>> both families. speaking outside of court after a trial that lasted nearly two months. but the family says it's still not over. >> there will be a civil trial. that means that we will come after his mother, his sister and the brother in law. they are all absolutely guilty. >> the murder came to national attention partially due to social media posts. >> elon musk took to twitter to make an effort to really shame san francisco, and to make it seem like this was about lawlessness in san francisco and about what's going on out in our streets. and we knew it was something different. >> good afternoon, i'm kristen z. >> and i'm dan ashley. thanks for joining us. nema is now facing 15 years to life after a jury found him guilty of second degree murder in the death of cashapp founder, bob lee. >> it's a case that drew national attention after a video of bob lee staggering and collapsing back in april 2023 went viral. >> reporter louis pena and melanie woodrow have been

covering the case since the very beginning. both were in the courtroom today and will begin our coverage here. our team coverage for you with melanie. she's here with more on the verdict today. >> melanie. dan and christine, this was a highly anticipated verdict. up until the last moment. the jurors came back yesterday afternoon, and then everybody had to wait overnight until this morning when that verdict was ultimately read. these jurors were thoughtful. they took their time to deliberate and go through the evidence. it was something that both sides thanked them for. six weeks of testimony, seven days of deliberations and 12 unanimous jurors. finding nemo mckinney guilty of second degree murder in the stabbing death of cashapp founder bob lee. not first degree murder as charged. bob lee's brother oliver, saying his family believes the murder was premeditated but understands the limits jurors faced. >> this case was extremely hard to prove because it was just nima's word versus my brother's word, which he's not here to be able for anybody to be able to hear those words. >> prosecutors agreed to lie and reinstate, argued mckinney

stabbed and killed lee after lee introduced mckinney's sister mckinney, to a drug dealer who she testified sexually assaulted her. san francisco district attorney brooke jenkins i knew and was confident that we had two of our best handling this case. the case received national attention following lee's death, when elon musk tweeted about violent crime in san francisco, jenkins saying musk got it wrong. >> we are a city committed to accountability. we are a city committed to public safety. >> while many defense attorneys argued he acted in self-defense, mckinney testified it was lee who attacked him with a knife after he made a bad joke, calling into question what type of father he was. >> this is obviously very disappointing for us. these are hard fought battles. >> mckinney's defense says he will appeal. >> mr. mckinney continues to have a right to fight for his freedom, and continues to have a right to fight in this process. >> his mother, who was in court every day of the trial, says her son is innocent. >> this is their decision. my son is not such a thing, such a person. he's the kindest person.

every mother would love to have a son like him. i know my son. >> she says he remains determined. when you spoke to nima last night and he was, he knew there was a verdict and he was waiting to hear it. how is he feeling? what was he sharing with you? >> he's always strong and giving me hope. >> mckinney waived his right to be sentenced within 15 days. a status hearing is scheduled for january 10th. bob lee's family is preparing to celebrate both his birthday this friday and the upcoming holidays without him. >> dan and christine, you know you were in court from the very beginning covering every detail of this trial, just putting together what you can gather from what you heard. what do you think led the jury to this decision? what were they going on? >> you know, it's so hard to know exactly, because of course, these jurors chose not to speak to reporters, which is absolutely their right to maintain their privacy. but i did wonder about the video that we saw in the defense's closing arguments, where they were alleging that bob lee was outside of the battery nightclub

doing drugs off of what appeared to be what they said was a knife. and so those defense attorneys were suggesting that it was actually bob lee that brought the knife to the interaction that he had with nima mckinney and not the other way around. and maybe that gets to premeditation. and whether or not nima momeni had premeditation in this murder. it's hard to say whether or not that's the piece of evidence that jurors were focused on. we won't know. we might not ever know. but that was certainly something i wished i could have asked jurors. >> certainly a key piece of evidence. thanks very much. >> the family of bob lee was also at the trial, of course, and appeared relieved with the verdict. >> abc seven news reporter luz pena has their reaction from outside the courtroom today. luis? >> yeah, well, this was a six week trial. the jury then deliberated for seven days, and this was difficult for both families. bob lee's brother, oliver lee, said this had been an open wound for their family. on the other hand, his mother said they are both victims. victims of drug abuse and says her son is innocent. 18 months

