right now. >> tonight, an oakland neighborhood is in mourning following the sudden death of a restaurant owner, and we're now learning about a violent altercation that happened just moments before. good evening.

thank you for joining us. i'm dan ashley and i'm j.r. >> stone. one man was sent to the hospital and another man ultimately died. >> it happened this sunday near clinton park at east 12th street and seventh avenue. >> abc seven news reporter tim johns has been piecing together the story and has more from frustrated community members. >> male, asian in his 60s. not breathing, not conscious, not bleeding. and we're going to have another male asian in his 60s, conscious bleeding, bleeding from the head. >> police dispatch audio describing the aftermath of a violent incident that happened in oakland's little saigon neighborhood sunday. the oakland police department says they were called out around 430 in the afternoon for reports of an assault. it all began near the best dim sum and pastry restaurant, where opd says a man was vandalizing cars. we spoke with the restaurant's owner, who told abc seven news she didn't want to go on camera. the woman says one of her employees ran out to confront the man who was unhoused. the employee was accompanied by the woman's husband. the pair chased the man down the road. at some point

during the chase, the woman's husband had a heart attack and ultimately died. around the same time, the employee was hit by what opd described as a blunt object. in surveillance video from a nearby gas station, you can see the suspect drop an object before entering the store. moments later, the victim approached the store, touching his head as if checking for blood. the unhoused man eventually walking away. jennifer tran, who is the president of the oakland vietnamese chamber of commerce, says the unhoused man was known among many business owners in the community. >> based on my understanding of the individual, you know, experience in episode one of several that he's had increasingly over the last few years. >> tran says sunday's incident is an example of the anxiety felt by the community when it comes to crime. a few doors down from the restaurant, we met lisa tran from lucky seven cigarettes. tran tells us she's terrified every time she comes to work. >> when i close open. very scared. not safety. >> trend says she feels crime in the area is out of control. she tells us the shop's windows have

been broken 13 times over the past few years. tran also sharing photos and videos of a time when a car drove through the front of their store. the results? the cylinder blocks they've installed near the entrance to try and prevent that from happening again. >> just you come here, you know, help out. nobody come in. how we have business, right? very difficult. >> opd says the unhoused man from the assault was arrested sunday evening. but the event has only heightened the sense of abandonment felt by many of the people in this neighborhood. >> most of the business owners here and the residents here are just holding their breath, hoping that they wouldn't be the next person who's going to be experiencing such tragic incidents. >> in oakland. tim johns abc seven news. >> oakland has seen homicides drop significantly this year, reaching a level not seen before the pandemic. the city even went through a stretch of 46 days where there wasn't a single killing. the neighborhood with the biggest drop is in east oakland. in 2020, the city

reported over 100 homicides annually. this year, there have been 73 homicides, a 35% decrease from last year at this time. the last time that number was this low was 2019, when there were a total of 78 homicides. you can get detailed information about what crime is like where you live with our abc seven neighborhood safety tracker. it includes information and trends for oakland, san francisco and san jose. you can find it at abc seven news.com or on our app. >> new details from milpitas tonight, where four people were found dead inside the burning apartment complex on tuesday. police are now investigating the deaths as a murder suicide. they identified the victims as vin nguyen, becky pham and the couple's two children, a nine year old son and four year old daughter. investigators say each victim was found with a single gunshot wound. a handgun registered to win was found in the apartment. >> this tragedy is a very difficult reminder of the

importance of addressing domestic violence and gun violence. the loss of their lives was preventable. >> police, of course, are still investigating the shooting. they believe the victims were dead for several days before they were found. after concerned family members asked police to do a wellness check. >> a shelter in place order was just lifted at san francisco state, where final exams were disrupted by an anonymous bomb threat. students on campus were told to take shelter for hours as university police conducted a sweep of the buildings, and students off campus were told to stay away. sf state says today's exams will be rescheduled. all activities and classes are canceled for the entire day. police are still investigating the threat after three months on the picket line. >> more than 2000 striking marriott hotel workers in san francisco may be headed back to work soon, but hundreds of hilton and hyatt hotel workers are still picketing. abc seven news reporter suzanne fawn has a look at the tentative deal and

what is still at stake. reporter. >> outside hilton union square hotel workers are still going strong, hoping to get their message across. among them is kenny faust. he works at the bell desk and guest services. >> i've been there 27 years. >> even though christmas is around the corner, faust says their fight is not over. >> we are fighting for our health care, our medical coverage and our wage increase. >> about 1000 hilton and hyatt employees remain on strike. this is day 89 of the strike for them. but on this thursday, good news for more than half of the striking workers. a tentative deal has been reached. in a statement, marriott said it was pleased to reach a new labor agreement. carlos santamaria, who's a banquet server at the marriott marquis hotel, is among those relieved about the new deal. >> it's important because it's a cure that health care for me and my family. it's also a secure wage increases for all of us. pension for us, for the new

