everybody. we actually just walked right through it. >> yes we did a wave of rain pushing through san francisco oakland into the east bay. level one system. breezy winds right now. thunder and lightning. well up to the north. you can see those lightning strikes staying there. and that wave of energy pushing through. but we have a cold front on the way today that's going to bring more scattered showers. six 8-80 over into the east bay, sunol and pleasanton, dublin. some wet weather moving out of hayward. we take you down further south to 237 and 8-80 where we've got wet weather into the south bay and then the santa cruz mountains. so scattered showers are on tap with breezy winds right now. winds up to 21 miles an hour. sfo san mateo up to 30. half moon bay and look at the fog from concord. mile and three quarters visibility. and throughout the day the showers become more scattered. that weak level one. staying with us today and into your sunday. stephanie. >> all right. lisa. thank you. today, family, friends and community members will gather for the funeral of one of the

students killed in a tesla cybertruck crash in piedmont. they will honor and remember the life of jack nelson on november 27th. he and his two friends, sean dixon and krista tsukahara, were in a truck when it veered off a road and slammed into a retaining wall and a tree, causing it to erupt in flames. all three were in college, visiting home during holiday break. they all graduated from piedmont high. a fourth person in the car survived that crash. they were pulled out of the burning car by another driver passing by in the east bay. a family run restaurant is reportedly shutting down because it held a ladies night promotion and had to settle a discrimination lawsuit because of it. now, due to financial concerns, the owner of lima and concord says she's forced to close at the end of the year. here's abc seven news reporter tara campbell. >> the sign on the door makes the closure clear. while inside, customers are enjoying one last cocktail. one more meal at lima.

>> it's just sad. it's just so sad. >> the family run restaurant in downtown concord has been around for nearly nine years, and is now set to close permanently at the end of the month. >> i mean, i love this place. i, you know, it's like they're like family to us. >> the owner telling us they haven't been able to fully bounce back from the cost of settling a recent discrimination lawsuit related to discounting drinks for women on its ladies night. >> a frivolous lawsuit that took us down. and it's this ambulance chasing lawyers. >> several similar lawsuits have been filed throughout the country, taking aim at variations of ladies night, including earlier this year in fresno, when its minor league baseball team was sued over a ladies night promotion. >> it was exactly that discrimination over ladies night. >> did it surprise you? were you shocked by that? >> i was a lot. yeah. i've never seen. i see ladies night everywhere else. >> according to the state, gender based promotions like ladies nights can land businesses in legal trouble. violating california's civil

rights act. here at lima, the cost of the lawsuit just piled on to an already tough time, with high inflation driving up the cost of getting these meals to the table. >> with restaurants, it's already the profit margins are razor thin, and stuff like this does not help business at all. it's just i don't know what should be done about it. maybe the city or the state should change some rules to help out the small businesses. >> and these customers agree. >> it's very sad to see a lot of family run places in in downtown concord disappearing, and soon it won't be the same for these servers or staff here soon to be out of a job. >> i'm really, really disappointed and sad. i was getting really accustomed to the community and knowing all the regulars that come to the restaurant, these regulars fitting in as much time as they can before the doors close on december 31st. >> a lot of people that come here, that enjoy this place, and it's that this is the end of it.

>> tara campbell, abc seven news. >> a south san francisco high school put on lockdown after a suspect scaled a fence and trespassed into a classroom. the incident caused a police standoff. school officials say the students were directed to safety as police responded. officers arrested the suspect and thankfully no students or school staff were injured during the incident. now to the investigation into a deadly shooting near san francisco's union square. a bizarre series of events led to police shooting and killing a security guard early friday morning. the security guard has now been identified as 50 year old peter hodge. police say he hit two teenage girls with his car at sutter and kearney while trying to chase down a man on an e-bike who had scraped his car. a source tells abc seven news hodge eventually hit the back of the delivery driver's bicycle, and police say witnesses saw the cyclist then run off. hours

