concord and livermore. east bay hills. you can see for miles. the visibility is terrific. 51 in the city, 48 in oakland. you're in the 50s around san jose and redwood city is in the 40s. frost advisory once again, midnight to 9 a.m. bring in your sensitive plants. as those temperatures tumble down to the low 30s, we will see some frost. and don't forget about those pets. here's a setup as to why we are concerned about particularly dangerous situation in southern california. low pressure has moved inland high pressure has built in the winds flowing between the high and the low, and southern california is under a red flag warning. extremely

dangerous situation down south developing with the santa ana winds as very critically dry fuels combined with gusty winds and low humidity. wind advisory for parts of southern california going until noon as well. so we're going to go and show you the winds at the lower elevations. it's not terribly windy. it's the higher elevations that are looking at the strongest gusts and going hour by hour, you will notice those winds picking up a little bit into the overnight hours tomorrow morning. tomorrow afternoon san luis obispo 17 miles an hour. but the higher elevations have already seen 4050 mile an hour winds. now here locall, mount saint helena, mount diablo, we've seen those winds 50 plus miles an hour. still gusty offshore winds not nearly as strong. the only thing that's good about our situation is we had so much rain last month that our fuels are moist. oakland hills, 32 miles an hour right now. going hour by hour. the winds pick up a little bit more over 40 at 1:00 in the morning and a half moon bay still gusty to start the day, but then the winds will ease once again. air quality did improve a

little bit today, but we still have good to moderate air quality and the air quality remains in the moderate category for most of you. the next two days south central bay will be good. so do expect some more haze by the time that system gets in and brings us some rain, it will clean out our air mass and clean out our air quality. so that'll be a good thing. but tomorrow morning, down near freezing, 32 napa below freezing in santa rosa and ukiah, 35 in livermore, you're looking at 42 san jose, 40 oakland, san francisco, half moon bay. tomorrow afternoon, mid 50s around antioch. and we're looking at upper 60s in san jose with increasing cloud cover. that leads us to what's going to happen after that. so the clouds increase. here comes the rain wednesday night in the north bay. by 10 p.m. it's spreading across the entire bay area early thursday morning. could see a few showers. now as we look at our rainfall projections. anywhere from about a quarter to just over a half an inch, the accuweather seven day forecast a cold morning will be followed by
