short time ago. and, zach, what are you learning? >> yeah, it is just incredible what happened here this afternoon. what we're talking about is the wharf over here in this direction. the very, very end of it, 150ft at the end, collapsed into the ocean. and just to show you how far some of the debris, actually building a restroom that was at the end of the wharf is all the way over in this direction over here. now you're seeing some of the video of the construction workers of that debris in the moments after it fell into the ocean. officials say this all happened after 1244 this afternoon, when they received the call that an end of the municipal wharf where the dolphin restaurant and restroom number three were collapsed into the ocean, along with three workers. some of those engineers working on the structural integrity of the wharf to see if they could bring construction into the area eventually, because they were anticipating this high surf. now, two of those victims were rescued by a lifeguard unit. one other person was able to self rescue themselves. we're seeing

some of the drone video now of the area that collapsed into the ocean. now, they had been anticipating this high surf, but still they said nothing is quite prepared them for what happened. and they believe that the worst is still to come. the debris in the ocean right now is the big concern. there are pilings in the ocean. there's that restroom in the ocean that we were talking about. so they really want people to stay out. we're out here almost every year around this time of year, where high surf and storm damage has impacted this community, and it's something officials talked about in the press conference this afternoon. take a listen to what they had to say about this uphill battle that they're facing. >> this most recent incident was another testament to the power of our changing climate. we're finding every year that our models or forecasts, despite all the effort that our staff put in collectively to planning for these potential incidents each year, it's really blowing through our forecasts. >> the ocean right now is extremely dangerous, so we're telling all people to stay away, to observe from a safe distance.

look over here. >> but again, it is that debris that they are most concerned with right now. they can't really make too much effort to go in and clear it out, because they are still in the heat of the moment, as they say. this high surf warning is expected to continue through tomorrow. so again, they're asking people to steer clear of the water, to not go anywhere near it because there are some serious hazards in there, physical hazards, and then also toxins that could be in the water because again, it's a restroom. it's a lot of debris that fell in there. so the wharf is closed indefinitely. and this is an impact to the small businesses on the wharf and really around it, because a lot of people are coming to this area during the holidays. again, though, amazingly, no one was seriously injured. all people that were at the end of the wharf are accounted for. so the worst case scenario that could have happened did not happen. but now again, they're watching conditions and figuring out how they're going to move past this as they continue to deal with the effects of the climate is having here in santa cruz county. so we're going to continue to track all developments and bring them to you as soon as we can. right

now, live in santa cruz county. zach fuentes, abc seven news. >> all right, zach, thanks very much. thank goodness no one was hurt. that is obviously the most important thing. but what a wild scene there. these are the conditions blamed for washing away part of the war for zach is this is in capitola now where monster waves trigger the closure today of the capitola wharf. the national weather service posted this video and says at the time it was shot, the swell had not even peaked yet, so it got bigger from there. every bay area beach is under a high surf warning. the national weather service says 30 to 40 foot waves are expected until tuesday afternoon. this is a look now at conditions today at linda mar beach in the in pacifica. the warning covers all pacific coast beaches and the national weather service warns of, quote, life threatening swimming and surfing conditions and significant beach erosion. >> and meteorologist sandyha patel has been telling us for days now about the stormy weather. and our strongest storm is yet to come. and sandy, i

know you're tracking the next round of rain as well. absolutely. and karina, let's just start first with that high surf warning. it was extended until tomorrow night and with good reason. take a look at this live picture from our santa cruz camera. those waves are still pounding the coastline. we have high surf warning until 6 p.m. tomorrow. current wave heights 21 footers at san francisco, bodega bay point arena 20 footers. those breakers 30 to 40ft and in favored areas could be up to 60ft. stay out of the water. this is life threatening conditions. we also have a coastal flood warning until noon tomorrow. certainly. watch out. low lying areas will see flooding with the conditions we're in right now. looking at live doppler seven, it's pretty quiet. we have some light showers in santa rosa, but the storm that is developing as you look at le doppler seven that is going to be a level two, has been kicking up those waves and that's why we are still concerned. that storm hasn't even arrived yet but it is sending us those waves. so

