of killing unitedhealthcare ceo, including his connection to stanford. >> plus, we are meeting the interim district attorney for alameda county after the recall of pamela price. details on a big day in that recall process. >> good morning to you. it's tuesday, december 10th. >> yeah. we're going to first check with drew. we know that you've been monitoring what's going on in malibu and then what's going on here as well. >> yeah. so down in southern california, red flag warning in effect here. locally winds are not an issue. it's the cold temperatures this morning. a live look outside from our east bay hills. camera. it is clear out there. a frost advisory is in effect until 9 a.m. this morning for big portion of the region for temperatures as low as the upper 20s this morning. that's where we sit right now in santa rosa. ukiah 29 degrees. need to bundle up this morning. 36 in danville, 34 in fairfield. the heavy coat, the winter hat, the winter gloves. even the scarf to stay warm. so it's cold this morning. later on this afternoon, we do remain dry.

we'll find some late day clouds moving in and temperatures mainly in the 60s. winds stay pretty light all day long, but it's a different story in southern california. we'll take you to malibu. here is malibu. this is where the franklin fire is currently burning. this broke out at 11 p.m. last night. currently under a red flag warning through tomorrow evening. look at the winds right now. 20 to 30mph. and they will continue to remain active through tomorrow evening. let's check in with sue. see those drive times this morning? >> good morning drew. and we are bogged down with a couple of issues. first we had the metering lights on this morning and that filled in rather quickly. so you are delayed about 12 minutes to get to the tolls and anoer 20 minutes or so to get across the bridge with brake lights. now we have two fatal accidents to inform you of. one is in south city, north of san bruno, north 101. all lanes remain blocked with this fatal investigation is underway. they are detouring traffic off to south airport boulevard and

onto 380 to el camino. right now, el camino is looking pretty good, but as we go through the morning, that's going to get pretty jammed. look at all the color there. the only color that's good is green. everything else means very, very slow. so avoid that area if you can. we have another fatal blocking three of four lanes. this one is eastbound 80 at american canyon. injuries and as i mentioned another fatality. so this is going to be quite some time to clear as well. >> all right sue thank you. and as you're waking up this morning we have been tracking breaking news out of southern california, a big fire is burning in malibu. the franklin fire broke out around 11:00 last night. it exploded in size due to extreme winds in the area. and it is already more than 1800 acres. you're looking at video from earlier. we do want to take a live look now at the scene overnight. we know thousands of people were put under mandatory evacuation orders at one point. pepperdine university was

surrounded by flames as students sheltered on campus. classes have been canceled today, though, the fire has burned past the university. now our sister station in los angeles has been covering this all night long. here's reporter monica deanda in the last 30 minutes. >> i want to give you guys a look right now at the firefighters, and you can see them there looking at this hillside between malibu road and pch. it's just really taken off here. and that is because of the wind. you may be able to hear it. it's now howling again. every time that the wind picks up, we start to see this fire just move its way up. the hillside. and that is not what we want to see. but that is unfortunately the situation here. there's a lot of dry vegetation in this area, a ton of trees, a ton of brush, and that is all helping fuel the fire. when we got here about an hour ago, the hillside did not look like this. there was little portions that had these hotspots that were on fire, but now it's slowly but surely connecting. and that is because of the wind. again, right now we're seeing it

pick up and you can see a big flare up right there. and that's what we've continued to see. it started small. it started toward the bottom of the hill. and it's just been working its way up. and you may even be able to see those embers. now you can see them going up just in through the air, past the smoke. and that just goes to show that the velocity of the winds, the strength, and then the possibility that this will continue to spread because those embers. right, if they hit the dry vegetation which is all around here and it lights it up, then boom, we have another hotspot and that is what firefighters are up against. but they are here again. we know so far more than 1800 acres have burned. we are expecting to learn more from fire officials around 730 this morning when they hold a press briefing. but we will be here continuing to monitor how this hillside looks and if any structures are threatened. for now. reporting live in malibu. i'm monica deanda, back to you guys. >> so again, there's that red flag warning happening in southern california. there have also been some strong winds in the east bay. this was from overnight. certainly not as

