abc seven mornings live right now at six, a san francisco security guard shot and killed by police. >> what officers say happened hours before this shooting. but first, an east bay restaurant in its final days. why? the owner says a ladies night promotion led to a devastating lawsuit. and we're getting ready for another round across the bay area of rain. good morning everybody. it's saturday, december 21st. we're tracking a level one storm with more to come after that, with more to come. >> you know what though? winter has arrived, so we've got that very early sunset. and the sunrise is 721 setting at 454. but by tomorrow we gain a few seconds as our sun set gets a little bit later, our sunrise a little bit later as well though. so yeah, it's going to be a cold and gray day today with the rain focused in the north bay. you saw those lightning strikes, the

most likely all of them staying to the north. can't rule out a rumble of thunder in the far north bay, but the rain just starting from cloverdale to santa rosa out towards bodega bay, our level one system providing a few returns here from bolinas to fairfax. but no rain there yet. we have this level one with scattered showers, rough and dangerous surf, breezy in spots today, and fog to start out in the east bay with three quarters of a mile in concord. visibility reduced in vacaville to a half mile and also just over a mile in novato, so winds are breezy throughout the morning hours. then they will lighten up. but the rain starts in the north bay here. notice 6:00 through about 730 it begins to track south and east with a few showers from oakland to half moon bay. and then by 9:00, still raining in the north bay with cloudy skies and scattered showers throughout the day. the rest of the bay area and we'll be looking at some morning rain for your sunday as well. we'll add up the totals light totals more or less for the weekend, before some

stronger storms into the christmas week and hanukkah. stephanie. >> all right, lisa, thank you. today, family, friends and community members will gather for the funeral of one of the students killed in a crash that rocked the piedmont community last month. they will honor and remember the life of jack nelson on november 27th. he and his two friends, sean dixon and krista tsukahara, were in a tesla cybertruck when it veered off a road and slammed into a retaining wall and a tree, causing it to erupt in flames. all three were in college, visiting home during holiday break. they all graduated from piedmont high. a fourth person in the car survived that crash. they were pulled out of the burning car by another driver that happened to be passing by in the east bay. a family run restaurant is reportedly shutting down because it held a ladies night promotion and had to settle a discrimination lawsuit because of it. now, due

to financial concerns, the owner of lima in concord says she's forced to close at the end of this year. here's abc seven news reporter tara campbell. >> the sign on the door makes the closure clear. while inside, customers are enjoying one last cocktail. one more meal at lima. >> it's just sad. it's just so sad. >> the family run restaurant in downtown concord has been around for nearly nine years, and is now set to close permanently at the end of the month. >> i mean, i love this place. i, you know, it's like they're like family to us. >> the owner telling us they haven't been able to fully bounce back from the cost of settling a recent discrimination lawsuit related to discounting drinks for women on its ladies night. >> a frivolous lawsuit that took us down. and it's this ambulance chasing lawyers. >> several similar lawsuits have been filed throughout the country, taking aim at variations of ladies night, including earlier this year in fresno, when its minor league baseball team was sued over a ladies night promotion. >> it was exactly that discrimination over ladies

night. >> did it surprise you? were you shocked by that? >> i was a lot. yeah. i've never. i see ladies night everywhere else. >> according to the state, gender based promotions like ladies nights can land businesses in legal trouble. violating california's civil rights act. here at lima, the cost of the lawsuit just piled on to an already tough time, with high inflation driving up the cost of getting these meals to the table. >> with restaurants, it's already the profit margins are razor thin, and stuff like this does not help business at all. it's just i don't know what should be done about it. maybe the city or the state should change some rules to help out the small businesses. >> and these customers agree. >> it's very sad to see a lot of family run places in, in downtown concord disappearing, and soon it won't be the same for these servers or staff here soon to be out of a job. >> i'm really, really disappointed and sad. i was getting really accustomed to the

