look back at his impact on the judiciary system. plus, the santa cruz wharf is back open today, nearly two weeks after a portion of it collapsed. and crab season is back. how local fishermen are preparing ahead of the big day tomorrow. good morning everybody. it's saturday, january 4th. happy new year. it's already going to be a dry one. >> yeah. you know we do call this hour. it could be a mid-winter dry spell where we take a break from the rain for a while. it will come back as we look out in our extended outlook, but for the near term, it is going to be a string of sunny and dry days. although today we've got more cloud cover. 42 in concord, 46 for you in hayward with low 40s in santa rosa. boy, the chill is on anywhere from 4 to 13 degrees colder in our east bay valleys this morning. so as we get towards 7:00 it is chilly, low to mid 40s. we'll see the high clouds come on in mid 50s by 1:00 and high temperatures from the mid and upper 50s this afternoon. a partly cloudy sky.

sunnier and milder weather on tap for sunday and the week ahead steph. >> all right liz thank you. happening today. six days of funeral observances for former president jimmy carter. begin. he died sunday at 100 years old. here's a live look from georgia at the phoebe sumter medical center in americus. that's where carter's family will gather in just about an hour from now. former secret service agents who protected carter will serve as pallbearers. they will walk alongside the hearse as it exits the hospital. a motorcade will carry his body from his hometown of plains, georgia, to the carter presidential center in atlanta. that's where he will lie in repose through monday. on tuesday, carter's body will travel to the u.s. capitol, where he will lie in state on thursday. carter's funeral will be held at the washington national cathedral. his remains will then be flown to georgia, where he will be buried next to his wife, rosalyn. jimmy carter

never had the chance to appoint a supreme court justice during his single term as president. however, legal experts say he made a lasting impact on the judiciary system. carter was the first president to make sweeping changes to the makeup of lower federal courts. here in the u.s, there was no administration in our history until you get to clinton, which is later that appointed the number of women and minorities to the court that carter and mondale appointed bay area lawyer joe cotchett says carter appointed at least 18 female or minority judges. former president carter appointed 41 women and 57 people of color to the federal judiciary during his presidency. now back here at home, inauguration events for san francisco's next mayor, daniel lurie, begin today. the official inauguration is wednesday, but lurie and his team will begin

cleanup events around the city until tomorrow, tuesday night. lurie attends an interfaith ceremony at congregation emanue, and on inauguration day, lurie will help serve up breakfast at saint anthony's and then take a cable car to ghirardelli square. he will be sworn in as mayor in civic center plaza at 1130, and that will be followed by a chinatown celebration with a night market and concert. the santa cruz wharf is reopening today much sooner than people anticipated. there will be a celebration at 10:00 today to welcome visitors back. 20 businesses on the pier have been busy preparing, and someone from the community returned. this the wharf's 100 year anniversary plaque. it went missing among the debris when part of the pier collapsed a week and a half ago. santa cruz parks and rec is encouraging the public to return any other artifacts to their office. tomorrow, crab season is

finally about to open in the bay area. usually the season opens in the middle of november, but it was delayed by migrating whales. abc seven news reporter suzanne fawn went to the docks and spoke to fishermen, crab fisherman mike harvey is happy to be back at work. >> excited to get going. finally. oh, i've been crabbing for 15 years. >> harvey is busy putting some of his crab pots away. >> we are allowed to use half our pots. so these are the ones that the extras and just put them back in the shed. >> on thursday, he and his crew loaded up his 58 foot boat. vaya con dios, and headed out. they dropped 250 pots down on the ocean floor. they'll wait until sunday to start harvesting. john barnett is the president of s.f. crab boat owners association. he and his crew have already made two trips to put their gear out. >> everyone's excited. fishermen are all gearing up and putting bait on the boat. >> this year, the commercial crab season in the bay area starts january 5th. last year it