later, officers shot hodge outside the union square dior store, where they believe he worked as a guard. it's still unclear what led up to the shooting. hodge's family in connecticut was shocked to hear the news. he's a good guy. >> he helped out my kids. the best he could from, you know, 3000 miles away. but it's definitely surreal. doesn't feel like it's real at the moment. >> san francisco police say it's still an ongoing investigation. the police department is expected to hold a town hall within the next ten days. we're getting new insight into the tip that put luigi mangione on the radar of san francisco police before he was a murder suspect. sfpd released this missing person poster of mangione back in november. his mother filed a missing person's report about her son in san francisco on november 18th. that was 16 days before he allegedly shot and killed unitedhealthcare ceo

brian thompson. mangione is facing three state murder charges, including two terrorism counts. he's scheduled to make his first court appearance in new york city on monday. now we report on break ins every week, and this latest one involves some cryptic text messages, drugs and a silicon valley coffee brewing business trying to make ends meet. and as abc seven news south bay reporter lauren martinez explains, it's the community support that's keeping them afloat. >> silicon valley coffee is bringing together new tech and roasting coffee, and you can customize each setting according to exactly how you want your coffee made. the two person company was founded by matt baker and vance bjorn, former tech workers. their lab is in menlo park. >> we call it the coffee lab, and it's kind of to help analyze coffee. >> three weeks ago, they started renovating a massive 6000 square foot space in san francisco off fourth street and townsend, across from caltrain. on sunday,

they discovered two people broke in. baker found a cell phone left behind. >> when i looked at the cell phone and i read a text message conversation on how to break into our property. >> baker said. san francisco police found two people using heroin at the back side of the property. they arrested them, but that's as far as it went, and we were kind of befuddled about an hour later when we saw them letting them go. >> the next day, we came back just to find that everything was stolen. >> they were hit twice in 24 hours. >> i was kind of drained of energy. >> baker took to reddit to express frustration, but also asked the question, how is the best way to handle this? >> we are too excited to let something like this set us back. >> after the post came an outpouring of support from the community and the city. >> they're waiving all the permitting fees and we have been getting emails from different departments asking them, asking us how they can help. i mean, when does the city email you? >> if anything, the amount of support has re-energized them to

open their cafe. >> i can't wait to have people in there. i can't wait to light up that entire block. >> it can really provide a lot of space for community and that's what we want to accomplish there. >> silicon valley coffee plans to be open in the spring in menlo park. lauren martinez, abc seven news. >> now we're hearing from another bay area victim of an air boat collision in the florida everglades. the crash sent players, coaches and family members of a pittsburgh youth football team into the water. david tolson and his family from antioch were traveling with a team, the airboat the tulsans were riding, and collided with another boat. 16 people were injured in this crash. david suffered a broken arm and five broken ribs. his wife and two young sons are also recovering from injuries. >> one of the worst feelings you can feel as a man to not be able to protect your family. >> florida's fish and wildlife conservation commission is

seven. the green you're seeing is the rain moving through the bay area right now. lisa is tracking a level one storm, primarily impacting the north bay. she'll have the latest for you in just a few moments. state health officials are alerting the public about the rising spread of bird flu. the virus is ravaging poultry and dairy farms across the state. two thirds of the state's dairies are now under quarantine because of this virus. california is the nation's largest dairy producer. this comes days after the governor declared a state of emergency over the illness. >> the overall risk to the public remains low. 35 of our 36 human cases in california are the direct result of exposure to infected cattle. >> health officials say they are working hard to get this problem under control. all but one of

the human cases of bird flu have been in farm workers here in california, but more cases are being reported across the country and people without known contact with animals. new developments. charges were dropped against the last alameda police officer involved in the death of mario gonzalez. the alameda county da's office says the charges were dismissed against eric mckinley because of inconsistent statements made by a forensic pathologist about the cause of gonzalez death. charges against the other two officers were previously dismissed because the da missed the deadline to file charges. gonzalez died in april of 2021 after officers responded to a call of a man behaving strangely. officers restrained him on the ground, with one officer putting an elbow on his neck and a knee on his shoulder, pinning him down for more than five minutes until he lost consciousness. the city of oakland will soon have 24 new police officers. they join a