after cash app founder bob lee was stabbed to death in downtown san francisco, around 30 to 40 of his closest friends and family members packed the courtroom for the verdict. his dad, brother and ex-wife coming together to speak. >> i know for a fact i'm never going to have my brother back, but this is the best of all worst outcomes. >> lee's brother describing the second degree murder verdict against nima momeni as the beginning of their healing process. but the family was hoping for a first degree murder conviction. throughout the case, prosecutors argued many planned to kill bob lee when he took him near the bay bridge and stabbed him three times, claiming he was angry at bob lee for introducing his sister, hassan momeni, to an alleged drug dealer who gave her drugs and sexually assaulted her. he said he acted in

self-defense after lee pulled a knife on him for making a bad joke. >> we think he had the intent to murder. the jury felt like he did not. >> bob lee's ex-wife, krista lee, claimed the jury didn't have all the evidence and spoke about their two kids. >> there will be a civil trial. that means that we will come after his mother, his sister and the brother in law. they are all absolutely guilty. kids are doing well. they're strong. i'm proud of them. >> nima, his mother spoke about her son, saying he's innocent. >> it's very disappointing. and uh. but i should first say my deepest condolences to the family. this is a difficult time for everyone. this is not a fair trial. and we will stand and we will continue. reporter. >> the jury had to consider at least 17 days of testimonies and thousands of pieces of evidence. nima, his mother, was present at every court hearing and deliberation. she said they plan to appeal. >> we both are victims. we are victims of drug abuse.

>> bob lee would have turned 45 years old on friday. now his family is planning to celebrate his life and legacy. luz pena, abc seven news. all right. >> luis, thanks very much. we've been covering this case, of course, from the beginning. if you want to go back and read any of our previous reporting or listen to reaction outside the courtroom, just go to our website, abc seven news.com. >> meanwhile, the man accused of killing united health care ceo brian thompson has been indicted for murder. according to court documents, luigi mangione was indicted today on several charges, including first degree murder and second degree murder as a crime of terrorism. the first degree murder charge carries a sentence of 20 years to life in prison. mangione has an extradition hearing scheduled in pennsylvania on thursday. >> new developments involving the now shuttered federal women's prison in dublin. the u.s. department of justice will pay nearly $116 million to resolve lawsuits brought by more than 100 women who say they were sexually assaulted at the

prison. the settlements come a week after the bureau of prisons announced the permanent closure of the facility, citing infrastructure and staffing. >> tomorrow, prop 36 will take effect across california, which means new penalties on drug and theft related crimes. >> at the same time, some residents in vallejo are asking the governor to send in chp officers to help fight crime. >> abc seven news reporter leslie brinkley has the latest. >> proposition 36 is set to take effect tomorrow and undo some of the unintended consequences ofof prop 47, passed in 2014. prop 36 means some repeat offenders could face felony charges for theft. it will increase penalties for use of illegal drugs and usher in more severe penalties for trafficking fentanyl. the solano county da's office expects it to help small businesses prosper and to help residents feel safer. but vallejo residents say they need more, much more as sideshows in

2024 and violent crime are fueling a cry for immediate action. >> somebody's got to do something. >> how ridiculous does think do things have to get as far as the lawlessness where people come to our city and think they can just do sideshows and get away with it? destroy property, hurt people. so it was kind of the last straw. >> paula conley launched an online petition asking for chp to come to the rescue. the petition is garnering more signatures. just a few weeks after a british rock band was robbed of its laptops, passports and instruments. at 9 a.m. outside a starbucks. >> i really started advocating for the governor. i've gone through the city, i've gone through the county, and i've been emailing the governor, sending formal requests, comments, emails and don't even get an acknowledgment that anything is received. he helped oakland by sending chp, and it's making a real difference there. and vallejo needs that help. >> vallejo city manager said they are aware of the petition, saying the mayor, city council and i have also sent recent

infrastructure with a record $15 billion loan from the federal government. >> p-g-and-e's expects to invest big money into energy projects.t p-g-and-e's says the loan could help the utility improve its hydroelectric infrastructure, which produces enough energy for 4 million homes. money could go to improve battery storage and electric vehicles. money could also go to improve power lines, expand and upgrade substations and transmission networks. mark toney is executive director with turn the utility reform network. >> this will allow p-g-and-e's to make needed investments in wildfire safety, in expanding the ability of the grid to serve more customers. >> the ceo of p-g-and-e's issued this statement in response to the conditional loan from the u.s. department of energy, saying, quote, investments in a clean and resilient grid for northern and central california will have significant returns for our customers in safety,

