spending. >> always live. abc seven news starts right now. >> all right. live doppler seven is lit up tonight, and we're not done. there is a lot more wet weather on the way. good evening. thank you for joining us. i'm dan ashy and i'm j.r. >> stone. we're still dealing with wet roads and soggy streets. but be prepared for even more rain in the next few days. >> on the exclusive abc seven news storm impact scale. today's storm ranks level one. that makes it a light storm. this weekend will have a level two. that's a moderate storm. >> let's bring in abc seven news weather anchor spencer christian, who has been tracking all of this. spencer. okay j.r. dan here's a look at our satellite radar composite image. we still have some light showers and light rain sweeping through the bay area right now. that pattern will continue into the late night hours with this light level one storm on the exclusive abc seven storm impact scale. some of this rain will continue into tomorrow morning. light rain showers. breezy at times we have rough surf. here's a forecast animation starting at 7 p.m. notice how it eases up and tapers off a bit going

into the late night hours, but then we get another round of light rain moving through the north bay tomorrow morning, which will probably complicate the morning commute. that will be followed by a much stronger storm tomorrow night, but from the current storm. rainfall totals will generally be under a quarter of an inch across the bay area, a little higher in the northernmost part of the bay area, and that rough surf advisory is in effect until 4 a.m. tomorrow, breaking waves up to about 22ft or higher, with the possibility of dangerous rip currents and sneaker waves. and we have a wind advisory that will be in effect for the. actually, a high wind watch is what it is for the entire coastline and the santa cruz mountains. gusts up to about 45mph, and a flood watch for the north bay, in effect from 2 p.m. tomorrow to 4 p.m. saturday. so a lot going on with the weather. i'll have a closer look and the accuweather seven day forecast a little bit later. dan. >> okay. spencer, thanks vey much. we'll touch base shortly. a new audit by the san francisco budget and legislative analyst is blasting the overtime practices of the city's police department. the report says sfpd

has failed to regulate the use of overtime, costing millions. here's abc seven news reporter tim johns. >> a new audit released thursday paints a critical view of the san francisco police department's use of overtime. the 128 page report says sfpd spent over $108 million on overtime during the 2022 2023 financial year. among the other findings, the report stating the department failed to adequately monitor or enforce overtime limits. it also says that around 200 officers, or about 12% of sworn staffers, accounted for about a third of the total overtime budget. additionally, the audit highlighting that the average employee took over 25 days of sick leave a year, up from 14 during the 2018 2019 financial year. outgoing san francisco supervisor dean preston commissioned the audit. >> some really shocking findings, i think one of the biggest of which is the use of sick time to then go work, get overtime pay working for private

companies. >> preston believes the city has let sfpd spend too much money for too long. he says that's especially true given the multi-billion dollar deficits san francisco faces. >> i've got constituents who are facing service cuts, folks who rely on the city for food aid, for other forms of relief. everyone's being told it's a deficit and we need to cut. meanwhile, you have this audit shows that the police department is just on a spending spree. >> incoming mayor daniel leary says he hasn't had a chance to review the audit, but told us he's committed to getting sfpd back to full staffing levels. we caught up briefly thursday afternoon. >> we are too short staffed. we rely too heavily on mandatory overtime. >> that sentiment was echoed by sfpd, who says they're currently about 500 officers short. they sent us a statement responding to some of the audits. criticism. it reads in part as a necessary stopgap measure, the sfpd has been using overtime to backfill our patrol and investigation units to ensure san francisco remains one of the safest cities in the country. as

we continue to rebuild our ranks, overtime hours will decrease, saving the city money and giving our incredibly hardworking officers a much needed break. an explanation preston says isn't good enough. >> if a nonprofit that we as a city had contracted with was shown to have this lack of oversight in their spending and this level of abuse of city money, we'd be either terminating the contract with that nonprofit or at least putting them on probation. >> the supervisor says he wants to see the city take a more active role in providing oversight for sfpd in san francisco. tim johns, abc seven news. >> a group of demonstrators that faces charges for shutting down the golden gate bridge tried to get the cases dismissed. >> they chanted today as they headed into the courtroom at san francisco's hall of justice. the judge denied the group's motion. a total of 26 people were arraigned and all pleaded not guilty. they were charged after this pro-palestinian demonstration in april. some commuters were trapped on the

bridge for three hours. earlier this month, a judge dismissed most of the charges against the group. major pushback tonight from both the mayor and the police chief in san jose. it's about a decision to release the man suspected in the death of a community service officer. loooooong pham was the first cso with the san jose police department to die in the line of duty. csos typically help police by responding to lower priority calls. pham was working to control traffic on a saturday night in august, when police say he was hit by a suspected drunk driver. abc seven news south bay reporter zach fuentes has the reaction from officials about these new developments. >> scathing reactions to a decision made in the case surrounding the tragic death of community service officer long pham? san jose police chief paul joseph and mayor matt mehan both issued statements wednesday night blasting a judge's decision they say allows the suspect behind pham's death to post bail and leave jail.

