starts right now. >> a night of mayhem on san francisco streets, ending with half a dozen police officers firing on a security guard. that guard accused of running down multiple people on the sidewalk just hours earlier. new video shows the guard pulled a gun on

officers in the seconds before the shooting. good evening. thank you for joining us. i'm dan ashley. for more than a week, we've had questions over what led up to the guard's killing. and tonight we have those answers for you. abc seven news reporter j.r. stone breaks down the dramatic new video released by police at town hall today. this is surveillance video showing the driver of a black suv chasing an e-bike rider on the sidewalk around 630 at night. >> days before christmas, near san francisco's union square. seconds later, the suv, which actually looks like a law enforcement vehicle, slams into that e-bike, sending the rider airborne. the 911 calls immediately came in from two women on the sidewalk who had been injured and were taking cover in this nearby chipotle. >> hello? me and my friend just got hit by a car and it was a van, and they were on the sidewalk and they they hit me and my friend with the car. okay. ran off like this. okay. >> what hurts on you? what did

they hit on your body? >> my foot and my side. and the. they say he flew. >> but the story doesn't end there. the driver who unsuccessfully tried to put the e-bike in his suv after hitting it, took the bag that was on the e-bike and left in that vehicle that was his suv. around seven hours later, officers say they located that suv and the man they believed slammed into the e-bike. 50 year old peter hodge, an armed security guard working outside of the well-known dior store. and police body cam video. you can hear officers attempting to make an arrest, even using nonlethal force at one point. >> turn around, turn around, head up. >> officers gave mr. hodge multiple commands to put his hands up and to turn around. mr. hodge partially raised his hands and stated, quote. for what? what are you worried about? mr. hodge moved his right hand toward his waistband area. officers number four and five yelled out, hey! >> hey! he's reaching, he's reaching! >> mr. hodge quickly took a

shooting stance with his feet shoulder width apart. two hands on the handgun, slightly bent forward while pointing at the officers in the street. >> that is when six police officers fired and struck hodge, who later died at the hospital. police say this was hodge's gun that he was holding during the shooting. as for the e-bike rider, he has not been located by police. sources say that hodge chased down the rider after he scraped his suv. we asked police about that monday but have not received clarification in san francisco. j.r. stone abc seven news. >> the man convicted of a notorious crime in vallejo now faces new charges for two other crimes in the south bay. matthew mueller was charged in court today for two 2009 home invasions and sexual assaults in mountain view and palo alto. he's accused of breaking into homes while women were sleeping. prosecutors say he tied them up and forced them to drink a fluid nyquil, and then left after the victims persuaded him not to

rape them. the attacks happened in 2009, years before another crime put mueller in the headlines. he's currently serving time for breaking into the vallejo home of aaron quinn and denise huskins. that was in 2015. he drugged and tied them up, then kidnaped and sexually assaulted huskins. vallejo police falsely accused the couple of making it all up. all right, let's turn now to your accuweather forecast and a frigid night ahead. as the temperature is dropping, you're looking out live from our mount tam cam where a frost advisory is in effect. abc seven news weather anchor spencer christian is here with a chilly spencer forecast. indeed. >> dan, what we were calling earlier the brr. so here's a look at the frost advisory. we also have a freeze warning. they're both in effect in effect until 10:00 tomorrow morning. frost advisory covers the north bay coastal range, covers the san francisco bay shoreline, the peninsula and the santa cruz mountains, the east bay hills and interior valleys, and the santa clara valley. so that's a

wide reaching advisory. and then we have the freeze warning indicator here in the purple area that covers the north bay interior valleys and interior mountains and the eastern santa clara valley. now, again, this is all in effect until 10:00 tomorrow morning. temperatures in the coldest areas may drop well below freezing. we're looking at projected lows right now for the overnight hours 29 at santa rosa. some locations away from the urban areas will drop down to about 28. you can see numerous locations in the inland east bay dropping into the mid 30s and even some low to mid 30s in the south bay. so prepare for a very cold overnight and early morning tomorrow. i'll give you the complete accuweather seven day forecast and a look at the new year's eve forecast in just a few minutes. dan. >> okay. thanks, spencer. see you in a moment. in the south bay, startling new video shows a driver accelerating through san jose's crowded christmas in the park event last night. just missing people by inches. police say officers had to try to pull. the driver tried to pull the driver over earlier for a ticket, but he took off driving