started january 18th. the commercial dungeness crab season usually starts in mid-november, but it's been delayed for the past few years. >> we had a delay this year because of the whales being present, and all of the issues we've been having about fishing around whales at fisherman's wharf. >> people are enjoying the fresh seafood, including the crab that's from oregon or canada. it's very tender. yeah, in a few days, that crab will very likely be from the bay area. >> they'll start being out there on the sixth. i would imagine, by then. so they'll be ready to roll. >> we really appreciate the public's patience. maybe the evening of sunday we'll have the crabs off the boat sales. we'll have the crabs in the fish markets. restaurants will be getting it, and that the public will have access to what they've been waiting for. >> fisherman mike harvey says the crab harvest is very promising. >> they're nice ones. >> this year in san francisco, suzanne phan. abc seven news. >> in the east bay, a year after

a massive menorah was destroyed at lake merritt, anti-semitic graffiti is now showing up there. as abc seven news reporter tara campbell explains, residents say enough is enough. >> anti-semitic messages like this painted alongside oakland's lake merritt. >> it was really just shocking, really hateful things said, i don't even want to. i'll send you pictures, but i don't even want to utter it. it's so ugly. >> it started after the october 7th hamas attack on israel last year. this graffiti, one of the latest incidents, it showed up on the last night of hanukkah right beside this massive menorah. last year it was vandalized and thrown in the lake when it originally started, that was my that was my walking path with my children, was going around the lake and seeing just the pure vitriol was really too much. >> and so that's what motivated me to start doing things. some removal on my own. >> zoe levine taking matters into her own hands, but quickly

realizing it was like drinking from a fire hose. >> you know, there was just so much every day, just more and more totally unchecked that i kind of had to get more help. >> jonathan mintzer is with the bay area's jewish community relations council. >> jcrc surveys that we do with professional researchers show that post october 7th, 60% of jews in the bay area feel less safe than they did before, and over a third have directly experienced or witnessed anti-semitism. >> the hate hitting right at home for mintzer. he lives in oakland and walks these paths. >> it is time for our leaders to really step up, to speak out against this ongoing hate, to take corrective action and to really dedicate themselves to supporting the jewish community during this difficult time. >> calling on the city's newly elected leaders to take action. >> it would go a long way from to hear from the incoming mayor and the incoming district attorney here in alameda, that

anti-semitism and all forms of hate have no place here in oakland, in alameda county, period. >> tara campbell, abc seven news. >> a decision on whether former forty-niner dana stubblefield will be released from jail has been postponed. stubblefield attorneys were in court in santa clara county yesterday. they're asking for his release after his 2020 rape conviction was overturned. last week, an appeals court found a statement prosecutors made referencing stubblefield's race violated an anti-discrimination law. the defense team has also long maintained the judge blocked important evidence. >> there are some technical issues and some technical areas of law. this is an unusual case. the judge in this case allowed that the jury did not hear the truth. >> the hearing was delayed due to jurisdictional issues. stubblefield's release will be considered again in two weeks. you see the da statement as we study this opinion to determine our next steps, we remain

our exploratorium camera. it is 612. there's a new plea to secure the release of eric and lyle menendez after 35 years in prison. it was made by 20 family members during a meeting with the new la d.a. yesterday. the menendez brothers were convicted of killing their parents back in 1989. prosecutors say they did it for financial gain. the brothers say they shot their parents after years of sexual abuse at the hands of their father, jose menendez. new los angeles da nathan hochman says he's reviewing the evidence before deciding whether to move forward with resentencing, which was supported by his predecessor. part of that process was speaking to the family. >> we're inputting that additional information that i received today, which was useful information into the entire decision matrix on what to do with this case. >> eric and lyle's family told the da they were prepared to support the brothers in any way

possible if they're released from prison. the u.s. surgeon general issued a new warning on alcohol. he says even moderate amounts increase your risk for seven types of cancer, making alcohol the third leading preventable cause of cancer here in america. he suggests updating the current warning on alcoholic drinks to include cancer risk warnings like they are on cigarette packs, for example. alcohol warning labels have remained the same for nearly 40 years. they currently warn of generic health problems, with specific mentions for drivers and pregnant women. >> it's not that surprising to see that these these guidelines have. the discussion has been going back and forth for so many years because the research is continuously evolving. >> congress would need to pass legislation to make a change to alcohol warning labels. now to a story we are following closely. oakland is temporarily closing two fire stations as the city