>> it's infuriating, frankly. >> pham was beloved by family, friends and colleagues at the san jose police department. >> his life, though tragically cut short, was filled with love, adventure and a deep commitment to serving others. >> the 34 year old's life cut tragically short when he was performing traffic controlas duties on august 3rd. feminist partner veronica barrett were standing outside their car behind flares and cones when the suspected drunk driver, 44 year old juan huerta palacios, crashed through the barriers. pham died at a hospital. bear suffered major injuries. >> it's been a very painful loss for the department, the city and the broader community, particularly our vietnamese community. >> in a statement, chief joseph highlighted the fact that the suspect is facing a murder charge, a charge he said is based upon a previous conviction for alcohol related reckless driving. chief joseph's statement said in part, we stand with the district attorney's office in objecting the defendant's release in the strongest possible terms. an officer is dead and the man who killed him was let out on bail

to go home. against our objection, against our community's objection. we reached out to the santa clara county sheriff's office, who said thursday morning that the suspect is still in custody and has not yet posted bail. still, officials are blasting the decision that gives him that option. >> you know, you're repeatedly making bad decisions and have had a warning and have failed to change your ways. and then deciding to engage in that risky behavior again has led to the death of an innocent person. i just have a i have a hard time with this decision. >> court records surrounding the case were confidential. in the santa clara county hall of justice records. we reached out to the da to find out more about the decision the judge made and have not heard back. in san jose, zach fuentes, abc seven news. >> all right. we have some incredible video of a high speed car crash, barely missing a man who was walking on the street in the north bay. the car then slammed into a house. it happened in a novato neighborhood near simmons lane and san marin drive. abc seven news reporter cornell bernard spoke exclusively with a quick thinking, quick

reacting man who narrowly escaped being killed. it's a story you'll see only on seven. >> i'm still, like, tingling. i still want to ph myself. is this real? you know, and it is. >> ralph macchio is living to tell the tale of his near miss with an out of control car during his morning walk in novato. >> oh, my god, if you saw the ring uh- thing, i said, oh my god. >> the scary crash caught on a ring home security camera thursday. police say the driver of a toyota camry lost control at high speed on san marin drive, jumped a curb and careened onto simmons lane, crashing into a house. watch again how close the car came to ralph and how quick he reacted. >> i'm walking. i'm walking up. i see it out of the corner of my eye. i see it coming and i just. and it happened and you know, and that's the reaction is from

being at the gym and doing the crossovers with the trainer. >> i was at my computer getting ready to send an email, and it was like crash, you know, sounded like a crash. >> got spade and her partner called 911 when they saw the crashed car in their front yard with two people inside. >> check out up here. this is this. all this glass here is from his windshield. >> novato police say the driver of the car suffered a medical emergency. seconds before the crash, both he and his passenger went to the hospital with injuries and are expected to survive. >> the sound of, like an engine racing and then like, mad collision. but it didn't sound like a car hitting another car. so i was like, wow, what was that? >> paul schneider heard the crash from blocks away called 911 and we went over to the car. >> we opened the door and the passenger door. the guy was seemed to be okay. >> ralph is glad everyone will be okay. he's also thanking his

lucky stars and his quick reflexes. >> within few seconds, i just scrambled out of the way. i was really very fortunate. something bigger than me was watching out. >> in novato. cornell, bernard. abc seven news. >> just miraculous there. firefighters are getting some help from the weather and getting a handle on a fire in malibu. the franklin fire has charred over 4000 acres, destroying or damaging several homes since it sparked monday night. containment is up to 30% now. enough progress is being made to allow some people to return to their homes. reporter sid garcia, with our sister station in los angeles, has the story. >> even though some evacuation orders have been lifted, first responders are asking residents to be carel as they return home. and for those who are still waiting to return, they are being asked to be patient. >> i can tell you i am boots on the ground and i assure this community we are working diligently. we are working so quickly on this. i mean, the