force struggling with not only staffing, but to pay millions of dollars in police overtime. here's abc seven news reporter anser hassan with the latest. who are we? >> what are. 4-1-1 is this? >> it was a proud moment for these new police academy graduates, and an important moment for the city of oakland as it gets 24 new police officers, you will largely use discretion, and not everyone needs to or has to go to jail or receive a ticket. >> in many situations, discretion is the better part of valor. >> this is the first academy to graduate under police chief floyd mitchell's watch. officer nathaniel larson was the academy's valedictorian. he says he knows the city of oakland faces challenges, but that's all the more reason to come to oakland. >> for me, i want to be able to give the most or give back to a community that may need the most help. so i'm up for every challenge there is, and i want to be able to be a good officer and be able to give back to a

great community. >> interim mayor nikki fortunato bass spoke, highlighting the diversity of this academy. i want to ask the women of this academy to please stand up so that we can appreciate. one of them was maya williams, who grew up in richmond. >> it's a tough city, but it's full of people who are tough, people who love the city, people who want to see it be better, do better. and when i chose to become a police officer, i knew exactly where i wanted to be, and that was oakland. >> but these graduates come into a department that is struggling with staffing, and a city that is struggling to pay the millions in overtime. new budget cuts passed this week include reducing police overtime spending by $25 million. for the past few weeks, the mayor has been meeting weekly with the police chief to monitor spending. >> i'll be joining the meeting on monday, and i want oaklanders to know that there's going to be a focus on ensuring officers are out on patrol, and they're also out on investigations, and so that means we are making sure our resources are going into responding and solving crimes.

>> anser hassan abc seven news. >> one of the organizers of the recall effort against san jose city council member omar torres is now looking to take his job. matthew quevedo announced he's running to fill the now vacant district three council seat. quevedo currently works as the mayor's deputy chief of staff, in charge of neighborhood outreach. >> i see the suffering on the streets when it comes to homelessness. i see the issues in our neighborhoods when it comes to public safety. i definitely be in a downtown residence. we do see the issues of blight and the need for beautification. >> the district three seat opened up when omar torres resigned last month while being investigated for child sexual misconduct. he has since been arrested and charged with three felonies. also in the south bay, two memorials were held to remember people who died while living on the streets. it also highlights the importance of doing more to help those experiencing homelessness.

here's abc seven news south bay reporter dustin dorsey. >> the cold, cloudy weather seemed to match the somber mood at san jose city hall friday. a memorial for the unhoused remembered by these tombstones after losing their lives this past year. >> a memorial service is for those who have loved and lost, who missed loved ones and must go on living without them. it is for all of us to remember those that are no longer here. >> those like infant camila amezcua, 104 year old elaine tanner, and around 200 others who died on santa clara county streets this year. so far, unhoused deaths are down 3% this year compared to last, but the suffering still exists in great amounts. >> if i'm correct, this year set a record for the number of dead babies, the number of dead dead asians, the number of dead females, the number of dead blacks, and more people froze to

death in california than anywhere else in the united states, according to the cdc. >> this is the reality of being unhoused. >> james and his mother experienced homelessness, and he says each name, each tombstone are grim reminders of the failures of our society. >> just the suffering that that that's going around. it's really unfortunate. and i just really want to ask the community that we do more because we can do more. >> leaders in the south bay have been trying to do more for many years, including san jose mayor matt mehan. he says the city has an ambitious goal next year to offer 1000 new safe, managed placements for people living on the streets and urgency brought on by this annual memorial. >> it's a tough day of reflection, but it also, if there is any silver lining, it's that it it kind of forces all of us to just reconnect with why we're doing the work and the harsh reality of things out there, and to recommit ourselves

so that next year there are less of these tombstones, maybe even zero. >> one day in san jose. dustin dorsey, abc seven news. >> in the north bay, marin county officials have reopened bolinas beach, but with several warnings for visitors. the popular beach was closed in september after a seeping liquid, thought to be human waste, was discovered at a nearby cliff. samples taken in september and november did not find any human waste. there was evidence, though, of chronic fecal contamination from multiple sources, including wildlife and pet waste. they say the bluffs are also unstable and prone to erosion and collapse. signs will soon be posted warning about the potential dangers. now, speaking of, there will be dangerous ocean conditions along the coast as lisa is tracking this level one storm and then a series of storms to follow the holiday week too. >> yes, that's right, we have light systems today and tomorrow bringing periods of scattered showers. but the surf definitely condition as we will see breakers over 20ft throughout