deals with a growing budget deficit. station 25, located on butters drive and 28 on grass valley road, are being shut down on monday. they will stay closed for six months. the closures will save the city $5 million this fiscal year. oakland's fire chief says the temporary closure is happening while fire danger remains low. >> we're not directly in wildland season. this was an opportunity to use a couple of our hill houses that normally are in our high fire severity zone. we feel like we can cover these districts adequately. >> chief damon covington says the fire department looked at data analytics and picked these stations for temporary closures because they're not among the city's busiest in the north bay. caltrans will soon begin overnight work on highway 37. it's for a project designed to prevent flooding and combat rising sea levels. the work, starting monday night, will impact a 12 mile stretch of eastbound 37 in solano county.

abc seven news reporter cornell bernard has more about this project. >> highway 37, a place where traffic, steel and asphalt meets eco sensitive north bay wetlands. >> there are a number of things going on on state route 37 right now, as we prepare to be more resilient to flooding. to address congestion and also to prepare for sea level rise, a long term plan preparing this roadway for the effects of climate change starts monday night, january 6th. >> caltrans is closing eastbound lanes of 37 overnight between highway 121 and railroad avenue in vallejo. a detour around the roadwork will be in place. >> that's about a 40 mile long detour. pretty significant. it's allow us to do geotechnical drilling so that we can get information that we need to design the new state route 37. >> flooding has become a routine issue on 37 during the rainy season in marin county, causing lengthy closures of the vital commute route. a plan to widen and elevate the entire 21 mile

stretch is the ultimate goal, creating more bicycle, public transit and carpool options for all travelers. >> it's easily going to take over 20 years to do the entire ultimate project, which is going to be an elevated viaduct. >> environmental advocates hope to create a corridor where wildlife and infrastructure can coexist. in a statement, the sonoma land trust says our role is to ensure we can work successfully with caltrans to enable restoration on both sides of the highway and reconnect the bay with the wetlands, both existing parcels and those yet to be restored. a series of public meetings on the project will be ongoing. monday's construction project will happen weeknights through february 1st in solano county. cornell, bernard. abc seven news. >> also in the north bay, two large trees came down, a redwood and a fir that crashed a car, even taking off a chunk of this house. the owner says there's damage to two of her bedrooms there in monte rio, right near

guerneville, and a p-g-and-e's power pole was also destroyed in this incident. thankfully, there were no injuries. certainly saturated soil from all the moisture we saw last week, but lisa is tracking some dry days ahead. >> yeah, very dry and quite gusty as we get into tuesday. wednesday i was looking at santa rosa. they are forecasting a high of 73 on wednesday. yeah, and the rest of the bay area will be in the upper 60s due to that offshore flow really getting going on tuesday lasting through wednesday. so the warmer weather ahead. but today, the coldest day out of the next seven, as we are looking at chilly numbers to start out, low clouds with the fog dissipating and then getting into some high clouds as a system moves overhead 40 degrees right now in livermore. it is 39 in napa. so looking at the cool numbers out there and the reduced visibility up in the north bay from novato, with a mile and a quarter and a mile and a half visibility, santa rosa, the san joaquin

valley, obviously, the dense fog, the bay area, nine and ten mile visibility. our forecast headlines areas of fog this morning. then we're partly cloudy today. sunnier tomorrow. large breaking waves throughout the day today. and then as we get into that sunny, dry pattern, we'll see the temperatures really respond with that offshore flow. the middle of the week. current wave heights 11 to 12ft up to 15 point arena. this takes us through the overnight hours and we could see breaking waves up to 25ft. so pretty dangerous along the pacific coast. throughout the day to day you'll see the high clouds. so we're partly cloudy for your saturday, waking up to some clouds on sunday. sunnier and milder for your sunday afternoon. then we get into even brighter conditions as we go through monday afternoon, so we'll look for that ridge of high pressure to build in quite strongly. and as we get that system to move to the east of us, those offshore winds really taking over tuesday