generation. >> if marriott workers ratify their contract, 1500 employees will return to their jobs on saturday. the new contract means big wins for marriott employees. lizzie tapia, the president of local two, explains we were able to achieve a fantastic contract with big wage increases, securing our medical benefits, which has been one of our biggest issues here, being able to improve our retirement plan and getting real language to address the shortages of, you know, the workload and cross-classification and staffing issues that we've had related to the pandemic. tapia says workers have pushed back against permanent big cuts to staffing and services in the hotel industry. they hope that hilton and hyatt workers will win big, too. >> really important that marriott workers here are setting the standard for san francisco, and we expect hilton and hyatt to do the same thing in san francisco. >> suzanne phan abc seven news. >> amazon is facing its biggest union action, with workers in four states on the picket line today here in the bay area. they've been outside a san francisco facility since 6 a.m,

calling for better pay, benefits and working conditions. >> we want a living wage. we live in one of the most expensive cities in the country. we want to be able to afford to live here. >> we're going to be fighting until we get what we deserve. >> the striking workers are members of the teamsters union, which represents 10,000 workers and delivery drivers. that's less than 1% of amazon's workforce. amazon says shipments to customers will not be affected. >> with mass deportations promised by the incoming trump administration, local nonprofits are worried about a growing wait list of people in need of immigration representation. abc seven news reporter luz pena went to the largest legal aid organization in san francisco to see what they're dealing with. >> 11 years ago, this single mom who asked us to blur her face and keep her identity private fled el salvador with tears in her eyes, she recalls gang members threatening to kill her and her disabled son. i was

afraid to lose my life and my son. and that's why i came here. she's now afraid of mass deportations under the new administration, even though she's just one step away from becoming a u.s. citizen. even though i have a green card, i'm still afraid that i could get deported. >> because laws changed. >> and with this new president, you never know what could happen. stories like this one are flooding nonprofits like open door legal, where many attorneys are sounding the alarm months before projected immigration operations. concerned that many won't have legal representation. >> there is a coalition of nonprofits with a waiting list of 1200 people who are in deportation, deportation in immigration court. >> if an undocumented immigrant doesn't have legal representation, are they still required to go in front of an immigration judge? >> yes, they are required. in

fact, if they don't appear before an immigration judge, it's very likely that they will be removed and deported from the country in absentia. an immigrant does not have a legal right of state funded legal representation. >> legal experts are also noticing another concerning factor not enough judges. >> immigration court system in the united states is broken. there are not enough immigration judges to handle the large number of people that are on the backlog. >> bill hing, professor of law and migration studies at the university of san francisco, believes funding now will be imperative to provide funding for representation because right now some people have been waiting for six, seven years for their immigration cases. >> and when people come in at the border who are fleeing violence, they have a right to a hearing for their asylum cases as well. >> in san francisco, luz pena abc seven news.

to run for mayor. it's interesting. lee is on her way out of the u.s. house of representatives after 26 years in congress. abc seven news reporter monica madden is tracking developments and is here with us. >> yeah, monica lee, well known in the east bay. >> absolutely. she is a quintessential figure of politics in the east bay, and she was regularly elected to her house seat with more than 80% of the vote. most recently, she ran for an open u.s. senate seat, but lost to adam schiff in the march primary. and now

oaklanders are asking her to lead their city through a time of challenge in the aftermath of a shakeup in oakland's leadership, members of the community are craving familiarity. >> we need barbara lee to run for oakland's mayor. >> in an open letter thursday, a diverse group of leaders declared oakland needs barbara lee. the coalition says the city is, quote, facing a crisis of leadership. our city needs someone who can restore integrity to the office of the mayor, unite us in a time of division, and help us address critical issues around the budget, public safety, housing and inequity in our town. >> we're coming together because we believe in the resiliency of the community and its ability to thrive with right leadership. >> community organizer subur lockett signed the letter. >> congresswoman barbara lee has a proven track record. she understands the city's challenges on a personal level. you know, barbara lee has consistently demonstrated, you know, courage to make really tough decisions, skills that would be tested as the city faces a $130 million budget