the wrong way on market street before cutting across plaza de cesar chavez. much of that areis in the park crowds now because of concerns over safety. police did not chase the driver, but he was arrested today. for months now, we've been following the story of california's home insurance crisis. tonight, there are some significant updates to share with you. it's kind of a good news bad news situation, though. a lot of families who can't find coverage may have new options. that's good. but the bad news all of us may end up paying for it. abc seven news reporter lauren martinez explains. >> insurance companies in california will have to follow new rules in 2025. insurers that stopped providing coverage in wildfire prone areas will have to write policies again if they want to keep doing business in the state, the state's insurance commissioner office announced the new regulation on monday. amy bach is the executive director of united policyholders, a watchdog in the industry. >> so he gave insurers some of

what they want, and he's also giving consumers some of what they need, which is increased options. >> insurers will have to increase their coverage in those high fire risk areas by 5% every two years, until they hit 85% of their market share, which could take time. in exchange, companies can start charging customers for the cost of reinsurance, which is basically insurance for insurance companies. >> it's a carrot and a stick. you get to do this, but you have to do that. and so for consumers, we're all sitting here with our fingers crossed saying, okay, i hope this works. >> residents impacted by destructive wildfires are faced with soaring bills. the camp fire in 2018 killed 85 people in paradise. steve crowder was elected as mayor two days prior. he lost his home and business. he has since rebuilt, but it's been a challenge. >> the company i was with, i was non-renewed a couple of years prior to they. they picked me

up. they've now left california, so now i'm with the california fair plan and my insurance basically quadrupled. >> instead of paying 1200 for annual coverage, it's now up to $5,000 post camp fire, he said. it's great more options will be there, but he hopes they'll be affordable. >> but will it lower the premiums? that's that's the thing, because the premiums that we're paying now are not sustainable. >> experts say we'll have to wait until the state's new rules are fully in place to see if they improve the insurance landscape. lauren martinez, abc seven news. >> now, if you're running into problems with home insurance, seven on your side is here to help. you can find details about how to contact them and complete coverage of the insurance crisis on abc seven news.com/7 on your side. we've done a good deal of reporting on this problem. your p-g-and-e's bill may also be going up in the new year, but the company says bills will be

steadier overall in 2025. p-g-and-e's says the average electricity and gas customer will pay 1% more on january 1st than they did at the beginning of 2024. the rates for gas alone will go up by more than 8.5%, so the company can pay to replace old pipelines. state regulators expect electric rates to fall through 2025 and 2026. all of this comes after a year of record price hikes for pg and e customers. the santa cruz harbor is still recovering from last week's massive swells. now, crews are getting a better sense of just how bad the damage really is. docks broke apart. a lot of boats sank. some of them were people's homes now gone. >> initial estimates are it probably exceeds the 2011 tsunami. the docks are badly damaged. infrastructure is damaged. there are a number of boats that are still on the bottom. >> the u.s. coast guard is assisting harbor patrol as they work to assess the damage fully

and to clean it up. the community is also coming together to raise money for repairs to the harbor and the santa cruz wharf as well. a new law kicks in in the new year that will wipe away thousands of street parking spots all across the state, but some cities are going to wait to ticket you for that. our latest case of parking procrastination is in the east bay. leaders in berkeley will wait to enforce the state's new day lighting law until april. starting wednesday, it will be illegal to park within 20ft of a crosswalk. in an effort to improve driver visibility and watch out for pedestrians, san francisco is also planning to delay issuing citations until march to give people time to get used to this. but some cities, like fremont will be enforcing the law come wednesday. day one some cities are also considering signs to warn drivers about this change. all right. on paper, tonight's 40 niners. lions monday night football game did not mean very much. but you wouldn't know that by the energy that both teams brought to

levi's stadium. it was a pretty good game. abc7 news sports director larry beil has a wrap up. >> dan, this was a game filled with highlights, big plays galore, but the same things that have wrecked this 40 niners season proved to be a problem once again. niners gave up four touchdowns on third down. this was the fanciest one as the lions run the hook and ladder. former cal star jared goff to amon-ra. saint brown to jamison williams 41 yards. goff threw for 303 yards, three tds. brock purdy also three touchdown passes, but two second half picks by kerby joseph swung momentum in detroit's favor, and purdy suffered what is believed to be an elbow injury on this play. mri tomorrow for more. let's go to abc seven's chris alvarez at levi's stadium. >> well, larry, the game for the 40 niners tonight followed an all too familiar pattern. they came out hot offensively at least early in this game. but late game turnovers poor execution down the stretch were completely costly in a 40 to 34 loss here to the lions. >> it's the nfl. it's your job. so we need to know how to execute. we need to know what to