the weekend through 4:00 on sunday, and the breezy southerly winds with us along the coastline. so it's not going to be raining all the time, certainly. but as we get into christmas eve, monday night, christmas eve, that's a stronger system, a level two, and we'll get to all of that with the seven day outlook. but you can see the lightning strikes here that are far to the north. i mean, we can't rule out a rumble of thunder, but the main activity heads to the north while we see waves of scattered showers throughout the day. and we saw one of those waves move through. and it currently is moving through livermore and dublin. 580 right now, a little bit wet as well as pleasanton. and as we take you further south into fremont, you can see the wet weather here, logan drive and then further 8-80 into the south bay where the east foothills and 280 some wet weather into 680 as well the santa cruz mountains, and not much going on along the peninsula except a few areas of sprinkles, and as well in the north bay. but our surf continues to get larger. it is

by the moment here, 9 to 10ft, and we've got that large westerly swell, the risk of sneaker waves and rip currents right on through the weekend. so the level one with us today and tomorrow, looking at the dangerous surf, breezy winds in spots. and then we'll have a bigger break tomorrow afternoon. but today doesn't look too bad either. but the fog has certainly been an issue from a mile and three quarters in concord and to about a mile up in santa rosa. so gray skies, our exploratorium camera. it is 58 with the clouds and the breeze in hayward, with 55 half moon bay raindrops. here the golden gate bridge a slick roadways for sure. 50 santa rosa, the upper 40s in our inland valleys and a wet tarmac at sfo. those breezy winds impacting some of the activity there for sure. so the winter showers winter arrived while you were sleeping. we'll see more showers through the overnight hours and then next week we're looking at a stronger storm, a wet and windy pattern monday night into christmas eve, christmas day and hanukkah look dry. that's a good break for us. our extreme north bay will be

looking at sort of compounding events with most of the rain to the north. so by the time we get to the middle and the end of the week, we could see some flooding, perhaps in the north bay, 43 with the rain showers and lake tahoe sunnier and milder vegas to la upper 60s. you can see the cold, clear conditions from kansas city and we had snow in the northeast. now it's cold 34 in new york. so here's the way it's going to look today as the showers continue to move across the area, 1130 and then into the afternoon light showers. this is overnight tonight into your early sunday. so we still have that level one. and then monday night looks a little bit stronger. the weekend rain totaling a quarter of an inch throughout the east bay. more than that than three quarters of an inch through the north bay. and there's a look at our breezy winds. so we are certainly looking at the possibility of some flooding potential. look at that. that's what i wanted to show you into next week. so highs today from the low 60s with the scattered showers, the accuweather seven day forecast, that stronger system into tuesday, more rain the

developments in alleged fraud issues involving zelle. it's an issue closely followed by seven on your side. the consumer financial protection bureau filed suit against zelle operator as well as bank of america, jp morgan chase and wells fargo. the suit claims zelle failed to implement proper fraud prevention safeguards, and the banks failed to properly investigate customer complaints. according to the suit, bank customers lost more than $870 million since zelle went into business seven years ago. all right. good news for pappy van winkle fanatics or those who crave those deliciously affordable rotisserie chickens. warehouse giant costco is getting bigger. it's opening dozens of new stores next year, including one right here in the bay area. a new costco in

the holiday week next week. stephanie. >> all right lisa thank you. happening today striking union employees at the hyatt hotel here in san francisco will make a critical vote ratifying a tentative agreement for a new contract. if that contract is approved, it would end a nearly 90 day strike. nearly 650 workers remain on strike at the hilton hotel that's also in union square. the agreement being voted on today is the same agreement ratified by marriott union workers on thursday. the terms include wage increases along with new protections against understaffing and workload increases. meanwhile, some are calling it strike miss, referring to the surge of strikes happening this holiday season. right now, thousands of starbucks workers, starbucks workers, rather amazon workers and other popular brands are picketing just days before christmas. abc's zohreen shah has the latest. the contract? >> no coffee.

