scene. authorities say 50 year old doctor plowed a rental car at high speed into the market, killing two people, an adult and a toddler. at least 60 were injured. 15 seriously? thee motive is unknown here. the incident happened in magdeburg, 100 miles southwest of berlin, around seven in the evening local time. authorities say the suspect is originally from saudi arabia and had lived in germany on a permanent residency permit since 2006. now to developing news out of washington, d.c. it appears a federal government shutdown has been averted. abc seven news reporter monica madden is here with the latest on the vote that just happened in washington. monica, what's in that package? >> dan, first and foremost, this is just a stopgap to avert the government from shutting down. and the bill would extend the current funding into march. so they'll run into that same problem again in a few months. now, this measure passed in the house, 366 to 34, coming after president elect donald trump and his ally elon musk threw a

grenade on the bipartisan deal reached earlier this week. this new package includes disaster relief funding, farming provisions and so much more. it also means federal workers will be getting a paycheck before the holidays. but funding to combat pediatric cancer was left out of the deal, along with a suspension of the debt limit, which has been a key demand from the president elect. now the bill is going to head to the u.s. senate, where it's all but certain to pass, and then it's going to be sent to president joe biden's desk to sign before the midnight, midnight deadline tonight. house speaker mike johnson says things are going to be very different around here when republicans take control of both chambers of congress in january. while applauding the passage of the stopgap stopgap spending bill on friday. >> we are really grateful that tonight, in bipartisan fashion, with overwhelming majority of votes, we passed the american relief act of 2025. >> and if all of this feels like deja vu to our viewers, you're

not alone. this has become almost an annual tradition for congress in which funding comes down to the wire at the 11th hour. now, washington's system of appropriating federal dollars has been in place for nearly five decades. and according to research from the pew research center. congress has only passed all of its required budget members four times in the in the last five decades. now, the last two times congress passed its appropriations bill on time was when there was a budget surplus in 1995 and 1997 under president bill clinton. now, abc seven news insider phil matier says this annual sprint is pretty par for the course. >> what we have is this is almost become an annual event, the debt ceiling. are we going to shut down the government and government these days in washington only operates when there's a crisis, and sometimes they create their own crisis in order to pass things. so that bill that they had the spending bill? yes. it was loaded up with pork. yes. it's essential to the government. it's all the above. but that's how washington does things. they hit the pause

button on it. i don't think they hit the brakes on it completely, but they hit the pause button on it and said, no, we're not doing business as usual. we've heard that before. it's sort of a dance we go through. >> although the bill is expected to pass in the senate, we can expect once it's taken up, senators will have similar back and forth floor debates like we heard in the house before. it ultimately heads to president joe biden's desk to pass later tonight. >> jor dan, monica, thank you so much. moving along, president biden today announced a new round of student loan relief that will benefit nearly 55,000 public service workers. more than $4.2 billion will be forgiven for people enrolled in the public service loan forgiveness program, according to the department of education. this brings the total loan forgiveness to roughly $180 billion. a spare the air alert is in effect for the entire bay area right now because of poor air quality concerns. that means burning wood or manufacturedeans logs and fireplaces, stoves,

pattern to come. so we're going to go hour by hour tomorrow at 5 a.m. it's moving into the north bay. scattered showers at 7 a.m. across the region. 11 a.m. you're still seeing that wet weather. it is certainly not going to be a washout, but hang on to those umbrellas because we still have some showers coming in saturday evening. i will be back to tell you about some stronger storms that are coming in next week. timeline is coming up. dan jr. >> all right sandra, thanks very much. now to a deadly shooting near san francisco's union square. a bizarre series of events led to police shooting and killing a security guard in union square overnight. abc seven news reporter louis pena is here with the newest. the latest developments on this story, louis. >> that's right. the security guard's family is n shock. his mother is flying right now to the bay area from connecticut. this family is searching for answers. the family of the security guard shot and killed by san francisco police officers thursday night is speaking out. >> my brother was peter, and he was 50. just turned 50in august.

>> thomas described his brother peter hutch as hardworking, according to his linkedin, he owned a security business. his family in connecticut shocked to hear he was shot. >> the hospital called and said that he had received multiple gunshots and was in surgery, and they weren't sure if he was going to make it. and then it was shortly after i received the call that he didn't make it. >> it's still unclear what led to this, but according to a source, he was chasing down a delivery driver on an electric bike who had scraped his car earlier. police say during the chase, hutch ran over the curb and hit two teenage girls coming out of chipotle. >> we got reports of a vehicle that was driving recklessly and erratically on the sidewalk northbound on kearny, between post and sutter. >> hours later, police found hutch outside the union square dior store after an attempt to take the suspect into custody

was unsuccessful. >> the officers were involved in an officer involved shooting. >> his family, still searching for answers. >> he's a good guy. he uh- helped out my kids. the best he could from, you know, 3000 miles away, but. it's definitely surreal. doesn't feel like it's real at the moment. >> sfpd said this is still an ongoing investigation. it's still unclear why police shot him. the police department is expected to hold a town hall within ten days of this shooting in the newsroom. louis pena, abc seven news. >> all right, louis, thanks very much. charges today were dropped against the last alameda police officer involved in the death of mario gonzalez. the alameda county da's office says the charges were dismissed against eric mckinley because of inconsistent statements made by a forensic pathology expert about gonzalez's cause of death.