reality is we weren't going to open until later and we pushed this and worked with our utility crews, worked with our fire department. >> there are still close to 2000 firefighters and their vehicles battling the franklin fire. that's one of the main reasons not all evacuation orders have been lifted. in some areas, power lines are down. once the franklin fire is fully contained and all evacuation orders have been lifted, l.a. county public works is asking residents to start thinking about mudslide threats. >> public works will be offering free engineering advice as we move in to recovery. many residents may be interested in knowing if they need further protection on their property due to burn scar. >> l.a. county fire says six homes have been damaged, four homes destroyed and five outbuildings were also destroyed. first responders and local politicians say the reason for the minimal amount of damage done was because of all of the pre-planning done before the santa ana winds hit. remember

an electron rang the opening bell today at the new york stock exchange. it was in honor of him being named time magazine's person of the year for the second time. joining him today was his wife melania, daughters ivanka and tiffany, along with vice president elect jd vance and others. trump calling it a tremendous honor. and time magazine is owned by san francisco's own marc benioff, the founder of san francisco based salesforce. the president elect is also getting support from meta founder mark zuckerberg, who donated $1 million to trump's inauguration fund. it's a shift of sorts for silicon valley, and abc seven news reporter monica madden is here with a closer look at this change. monica. >> well, dan, in his first term, trump regularly clashed with big tech, accusing social media

giants of manipulating coverage of him. but now founders and ceos are looking to improve those relationships, with many now publicly embracing the incoming president. >> salesforce ceo marc benioff applauded the time person of the year selection, writing on x quote, we look forward to working together to advance american success and prosperity for everyone. >> benioff was once a trump critic and in 2016 supported hillary clinton. >> okay, we see which way the wind is blowing. now we're going to suck up to the new regime. >> and tech giant mark zuckerberg, usually a supporter of liberal causes, is also shifting toward embracing trump in a way deeper than policy. >> there's libertarian ethos in silicon valley. it's been a really, really big part of the culture for decades. >> steve hilton is a silicon valley entrepreneur and trump supporter.repreneur and trump >> for the longest time, it's just been assumed that everyone in silicon valley is a democrat. and so i think that was the reason that he probably went along with some of those things. but deep down, that libertarian drive and ethos, i think is

really, really central to mark zuckerberg and a lot of these tech founders, silicon valley leaders, are regularly discussing these shifts online, like on a recent episode of the all in podcast, where former paypal executive david sacks said he's bullish about the policy changes for big tech. >> you're going to see the end of this era of deceleration, of regulatory capture and lawfare, his all in cohost jason calacanis noting it wasn't without work on the back end. >> as we all know, we talked about it on the show. trump heavily, heavily courted the crypto industry during his campaign. >> remember, all these people think of themselves, and mostly they are as disruptors, as taking something that's sclerotic and broken and completely revolutionizing it. that's how they think in terms of their businesses. and so i think that, in a broad sense, excited about now doing that at the government level for the federal bureaucracy. i'd love to see that happen in california, too. >> president elect trump has vowed to repeal president joe biden's ai executive order,

which was aiming to create safeguards and protect people's rights without hurting innovation. it still remains to be seen about how the incoming republican controlled congress will tackle big issues around high tech regulation. jor, dan. >> we'll see. all right, monica, thanks very much. >> yeah, it was a wet ride into work today for me. and i know it's probably a wet ride home for many people out there. >> it was last night was a pretty messy night. spencer, krista is tracking the weather for us. >> yeah, we have more wet commutes coming our way, that's for sure. take a look at what's happening right now on satellite radar. composite image. we have light rain and scattered showers. it's still wet out there. the evening commute reflects that because it's getting a little slow and slippery in some spots. it's getting breezy out there as well. we have gusts up to about 20mph right now at sfo, and the wind gusts will get even stronger with the next storm coming in late tomorrow night and into saturday. right now, temperature readings are generally in the low to mid 50s in san francisco, oakland, hayward, san jose, redwood city and half moon bay. basically about 52 to 54 degrees at all those locations. and what look at the slow