strong as what we're seeing in malibu, but they are being blamed for causing this tree to come down on a home on eunice street in berkeley. and as you can see, when you have winds that go up to 30 miles an hour, it also knocks down things that are anything really that is outside, including these umbrellas and outdoor furniture and some displays at a local store. we haven't heard of any injuries. there. this morning, the person accused of shooting and killing the ceo of united health care in new york last week is now facing a murder charge and is being held in a pennsylvania jail. >> 26 year old luigi mangione was captured thanks to an employee at a mcdonald's and a rookie police officer. we've also learned mangione has ties to the bay area. >> police arrested mangione yesterday in altoona, pennsylvania. that's nearly 300 miles from where the shooting happened. he was escorted by multiple officers to the courthouse. he'll remain in custody pending extradition to new york. >> according to an online court docket, he's facing second degree murder charges. the docket shows he's also charged with possession of a loaded firearm, possession of a forged

instrument and criminal possession of a weapon. now, the forged instrument, as they're calling it, is the fake new jersey driver's license. he allegedly used to check into a hostel ■before the shooting. >> police believe he left new york on a bus, then traveled to pennsylvania. he was eating in a mcdonald's yesterday when an employee recognized him and called 9-1-1, an altoona police officer who has only been on the job six months, made the arrest. the mangione family released a brief statement that reads in part, our family is shocked and devastated by luigi's arrest. we offer our prayers to the family of brian thompson, and we ask people to pray for all involved, and we have been learning more about the ties luigi mangione has to the bay area. >> abc seven news reporter lena howland is in the studio this morning with what we know about his time here. lena. >> amanda. after luigi mangione got his bachelor's and master's degrees from the university of pennsylvania in engineering and computer science, we learned he came right here to the bay area to start working for four

months. in the summer of 2019, stanford university confirms. mangione worked there as a head counselor in the pre-collegiate studies program. according to his linkedin page, he says he taught artificial intelligence to gifted high school students. his facebook page included several photos of him enjoying the sights around the bay area, before eventually moving to hawaii. we talked to a friend and former roommate from hawaii. he doesn't know what may have gone wrong, but is well aware of mangione's back problems and a recent surgery that he had. >> i knew he was going to have a surgery, so earlier this year i checked in with them. he confirmed that he had had surgery and he sent me the x-rays. it looked heinous with just giant screws going into his spine and the backpack that was found tossed out in central park after the killing was made by peak design, which is a san francisco company. >> each contains a serial number where the company can trace the purchase. history. the owner of that company told abc seven news

i-team reporter dan noyes that he is now talking with authorities since 2020. mangione also wrote on linkedin that he worked at truecar, the used car app based out of santa monica. but the company tells us he stopped working there in 2023. live in studio lena howland, abc seven news. >> thank you lena. it's been less than a week since the shooting, and so much has happened very quickly. you can see a visual timeline of the case with images of the suspect that helped investigators track him down. it's all a part of our coverage at abc seven news.com. >> embattled san mateo county sheriff cristina cortez is refusing to testify before the board of supervisors as they try to pressure her to step down. corpus lawyers say county supervisors asked her to testify under oath at a meeting today. she says she won't do it because some of the supervisors have already decided against her. corpus is facing allegations of misconduct and corruption, which she denies. the abc seven news i-team has learned the county

offered corpus $1 million to resign, and she refused. in march, voters will decide whether to give the board of supervisors the power to fire the elected sheriff. >> today, the alameda county board of supervisors could finalize a process for appointing a replacement for the county district attorney. in the meantime, an interim da is now in place. roy roberts is stepping in for pamela price, who got recalled by voters in november. roberts served as price's assistant chief for two years, his former boss accused of being soft on crime and insensitive to crime victims. that's a mandate not lost on roberts. >> i think that the goal is safety, public safety. and you know, what the public should know is that if a person commits a crime and is charged in alameda county, they will be prosecuted. >> it's unclear how long roberts will be in charge, but he says he'll fill in as long as it's needed. whoever the board selects will serve until the county's next scheduled election in 2026. >> 610 this morning, we're