community and knowing all the regulars that come to the restaurant, these regulars fitting in as much time as they can before the doors close on december 31st. >> a lot of people that come here that enjoy this place, and it's that this is the end of it. >> tara campbell, abc seven news. >> a south san francisco high school put on lockdown after a suspect scaled a fence and trespassed into a classroom this week. the incident caused a police standoff, which you see here. school officials say the students were directed to safety as police responded to this. officers arrested the suspect and thankfully no students or school staff were injured during the incident. now to the investigation into a deadly shooting near san francisco's union square. a bizarre series of events led to police shooting and killing a security guard early friday morning. the security guard has been identified as 50 year old peter hodge. police say he hit two teenage girls with his car at

sutter and kearney while trying to chase down a man on an e-bike who had scraped his car. now, a source tells abc seven news, hodge eventually hit the back of the delivery driver's bicycle, and police say witnesses saw the cyclist run off. hours later, officers shot hodge outside the union square dior store, where they believed he worked as a guard. it's still unclear what led up to the shooting. hodge's family in connecticut was shocked to hear the news. he's a good guy. >> he helped out my kids. the best he could from, you know, 3000 miles away. but it's definitely surreal. doesn't feel like it's real at the moment. >> sfpd says it's still an ongoing investigation. the police department is expected to hold a town hall within the next ten days. we're getting new insight into the tip that put luigi mangione on the radar of san francisco police before he was a murder suspect. sfpd released this missing person

poster of mangione back in november. his mother filed a missing persons report about mangione in san francisco on november 18th. that was 16 days before he allegedly shot and killed unitedhealthcare ceo brian thompson in new york city. mangione is facing three state murder charges, including two terrorism counts. he is scheduled to make his first court appearance in new york city on monday. we report on break ins every week, and this latest one is forcing a silicon valley coffee brewing business to come up to san francisco. and as abc seven news south bay reporter lauren martinez explains, the community is now rallying behind them. >> silicon valley coffee is bringing together new tech and roasting coffee, and you can customize each setting according to exactly how you want your coffee made. the two person company was founded by matt baker and vance bjorn, former tech workers. their lab is in

menlo park. >> we call it the coffee lab, and it's kind of to help analyze coffee. >> three weeks ago, they started renovating a massive 6000 square foot space in san francisco off fourth street and townsend, across from caltrain. on sunday, they discovered two people broke in. baker found a cell phone left behind. >> when i looked at the cell phone and i read a text message conversation on how to break into our property. >> baker said. san francisco police found two people using heroin at the back side of the property. they arrested them, but that's as far as it went, and we were kind of befuddled about an hour later when we saw them letting them go. >> the next day, we came back just to find that everything was stolen. >> they were hit twice in 24 hours. >> i was kind of drained of energy. >> baker took to reddit to express frustration, but also asked the question, how is the best way to handle this? >> we are too excited to let something like this set us back. >> after the post came an outpouring of support from the community and the city is they're waiving all the permitting fees, and we have been getting emails from

different departments asking them, asking us how they can help. >> i mean, when does the city email you? >> if anything, the amount of support has re-energized them to open their cafe. >> i can't wait to have people in there. i can't wait to light up that entire block. >> it can really provide a lot of space for community and that's what we want to accomplish there. >> silicon valley coffee plans to be open in the spring in menlo park. lauren martinez, abc seven news. >> we're hearing from another bay area victim of an air boat collision in the florida everglades. the crash sent players, coaches and family members of a pittsburgh youth football team into the water. david tolson and his family from antioch were traveling with the team. the airboat the tolsons were riding in collided with another boat. 16 people in total were injured in this crash. david suffered a broken arm and five broken ribs. his wife and two young sons are also

recovering from injuries. >> one of the worst feelings you can feel as a man to not be able to protect your family. >> fish and wildlife conservation commission is investigating this crash. tolson's attorney says the airport tow tour company rather is negligent. and this is the statement we got from the company's website saying, quote, wooten's everglades airboat tours regrets that a collision involving two airboats occurred. we immediately contacted local area emergency authorities, who responded rapidly to the scene, providing care to the passengers. we'll keep you posted on that story. all right, for now, let's get you outside and check in with lisa. >> okay, we are looking at some dry conditions. a few scattered showers well up to the north. a level one system arriving today. the focus will be in the north bay, but we've got more rain chances for your sunday and a stronger system arriving around christmas eve. full details just