and wednesday, we could see some wind advisories from the national weather service. san jose average highs in the upper 50s. so tomorrow big bump up into the 60s and we'll get into partly cloudy skies and mostly sunny conditions throughout the workweek. notice the tuesday wednesday temperatures in the upper 60s here. could see some 70s from napa to sonoma midweek. but as for today, we're cool and temperatures will be below average in the mid 50s for you. for palo alto, 56 in richmond, look for 57 in oakland. so bands of high clouds allowing for the partly cloudy sky today, 58 santa rosa and the mildest number probably in the santa clara region, upper 50s. the accuweather seven day forecast. we're partly cloudy today. milder afternoon with low to mid 60s. some more sun on sunday. monday the winds will begin to pick up late at night, but it's tuesday, we're breezy and the temperatures continue to soar

through the mid and upper 60s around the bay shore inland mid 60s the coast could see some mid 60s with the dry pattern continuing all into next week. stephanie. >> all right lisa thank you. today is the first day of a week long of funeral services to say farewell to america's oldest living president, jimmy carter. he died on december 29th at 100 years old. abc news reporter faith abubey has the very latest from georgia. >> this morning, a motorcade taking former president jimmy carter from his hometown of plains, georgia. pausing for a moment at his boyhood farm before making the 100 mile trip to atlanta. arriving at the carter center, where there will be a private funeral service and public viewing tuesday, his body will be flown to washington, dc, where he will lie in state at the u.s. capitol. a national service at washington's national cathedral, planned for thursday before his remains are flown back to his georgia hometown for a private burial at the national service. his longtime friend, president joe biden, will

deliver a eulogy. president elect trump also expected to attend. president carter will ultimately be laid to rest next to his beloved wife, rosalynn, in plains. he once called her his secret weapon. they were married for 77 years until she passed away just over a year ago. jason carter is one of his 12 grandchildren. >> i knew that he was ready, and i knew that, you know, he had said in these last few weeks that that, frankly, he he wanted to go see rosalynn. that was his words and that that made us all feel okay with it. right. he is at peace. we were at peace. >> carter was born into a humble family in rural georgia. they were peanut farmers. carter enlisting in the navy, becoming a state senator, georgia governor, and eventually sitting in the most powerful office in america i. >> jimmy carter, do solemnly swear. >> james earl carter taking the oath of office in january 1977, serving just one term with challenges at home and abroad. but most agree his years after

former leader of the house received a round of applause from colleagues while casting a vote for hakeem jeffries to become the next speaker. but jeffries fell short and will remain minority leader. the house of representatives voted to reelect house speaker mike johnson by a razor thin margin. the 119th congress has convened, and there are some changes with the bay area's contingent. after a contentious election. former san jose mayor sam liccardo is now taking over for former congresswoman anna eshoo to represent district 16. abc7 news south bay reporter lauren martinez spoke to liccardo about his priorities. >> will you raise your right hand? >> friday marked the first day of a new congress. among those sworn in former san jose mayor and now congressman sam liccardo. >> congratulations. you are now members of the 119th congress. >> on friday afternoon, we spoke with liccardo from his washington, d.c. office.

>> i feel enormous pride for the opportunity and the privilege to be able to serve in this way. >> liccardo replaces longtime representative anna eschew. his district stretches from the south bay to the mid peninsula and coastal san mateo county. when not on capitol hill, liccardo will be at the same offices as you had in palo alto and half moon bay. >> well, we're trying to build teams in two cities right now. literally back home and in washington, d.c. >> liccardo, a democrat, is a first term member in a minority party. he said he knows there are daunting challenges ahead, working with his party and the new administration. >> we think about the cost of housing, for example, the cost of childcare, and these are not issues that are finding their way into legislation or floor battles. those are the opportunities, i think, for young members like me to reach across the aisle, build coalitions and get some things done with relatively nonpartisan steps that can actually provide real relief for families that are struggling every day. >> liccardo said he plans to