looking live from our east bay hills camera. we have cold conditions this morning. we do have clear skies out there, but you'll find some high clouds moving in throughout the day. so temperatures right now we have a frost advisory in effect. some of our coldest areas are in the upper 20s currently. so you do want to have a lot of layers on this morning to stay warm later on this afternoon. it is a dry day. it does get mild later on today, but those temperatures do take their time warming up, so keep those layers on for much of the morning. rain is back here in the forecast starting tomorrow night with showers lingering into thursday. it's a level one on the abc seven storm impact scale. rainfall anywhere from a quarter up to an inch with breezy conditions at times and some slick and slower travel future weather. let's go hour by hour, here's wednesday evening 730 rain beginning to enter the north bay. then around midnight, we have those widespread light to moderate showers for the thursday morning commute. it does look pretty quiet out

out of monterey county. deputies there say they can't verify a hikers claims that someone tied her to a tree and left her there for hours. last week, the sheriff's office announced it was searching for a suspect after a woman said a man tied her to a tree in the pebble beach area. the woman said the man had followed her but did not hurt or rob her. investigators say they found a witness who didn't back up the hikers account. they say an extensive search of the area also didn't turn up a suspect. >> uc santa cruz is being sued by the people who were hurt in a bus crash on campus nearly a year ago. three of the six people who were injured are seeking damages. one alleges the driver who died had been speeding and braking hard the entire trip. ucsc responded saying this bus crash was a tragic and heartbreaking moment for our uc santa cruz community. we continue to mourn the death of our bus driver and extend our sympathy to the students who

were on the bus. to date, we have not been served thousands of striking san francisco hotel workers are trying to discourage people from going to a big health care conference next month. the jp morgan conference is set to be held at the westin saint francis hotel in union square. a union spokesperson says the hotels aren't being transparent about what kind of experience attendees will have in a hotel on strike, so union members are reaching out to attendees to let them know what they believe the experience will be. hotel owners have not commented on upcoming conferences, but have said they are committed to negotiating a fair contract. >> an iconic san francisco restaurant is closing its doors. the maltese french bistro at 315 fifth street in soma officially closed on december 31st for 30 years. the restaurant, described as a charming hidden gem, has served traditional french food. the owners have not revealed why the restaurant is closing, but they will keep their other french restaurant in duboce

rainfall starting tomorrow night, but today we're dry. it's cold this morning. future tracker showing you temperatures are slow to warm, so you'll likely keep your layers on all morning long. this afternoon, our warmest areas getting into the 60s, you'll notice some high clouds streaming in later on. this afternoon will be in the low 60s to the mid 60s around the bay shoreline later today. overnight tonight, partly to mostly cloudy skies. no frost advisories in effect, so not as cold as we are right now. rain is back here wednesday night into thursday. it's a level one for scattered showers, slick and slower travel. your biggest impact. but on the heels of this storm, another one is set to arrive on saturday and the one on saturday looks stronger. this is a level two moderate storm that is set to bring us a soggy saturday here to kick off the weekend, and then another storm likely early next week. so starting tomorrow night, the pattern turns pretty stormy for the next seven days. here's the accuweather seven day forecast cold this morning. dry today. rain returns tomorrow night, lingering into thursday. and

from our san jose camera this morning. it is cold right now. 41 degrees in san jose. humidity is down to 55%. you notice that dry, cold air overhead at 29 in santa rosa. a frost advisories are in effect. so you want to bundle up several layers this morning to stay warm. here's the frost advisory. this will continue until 9 a.m. this morning for temperatures as low as the upper 20s. we're seeing that this morning. later on this afternoon it is dry. we'll find some late day clouds moving in temperatures, mainly in the 60s. we are tracking that red flag warning that is in effect in southern california. this is a major issue this morning. a new fire has broken out in malibu. this is the franklin fire. this is the same area in 2018 where we had the woolsey fire. so firefighters are battling some very strong winds right now. this is an extreme fire event that is underway. winds currently in the region anywhere from about 15 to 30mph. and those winds in the hills have been even stronger over 50mph.