human cases in california are the direct result of exposure to infected cattle. >> health officials say they are working hard to get this problem under control. all but one of the human cases of bird flu have been in farm workers here in california, but more cases are being reported across the country and people without known contact with animals. new developments this morning. charges were dropped against the last alameda police officer involved in the death of mario gonzalez. the alameda county da's office says the charges were dismissed against eric mckinley because of inconsistent statements made by a forensic pathologist about gonzalez's cause of death. charges against the other two officers involved were previously dismissed because the da missed the deadline to file charges. gonzalez died in april of 2021 after officers responded to a call of a man behaving strangely. this is the body camera footage that shows officers restrained him on the

ground, with one officer putting an elbow on his neck and a knee on his shoulder, pinning him down for more than five minutes until he lost consciousness. the city of oakland will soon have 24 new police officers. they join a force struggling with not only staffing, but to pay millions of dollars in police overtime. here's abc seven news reporter anser hassan with the latest. who are we? >> what is this? >> it was a proud moment for these new police academy graduates, and an important moment for the city of oakland as it gets 24 new police officers, you will largely use discretion. >> and not everyone needs to or has to go to jail or receive a ticket. in many situations, discretion is the better part of valor. >> this is the first academy to graduate under police chief floyd mitchell's watch. officer nathaniel larson was the academy's valedictorian. he says he knows the city of oakland faces challenges, but that's all

the more reason to come to oakland. >> for me, i want to be able to give the most or give back to a community that may need the most help. so i'm up for every challenge there is, and i want to be able to be a good officer and be able to give back to a great community. >> interim mayor nikki fortunato bass spoke, highlighting the diversity of this academy. i want to ask the women of this academy to please stand up so that we can appreciate that. one of them was maya williams, who grew up in richmond. >> it's a tough city, but it's full of people who are tough, people who love the city, people who want to see it be better, do better. and when i chose to become a police officer, i knew exactly where i wanted to be, and that was oakland. >> but these graduates come into a department that is struggling with staffing, and a city that is struggling to pay the millions in overtime. new budget cuts passed this week include reducing police overtime spending by $25 million. for the past few weeks, the mayor has been meeting weekly with the police chief to monitor spending. >> i'll be joining the meeting on monday, and i want oaklanders

to know that there's going to be a focus on ensuring officers are out on patrol, and they're also out on investigations, and so that means we are making sure our resources are going into responding and solving crimes. >> anser hassan abc7 news. >> in the south bay, two memorials were held to remember people who died while living on the streets. it also highlights the importance of doing more to help those experiencing homelessness. here's abc seven news south bay reporter justin dorsey. >> the cold, cloudy weather seemed to match the somber mood at san jose city hall friday. a memorial for the unhoused remembered by these tombstones after losing their lives this past year. >> a memorial service is for those who have loved and lost, who missed loved ones and must go on living without them. it is for all of us to remember those that are no longer here.

>> those like infant camila amezcua, 104 year old elaine tanner, and around 200 others who died on santa clara county streets this year. so far, unhoused deaths are down 3% this year compared to last, but the suffering still exists in great amounts. >> if i'm correct, this year set a record for the number of dead babies, the number of dead dead asians, the number of dead females, the number of dead blacks, and more people froze to death in california than anywhere else in the united states, according to the cdc. >> this is the reality of being unhoused. >> james and his mother experienced homelessness, and he says each name, each tombstone are grim reminders of the failures of our society. >> just the suffering that that that's going around. it's really unfortunate. and i just really want to ask the community that we do more because we can do more. >> leaders in the south bay have

been trying to do more for many years, including san jose mayor matt mehan. he says the city has an ambitious goal next year to offer 1000 new safe, managed placements for people living on the streets and urgency brought on by this annual memorial. >> it's a tough day of reflection, but it also, if there is any silver lining, it's that it it kind of forces all of us to just reconnect with why we're doing the work and the harsh reality of things out there, and to recommit ourselves so that next year there are less of these tombstones, maybe even zero. >> one day in san jose, dustin dorsey, abc seven news. >> officials continue to assess the response to the 7.0 magnitude earthquake that hit off the humboldt county coast. that includes a tsunami warning that was quickly canceled. now we're hearing from a bay area author researching the impacts that could happen here locally in the future. this is video from a 2011, when a quake in