this evening at 5:00, just some scattered light showers that continues later on this evening. and here comes that next storm while you're sleeping. hopefully 3 a.m. downpours coming through the region that continues at 5 a.m. and even into 9 a.m. today's system is level one. scattered light showers, slippery roads, dangerous surf. tomorrow's system. it is a level two. it's a moderate strength storm with the life threatening surf continuing. those downpours, gusty winds and even the possibility of thunderstorms. i'll be back with a full look at the timeline, plus your accuweather seven day forecast, which is an active one. dan boy, it sure is. >> sandy, thanks very much. here's a live look now at conditions in the north bay from our camera atop mount tamalpais. stormy conditions there are expected to hit that area particularly hard, as is so often the case. abc seven news reporter cornell bernard is staying on top of it live now with a look at how the north bay is getting ready for the next round of rain and wind. cornell. >> yeah. hey, dan, the chp is

urging so many drivers out there to be careful. they are watching this storm and they urge everyone just to take it slow. no matter where you're going this holiday. meantime, there is an effort to provide emergency shelter to the area's unhoused population. >> the worst weather always seems to come in those overnight hours. >> bourbon county responding to the weather and a christmas eve storm set to deliver a lot of rain. this emergency weather shelter is opening on kerner boulevard in san rafael with room for 60 people. >> this is open to all homeless individuals who want to get out of the weather and rain, have a dry place for the night and get connected to some food and fellowship with other folks, but mostly just to stay warm and dry. >> it's tempting. i want to. i'd like to get indoors. >> jason odom hopes to make it to the shelter because he's not prepared for the storm. >> geez, louise, i got a emergency poncho and an umbrella. you heard the song

you. >> well, weather is putting a damper on some holiday travel plans. the number of flights there. it's breaking records, and some travelers are dealing with delays. the fog brought some setbacks this morning. sfo saw an average of 160,000 travelers per day over the weekend. nearly 8 million americans are flying, and triple a says another 107 million will be on the roads. >> it's pretty busy. definitely busier than i expected. i probably should have left a little bit earlier. >> pretty long line, but i've been traveling a lot by myself and i'm pretty used to it. but it's nothing out of the ordinary for, you know, holiday travel. >> there have been just over 180 delays at sfo today, and just one cancellation tomorrow will be busy, but the rush should taper off for the rest of the week. well, the weather didn't cause any big uptick in delays or cancellations at the san francisco bay oakland international airport. more than 500,000 passengers are expected to pass through the airport for

the december holidays from december 20th through january 6th. airport officials expect the busiest travel days to be this past friday the 20th, as well as this upcoming friday the 27th, and you can stay with abc seven news and abc seven news.com for storm. watch as we track the continuing rain. you can get live updates on the abc seven news bay area app, where you access the same live doppler seven tools. >> our weather team uses. the holiday commute on highway 24 was stalled by a fire in the caldecott tunnel this morning. the chp says a minivan burst into flames after colliding with another vehicle inside the eastbound portion of the tunnel. this was just before 10:00. the driver of the minivan got out safely. no other injuries were reported, but all eastbound lanes had to be closed temporarily to deal with this. five skiers are recovering from injuries suffered in a fall from a lift at heavenly mountain resort. the resort says at least three of the people fell from the comet express chairlift this

morning. the chair they were riding in slid backwards, striking the chair behind it. all three skiers fell about 30ft onto the snow. two others on the ground also suffered injuries. all five people had to be taken to a hospital in reno. >> the salvation army in san francisco says a grinch has gotten in the way of their christmas meal deliveries. they say multiple batteries have been stolen from their delivery trucks, and they believe the most recent one was taken overnight. abc seven news reporter lena howland explains how they are moving forward with christmas meal deliveries, despite the speed bumps. >> my guess is they just got a carjack, put it sideways and started cranking in between these two until it broke. >> the broke the welds. on the cusp of the salvation army's busiest time of the year, an unexpected setback at their soma location. with christmas only two days away. >> somebody had busted through our fence, got into one of the trucks that has some of the items that we're going to be passing out and has stolen the