reliability and economic growth. p-g-and-e's says the money could also be invested into lowering costs for its customers. turn questions that we think that reducing ratepayer bills is a very high priority. >> p-g-and-e's has had foure increases that went into effect in 2024, and there are two more rate increase proposals on this thursday's california public utilities commission agenda. >> turner says there needs to be oversight on how the money is spent, because it is a loan, and p-g-and-e's customers will be the ones paying it back, not shareholders. >> so this is a good thing. we just need to make sure that the money is invested wisely in projects that bring the most value. >> this conditional loan still has to be finalized now. p-g-and-e's faced billions of dollars in wildfire liabilities and filed for bankruptcy protection in 2020. it's also facing big pressure to prevent

its equipment from sparking devastating fires. the department of energy says the loan will help p-g-and-e's meet its forecasted load growth and increase electric reliability. live in the studio suzanne fawn, abc seven news. suzanne. >> thank you. p-g-and-e's reported a record profit last year of $2.2 billion. it could be another big year for the utility. there were four rate hikes this year and it asked for a fifth since january 2021, residential utility rates have risen by over 50% in october. the proposed average monthly bill that went into effect for the typical home was $212.45. >> all right. we are a big step closer to ending those junk fees that cost all of a lot of money. today, the federal trade commission finalized a rule that would ban surprise fees for event tickets, hotels and vacation rentals. the rule would require businesses to disclose total prices up front, rather than tacking on extra costs like convenience fees when

people check out online. the chair of the ftc said in an exclusive interview with abc news that the new rule could equal about $11 billion in savings over a decade. >> this should really provide the american people with just some more clarity and confidence so they don't feel like they're getting, you know, cheated. this is really about saving people money and saving people time. >> the ftc says the final rule will take effect around april of next year. it's projected to save consumers 53,000,000 hours in wasted time searching for the total price. you'll have to be told up front. >> all right, well, we finally got some sunshine today. after the rain. we're done. >> it was intense for a while, but more rain may be coming back here. but meteorologist sandhya patel is here to talk about this. nice break, sandhya. >> yeah, it was definitely a nice break, no doubt about it. and dan and kristen, this morning we started out with heavy fog, even some damp roadways. let me show you a live picture right now from our south beach camera. we are seeing some

high clouds overhead and still some patches of fog lingering this afternoon. as we look at live doppler seven, you can kind of see the combination of the two taking you back in time. the visible satellite picture showing you how heavy the fog was earlier in the day. now, most of it did clear out, but we do have those few patches that are still hanging around reduced visibility across parts of novato down to four miles right now. so do expect another round of this coming our way. we are watching this system here that is basically just soaking the pacific northwest, bringing them some snow. it's an atmospheric river. we're not going to get any rain out of this one yet, but we certainly are seeing a lot of cloud cover out of it, and it is responsible for kicking up the surf. current wave heights are 5 to 13ft. we do have a beach hazard statement at 6 p.m. tomorrow evening until 6 p.m. thursday. we are expecting that long period west northwest swell, bringing a risk of sneaker waves and rip currents, so keep that

in mind. meanwhile, we still have a flood advisory for parts of sonoma until 1030 tonight. they are still seeing some minor flooding in the area. live view from our emeryville camera in downtown oakland is a little hazy right now. mid 50s from san francisco to oakland, hayward, 60 degrees in san jose and 61 and half moon bay. golden gate bridge camera a beautiful view right now. 62, in santa rosa. you're still in the 50s in many areas, from petaluma to concord to livermore, where the fog was slow to burn back. san jose cameras showing you a lovely view right now. overnight tonight. areas of dense fog again. next few days. mix of sun and high clouds. and this weekend, winter starts and the rain returns. looking at the hourly forecast tonight, the high clouds continue to stream in. but we're also going to see patches of fog developing. and by tomorrow morning there will be some fog around in our valleys and along the coastline. tomorrow afternoon, filtered sunshine as those high clouds continue to come in 30s and 40s on your temperatures tomorrow morning. tomorrow afternoon you are looking at 50s and

