>> now to the suspect accused of killing unitedhealthcare ceo, luigi mangione 11-count indictment, first-degree murder and terrorist charges. senior investigative correspondent aaron katersky with more. aaron, luigi mangione facing one state and one federal charge. >> accused of insurance executive to appear in a courtroom for a second time today, but this time facing state charges and accused him of acting like a terrorist. >> this morning, luigi mangione due in new york state court for charged 11-count indictment for murdering unitedhealthcare ceo, brian thompson. he was shackled at the waist and his ankles. he came in civilian clothes, cappy gillnet khaki pants, maroon sweater over a white button down shirt and he had read the words "not guilty" when asked how he pleaded to the charges. he was in a state court with 11 count indictment with murdering united health care ceo brian

thompson. >> targeted premeditated terror. >> mangione has appeared in federal court on stalking and murder charges after returning to new york following an arrest in pennsylvania where investigators found handwritten >> this is an "abc news" special report. >> we are coming on the air because the man accused of killing united health care ceo brian thompson pleaded not guilty in new york state court. 26-year-old luigi mangione facing 11-count indictment first-degree murder in furtherance of terrorism for allegedly shooting thompson in the back outside of manhattan hotel. if convicted he faces life in prison without parole and federal making him eligible for the death penalty. his lawyer calls federal charges a pylon and promises to "move forward with vigorous defense

and mangione entered the state charges plea. listen. we saw just a moment ago, he walked into the courtroom. you can see him in handcuffs flanked by law enforcement as well as attorneys. they were plenty of people in the courtroom as well. some supporters have him and again let's look at the moment he entered his plea before the court. >> not guilty. >> we have a copy of the indictment notice of immigration consequences as well as rap sheet. i believe the court has it and we gave the cord an extra copy and went to counsel appeared to the court wish to be her respective bail? >> there is one situation of the

federal charges. >> as we understand that we have primary jurisdiction and we have been informed by the u.s. attorney, they intend to allow us to try our case first. so with respect to whatever goes on there as the party of primary jurisdiction, the trial in the sentencing will take place here prior to anything that takes place in the federal system. >> what you just said the, the answer is, but is fine to take him into custody? >> that i am not sure because your honor, signed a writ in which it says we will return the defendant to federal custody. so, i think that would be step 2. i think logically as the party with primary jurisdiction coach at the custody should be here. asked the court in light of the court signing the writ

the people have had this case almost three weeks. and that is more than enough time to gather as much information as they can give to us especially now that we have to go proceedings that we have to answer to, one of them being death eligible. we are requesting we get immediate discovery of new york city police department and fbi and federal and state documents. second thing i want to make a record of, your honor, i am very concerned about my clients right to a fair trial. he has been prejudiced by statements made by government officials. like every other defendant, is entitled to a presumption of innocence. unfortunately, the way it has been handled so far, his rights are being violated appeared till l'affaire guarantees a right to a fair trial but nothing put in place yet that in fact the

opposite of what's been happening. he has a young man and he has been treated like human ping-pong ball between warring jurisdictions here facing federal and state prosecutors coordinating with one another right at the expense of him that conflicting theories and their indictments. they are literally treating him like he is -- like some sort of political thought or or some spectacle. he was on display for everyone to see on the bank's stage i ever seen in my career. it was absolutely unnecessary. has been cooperative for with law enforcement in an custody over a week. he waived extradition and cooperative all accounts. there was no reason for nypd and everybody to have big assault rifles, quite frankly, i had no idea was in their arsenal. to have the press there and the media there, perfectly

choreographed. what was the mayor of new york city doing at the press conference? that made it utterly political and as you know, the court of appeals for the second circuit held it to be clearly established that the staged median related to legitimate law enforcement objective is unconstitutional. i submit zero law enforcement objective to do that sort of pergola. absolutely no need for that whatsoever. and frankly, your honor, the mayor should know more than any one of the presumption of innocence that he too is supported when dealing with his own issues and frankly i submit he was just trying to detract from those issues by making expectable of mr. mangione. there is consequences to this, he has a right to a fair trial. i want to put on the record statements the mayor made publicly about my client and nothing saying allegedly, for

may be rachel. we turn to the blockbuster headline out of hollywood, actress blake lively filing a complaint with the costar director justin baldoni accusing of sexual harassment and trying to ruin her reputation. allegations he denies and this is serious and a lot of people are talking about this this morning, lara. >> blake lively allege violated physical boundaries with multitiered plan designed to destroy her reputation. over the weekend that fallout already apparent as baldoni was let go by the agency. william morris endeavor. >> this is a big moment. >> sure is thank you for your service business. >> this morning blake lively taking legal action against justin baldoni, costar and director box office hit, "it ends with us" accused of sexual harassment in smear campaign against her which he denies. >> stop walking through this

there. thank you. we turn to the hair-raising rescue for nearly 200 skiers and snowboarders in colorado when gondola malfunction leaving them trapped some four hours. andrew is here mack and he has the story, this was terrifying for the skiers. >> yes, it was, good morning, rachel, they were hoping for a day on the slopes but had to be saved by ropes. after ski lift gondola malfunctioned and 160 skiers and snowboarders needed rescuing many 40 feet in the air for hours. >> this morning a dramatic rescue at a popular ski resort in colorado. video capturing skiers and snowboarders lowered from gondola after malfunctioned leaving stranded and suspended in midair six hours. >> we heard them power it down and then i realized this was not your normal run of the mill, let's stop the left. there was something really serious. >> you've got this, girl. rescuers
