>> plus, school closure is a last resort for me. >> s.f. unified isn't closing schools, so how will it balance the budget? >> always live abc seven news starts right now. >> you could hear that wind and you can see the damage it did. and this is just one concern from the weather that's heading our way this week. good evening. >> i'm ama daetz and i'm dan ashley. thanks for joining us. gusty winds, freezing conditions, rainy days, potentially dangerous weather hitting the bay area this week. >> look at what happened to a house in berkeley. a large tree fell onto it. going right through the roof. gusts of up to 50mph caused the tree to crash onto the back of the home on eunice street around 130 this morning. here's a view from the ground. the house has now been redtagged. the house next door sustained minor damage. >> the winds also knocked over store displays and an outdoor seating area of an italian restaurant off shattuck avenue.

several of their outdoor heaters were blown over and shattering glass and leaving a trail of damage behind caused problems as well. so let's bring in abc seven news meteorologist sandhya patel. yeah. >> sandhya, you're not only tracking wind, but also low temperatures and some incoming rain. that's right. ama and dan. let's take a look at our winds first, and then we'll talk about what's ahead. so the winds have really backed off. we had gusts anywhere from 50 to 60 miles an hour. as far as the strongest locations in our hills, healdsburg hills picked up wind gusts up to 60 miles an hour. looking ar rain chances over the next seven days, there are multiple opportunities. so get your umbrellas out. live doppler seven. tracking our first in the series of systems. it is a level one. it gets here tomorrow night and as you look at the timeline, you'll notice that rain at 9 p.m. in the north bay. by midnight it is spreading across the entire bay area thursday morning, still seeing some wet weather before the rain gets here. another frosty cold night in store. frost advisories 12 to 9 a.m. tomorrow. temperatures as

low as 30 degrees. you can expect the frost. switching gears to the malibu fire, you can see just how dangerous this situation is. as that fire exploded with very strong, gusty santa ana winds. not as strong right now. you'll notice malibu hills is 31 miles an hour, but they've seen winds anywhere from about 70 to 95. in southern california. critically dry fuels and of course a really they haven't had a whole lot of rain. so the red flag warnings are going through tomorrow evening. it's a particularly dangerous situation. wind advisories until noon tomorrow for the areas shaded here. that excessive or extreme risk of fire danger continues heading into tomorrow morning. and of course, the very dry conditions for them as they are not expecting any widespread rain anytime soon. >> dan really frightening there. sandhya, thanks very much. and that wind whipped fire in southern california forced people to evacuate their homes overnight. it's called the franklin fire, and it's burned more than

2800 acres near malibu since starting around 11:00 last night. reporter josh haskell from our sister station in los angeles, spoke with people whose homes are in danger. >> the sarah retreat neighborhood in malibu, taking a direct hit from the franklin fire, which started late monday night. flames surrounding the entire community. this home on mariposa de oro street a complete loss, completely surrounded by fire. >> every direction you look, surrounded by fire. i thought i was going to have to drive through a ring of fire just to get out of here. >> some residents of the community were luckier working all night to protect their homes and animals. >> the smoke was so thick you couldn't really see, like someone was standing over there. you couldn't see him. it was crazy. it's insane. i mean, they had so many fire trucks in here and just so many. i mean, the people that know this land, they they they really fought for it. >> although a number of homes were damaged, just one in serra retreat appears to be completely

burned to the ground on sweetwater mesa road. the garage was destroyed at a home, but the rest of the home was saved thanks to an all night firefight from the ground and from the air. the fire came close to the malibu pier and cross creek shopping center, but both were spared thanks to help from the community brigade volunteer malibu residents who worked the fire to save their community. >> this thing was born out of woolsey and a realization that community members really need to be take ownership of their risk to live in this area, and we worked with l.a. county and with their blessing and their uh- tutelage really grew this thing over the last five years. >> the fire burned through the santa monica mountains on both sides of malibu canyon road. that leads to pch and where malibu canyon hits pch. that's where you find sarah. retreat. >> we saved our house in malibu. we know there's going to be fires we prepare. >> josh haskell, abc seven news. >> what a situation there. well,

time is up for san francisco unified to present its early financial report to the board. >> now, the school district paused closing schools back in october despite facing a huge budget deficit. >> abc seven news reporter lyanne melendez is here with information on where they are going to make those cuts. leanne. that's right. >> so this is the financial plan we've been waiting for, and the school board is reviewing it as we speak. so the school board gets the plan tonight, approves it. and that plan must be in the hands of the state, which is overseeing sfusd finances by december 15th. now, the plan calls for not closing any schools next year. so they have kept their promise. instead, 535 positions will be eliminated. and that's not going to sit well with everyone. san francisco unified has to cut next year's spending by $113 million. if a few schools are not to be closed, then eliminating 535 positions district wide is their