japan sent the tsunami all the way across the pacific and into the santa cruz harbor. it caused $100 million in damages. they've happened here long before that. richard schwartz recently published a book that talks about the tsunami that wreaked havoc after the great quake of 1906. >> there are local little events that wind up in the paper, along with the bigger catastrophe. and there was so much chaos after the earthquake. nobody much cared or looked at the smaller events because there was so much to deal with, and then they were just lost. >> so everyone was focused. after the oh six quake on the damage from the quake, the fire and everything else that some of these tsunamis and just fell underneath the radar under the ones that happened. >> but there was so much more fear of tsunamis back then. >> richard says people were so scared of the tsunami after the oh six quake that they camped out in the oakland hills for days. his new book is called

earthquake exodus 1906. berkeley responds to the san francisco refugees in the north bay. marin county officials have reopened bolinas beach, but with several warnings for visitors. the popular beach was closed in september after a seeping liquid, thought to be human waste, was discovered at a nearby cliff, but samples taken in september and november did not find any human waste. there was evidence, though, of chronic fecal contamination from multiple sources, including wildlife and pet waste. they say the bluffs are also unstable and prone to erosion and collapse. signs will soon be posted warning about the potential dangers. speaking of, the series of storms in round are expected to bring some dangerous ocean conditions. lisa is tracking the latest on that with some wet conditions for us. you were saying primarily the north bay, though, is for this weekend? >> yes. i mean, we'll see some scattered showers throughout the day in the city over in oakland, maybe in the next hour. but the

rainfall accumulation definitely is focused on the north bay through the weekend, where you'll see the heaviest rain. we're not talking any flooding, but we are looking at stronger systems. a couple of them into next week. winter arrived while you were sleeping and you can see the lightning may hear a rumble of thunder far to the north, but not very likely that we'll get into that lightning or thunder here locally in the bay area. but we are looking at rain moving into santa rosa, the coast there, sonoma, into marin county. we go closer and you'll notice right here looking at sebastopol, some light rain in and out of a little bit of light rain there in santa rosa and back westward towards guerneville. and you can see right here from inverness to bolinas, perhaps a few scattered light showers, but still the activity offshore. but notice it's going to all move to the east. so san francisco, oakland, you'll be getting your head wet throughout the morning hours and then becoming more scattered throughout the afternoon. high

surf advisory right on through sunday. so dangerous conditions right now. 8 to 9ft. san francisco bodega bay could see as high as 20ft out there throughout the weekend. it is a mild 56 with those south winds and the cloud cover in oakland, but a cool 46 in sonoma, and there is a lot of fog in the east bay from concord to livermore, 2 to 3 mile visibility. vacaville half mile and up towards the north bay about three miles now in novato. festive. look out there from our exploratorium camera. winter rain for the weekend. light level one system, though next week the systems will be stronger. wet and windy snow levels will be fluctuating and kind of high, unfortunately, and looking at a dry day for christmas, a good break there before we get into that strong storm christmas eve and then perhaps another hefty one after christmas. still have to follow the forecast because it is several days out. breezy conditions there along the coast. noontime. still a little

breezy there and then the winds certainly lighten up. tracking the rain. then notice the north bay through the morning hours. slipping into the east bay, maybe san francisco, and then by 9:00, another wave of shower activity scattered east bay and south bay again. and rainfall amounts through sunday morning. very light. you'll notice we get a few more into the east bay. this is sunday night where we'll see a stronger system, but through 11:00 sunday night, anywhere from about a 10th of an inch in the east bay to 2/10 to upwards of a half inch or better in the north bay. it is in the 40s. lake tahoe 67, in vegas, so milder there. sunny throughout the nation's midsection. 40s and 50s and then cool 20s and 30s with that snow ending in boston looking at 50 to 55. dry for hanukkah on wednesday, christmas day. there's our break with cloudy skies. we'll have those downpours christmas eve. highs today with scattered showers. 62 in fremont, upper 50s in the north bay. the accuweather seven day forecast, a series of weak