batteries. >> the nonprofit is gearing up to deliver 4000 meals to homebound seniors across the area on christmas morning. but only a few weeks ago, major matthew madsen says the batteries were stolen from another delivery truck in the same lot. >> those were stolen. we decided not to put those in there until we needed to move them, because we didn't want the new ones to get stolen. >> inside of one of these trucks is filled with nonperishable goods that were set aside for wednesday's meal deliveries that they can't get to without a battery. >> it's very, very frustrating. and yeah, there's costs involved, but it's more just, why are we doing this? it's right before christmas. it's disheartening. >> and they're string of bad luck didn't end there. just as they were dealing with the stolen battery. monday morning they got a call that five gunshots went into their bayview location overnight, shattering the front door and leaving another bullet lodged in a wall inside. >> we're just trying to do the best we can to serve the community. and unfortunately, i mean the salvation army. we are in the communities that need our help the most, and oftentimes

has been reached between hilton hotels and the remaining 650 striking hotel workers. so far, the details of the agreement have not been disclosed. a vote

to ratify the deal is scheduled for tomorrow morning. if approved, this would end a three month strike that included workers from hilton, hyatt and marriott hotels near union square. over the weekend, hyatt reached a deal with its union workers, and marriott did the same last thursday. >> nordstrom is going private once again. the department store's founding family says it is regaining control of the 123 year old company. the $6 billion deal is expected to close early next year, but first, it must be approved by two thirds of nordstrom's common stockholders. the family tried to take the retailer private in 2018, but the board rejected the deal, saying the price of $50 a share was too low. since then, the company's stock has plummeted to nearly half that amount. back in august, nordstrom closed its flagship store in san francisco because of declining sales. after 35 years of doing business, downtown santa has delivered a little early for some kids in the south bay who

can't be home for the holidays. >> in this case, santa is several santa clara county firefighters. this morning, they dropped off christmas toys to dozens of young patients at valley medical center, including roston, houston. roston was injured recently in a fire at his family's home in santa cruz. >> it means a lot to me, and it's it makes me it humbles me just with what the valley and the people of the valley are doing. and it restores my, my whole faith and just people in general. >> it's a very special day. these kids, they're having a tough time, and we're here to spread some joy. >> 45 straight ahead. >> this is the second year of the hospital toy giveaway. most of the gifts were donated by citizens who dropped them off at fire stations around santa clara county. >> just the sweetest thing to do. good for them. all right. let's talk about the weather. what a murky day. >> it's been so gloomy and gray. maybe we'll see some sun, i don't know. let's check in with sandhya patel to see if she has any good sunny news for us.

okay, well, we're going to have to wait about a week, but we will eventually see the sun as far as bright skies. okay, karina and dan, let me show you some live pictures right now from our tower cameras. you both are absolutely right. good afternoon to all of you. it is a murky view. no matter which direction you look in. and that is because we do have not only fog, but we have a lot of cloud cover. and once again, i do want to draw your attention to that live picture from santa cruz. the waves are really big right now. they're dangerous at high surf warning and coastal flood warning are both in effect until tomorrow, so please stay out of the water. it is not safe to go in. here is the storm that is basically kicking up the waves. it's already triggering lightning along the northern california coast here. locally, we're just seeing a lot of cloud cover and some spotty light showers, especially in our northern part of our viewing area like santa rosa. temperatures right now anywhere from the 50s to the 60s. but look at gilroy. it is 70 degrees. pretty mild down there. okay, cameras showing you a cloudy view today. occasional light