main solution. starting with staff that are close to retiring. >> if you're 55 years old and have worked with us for five years or more and you choose to retire from the district, then the incentive is that we'll give you 60% of your current pay as an incentive to take on the early retirement package. >> think of it as a one-time buyout. but if not enough people take that deal, then the district will begin sending layoff notices in march. that's not sitting well with the teachers union, where they're going to find 500 additional jobs that they don't determine they need for students. >> is impressive and surprising and, quite frankly, disappointing when our students and families are saying they need more, not less. >> the district has also had a hiring freeze. another area of cuts will come from reducing the number of contracts the district has with outside parties. this

budget crisis is due in part because some families have left through the years, meaning schools continue to miss out on millions of dollars from the state. there are approximately 49,000 students in the district. the previous superintendent, supported by most members of the school board, had decided to close or merge some schools in an attempt to balance the budget. here's what doctor matt wayne told abc seven news back in october. >> i think we need to do a better job of explaining our budget crisis, and then why school closures fit into our picture of addressing this budget crisis. >> but mayor breed and others said there was a lack of transparency in the process for closing schools, and the district was forced to hit the pause button. instead of being realistic and saying, we have low enrollment, we need to close schools instead, you are possibly cutting jobs and somebody's livelihood. what do

you say to that? >> school closure is a last resort for me. it makes no sense to board up beautiful school buildings in beautiful neighborhoods just so that we can get to a number. i think what's really important for us is to make the hard decisions. now to rightsize our budget. and if we have if we have to in the further years, in the out years, i'm a decide on school closures. we will. and so i want to be sure that when we when that time comes, i want to be ready to have answers for families. >> now, if they are able to make those spending cuts, they are still not out of the woods for 20, 2627. they would still need to cut another 13 million. not so much. which represents cost of living increases. now the district is hoping to get more families to enroll in san francisco schools, which would bring in more money from the

state. but as we were discussing, you know, the entire state of california is going through this. people are not having kids, as you know, like they used to. yeah. the country. >> yeah, they have to make some really challenging decisions. that's right. years ahead. thanks, liane, very much. sure. >> we move now to developing news. we are learning more about 26 year old luigi mangione, the man accused of killing the ceo of united health care in new york city last week. mangione went before a judge today as part of legal efforts to return him to new york. abc seven news reporter suzanne fawn joins us live with the latest tonight. suzanne. so we got a good look at luigi mangione today. >> cameras were rolling when he shouted out to reporters as he was escorted into court. now, we asked san francisco police chief bill scott more about mangione's connections to the bay area. luigi mangione resisted police as they escorted him into a pennsylvania court for a hearing to bring him back to new york city. he yelled out to cameras as completely out of touch, and is insulting the intelligence of

the american people. mangione, seen here in his booking photo, faces murder charges in the shooting death of brian the thompson, the ceo of united health care. investigators found writing about the crime when police arrested him at a mcdonald's in altoona, pennsylvania, on monday. we're learning mangione considered the killing to be a symbolic takedown of united health care over perceived corruption and, quote, power games, according to a confidential assessment of the crime described to abc news by the nypd intelligence bureau. according to the criminal complaint presented in court on this tuesday, officers found a 3d printed pistol and black silencer. mangione faces charges in pennsylvania for having a ghost gun. mangione has a number of ties to the bay area. abc news has confirmed with police sources that his mother filed a missing person report in san francisco before the shooting. we asked the san francisco police chief about that and whether sfpd is working with

nypd on the investigation. >> did you have contact with nypd? again, i know there's a whole lot of interest in this. we're getting a ton of inquiries. i'm going to have to defer answering any questions. refer you to nypd. >> according to authorities, mangione was allegedly found in pennsylvania with $8,000 of u.s. currency and $2,000 in foreign currency. during a brief appearance in court in blair county, pennsylvania, mangione challenged his extradition to new york to face second degree murder and other charges there. mangione remains in jail without bail. late today, a comment from mangione's defense attorney. >> if you're an american, you believe in the american criminal justice system. you have to presume him to be innocent. >> and according to nypd intel analysts, mangione appears to have been inspired by the unabomber. the report, obtained by abc news, was distributed to law enforcement and warned that mangione may become a martyr who inspires a wide range of extremists to act. mangione allegedly described himself as the first to face united

dropped about 50. the s&p went down nearly 18. general motors has decided to put an end to its cruise robotaxi service. gm spent billions of dollars developing autonomous vehicles and rolled them out in san francisco, before expanding to arizona and texas. but crews quickly ran into problems. vehicles would stall, and there was an incident in which one dragged a pedestrian after the person was struck by another vehicle. the dmv suspended cruise's permit in october of last year. >> boeing announced today that it is resuming production of the 737 max planes. production came to a halt earlier this year due to a seven week strike by boeing employees. the strike ended in november. boeing says the plane building resumed after potential problems were identified and fixed, and workers were retrained. the federal aviation administration limited boeing's production of the max jets to just 38 per month, after a door plug blew out of a 737 during an alaska airlines flight in january. the global airline