60s. some of the mildest locations will be around the bay shoreline, like san jose coming in at the upper 60s mark. now ridge remains in place for a couple of days, keeping us dry. friday night a system passes to our nort. and then here comes the rain saturday, going into sunday night, and then again going into early next week, so that wet weather will result in a rain snow mix for the sierra. i want to show you the rainfall projections beginning this weekend all the way into early next week. about 8/10 in san jose, over three inches in santa rosa. accuweather seven day forecast, morning fog giving way to a mild day and that pattern will repeat for a few days. rain for the first day of winter on saturday. level one, level one sunday, monday and tuesday. >> oh boy. >> kristen and dan, are you prepared? >> yes. okay. many communities offer a warming centers when it gets cold, but sunnyvale is trying a different approach. >> that's right. they're renting out hotel rooms to unhoused residents free of charge. >> abc seven news south bay

reporter dustin dorsey explains this could be a life saving solution this winter. >> this week's cold, wet weather is just a reminder of how brutal winter can be here in the bay area, especially for the thousands that live on the streets with no place to call home. unhoused advocate sandy perry says the elements can be devastating for this community. >> if you live outside over a period of time, you develop some serious health conditions. people get colds, people get flu, and people get pneumonia, and there's no way to heal if you're living outside all the time. >> in sunnyvale, leaders think they found a solution that may help on those cold winter nights. a new pilot program will allow the unhoused to stay at a hotel during bad weather. the city will cover two meals a day and a hotel room at the extended stay america on orleans drive for up to 20 days. a temporary hotel room may not seem like much to most, but for someone with nowhere to go on thosene freezing winter nights, this is everything. >> oh, it makes all the difference in the world. it

really it makes a difference between life and death in some cases, i hope, and i know that this program will put a stop to that loss of life even once. >> it will be worth it, but i know it will be more than once. >> this is an issue near and dear to the heart of council member alyssa cisneros. her mother experienced homelessness in sunnyvale for five years. this unique approach takes down barriers that residents face when dealing with traditional warming centers, like occupancy restrictions and referrals. it's not a final solution for the nearly 400 unhoused residents in sunnyvale, but cisneros said during the council meeting that this is a start. >> we just go after this with whatever we got and focusing in on the life and death scenarios that are happening in our city, because if somebody dies on our streets, on our sidewalks, in the corner of a park, or in a tent on a bench, we failed. >> the program will officially begin during the next big storm and run through april. if they are successful, the program will be extended in the future. in sunnyvale, dustin dorsey, abc

or a car smashed into a bar in san francisco. you can see significant damage in this video of the meraloma club on portolao drive. again, three people injured, one apparently in critical condition. two of the victims were inside the bar. the third is the driver. this happened a little over an hour ago. investigators are on the scene trying to figure out exactly what caused this crash. we do not yet know. >> happening now in oakland. the city council is discussing the city's $130 million budget deficit. >> abc seven news reporter anser hassan has a look at what today's city council vote could mean. >> at tuesday's oakland city council meeting, a historic vote on a historic budget deficit close to almost $130 million. >> there are no good choices there, only a different range of bad choices. >> oakland city council member dan kalb, who will likely become acting city council president after tuesday's meeting, hopes council will pass the budget before the end of the year. it includes tackling the city's structural deficit, which means cuts to ongoing expenses. >> and that means not just

freezing some positions, but deleting some positions, some positions that were created in the past five years. >> the budget cuts will come in two phases. the first phase is immediate and includes browning out of two fire stations. the second phase includes layoffs, which will begin next year. >> i'm very glad that the proposal that we have before us today is substantially improved. from what we were looking at just a few weeks ago. >> at-large city council member rebecca kaplan says city council approved moving almost $40 million of restricted funds to the general fund to help close the deficit. it will also impose restrictions on oakland police, forcing it to cut overtime spending by $25 million. that's equal to about 20% of the entire budget deficit. >> and making sure that police aren't being wasted by being sent where there's no activity and no need and no call for service. >> the police union and fire officials argue the proposed cuts will lead to cuts to public safety. labor unions urge the city to increase revenue collection as a way to prevent

layoffs and service cuts. >> they've pretty much done what they can do without going back to the labor force and asking for givebacks. >> professor dan lindheim is a former oakland city administrator. he now teaches public policy at uc berkeley. he says oakland should have controlled spending tax revenue over the past few years to help offset periods of drops in revenue, such as now and then. >> they have to hope and pray that maybe this coliseum sale will be real. and if it is, then these cuts will go somewhat in the direction of helping them in the following year, the budget needs to pass with majority vote in oakland, anser hassan. >> abc seven news. >> today is oakland mayor chantelle's last day in office. 64% of oakland residents voted in november in support of recalling her. she served less than two years. oakland city council is set today to certify the results of that election. council members are also