showers tomorrow morning. it's a stormy start to the day. and christmas and hanukkah. well, let's just say it's going to be dry for the holidays. so it's all about the timing. and right now we'll keep it as a level one for today. just scattered light showers, slippery roads, dangerous surf. it becomes a level two, a moderate strength storm for tomorrow. with those downpours and gusty winds, even a slight possibility of thunderstorms. certainly life threatening surf. so watch out for that as we look at the winds. look at the clock 2 a.m. out of the south over 30 miles an hour at point reyes. those winds will remain gusty at 4 a.m, but it is really going to be a really short lived event. the winds will back off pretty quickly once that system moves in. so as we go hour by hour this evening, just a few scattered light showers between 5 and 7 p.m. and then here comes that next storm. 3:00 in the morning you are going to be woken up. if you're a light sleeper in the north bay by pounding rain just about anywhere at 530 in the morning, as you can see, becoming more widespread. 8 a.m. we're seeing pockets of

moderate rain. this really just starts to push off by 10:00 in the morning, but more showers start to pop up in the afternoon and could even see a thunderstorm or two. so definitely don't let your guards down. as we look at the rainfall projections, anywhere from about 2/10 of an inch in brentwood to over an inch of rain in the northern part of our viewing area, this does turn to a mix of rain and snow in the sierra, where winter weather advisory goes up tomorrow 5 to 10in above 6000 higher over the peaks. with those gusty winds, it's going to be tough to get up there with slippery roads and chain controls at times. so if i were you, i would get up there before that storm arrives or hold off. stormy start to the morning, 40s and 50s to start the day tomorrow afternoon. you're looking at highs ranging from the 50s to the 60s. once again, the steadier, heavier rain and the gusty winds will be to start the morning. it's a level two later in the day turns more showery. it's a level one for thursday, friday, saturday and sunday as periods of rain continue.

and around the bay area continue to show their appreciation for a's legend rickey henderson after news of his death over the weekend. they called him the man of steel and the greatest athletic of all time. fans have been stopping by the 66th avenue gate at the coliseum to honor henderson. the hall of famer passed away friday at ucsf from complications of pneumonia and asthma. he was 65 years old and in fact, would have turned 66 day after tomorrow on christmas day. henderson had a 25 year baseball career and his major league baseball's all time leader in stolen bases, leadoff home runs and runs scored. >> attention last minute holiday shoppers, you have two days. here are some of the stores open for that last minute shopping. target is open on christmas eve

from 7 a.m. to 8 p.m. tj maxx, marshalls and homegoods will be open from 7 a.m. to 6 p.m. all of these stores are closed on christmas day. as for grocery stores, safeway is open on christmas eve and some safeway locations will also be open on the 25th. trader joe's and whole foods are both open on christmas eve, but are closed christmas day. most shipping services like ups and fedex are open on christmas eve with modified hours, but are closed on the 25th. most local, state and federal government offices are also closed on wednesday. >> you'll want to plan ahead if you're taking public transportation during the holidays tomorrow. muni, bart, vta, ac transit, and samtrans plan to operate normal service, but on christmas day, they will all operate on a holiday schedule. caltrain will run on a modified schedule tomorrow and a holiday schedule on wednesday. >> in the east bay, a holiday giveaway is helping out families, singles and seniors in need. a thousand baskets full of

mayors and now is coming back. ned siegel well, that's an interesting one. he's a longtime lifelong friend of lurie's. they went to school together. he's been working with them on tipping point. he's coming in as a friend and an adviser with the mission of trying to revitalize san francisco's downtown. that's a big job. but they hope that his contacts with twitter and such would be a boon to it. >> matier says lurie is fulfilling his promise to voters. >> lurie was elected to take a fresh look at city hall. that's what he pitched and that's what he is doing. >> and the hires suggest a focus on pro-business policies, as lurie looks to deliver on one of his top priorities, he told abc7 about in september. >> i just want to turn around the city that i love, and eight years from now, artists, creatives, business leaders are going to be like, i got to be in san francisco. >> while the incoming mayor has been looking outside of city hall for his immediate staff, he still has two major appointments left. chief of police and head of sfmta. >> those are the two most important appointments. we'll