drove a rented truck from houston to new orleans on december 31st. he reportedly posted multiple videos to facebook claiming he joined and pledged allegiance to isis. at 2:03 a.m, he is seen near bourbon street and the fbi says he planted explosives in two coolers with a remote detonator. by 315 in the morning, surveillance video shows him taking a right turn and barreling down bourbon street. you just saw that. investigators have also determined he booked his truck rental on november 14th, so that suggests he may have been plotting the attack for more than six weeks. we're also following new developments with the cyber truck explosion outside the trump hotel in las vegas. officials say the suspect, matthew leibensperger, shared personal and political grievances and two letters found on a phone in the vehicle. according to the letters, the country was being led by those out to, quote, enrich themselves. he also claimed the

against the county, alleging discrimination and harassment. it comes after that 400 page report alleged acts of intimidation, conflicts of interest and corruption within the sheriff's department. the report also said corpus and her former chief of staff have an improper relationship. now. they've both denied that. sheriff corpus says the investigation is part of a conspiracy to defame her. she will address the legal claim on monday. a warning now from police in the east bay. they say suspects are intentionally causing minor car crashes to rob people. the mercury news reports the tactic has been used in robberies in and around oakland in recent weeks, including one at 28th avenue and international boulevard. the victim was forced to give up a rolex watch, a wedding ring and other jewelry worth more than $15,000. police say the thieves will intentionally rear end another car, then rob the victim when they get out to exchange

information. now they've also linked the same crew to a purse snatching in hayward. we continue to follow the health of an endangered monkey rescued during a drunk driving stop. take a look. this is the female spider monkey that will undergo a critical procedure today at the oakland zoo. she was found monday inside a rolls royce in madera. the monkey was malnourished, with an abnormal coat and skin and suffering from an upper respiratory infection. it may take months for her to recover. she's in a quarantined area of the zoo in a controlled air environment. >> she has not received proper nutrition. she would still be nursing from her mother for two years. we estimate that she's maybe somewhere between 5 and 6 months old. >> so cute to today. the spider monkey will be put under anesthesia so she can be examined thoroughly. if she recovers, the spider monkey will likely live the rest of her life in a zoo or sanctuary. we wish

and from our roof camera, you'll notice that we do have partly cloudy conditions. 41 santa ros. 39 petaluma, with 42 in concord. and there's fog in our inland valleys. livermore three quarters of a mile. two miles now getting better from novato to santa rosa. and a look from our sutro tower camera. so areas of fog this morning over the weekend, large breaking waves. so the day with the most dangerous conditions is today, saturday. then things quiet down on sunday. the dry pattern takes hold. we are warmer for the second half of the weekend, then much warmer for the week ahead with those dry conditions continuing. 12 to 14 foot breakers here along the north coast, san francisco. so all along the pacific, dangerous breaking waves up to 25ft. so keep that in mind if you're headed to the shoreline throughout the day. today we see advancing high clouds, and that system sets up overhead as we get into early next week. and that's going to provide the wind and the warmth for sunday

morning. some clouds. then we are looking at partly cloudy skies in the afternoon, and we get sunnier on monday afternoon. and then monday night the offshore winds take hold. the windiest days should be tuesday and wednesday, and temperatures will be well into the 60s throughout the week ahead. this is the south bay with average highs in the upper 50s, but in the north bay where we have those gusty offshore winds, we could see 70s arriving into tuesday. as for highs today, it's below average, the coolest day of the week with more mid and upper 50s around the bay. so certainly taking some time to take the chill off this morning and then still a chilly afternoon. we're looking at 56 in napa, 57 in oakland with those upper 50s and the high clouds entering today. we've got the low clouds right now. so that fog in patches from the north bay to the east bay giving way to partly sunny conditions. and so with today, the coolest day, we'll get into a little bit