charges against the other twoth. officers involved in the incident were dismissed previously because the district attorney missed the deadline to file charges. gonzalez died in april of 2021 after officers responded to a call of a man behaving strangely. officers restrained him on the ground, with one officer putting an elbow on his neck and a knee on his shoulder, pinning him down for more than five minutes until he lost consciousness. the city of oakland will soon have 24 new police officers. they join a force that is really struggling with staffing, and a city that is struggling to pay millions in police overtime. abc seven news reporter anser hassan has the latest. who are we? >> what does this.? >> it was a proud moment for these new police academy graduates, and an important moment for the city of oakland as it gets 24 new police officers. >> you will learn to use discretion, and not everyone needs to or has to go to jail or receive a ticket. in many

is struggling to pay the millions in overtime. new budget cuts passed this week include reducing police overtime spending by $25 million. for the past few weeks, the mayor has been meeting weekly with the police chief to monitor spending. >> i'll be joining the meeting on monday, and i want oaklanders to know that there's going to be a focus on ensuring officers are out on patrol and they're also out on investigations, and so that means we are making sure our resources are going into responding and solving crimes. >> the oakland police union says graduating 24 officers is significant because opd loses about 5 to 7 officers a month. two schedule academies have been canceled because of budget cuts, which means the next academy won't be until the next fiscal year, which starts in july. in oakland, anser hassan, abc seven news. >> thank you so much. today, the city of fremont announced big signing bonuses for ten new police officers. now, at

$100,000, that makes it one of the nation's largest law enforcement hiring incentives. before this, the signing bonus was $20,000. this is part of the city's effort to improve officer retention and benefits. the faa is investigating an emergency landing by a small plane in the east bay. the single engine cessna safely landed, thank goodness, at the former naval air station in alameda just after 1030 this morning. officials say the pilot reported some kind of mechanical issue. both the pilot and the passenger were not injured. we're glad to say. investigators say that the plane was headed back to the palo alto airport, where it had taken off when it ran into some trouble fighting against the bird flu. what the state is doing to try to keep you safe. targeting not only zelle, but the banks that are not protecting their customers from predators. and some good news if you're hoping to have grab crab that is

resolution to what they say are unfair labor practices. workers from over 500 stores in l.a, chicago, seattle are protesting. they expect the protests to get bigger over the next few days. workers say starbucks backtracked on an agreement about fair pay and future organizing and say starbucks offered, quote, an economic package with only a 2% wage increases. for now for most baristas and a guarantee of only 1.5% wage increases in future years. starbucks says the union is demanding far more, claiming, quote, workers united proposals call for an immediate increase in the minimum wage of hourly partners by 64% and by 77% over the life of a three year contract. this is not sustainable. workers here at the starbucks know that the customers are really going to feel the impact of their protests, especially these next few days, and they're hoping that they can really motivate the company. zohreen shah, abc news,

burbank. >> the party is over for party city, according to cnn. the company's ceo told employees today that the chain store is going out of business, closing about 800 stores all across the country, including 14 that are here in the bay area. party city opened its first store four decades ago. it filed for bankruptcy in january of 2023 after struggling to pay off $1.7 million in debt. dave and busters is moving into oakland's jack london square. the popular arcade chain and restaurant will provide will move into 55 harrison. the building went up in 2019 and was supposed to be a high end food hall. that plan fell through during the pandemic and it's been vacant ever since. the official opening date for dave and busters has not yet been released, but we'll try to keep you updated on that. >> they had planned a fun fy adventure, but it was not that blink of an eye. tragedy struck a bay area victim sharing his family's story after an airboat

football team. >> things started out great. the kids were happy. >> but moments after this video was taken, at the blink of an eye, tragedy struck the airboat the tolsons were riding in collided with another, tossing passengers into the water. 16 people were hurt. david suffered a broken arm and five broken ribs. his wife and two young sons also injured. >> i was helpless and that is probably in any. any father will probably tell you that feeling is probably going to be one of the worst feelings. one of the worst feelings you can feel as a man, to not be able to protect your family. >> kids were screaming blood everywhere. >> earlier this week, i'll see a wyndham from antioch told us how she and her seven year old wound up in the water. >> and so there was two boats coming like this. so we the moment we saw it, it was too late to even react. respond. and it was just the last thing i remember seeing was the boat. and i'm like, oh, we're going to crash. >> florida's fish and wildlife conservation commission is investigating the crash. david tolson's, florida attorney, says the airboat tour company was

>> california health officials updating the public friday on the spread of bird flu around the state in a virtual news conference. >> the overall risk to the public remains low. 35 of our 36 human cases in california are the direct result of exposure to infected cattle. >> the news conference comes just days after governor gavin newsom declared a state of emergency over bird flu. the virus ravaging poultry and dairy farms around the state, a problem health officials say they're working hard to get under control. >> the primary approach for each is a state veterinarian, quarantine and disease control zones to limit the movement of animals, products and equipment. >> all but one of the human cases of bird flu have been in farm workers here in the state. however, more cases are beginning to pop up around the nation of people getting infected without having prior contact with animals. and that is worrying some health officials. >> you know, people might say, why is this a public health emergency in california? and the answer is very simple. we need more hands on deck than we do right now.

seemed to match the somber mood at san jose city hall friday. a memorial for the unhoused remembered by these tombstones after losing their lives this past year. >> a memorial service is for those who have loved and lost, who missed loved ones and must go on living without them. it is for all of us to remember those that are no longer here. >> those like infant camila amezcua, 104 year old elaine tanner, and around 200 others who died on santa clara county streets this year. so far, unhoused deaths are down 3% this year compared to last, but the suffering still exists in great amounts. >> if i'm correct, this year set a record for the number of dead babies, the number of dead dead asians, the number of dead females, the number of dead blacks, and more people froze to death in california than anywhere else in the united states, according to the cdc.