alleged fraud issues involving zelle. it's an issue that's closely followed by seven on your side. the consumer financial protection bureau filed suit against zell's operator, as well as bank of america, jp morgan chase and wells fargo. the suit claims zell failed to implement proper fraud prevention safeguards, and the banks failed to properly investigate customer complaints. according to the suit, bank customers lost more than $870 million since zell went into business seven years ago. warehouse giant costco is getting bigger. it's opening dozens of new stores next year, including one right here in the bay area, a new costco in brentwood in contra costa county is scheduled to open in march of

legislation passed and head down to the wire. vote in just a few hours. president joe biden is expected to sign it into law. good morning, everybody. thank you for joining us. this half hour. we are tracking this level one storm moving through the north bay right now. yes. >> we are seeing some showers in the north bay also along the coast of the marin county, sonoma. and you can see the lightning strikes there extreme northern california. so don't worry, we are not repeating what we saw last saturday. could hear a rumble of thunder in the north bay, but most likely this stays to the north. but here comes the rain. from santa rosa to occidental. it is light shower activity from yountville, saint helena we go back towards the coast and from the marin county coast, point reyes to san francisco. some light returns, but nothing happening in the city or east bay except fog. right now it will be scattered showers throughout the morning and afternoon hours less so, but rough and dangerous. surf right on through the weekend. breezy in spots and the fog. what an issue from the east bay to the north bay out through vacaville.

breezy winds certainly along the coast. our beaches very dangerous. and here's the timing. notice how we have those returns up in the north bay. they sink to the south and east throughout the morning hours, and then it is more widely scattered throughout the day. so it's not dry, but it's not raining all day by any means. we will track a similar situation for your sunday. in fact, more breaks on sunday in a few minutes, please. >> thank you. we're taking a live look at the nation's capital this morning, where lawmakers avoided a holiday crisis. at the very last minute, the house and senate passed a funding bill keeping the government open through mid-march, despite pushback from president elect donald trump. both parties were able to come to an agreement. abc news reporter johny fernandez has the details. >> democratic and republican lawmakers moved to halt a government shutdown set to occur before christmas on friday, the house passing a short term spending bill to keep the government open through march

14th. the senate passing the bill after the 1201 deadline. the bill gives $100 billion for disaster aid, 30 billion for farmers and a one year extension of the farm bill. >> we will not have a government shutdown, and we will meet our obligations for our farmers who need aid for the disaster victims all over the country and for making sure that military and essential services, and everyone who relies upon the federal government for a paycheck is paid over the holidays. >> house democratic leader hakeem jeffries, praising the passage of the government funding bill. >> this is a victory for the american people. we have successfully advanced the needs of everyday americans. but there are still things to be worked on, and we look forward to that fight in the new year. >> this comes as elon musk called the bill a crime because, like many bills, it included spending for many other areas. he threatened the republicans

who supported it, saying they deserve to be voted out. and trump pushed for republicans to raise the debt ceiling. the debt ceiling is how much the government is able to borrow, which will hit next year after trump is inaugurated president, potentially posing a challenge for his presidency. trump told republicans that without it, a deal shouldn't be made. the bill is set to head to president biden's desk to be signed. johny fernandez, abc news, new york. >> this comes as president joe biden approved the largest military aid package the u.s. has ever granted taiwan. the president announced the u.s. would be giving $570 million to the taiwan military. part of the funds will go towards military education and training. taiwan, of course, remains a major point of contention between the u.s. and china. biden has shared he hopes for the chinese military activity around taiwan to end. developing news overnight, the death toll and the attack on a

christmas market in germany has risen to five, including a small child, according to officers. a doctor intentionally drove into this crowded market filled with holiday shoppers at the time this morning, people have been passing by the crash site, dropping off flowers and saying prayers. at least 200 others were injured in this incident. the suspect is now in custody. this morning, the chancellor of germany visited the crash site. abc news reporter zohreen shah has more on the investigation. >> horror before the holidays after a car plowed into people visiting a christmas market in magdeburg, germany, the attack killing at least two and injuring about 60 others, according to german security officials. this is the moment a car captured on cctv suddenly drove into the evening market, plowing through the holiday crowds at high speeds. a suspect has been arrested in the attack that sent shoppers fleeing in panic. u.s. law enforcement sources told abc news. according

at sfo this morning as people head out for the holidays. this just in. the faa has put out a status advisory due to the winds in the area. they are experiencing some delays for arriving flights on average between an hour and 15 minutes up to three hours. so check your flight if you are expecting some loved ones to be coming in this morning. other flights are around 15 to 20 minutes. now, this comes as flights to and from the northeast have been impacted by the cold weather. reporter laura aguirre brings us the latest. >> pack your patience, please. it's going to be busy across the nation.

