hard to swallow. >> oakland comes face to face with its massive budget deficit and finds itself having to make some very difficult decisions. good evening. thank you for joining us. i'm dan ashley, just about 30 minutes ago, after a lengthy debate and public comment, the oakland city council moved forward with budget cuts. public safety became the hot issue. during tonight's discussion. council members and the public alike both expressed concern about potential reductions, eliminating police academies and brownouts for fire stations. hearing this, the council did make an amendment that will allow for money from the sale of the coliseum property to be used to keep fire stations from closing. the debate over what to do went on for several hours after the budget passed. council president nikki fortunato bass acknowledged it's a difficult situation. >> thank you everyone. that was certainly not easy. however, we look forward to continuing to partner with the administration, the finance team and all our department heads, as well as our

workforce and the public to continue putting oakland on solid ground. >> this budget freezes hiring but does not eliminate positions or delete them. in the words of one council member. and just moments ago, the city council also voted to certify the results of the november election. that includes the recall of mayor sheng tao, in which 64% of oakland residents voted to recall her after less than two years in office. therefore, city council president, who you just heard from, nikki fortunato bass, is now the interim mayor and city council pro tem. dan kalb is the city council president. now. a special election will be held april 15th for the new mayor as a permanent position. meantime, outgoing east bay congresswoman barbara lee gave her final remarks as a member of the house today. >> for 26 years now, it has been the privilege of my lifetime to serve my incredible constituents of california's 12th congressional district. i feel a sense of gratitude for the

opportunity to not only serve my community, but to advance justice, equity, and peace throughout our country and the entire world. >> to mark the occasion, lee wore the same outfit that she wore when she was first sworn in to congress in april of 1998. you heard her say. there she represented california's 12th district, which includes oakland and most of alameda county. lee did not seek reelection this year. in january, the newly elected lateefah simon will take her seat. new developments now involving the shuttered federal women's prison in dublin. te u.s. department of justice wille pay nearly $116 million to resolve lawsuits. those lawsuits were brought by more than 100 women who say they were sexually assaulted at the prison. the settlements come a week after the bureau of prisons announced the permanent closure of the facility, citing infrastructure and staffing problems. a san jose robbery suspect, also accused of sexual assault is now in custody. police say he broke

into an apartment on south ninth street in early november. armed with a gun. he tied three people up, threatening to kill the man before sexually assaulting the two women. >> this was a very a very horrible case of just three adult victims in their residence going about their day. >> i mean, it was 145 in the morning, so they were probably sleeping. and someone who had violent intentions in mind, not only committing a home invasion robbery, but sexually assaulting the two adult female victims. >> now, police tell us they are not aware of any other crimes he may be connected to. but if you have any information about this case or similar cases, you are asked to contact the san jose police department immediately. niuma mohamed. she was found guilty today in the killing of cashapp founder bob lee. lee was stabbed to death last year in san francisco's south of market neighborhood, and the case drew national attention. now, he faces the possibility of spending the rest of his life in prison. abc seven news reporter melanie woodrow has been in

court every day for the trial, and was there when the verdict was read. >> six weeks of testimony, seven days of deliberations and 12 unanimous jurors. finding nemo mckinney guilty of second degree murder in the stabbing death of cashapp founder bob lee. not first degree murder as charged. bob lee's brother oliver, saying his family believes the murder was premeditated but understands the limits jurors faced. >> this case was extremely hard to prove because it was just nima's word versus my brother's word, which he's not here to be able for anybody to be able to hear those words. >> prosecutors agreed to lie and reinstate, argued mckinney stabbed and killed lee after lee introduced his sister, hussar mckinney, to a drug dealer who she testified sexually assaulted her. san francisco district attorney brooke jenkins i knew and was confident that we had two of our best handling this case. the case received national attention following lee's death, when elon musk tweeted about violent crime in san francisco. jenkins saying musk got it wrong. >> we are a city committed to accountability. we are a city

committed to public safety. >> while many defense attorneys argued he acted in self-defense, mckinney testified it was lee who attacked him with a knife after he made a bad joke, calling into question what type of father he was. >> this is obviously very disappointing for us. these are hard fought battles. >> mckinney's defense says he will appeal. >> mr. mckinney continues to have a right to fight for his freedom, and continues to have a right to fight in this process. >> his mother, who was in court every day of the trial, says her son is innocent. >> this is their decision. my son is not such a thing, such a person. he's the kindest person. every mother would love to have a son like him. i know my son. >> she says he remains determined. when you spoke to nima last night, and he was, he knew there was a verdict and he was waiting to hear it. how is he feeling? what was he sharing with you? >> he's always strong and giving me hope. >> he waived his right to be sentenced within 15 days. a status hearing is scheduled for