evacuate and cannot go home yet. a red flag warning will not expire for another 24 hours, so it's going to be a very tense time down south. tonight, new details on the federal raids involving soon to be former oakland mayor sheng tao. >> this was big news when it happened six months ago. before dawn on june 20th, fbi agents raided tao's home on maiden lane in the lincoln highlands area of oakland. other agents, including from the irs, raided the offices of california waste solutions on embarcadero in oakland. the fbi also raided two homes on view crest court and skyline boulevard, linked to the loooooong family, which runs california waste solutions, a major garbage vendor. >> abc seven news reporter anser hassan has new information that helps connect the dots. >> reporter this 55 page motion filed monday alleges there is, quote, financial motive to commit a crime and that the money was likely obtained for unlawful purposes. the case goes back to 2022. mario juarez is a longtime oakland business owner and former candidate for oakland city council. he faces felony

fraud charges for bounced checks used to pay for political mailers that attacked then candidate sheng tao's opponent in her bid for oakland mayor. the motion, first reported by the east bay times, claims that a review of the account gives, quote, a more complete picture of what was occurring, and some involved are also targets of an fbi investigation from june. the motion claims that juarez received a $75,000 check from california waste solutions. the company is owned by the duong family, which has contracts with oakland to provide waste management services. homes owned by the family were raided in june as part of an fbi investigation, as well as the home of mayor tao. though details of the federal investigation have been limited. juarez also received another check, this one for $50,000 by abc security, another company with a contract with the city of oakland. the motion also states that juarez received another $170,000 from the companies. the motion goes on to say that juarez was, quote, essentially a conduit for these companies to

help the mayor win and preserve and enhance the company's access to taxpayer funded contracts, though the motion does not claim that either company committed a crime. >> mayor tao has repeatedly told the story that she barely knows the songs. they're people who showed up in photographs with her. the motion from the alameda county da's office seems to tell another story. >> justin burton is a media and political strategist and the communications director for mayor tao's predecessor, mayor libby shaft. he points to the two checks paid to tao's partner, andre jones, after the election, as documented in monday's motion, though it does not specify what the payments were for. and there is no indication that tao knew of the payments. >> and so now there's a credibility war between the mayor of oakland and the prosecutors in the district attorney's office. >> another political consultant who would not speak on camera points out that california waste solution contracts were already in place before tao was elected mayor. tao declined a requested

for comment. the attorneys for the others did not return our request for comment. in oakland, anser hassan, abc seven news. >> san francisco city officials are encouraged by a new report about crime in the city. today, officials released data showing homicides are at their lowest level in more than 60 years. a total of 33 so far this year. police chief william scott says crime in all major categories is down. he says that is no accident. >> we want to rewrite our narrative in this city because, you know, we've we've taken some lumps, sometimes justified, sometimes not. we got to get the truth out there and show people what we're doing. show people the results. and that's going to help with the feeling of safety. >> officials credit the drop in crime to community policing initiatives, plus new technology like drones, public safety cameras and license plate readers. mayor london breed cheered the report, saying it was a product of hard work, but added that officials know they have more work to do to make people feel safe. san francisco says 33 homicides so far this

vegas, 30 year old debra redden was being sentenced for attempted battery when he attacked the judge. no one was seriously hurt. redden pleaded guilty but mentally ill for charges of attempted murder and today was sentenced to 26 years. >> i saw nothing but red and i don't remember doing anything except for jumping on top of her and doing this to her robe. i was like, why are you doing this to me? that's what i wanted to ask her if i think i know myself, but i'm not really sure. >> when handing down today's sentence, the judge called the incident in january an attack on the entire judiciary. >> republican senate leader mitch mcconnell fell at the capitol today. the 82 year old was cleared to continue working. mcconnell suffered a sprained wrist. he was seen walking around later with a brace on his wrist as you see, and a bandage on his face. last year, mcconnell fell while at a hotel and suffered a concussion and fractured rib, which kept him out of the senate for weeks. mcconnell also sparked concern twice last year when he appeared to freeze in front of television

these two tickets on stubhub for taylor swift in vancouver, canada. >> kayvon kafaji got emails confirming the $5,400 tickets, and his 11 year old daughter,, sophia, was over the moon. fast forward to last week. the seller had not released the seats. >> i saw the concert. they got closer. we started becoming anxious because we didn't receive the tickets and we were flying to vancouver. so we started calling customer service. >> they, like the seller, has till 3 p.m. pacific time, four hours before the event to release the tickets. i'm like, this is cutting it too close. >> the family said they were repeatedly told about stubhub fan protection guarantee. no matter the issue with the ticket, we will strive to find an equivalent or better ticket to get the buyer into an event or provide a full refund. so sophia and her mom flew to vancouver, making friendship bracelets along the way with six other friends who had gotten their tickets.