>> with just four days to go until christmas. thousands of workers protesting two major american companies. >> we struggle every month to pay our rent to afford groceries, and that's unacceptable. don't get it. >> shut it down. starbucks baristas in california, chicago and their home base, seattle began a five day strike friday, demanding better pay, benefits and resolution to what they say are unfair labor practices. >> the holiday season is huge for starbucks, and there is an economic aspect to striking that's really important. >> workers say starbucks backtracked on an agreement with only 2% wage increases now for most baristas. starbucks says the union is demanding far more, proposing an increase that they claim is, quote, not sustainable. put it in park, put it in park. and it's day three for delivery drivers for amazon. on the picket line in four states after the company ignored

mid-march. president joe biden signed the bill just moments ago, and despite pushback from president elect donald trump, both parties were able to come to this agreement. abc news reporter johny fernandez has the latest. >> democratic and republican lawmakers moved to halt a government shutdown set to occur before christmas. on friday, the house passing a short term spending bill to keep the government open through march 14th. the senate passing the bill after the 1201 deadline. the bill gives $100 billion for disaster aid, 30 billion for farmers and a one year extension of the farm bill. >> we will not have a government shutdown and we will meet our obligations for our farmers who need aid for the disaster victims all over the country and for making sure that military and essential services, and everyone who relies upon the federal government for a paycheck is paid over the holidays. >> house democratic leader hakeem jeffries, praising the passage of the government funding bill.

that spending bill into law within the last hour. now to developing news out of germany, the death toll in the attack on a christmas market has risen to five, including a nine year old child, according to officers. there, a doctor intentionally drove into this crowded market that was filled with holiday shoppers at the time. this morning, as you see here, people have been passing by the crash site, dropping off flowers and saying prayers. the chancellor of germany also visited this morning. at least 200 other people were injured in this. the suspect is a 50 year old saudi doctor who has lived in germany for nearly two decades practicing medicine. the reason why he did this is not known. president joe biden approved the largest military aid package the u.s. has ever granted to taiwan. the president announced the u.s. would be giving $570 million to the taiwan military. part of the funds will go towards military education and training. taiwan,

of course, remains a major point of contention between the u.s. and china. biden has shared he hopes for the chinese military activity around taiwan to end. the fda has approved the first prescription drug for obstructive sleep apnea. the weight loss drug rebound is part of the class as ozempic. it was clear to treat moderate to severe forms of the sleep condition in people with obesity. drug maker eli lilly says it should be used with both diet and exercise. obstructive sleep apnea affects as many as 30 million people across the u.s. still ahead this morning. travel experts say this weekend will be the busiest yet at airports since the pandemic, but a storm moving along the northeast could cause some problems for travelers. we're tracking it, and here's this live view from our golden gate bridge camera. you see all the raindrops on our lens? lisa is tracking

prepared. i'm laura aguirre, reporting. >> a lawsuit has been filed to try to stop the expansion of the oakland airport. the stop oq expansion coalition claims the port of oakland, which runs the airport, is in violation of state laws. it's in part because the port has not requested a health impact assessment from alameda county. the lawsuit also claims the expansion would increase flights at the airport by 55% and increase air pollution in east oakland. still to come this morning, we have much more on this level. one storm. let's get you outside. how's it looking, liz? >> well, we are certainly rainy out there. take a look at our exploratorium camera, where it is 57 degrees. winds are up to about 20 miles an hour at the airport, so it is kind of a mess. throughout san francisco, a wave of rain moved through oakland. there's more in the santa cruz mountains, so becoming scattered throughout the day. level one through your sunday, we'll talk rainfall totals and a stronger system before christmas and hanukkah. when we return from the break.