francisco describe an abandoned lot that has turned into a health hazard. >> now, after more than two years of complaints, solutions are on the way. abc7 news anchor dion lim is here now with the update. dion. >> dan and christine, after all of these complaints about the state of this so-called lake, residents feel like their calls for help have fallen on deaf ears. but after a lot of frustration and two lawsuits, change is finally coming. >> i've seen people in the lake. i've seen people just dump trash in here, and it's kind of just feels like it's a neglected piece of the city. >> this lake is referring to is actually an abandoned construction project that has plagued residents along clara and fifth streets in the soma neighborhood for years. >> it's also a massive safety hazard. on a daily basis, the fence gets ripped open and people trespass into here. >> and i've seen several people die in it. homeless people break in and go down the ramp. >> abc seven has been monitoring the site for months. in 2023, it was a grassy parcel of land. it

started collecting water last year, and in january we saw green algae and plants start to grow. the project was cited by the department of public health in june, and with our recent rains, we noticed the body of water turned black. >> it's mostly just trash and debris and kind of like crap. >> reporter i reached out to the san francisco city attorney's office, who filed a lawsuit in september against 365th llc, the developers who own the lot. they told me 3-1-1 calls started coming in about mosquitoes and standing water in the spring of 2022. the developer's lender also filed suit this past fall, and as a result, a receiver was appointed to abate the violations and hazards. >> the plan is to pump out the water, clean up the residual debris, and then we will proceed to backfill the site to bring it up to grade, stabilize it and repair all the sidewalks and make it so it's a presentable

piece of property. >> work by thompson builders is slated to begin in the next couple of weeks and take several months. residents i broke the news to were relieved. >> so people could feel safe to walk around it and won't have to worry about rats running up to them and stuff. >> but some, like tina, hope what happened on his block prompts more attention next time. >> that's great that they're making some progress on this, but we have to have some type of system in place where properties don't just get neglected like this. >> thompson builders tells me a new ownership group of local investors are planning to build an eight story, 130 unit building on that site. we will continue following this story. dion lim abc seven news. back to you. >> all right dion, thank you. a former tech executive will lead a new city office in san francisco. mayor elect daniel lowry said today he's hiring ned siegel as the first ever chief of housing and economic development. siegel worked for five years as the chief financial officer of twitter. lowry and siegel have known each

other since they both attended a private middle school in the city. >> a popular bakery in the east bay is leaving oakland after ten years. firebrand artisan breads will close its broadway location in uptown oakland on friday. in a social media post, the founder said he decided not to renew the lease. firebrand will consolidate into one location at its production facility and cafe, which is in alameda, not too far away. the company makes an effort to hire people who are formerly incarcerated or have other barriers to employment. today, california's attorney general held a meeting in los angeles to talk about the rights of immigrants across the state. the meeting is the first in a series leading up to inauguration day in january. >> as the president elect makes clear his intent to move forward with. let's be clear an inhumane and destructive immigration agenda. i'm here to make clear that california's immigrant

communities have my support, and will continue to have the support of my entire team at the california department of justice. >> california is home to 11 million immigrants. that's the most of any state. that's why bonta is getting the word out about what people should know ahead of the next trump administration. in california, immigrants have the right to apply for housing without sharing their immigration status. they also have the right to access emergency care and the right to an attorney. also, state and local law enforcement cannot ask about immigration status or share someone's personal information. mountain view based waymo will soon start testing ther vehicles in tokyo. the alphabet owned autonomous driving company says this project will help their vehicles maneuver on left handed roads. the cars will be operated manually before they're ready to take the road on their own. the test is expected to start early next year, and santa cruz based joby aviation is one step closer to having their air taxis take off. joby recently

joining us you guys. so white actors still have the hollywood spotlight. that's according to a new tv study. ucla's latest television diversity study says women and people of color remain underrepresented in key creative and lead roles. the new study examined the top 250 shows on streaming platforms last year, 77% were led by white actors, just 5% featured black leads. still, still a ways to go, you guys. >> yeah. underrepresented. i mean, remember, something like 14% of the u.s. population is african american. so definitely underrepresented. >> it feels like this conversation just goes around and around in a circle. remember we had it in the academy awards a couple of years ago, and you would assume that some progress was being made. but it feels very, very incremental. >> i feel like for a while there was more progress when all these streaming shows were being greenlit. but i feel like studios or, you know, they have pulled back. the streaming