traffic on both directions of interstate 80 over emeryville 53 right now in santa rosa, petaluma 50. we have low 50s at napa, fairfield, concord and livermore. and this is how it looks on the embarcadero from our rooftop camera. and this is how our forecast headlines shape up tonight. more scattered showers tomorrow we'll see a few morning showers, mainly in the north bay. but the more significant storm more impactful storm comes in tomorrow night into saturday, bringing stronger, heavier rain and stronger wind gusts. but our current storm is a light level one storm on the exclusive abc seven storm impact scale. again, light rain and showers. breezy at times and we have rough surf. here's the forecast animation starting at 7 p.m. notice later tonight this tapers off to almost nothing, just a few trickles of light rain up in the north bay. but then after midnight, we'll see another round of showers swinging mainly through the north bay, so the morning commute will be wet in at least parts of the bay area. and then late tomorrow night into saturday we get the stronger level two storm coming in. rainfall totals from the current storm will generally be under a quarter

of an inch. i mentioned rough surf. we have a high surf advisory in effect until 4 a.m. tomorrow. wave heights may reach or exceed 20ft, and that means a dangerous rip. currents and sneaker waves are possible as well. a wind. high wind watch will be in effect from tomorrow afternoon through saturday afternoon for the entire coastline and the santa cruz mountains. winds gusting up to and even above 45mph. and we have a flood watch that will be in effect for the north bay from 2 p.m. tomorrow to 4 p.m. saturday. flooding likely or possible at streams, creeks and roads and low lying areas, along with the coastal flood advisory, which is in effect until 1 p.m. monday. that's mainly because of high tides, and this mainly covers the bay shoreline and the interior valleys of the north bay. now that second storm barrels through tomorrow night into saturday and it'll produce more rain than the current storm, it will produce significant snowfall in the sierra, where a winter storm warning will be in effect. so back to the bay area for tonight. look for low temperatures in the mid to upper 40s. highs tomorrow up to about 6061 degrees. and here's the

accuweather seven day forecast. as i mentioned, our level one storm into friday morning, followed by a level two storm friday night into saturday. a break on sunday, but a brief break because another round of rain comes in on monday. and then we get some drying out on tuesday, wednesday and thursday. but basically it's an unsettled and potentially wet pattern into next week. looks like it. >> all right. thanks. >> yeah. no skiing parties for us. no. keep it safe. all right. new developments tonight. the port of oakland today filed an appeal to the order that's temporarily blocking it from using the new name for the oakland airport. it changed its name to san francisco bay oakland international airport in may. san francisco sued over the name change, saying it was too similar to san francisco international airport. the port of oakland, which runs the airport, disputes the claims. a month ago, a judge temporarily blocked oakland from using the new name while the case is decided. >> all right. coming up next, money, media and more. the most powerful women in the world. according to forbes. taylor

all three major indexes slid into negative territory today for a ninth straight day. it's the first time that's happened since 2001. here's a look at today's closing numbers. the dow went down 234 points. the nasdaq

dropped 132, and the s&p fell nearly 33. a new federal rule will cap bank overdraft fees at $5. millis of americans pay around $35 per transaction when they overdraw money from their checking account. the consumer financial protection bureau says this change will save americans $5 billion a year. it's part of a biden administration plan to crack down on junk fees. >> big banks love overdraft. it is easy profit for them, but it is punishing for so many americans, especially those who live paycheck to paycheck. >> the consumer bankers association filed a lawsuit against the federal agency, claiming blatant overreach. the law is set to take effect in october of 2025, but legal challenges could delay that timeline. >> right. if you're watching us on youtube tv, the price is going up again. the cost of a

preemptive strike against the incoming trump administration. we've told you about the state legislature's plan setting aside millions to defend some of the golden state's progressive laws. but what about imposing other measures? >> abc seven news building a better bay area reporter, lyanne melendez, has been looking into that. here's what she found. >> and it's not just rhetoric. it's not just threats. >> governor newsom and most democratic lawmakers are preparing to protect california's progressive policies in the courts, like they did during the first trump

administration. >> california won 80% of those lawsuits. and so this is a man who has no issue violating the law. and we want to send a very clear message, not just to donald trump, but to the people of california, that we have people's backs here in california. of course we should and we will work with the president elect on areas where we agree, and there's always going to be some agreement. and you shouldn't. it's not about fighting for the sake of fighting. >> this time, lawmakers anticipate there will be more on the list of possible lawsuits. >> it could be things like climate action, reproductive freedom, civil rights, immigrant families. but also one part of this that's important as well is protecting california taxpayers. >> protecting california taxpayers means ensuring that if californians pay their share of taxes to the federal government, then president elect trump should not withhold any kind of