january 10th in san francisco at the hall of justice. melanie woodrow, abc seven news. >> roughly 30, maybe 40, friends and family members of bob lee packed the courtroom today for the verdict. his brother oliver expressed his relief, saying the verdict is the first step in the healing process. >> i know for a fact i'm never going to have my brother back, but this is the best of all worst outcomes. >> following the verdict, nemo, mckinney's mother spoke publicly for the first time, saying her son is innocent. >> it's very disappointing and uh, but i should first say my deepest condolences to the family. this is a difficult time for everyone. >> his mother also says they plan to appeal the verdict. he faces a sentence of 15 years to life in prison. the man accused of killing united health care ceo brian thompson has been indicted for murder. now, a new york grand jury today indicted luigi mangione on first and

second degree murder charges. they also added a terrorism enhancement. the manhattan district attorney calls the crime a, quote, frightening, well-planned, targeted murder with the intent to cause terror. >> because of the type of murder, this was a planned hit. staking out the ceo of a health care company that indicates that he was doing that within that first degree murder statute. and the terrorism enhancement to coerce or influence members of the public on a on a policy matter. so that is highly unusual. >> the first degree murder charge carries a sentence of 20 years to life in prison tonight. mangione is still in jail in pennsylvania, where he was arrested. he has an extradition hearing scheduled on thursday that could ultimately bring him back to new york. well, coming up next, san francisco mayor london breed makes her final appearance at the board ofal supervisors meeting and is denied several key appointments.

board of appeals, the other for municipal transportation agency board of directors. a third candidate withdrew earlier. board of supervisors president aaron peskin expressed his desire for incoming mayor daniel lowry to start with a clean slate. the move came just minutes after breed made what could be her final appearance before the board as the city's mayor. a former tech executive will lead a new city office in san francisco. mayor elect daniel lowry said today that he's hiring ned siegel as the first ever chief of housing and economic development. siegel worked for five years as the chief financial officer on twitter. lowry and siegel have known each other since they both attended a private middle school in the city. a small yet possibly significant change in vacancy rates could be a first sign of a turnaround for san francisco's office market. numbers from commercial real estate market research firm jll show the office vacancy rate fell slightly in the fourth quarter. this decrease is less

than a full point, but it is the first decline. keep in mind, since 2020. san francisco has been struggling, as you know, to get workers back into the office after remote work became the norm during the pandemic. another big development plan is in the works for san francisco's outer sunset neighborhood. the two mixed use towers, 124 stories high. the other 22 stories, would have 446 units of housing. our media partner, the san francisco standard, shared these renderings with us. 207 units would be below market value for seniors. now this is at 2700 sloat boulevard, the same site where a different company wanted to build a 50 story residential commercial tower. the community, though, pushed back because it was too big, they felt, and the developer withdrew that application. so now the new plan is two towers. all right, let's turn to the weather as we take a look. live at the conditions. the rain has abated for the time being, but it's coming back.

apparently, meteorologist sandhya patel is here. sandhya? >> yeah. dan, that rain will get in here this weekend. but right now, the concern, as you just showed us from our emeryville camera is the fog. so let's look at san rafael camera and you will notice it's hard to see anything. the fog is heavy. visibility is low. you can see on live doppler seven what areas are under that blanket of fog? visibility down to a quarter mile in santa rosa. zero in novato. a mile in oakland. even places like livermore, concord, san jose reduced visibility. so watch out in the morning. dense fog advisory for all areas shaded in gray until 9 a.m. tomorrow. it's going to be a quarter mile or less through the night going into tomorrow morning. the other concern if you are traveling to southern california, a red flag warning starts tomorrow afternoon, runs until wednesday evening as gusty offshore santa ana. santa ana winds will be developing and they do have a wind advisory. san luis obispo until 6 p.m. los angeles county as well. so

tomorrow morning. watch out. just like this morning. it's going to be hard to see, especially with the thick fog out there. you might need that extra time to get to work or get to where you need to go. there may be a little bit of mist out there as well as we head into the afternoon, higher clouds moving in, so we'll pretty much see a mix of fog, high clouds and sun temperatures in the morning, 30s and 40s. definitely a chill in the air. tomorrow afternoon. you're looking at high temperatures that will be in the mid 50s around our inland areas like antioch, all the way to 68. in san jose, 62, oakland, 60. in the city, san rafael, 66, in santa rosa. now, i want to show you what's going to happen as we head towards later in the week. not until saturday when the rain starts to move in. you will notice another round coming in sunday night, going into monday, and then one more round on christmas eve. we will see a rain snow mix in the sierra. hopefully santa will have no problems with this as we look at the rainfall projections. much needed rain over four inches up along the north coast for