highway one. the pch is closed in this area as firefighters try and battle it. cal fire has said once the sun is up here at 730, they're going to send 15 tankers to the region to douse this area. so we'll keep you updated on that. let's check in with sue and see those drive times this morning. >> all right. it's pretty scary scene there we are here in the bay area. another scary scene. we have a live shot now of this fatal accident. this is on south city 101 northbound. you can see the cars on the right shoulder. and just now, that chp officer coming up on the left shoulder. so a little squeaking by on the right hand shoulder. but the main freeway is still shut down for this fatal accident. traffic is being diverted off at 380 and at south san francisco, over to north airport boulevard. a pardon me, the el camino real is your other good alternate to get around it. and so far not bad at

all. you can see a little bit of yellow on the el camino, which is that stretch to the left of the freeway. freeway is still just crawling, and an american canyon. another fatality with three of the four lanes shut down. traffic is now backed up into vallejo beyond highway 37. no real great alternate here. they are still investigating this one, so expect some more time before they get it cleared. >> all right, sue, thanks. we'll continue to check in with you. we do want to show you some new video now of the breaking news that we've been tracking all morning long. this is from pepperdine university. as the franklin fire was surrounding the campus overnight, students were being moved to a central location to shelter in place as thousands of people in malibu were being told to evacuate. and then here is a live look at the area. now, this fire has already grown to more than 1800 acres since it started around 11 p.m. here is a look at some of the

live coverage from reporter monica deanda, from our sister station in los angeles. >> but earlier we were on pch, the flames got out of hand. we saw those flames jump and we had fire on either side of pch there. this is affected not only the residents who live here, but also the schools in the area. we know that pepperdine classes and finals are canceled for today, and all malibu schools in the santa monica, malibu, usc are also closed today. so that's going to affect many schools like webster elementary, malibu elementary, and even malibu middle mill middle school and high school. right now where we're standing, the winds are pretty calm. but you know, once in a while we'll get these large gusts and those gusts, i mean, they're, you know, 60 to 80 miles an hour. so you can imagine just how fast this fire can spread. those embers can cross into another area when those winds are really, really picking up. sara retreat. that was a big focal point earlier this morning. that's a catholic

retreat and conference center buildings there were definitely on fire. we actually spoke to someone earlier this morning. they lived in that area. they had to evacuate. they got one horse out from where they were living, but unfortunately two had escaped. but the woman that i spoke to, she was just in tears. she was emotional. she never expected the fire to get this bad. but i spoke to l.a. county fire officials yesterday, and they said that they were expecting the winds to really pick up around midnight. this fire, of course, started closer to 11. so it's no surprise here that a fire like this broke out. we know the governor's office. they had approved some pre-positioning of resources in this area, like helicopters. l.a. county fire. yesterday they told me that they had strike teams in place in certain areas. and so these firefighters are definitely prepared. we've seen fire units, emergency units, sheriff's units everywhere around malibu. but of course,

those evacuation warnings, if you are in those areas, definitely be aware. if you're in an evacuation zone, definitely leave because, you know, officials have been saying all morning things can be replaced, but people can't. >> that's a good reminder. certainly, san francisco unified school district leaders are set to present their plan to close a huge budget gap. today, the district is talking teacher layoffs, possibly cutting more than 500 jobs district wide. they're offering a supplemental early retirement package to entice many to leave on their own. it will include 60% of their current salary. for those who have been with the district longer than five years, and they're boosting their transitional kindergarten enrollment. >> everyone wants us to succeed and everyone wants to help. and so it gives me so much hope that we can and we will get through all of this, because in two years time, we will have a