carter, a day after his death at the age of 100, the peanut farmer and former georgia governor rose to national prominence as president in 1977. mr. carter will be buried next week alongside his wife, rosalynn, who died last november. they were married for 77 years. the white house has lowered the flag to half staff in his honor. americans say today shared what they thought of mr. carter and his 100 years of life. >> my favorite president, for sure, because he was gentle and kind, strong and loving, leading by example. >> you know, he had bible study. he did habitat for humanity. those are all good examples of how we should lead and how we should interact with our fellow americans. >> his dedication to helping other people. i think that's the primary purpose for all of us in our lives. >> so many nice things people are saying. tonight. the state funeral for jimmy carter begins saturday with a motorcade which will travel through his hometown

of plains, georgia. that evening, the former president will lie in repose at the carter presidential center in atlanta. mourners can pay their respects through monday. then on tuesday, january 7th, carter's body will be moved to the u.s. capitol, where he will lie in state until thursday. on january 9th, there will be a service in washington, and then carter will be brought back to plains, georgia, for a private funeral service. well, moving on today, venezuela's supreme court issued a $10 million fine against tiktok. it is for, quote, not implementing measures to prevent viral video challenges that are said to have led to the deaths of three venezuelan children. two of the instances involve the teenagers ingesting or sniffing substances. the judge says the social media company acted negligently, negligently and gave it eight days to pay the fine. tiktok has not yet responded to requests for comment. the fda is planning to collect samples of certain aged cheeses to test for bird flu.

they'll be testing aged cheese made from raw or unpasteurized cow's milk. pasteurization, of course, is a process that kills viruses and bacteria, the fda says. samples that test positive for bird flu will be evaluated on a case by case basis. meantime, the usda is testing raw milk itself for bird flu. the current bird flu strain was first detected in u.s. dairy cows in march. and diners in california and in fact, across the country are paying more because of a nationwide egg shortage caused in part by the bird flu. restaurant owners are raising prices to offset their costs. the owner of one restaurant in san luis obispo says it's his first price hike in decades. he's added a menu surcharge of $1 per egg for certain meals. >> a couple of weeks ago, we were paying $51 for a box of eggs, which is 15 dozen, and that went to 110 when i saw they had to charge the extra dollar

per egg or whatever. i was like, oh, i'll get oatmeal and sausage this time. >> it's unclear when the price of eggs will begin to fall, but everyone is waiting. well, good news for people who enjoy fishing. tonight, a popular lake in monterey county has been restocked with fish following a big die off last summer. the department of fish and wildlife says more than 4,000 pounds of rainbow trout have been planted back into lake san antonio. officials found the die off was caused by a natural algae phenomenon. due to the high heat that we had back in july. san francisco is gearing up for its big new year's eve fireworks show happening tomorrow night. the 15 minute show starts at midnight along the eastern side of the embarcadero. spectators are encouraged to arrive early to grab a good viewing spot. and if you'd like more information about more local events tomorrow, you can visit our website abc7 news.com to find our guide for everything that is happening around the bay area

for new year's eve. and the question is, will we see fireworks or spencer colored clouds? >> exactly. well, the clouds may be moving in, but skies at this moment look like they'll be mainly clear. here's the satellite radar composite image. we have mainly clear skies right now, with just a few thin, high clouds moving through. wind is really, really light right now. not a factor at all in our weather. at least not a negative one. speaking of negativity though, we've got temperatures dropping sharply from where they were this time last night. ten degrees cooler right now over fairfield, and it's going to be quite cold in many locations. 50 degrees in san francisco right now, upper 40s in oakland and hayward, low to mid 40s at half moon bay in redwood city. so temperatures are dropping there. looking along the bay bridge from emeryville, other temperature readings right now 37, in petaluma, napa, santa rosa, 39. and most of these locations are in their low 40s to upper 30s, which is pretty chilly. we have a frost advisory and a freeze warning in effect overnight until 10:00 tomorrow morning. we'll start with the frost advisory indicated here in

blue, which covers the north bay coastal range, the san francisco bay shoreline, the peninsula and the santa cruz mountains, santa clara valley and the east bay and the east bay hills and the inland east bay as well. now let's lay over that. the freeze warning, which covers the north bay interior valleys and interior mountains, and the eastern santa clara valley once again, both of these in effect until 10:00 tomorrow morning. it's going to be a very cold overnight period. we expect low temperatures to drop down to about 29 in santa rosa, 33 at napa, over in the inland east bay. we're talking about mid 30s, 34 at livermore, 36 concord, even around the bay shoreline, 35 will be the low at fremont, 38 san mateo and down into the south bay. 35 low in san jose and 33 at morgan hill. now tomorrow skies will be mainly sunny, but don't expect much of a warm up in the afternoon. it's going to be seasonably cool with highs mainly in the mid 50s, about 55 to 56 degrees in most locations. so let's move along. take a look at the new year's eve forecast. partly cloudy skies.