see what happens. >> and lurie has also announced that he's going to be shaking up the organizational structure in his office. now, i know most of you hear that word and you might yawn at that phrase, but lurie says it's a big deal. so currently, all 56 department heads report to one single person, which is the mayor's chief of staff. now under lurie. he's announcing he announced earlier this month that he's going to add four policy chiefs to coordinate with the departments on different issues, saying it's going to improve with cooperation and communication amongst everyone in the city. so you'll be having more of, you know, four different people for all of those department heads to talk to rather than just one person. >> more manageable, actually. >> possibly. i mean, that's the goal, right? so we'll see. >> all right monica thank you. >> well, developing news now, former president bill clinton is in the hospital after reportedly developing a fever. he's under observation and undergoing tests at medstar georgetown university hospital in washington, d.c.sity aides say mr. clinton is awake and alert. a source close to the former president says the situation is not urgent, and that he wanted to be checked

out. out of an abundance of caution. clinton has faced a number of health scares since he left office in 2001. he is now 78 years old. >> in developing news now, the house ethics committee released its investigation into former representative matt gaetz, the man initially chosen to lead the justice department by president elect donald trump. it found gaetz violated florida's statutory rape law and paid for sex. abc seven abc news reporter christiane cordero has the details from washington. >> today, the house ethics report at the center of matt gaetz short lived confirmation process for attorney general has been made public. the bipartisan committee alleges between 2017 and 2020, gaetz paid 12 women for sex almost $100,000 combined, according to the report. one woman listed as victim a testified she was 17 years old and had just completed her junior year in high school in 2017, when she and gaetz had sex. she told investigators she received $400 in cash, which she

understood was payment for sex, but did not tell gaetz she was underage at the time. and she says he didn't ask. the committee concluded there is substantial evidence gaetz violated florida's statutory rape law. its years long investigation also found evidence of illegal drug use, acceptance of improper gifts, granting special favors to personal associates, and obstruction after gaetz refused to comply with subpoenas and withheld evidence from the committee. gaetz has long denied all wrongdoing and today disputed some of the findings in a post on x, writing quote, there is a reason they did this to me in a christmas eve eve report and not in a courtroom of any kind, where i could present evidence and challenge witnesses. a justice department investigation into similar allegations ended with no charges brought against him. last month, the house ethics committee voted not to release the report. then last week, members quietly voted to make it public. committee chairman representative michael guest said releasing the report after gaetz's resignation has potentially catastrophic

consequences. congressman mark desaulnier says he voted in favor of releasing the report, saying transparency and accountability are crucial for good governance. gaetz filed a federal lawsuit todo try and stop the report's release, saying it would cause damage to his reputation, calling the information defamatory, adding because he's a private citizen, he's no longer subject to the committee's jurisdiction. the committee released the report hours later. christiane cordero, abc news, washington. >> the man accused of killing united health care ceo brian thompson appeared in court in new york today for his arraignment to formally hear the charges against him. luigi mangione spoke only once to plead not guilty to 11 counts, including first-degree murder. his attorney then spoke on his behalf, saying mangione has become political fodder for new york mayor eric adams and other politicians. she pointed to mangione's high profile arrival in new york, flanked by new york mayor eric adams and a large squadron of officers.

monica and sandy are joining us, and the owners of a popular peruvian restaurant in concord say a sex discrimination lawsuit is forcing them to close at the end of this month. and it's not for the reason you might think. the restaurant lima settled a lawsuit over its ladies night promotion, offering discounted drinks to women. the owner says they weren't able to recover from the financial hit from that lawsuit. all right, we got three ladies versus one guy here. dan, do you want to start? i mean, would you feel offended to see a ladies night and you don't get a discount on a drink or an appetizer or something? >> i wouldn't know. and it's lawyers that go find these restaurants and file suit. i wouldn't i mean, the theory is they're trying to encourage more ladies to, to show up and be there. so i wouldn't personally be offended, you know, or put out by it. but yeah. >> monica, what do you think? >> i mean, wasn't there a time in the world where women weren't even allowed to go to bars?