school district that will be standing solidly on our own two feet, making our own decisions for the best of our students. >> the school closures that led the former superintendent to step down this fall are off the table, at least for now. the clock is ticking for sfusd to get a balanced budget plan to the state by december 15th, as they are still at risk of a full state takeover. >> this morning, a man is in police custody for the murder of unitedhealthcare ceo brian thompson. luigi maglione was arrested at a pennsylvania mcdonald's yesterday after a nearly week long search. the break came when someone recognized him from surveillance images and called 9-1-1. abc news reporter nicole d'antonio has the latest developments. >> this morning, 26 year old luigi mangione is in custody for the murder of unitedhealthcare ceo brian thompson. police say the man was arrested at this mcdonald's in altoona, pennsylvania, after nearly a week long search. the break came

when an employee recognized mangione from the surveillance images and called police. >> when officers arrived, they made contact with the male, who had a face mask on. uh- that male was asked to remove his face mask, and officers immediately recognized him as a suspect in the new york city shooting. >> police discovered mangione had a passport and several fake ids, including a fake new jersey id, the same one allegedly used to check into a hostel in new york. police say he also had a 3d printed silencer and a 3d printed ghost gun, which is untraceable with no serial numbers, as well as a three page document which sources say mentioned unitedhealthcare by name and included the quotes. these parasites had it coming, and i do apologize for any strife and trauma, but it had to be done. >> i understand people have real frustration with our health care system. this killer was not a hero. he should not be hailed. >> mangione was valedictorian at

the summer of 2019. stanford university confirms. mangione worked there as a head counselor in the pre-collegiate studies program. according to his linkedin page, he says he taught artificial intelligence to gifted high school students. his facebook page included several photos of him enjoying the sights around the bay area. online, there are actually thousands of comments in support of mangione. some online saying he didn't do it. others talking negatively about corporate america. >> and in a very disturbing way, this young man has become almost a folk hero on the line for the way he conducted this homicide. and i think prosecutors want to send the message that you may have a grievance with the health care industry or corporate america, but you cannot do this type of act since 2020. >> mangione wrote that he had worked at truecar, the used car app based out of santa monica, but the company says he stopped working there last year and the

the san francisco zoo. this follows a troubling report from an advisory committee, which claimed the 95 year old zoo is unsafe for animals, employees and visitors and that it's dilapidated. the committee has also raised concerns about outgoing mayor london breeds plan to bring pandas to the zoo from china. the board is expected to approve the audit. >> right now at 646, part of building a better bay area is highlighting economic growth. and this morning some good news. another ai computing company is expanding into san francisco. the chronicle reports the startup lamda is leasing a 20,000 square foot office at 45 fremont street. now, lamda actually launched in 2012, in the city, but it moved its headquarters to san jose. now, that office space in the south bay is at capacity. so the founder tells the chronicle they're opening another office in san francisco because they say it's clear the city is the central hub for ai. and the king of ai, of course, is open ai.

and we now know that that big player in this space has a new advancement. it is a model that generates video. they call it sora. it was first rolled out in february. the safety testers now people paying for chatgpt will have access to it. although this morning our producer tried and it's not letting them sign up. users give it text or still image and the tool spits out a video up to 20s long. it seems to be a hit. the service reporting that heavy traffic. so it looks like that's why they have disabled new account creation. openai says it will limit the ability to upload images of people. at first, they have concerns that folks are going to use these photos of people for inappropriate sexual conduct. and welcome to the internet. now for your morning money report. boeing has laid off hundreds of additional employees in washington state and here in california. it's part of planned cuts that will eventually reduce the company's workforce by about 17,000. nearly 500 boeing employees in

california were let go. boeing is cutting 10% of its workforce as it tries to recover from financial and regulatory troubles. and that recent strike by machinists that lasted almost two months. let's take a look at what is happening at the new york stock exchange this morning as trading gets underway. we are in negative territory down so far, about 131 points. >> and we do want to go to a live look this morning at the bay bridge. you can see the commute well underway. and we do know that you will soon see more lights. the installation of the new bay bridge lights display is underway. the group behind this display, illuminate, posted on their website that crews are working to put up 50,000 new custom engineered led lights. testing will begin early next year. back in may, illuminate said the goal was to have the display back on by march, exactly two years after the lights went dark. the new lights were paid for by private funding