weather to portions of the great lakes and northeast early next week. >> the terminals are going to be very busy across the nation. >> the best way to avoid a tsa delay in tsa, you can simply type in what you want to bring and it will tell you. >> should i put it in my carry on bag? should i put it in my checked bag or should i not bring it at all? >> as always, be early. be prepared. i'm laura aguirre, reporting. >> a lawsuit has been filed to try to stop the expansion of the oakland airport. the stop the expansion coalition claims the port of oakland, which runs the airport, is in violation of state laws. it's in part because the port has not requested a health impact assessment from alameda county. the lawsuit also claims the expansion would increase flights at the airport by 55% and increase air pollution across the east bay. alameda county fire crews teamed up with iheartradio and community groups to help spread a little holiday cheer this

season. a toy and food drive was held at the bay fair mall's chili's in san leandro, and they collected unwrapped toys, canned food, and diapers to help those in need this holiday season. one local business even showed up with a classic fire truck full of toys. >> it's one of my collection of six, so it's just a fun hobby that we have. we are collecting plastic fire trucks, keep them up and running and do fun things like this right here. >> toy and money donations are going to the alameda county fire toy program. nonperishable food donations benefit the alameda county food bank and donated diapers benefit oakland's youth uprising. well, disney parks are bringing the holiday cheer this season with their disney parks magical christmas day parade. the star filled event features performances, floats, and your favorite disney characters. here's abc's george

system arriving this morning in the north bay, spreading to the south and east. while we're not expecting steady rain, we are looking at some winter time showers as winter arrived while you were sleeping. look at those lightning bolts. not like last weekend by any means. we are probably going to see all of this stay to the north, but can't rule out maybe a rumble of thunder in the extreme north bay. but they are light showers as we go in a little bit closer, you'll notice the activity there to the north of us, and then some light rain from santa rosa to occidental, glen ellen,

sonoma, highway 116, and then back westward to dillon beach, marin county, lagunitas, highway one and bolinas, as well as inverness. some wet weather finally beginning in san rafael and perhaps southern marin county, down through tiburon, right off the coast of san mateo here. so you're going to get some showers into the city in the next hour or so, and perhaps slipping into oakland. but then there's not a whole lot of this system left, but we have breezy winds ahead of it. it's going to be a level one throughout the day and into sunday. high surf until 4:00 tomorrow, 8 to 9ft right now, but we could see as high as 20ft trying to get you a shot where it is light out there, because the sun not coming up until 721, 50 degrees in santa cruz, a high of about 60 today, 50 downtown right now, a mild 56 in oakland. so not as cold out there. those breezy southerly winds allowing for that insulating blanket with the clouds and that mixed atmosphere. 51 in santa rosa, but a cold 44 in napa. and some

fog here from the delta to our inland valleys up in the north bay. and finally our exploratorium camera. so winter showers over the weekend. level one today and tomorrow. next week we will compound the saturated ground with some stronger systems. windier that level two arriving for christmas eve and then christmas day and hanukkah. dry, cloudy and cool. here's a look at the breezy winds 20 to 30 miles along the coast. so we've been having some issues at sfo with those gusty south winds, but throughout the day they do subside. here's a look at the track of the rain. notice the focus is in the north bay, but we have some showers throughout the peninsula and east bay. 930 more rain up towards santa rosa and then by noontime, scattered showers from the peninsula. and then the bulk of the day. really not bad. it will be dry into early sunday morning, probably while you're sleeping. some light showers there and a dry afternoon later on sunday. you can see some heavier activity moving into the