deficit. >> barbara lee is at the senior end of the chain in washington. her life is pretty much a magic carpet ride coming back here. it's going to be a very rough and bumpy road in washington. she's one of more than 400 congressional people who makes a decision on any given day in oakland. she would be the one. >> abc seven news insider phil matier says if lee entered the race, she'd be an immediate frontrunner because the people backing her are the public employee unions and the labor council in alameda county, along with various other groups who are on the progressive end of the spectrum. >> and they would be willing to put up money. and basically, barbara lee getting in would keep a lot of people from getting in. >> a spokesperson for lee tells abc seven she is currently weighing all of her options as she finishes her final days in congress. now, lee is not the only person mulling a run for oakland mayor. former nfl and berkeley star marshawn lynch did not rule that possibility out. in an october episode of his

podcast with governor gavin newsom, former city council member lauren taylor also launched a bid for oakland mayor, as well as a former tao staffer, renea webb. so already it's getting to be a crowded field. >> beast mode and oakland beast mode for mayor. >> wow. >> i know, i know. governor newsom was like, hey, i mean, if you threw your name in. people love you in oakland, so we'd have it sometimes. you know, with ranked choice voting, it can be a popularity contest. so we'll see. >> thanks so much. >> all right, well, while we're talking oakland, oakland may end up getting a pro sports stadium after all. oakland roots soccer club put in an official bid to build a 25 000 seat stadium at howard terminal. it's one of several proposals that came from yesterday's deadline for prospective developers. this was the only sports bid. while the others are all industrial or commercial in some way. one issue, though, the team says it could take up to 15 years to make a permanent stadium in three or so years that may be able to. they may be able to construct a smaller, temporary

site as they finance and build the big, real one. >> it is official. this morning, san francisco mayor london breed signed legislation that makes treasure island the new home of the bay fc soccer club. the team plans to break ground next year on a new training facility with three soccer fields at the site. the goal is to begin operating there by 2027. the agreement calls for a 25 year lease at treasure island. bay fc plays its home games at paypal park in san jose. while it looks to build a new stadium in the bay area. >> all right, coming up here. it's dry out there as you look live at santa cruz. beautiful. but the rain is back in the forecast. we'll check in with abc seven news meteorologist

been suffering as we have high pressure, light winds and the pollutants getting trapped right down near the surface. spare the air has been issued for tomorrow. poor air quality in the north bay. moderate elsewhere as we head into saturday. moderate air quality expected for everyone. you can see it is moderate in the yellows, so if you are particularly sensitive to my, tomorrow might be a day where you'll want to avoid exposure to the pollutants. temperatures right now in the 40s and the 50s. definitely a chill in the air if you are getting away to escape the chill. here's a look at your fiesta friday travel forecast. oakland. mostly cloudy skies, 62 degrees. you certainly will have a little bit of fog in the morning if you're heading to cabo san lucas. sunshine 79, morelia 10% chance of a shower 70 degrees and zacatecas 62 with thunderstorms and showers. looking at live doppler seven. some high clouds are moving in. we still have some patchy fog out towards the delta, but that's all going to change as we

head towards the weekend. right now there is a system moving in along the north coast. the pacific northwest is getting wet for us here in the bay area. we're just going to get clouds initially. and then here comes our first system in a series that arrives on saturday. those systems are kicking up the swells beach hazards until 6 p.m. tonight. watch out for sneaker waves and rip current risk. we have a high surf advisory this upcoming weekend. a large westerly swell builds 15, possibly up to 20ft, and that will keep things a little bit rough along the coastline, so watch out! gorgeous view from santa cruz tomorrow. fog, clouds and haze. saturday winter starts, showers arrive, and sunday into next week. a wet pattern is setting up with gusty winds at times. let me show you the morning temperatures with the fog out towards the north and east. bay valleys 30s 40s across the region. tomorrow afternoon i would hang on to that extra layer because some areas only in the mid 50s out towards the delta. but you're in the low 60s in santa rosa, 68 in

san jose, oakland, san francisco, low 60s. high clouds will continue to filter across our region. you have the fog tomorrow morning and then saturday. here comes some wet weather. 7 a.m. the rain moves in. it's just very scattered by 1030 in the morning. and then an isolated shower or two will continue into the early afternoon before the system is done with us. look, the rainfall is not going to be much if you still have a lot of holiday stuff to get out and do, you're fine. a couple hundredths around places like mountain view to about a half an inch in ukiah. now saturday night you're okay. but sunday we do have some more rain moving in. it's mainly a little bit in the morning, a little bit in the evening, and then monday night into tuesday is our stronger storm. it will be wet and windy. christmas is dry. thursday we have another storm that is coming in. here's a look at the accuweather seven day forecast. we have a dry day tomorrow. level one for the first day of winter all the way through tuesday and then christmas is perfect timing. you