spay right now. piedmont and oakland. some light shower activity. highway 13. there. emeryville. the damp roadways. and as you get further south into mount hamilton, it is certainly wet. back into the santa cruz mountains, ben lomond and felton and more showers offshore. so we'll continue to see periods of showers, light showers throughout the day. there is a high surf advisory where the breakers through tomorrow could possibly hit 20ft. so dangerous. surf conditions are level one system today with the scattered showers, breezy winds. and here's a look at those winds over 20 miles an hour. san mateo you can see right along the

coast here, but upper elevations 45 to nearly 50 miles an hour. so vigorous little system working through throughout the day today over a mile. that's not great. visibility from concord to novato and a little over two miles in livermore. so you can see from our east bay hills camera. it's a little nasty out there with a light rain blowing through. 52 downtown, 57 in san jose. and look at the golden gate bridge. it is soggy. upper 40s cold conditions with the fog. 47 in napa. and as we go through the rest of the morning hours, notice the scattered nature of the showers. and another line here from 1130 into about 130. moving into the east bay, the peninsula, and then into the overnight hours, we'll have a few more showers. so a lot of clouds around throughout the day today and then early tomorrow looking at that rain, a bigger break and then more rain, heavier rain sunday into monday and that stronger system monday into christmas eve. this is the weekend rain quarter of an inch for most of you through 11:00 tomorrow night, and then a third

of an inch, perhaps through san francisco, a little bit more as you get to the north wine country. santa rosa, over three quarters of an inch. but then we get a break as we get into the holiday. cool and dry for the evening, for hanukkah on wednesday in the morning. looks dry for christmas as we'll see cloudy skies. so the showers leading up to that on christmas eve could be heavy. so we're talking about monday night into christmas eve. a little bit of a stronger system, a level two. then we dry out on wednesday, which is some good news because we have more rain and storms following on christmas into that thursday, friday and possibly next weekend that could see some potential flooding up in the north bay. as for today, scattered showers. level one, breezy winds 58 in richmond, 60 in oakland and the accuweather seven day forecast. we'll keep with that level one into sunday morning showers, a bigger break sunday afternoon and then late monday into christmas eve. that's when we'll see the heavier rain, gusty winds a level two for tuesday, a break

and in fact it eliminates deductibles entirely. currently, around 800,000 of our enrollees are benefiting from this program. we cover 1.8 million as we head into 2025. every covered california enrollee will be eligible for the program. can enroll in a silver plan with lower costs with things like primary care, prescription drugs, and also no deductibles at all. the second new thing this year is we're also available to more californians than ever before with a new federal regulation that came to be over the summer. daca recipients can now access covered california, the coverage we offer, and all of our financial assistance programs for the first time. there are around 200,000 daca recipients that call california home. we estimate 40,000 could access covered california, our health coverage, and our financial support, and get covered in many cases for the first time. now, we are watching a legal challenge to that expansion, but right now we are open for daca recipients,

and we will provide accurate, up-to-date information if anything changes. so, covered california offers two kinds of financial help. the first lowers that monthly premium cost that we know. that's what people look out when they're deciding whether to get covered. we have 90% of those we cover receive that type of financial help. many people pay just $10 or less for coverage. in fact, about 2/3 of those who are uninsured and eligible for covered california would pay an estimated $10 or less per month to get coverage. we also offer subsidies that lower those out-of-pocket costs, so once you're covered, you can afford the care that you need. so this is lower co-pays, lower or no deductibles, right? those things that you might have to pay if you seek care, so you can access whatever the care is that you need. we're incredibly excited that california has lowered our uninsured rate more than any state in the nation, down from over 17% to just 6.4% based on the most recent data. yet we also know there are

over 1.3 million californians who continue to go without coverage and who are eligible either for no-cost coverage through medi-cal or low- or no-cost coverage through covered california. it's really hard to reach the remaining uninsured-- it's harder work than it used to be at the beginning. but we know there are barriers that remain, and one of them is just that our health care system is confusing and it's hard to navigate. and that's why, this open enrollment, we're launching our campaign let's talk health. it infuses open enrollment with health literacy, providing new resources that are in-language, tailored to our communities, and available across the state, through partnerships with our libraries. over 1,000 libraries across the state of california are joining us this open enrollment to help distribute those resources and further serve the communities in which they reside. covered california wants to make the process of enrolling as easy as it can be, so however is best for you is how you can enroll. you can enroll online at coveredca.com