federal disaster funds, as he threatened to do last october. on the flip side, 1st may argue that necessity is the mother of political innovation. new york state senator liz krueger recently suggesting some liberal northeast states could withhold billions of dollars in federal taxes if president elect trump goes through with his plans for mass deportations. california already gets back less in federal taxes than it pays 2022. data reveals that california and 12 other states shown here received less in federal funds. that means california and the other wealthier states are subsidizing the rest of the states shown in blue. in fiscal 2022, california sent about $692 billion to the federal government and only got back around $620 billion in federal funds. that's about a $72 billion deficit. by comparison. that's about three times the

state's $27 billion 20 2324 budget deficit. we've known about this disparity for some time because in 2003, then republican governor arnold schwarzenegger complained that the federal funding system was unfair and that he would fight for the money. he was quoted then as saying, for each dollar that we pay, we only get $0.77 back. so there's a lot of money we can get from the federal government. but would california lawmakers y have the political will to intensify its pressure on the trump administration? >> i think if you're going to start to threaten the federal government with withholding, demanding that individuals withhold their federal tax payment, that isn't a rhetoric that actually works very well. and you don't actually really, i don't think, want to be in that battle. >> john perez was speaker of the assembly near the end of schwarzenegger's administration, and says there are ways to get more money for california. >> one of the things that i think are going to be the most

successful strategies at drawing down more federal money, is actually keeping money here at home. how do we do that? we do that by working on a bipartisan basis to, to, to, to overturn the limits on deductibility of california state and local taxes. >> tax reforms passed last time president trump was in office. limited tax deductions to $10,000. he has indicated he may reverse those limits on things like vat cap on your mortgage interest deduction. voters have also indicated they want government to work for them. and as the national election showed us here in california, there was voter frustration over some of the state's progressive policies. that's one reason why republicans gained ground in almost all counties in the state. >> our constituents, they don't feel that the state of california is working for them. >> and so the new speaker of the california assembly suggested that we set certain issues aside

and focus on charting a new path forward and renew the california dream by focusing on affordability. >> they're anxious because they feel it. they feel it at the grocery store when they have to pay their bills. they feel it every time they fill up their gas tank for their long commutes from work to home. >> the democratic party has not sufficiently addressed the rising cost of living, has not sufficiently addressed economic concerns. so certainly, if you're going to talk about the agenda for the for the legislature for the coming year, addressing affordability, the cost of living, housing, those related set of issues that we know are priorities for voters is critical for the legislature to address. >> so how do you make california more affordable housing, making energy cheaper and improving public infrastructure? all of that has to happen quickly and efficiently, something california doesn't always do. lyanne melendez, abc seven news. >> san francisco mayor elect

daniel lurie has announced three more appointments to his leadership team. lurie chose stacie slaughter to serve as chief of staff. he also added matthew goudeau as deputy chief of staff and han zhu as director of public affairs. slaughter worked for the giants for nearly three decades as executive vice president and senior advisor to the ceo. most recently, she served as an advisor to the global investment firm sixth street partners and as a board member of bay fc, the bay area's new national women's soccer league franchise. san francisco voters are getting what they want. today, the california coastal commission unanimously granted permit approval to turn upper great highway into a car free zone. voters narrowly approved prop k in last month's election to permanently convert a two mile stretch of the great highway from lincoln way to sloat boulevard into a pedestrian and bicycle only recreation area. it should become a full time park sometime early next year. >> in the east bay, oakland

officials today celebrated the reopening of the city's main library. the downtown branch has been closed since may for renovations, including a new roof, a modernized electrical system, and ceiling upgrades throughout the building. along with the library reopening, the oakland history center is back open now, too. great news there. oakland's jack london square is getting a new restaurant. today was the grand opening of dragon gate, which serves traditional taiwanese food in a new and bigger location on franklin street. the owners say they are pushing back against oakland's doom loop narrative and hope to be a model for others thinking about oakland as a place to do business. abc seven news reporter anser hassan has the story. >> reporter the cooks at drn gate restaurant have been training for the past six months learning how to cook traditional taiwanese dishes to bring the people. >> it was actually working on the asian street or taiwan night market or working on the street. i can get something really

jury is starting to hear evidence in the case against luigi mangione, the suspect in the killing of unitedhealthcare ceo brian thompson. mangione is being held without bail in pennsylvania. he was arrested there monday after an intense search. you may remember thompson was shot from behind
