oversight. it all comes after an investigation into the city's police department by the fbi uncovered a racist texting scandal. abc seven news reporter anser hassan has been followingr the story and got some answers as to what this means going forward. >> in the summer of 2023, the fbi unsealed indictments into claims that the antioch police conspired and agreed to injure, oppress, threaten and intimidate the residents of antioch. on friday, the u.s. department of justice announced it reached an agreement with the city to resolve its investigation. >> my first initial reaction to the mou was that it's a step forward. >> antioch city council member tamisha torres-walker is glad the investigation didn't drag out for years. the agreement, outlined in a 25 page memorandum of understanding, includes hiring a consultant who will work with the police oversight commission to monitor use of force and misconduct allegations, review hiring and promotions within the

department, and update department policies. torres-walker concern is over accountability. >> it does look a little standard. it doesn't really cite any clear accountability. this is good to know that an agreement was reached. but what is the accountability behind it? what is going to change the culture in a police department and not just the department, but in the community? >> it is ultimately up to the good people of antioch to demand better. and what this agreement does is it prescribes a pathway toward better service, greater public safety. >> department of justice studies professor greg woods says even if the mou seems somewhat standard, what's important is that it's backed by the power of the u.s. government to enforce it. but woods also points out that an incoming trump administration may not be as concerned with police oversight, and that's a concern for attorney carmela caamano. >> with an incoming trump administration. we can't be for certain how the department of justice is going to conduct itself over the next four years.

so, like i said, it's a beginning. it's not the end. >> carmona's client, tyrone pugh, was singled out as a victim of the texting scandal and a special report prepared by the contra costa county district attorney's office. karmanos launched a federal civil rights case in which she hopes will have a consent decree in place to impose greater restrictions on the department. but another issue is funding, such as for the auditor. >> how would these things be funded over time? is one of the challenges that this council will have to discuss and think about without cutting critical community services? >> the california department of justice hasn't finished its separate investigation, and more measures could be put in place as a result. antioch police did not respond to requests for comment. in antioch, anser hassan abc seven news. >> one person died tonight shortly after being hit by a car in san francisco. police are looking for the driver responsible who fled the scene right after the collision.

someone reported the accident on silver avenue and colby street just after 530. a person is in the hospital tonight suffering from a gunshot wound. that incident was reported at about 630 tonight at fifth and bryant at a san francisco homeless shelter. one person was arrested and police are investigating. in the east bay, a man is recovering in the hospital after being shot by an oakland police sergeant. the oakland police department says it all happened when the officer saw someone firing a rifle on macarthur boulevard near 66th, just after five this morning. there was a chase with the police officer firing at the suspect. the oakland police union says that person was shot but was able to barricade themselves in a nearby home. they surrendered after a lengthy standoff. no one else was hurt. the sergeant is on administrative leave and that shooting is being investigated. while investigating a shooting from september. contra costa county deputies arrested a suspect they say was also

illegally making and selling guns. deputies served a search warrant at a home in pittsburg on thursday in connection to the shooting. they say someone was shot with an illegally manufactured gun during an argument at the contra costa county fairgrounds in antioch. authorities are also investigating whether the suspect is connected to another shooting in the area at the time. >> we're still investigating if the two are linked. it may be a continuation, but we're again, we're still gathering facts. >> at the home. investigators found assault weapons, as you see here. some did not have serial numbers. the weapons will be tested to see if they're linked to any shooting or crimes. dozens of families were forced from their homes in san francisco today when a gas pipe was ruptured in the area of 47th avenue and balboa street. those neighborhood evacuations lasted hours until the leak was finally stopped. abc seven news reporter cornell bernard spoke to some of the evacuees. >> reporter a geyser of water

and gas shooting up from the pavement on 47th avenue in san francisco. >> and we all ran. they told us to split. you know. yeah, yeah. so i smelled it instantly. >> christian burch was having a garage sale across the street from where he says a city crew was repairing a water leak. >> i came out this morning. there's a big water leak all night long. and then the water department finally showed up. they started taking care of it. and then about 1030 or 11, they hit the gas line. >> upon arrival, we were able to confirm that city workers were doing street work. they struck a four inch gas line which caused this rupture. >> as a precaution, police and fire crews evacuated neighbors in a two block area around the leak. >> it is extremely scary. you can see behind me the loud hissing. you can smell the gas that's out here. >> we arrived on scene about noontime, and that smell of gas has been pretty strong in theas air. it changes with the wind direction. >> it was like standing in your kitchen, turning the stove on

with nothing, igniting it. no, it was heavy duty. >> by 2 p.m, p-g-and-e's crews were able to shut off the gas leak. evacuation orders were soon lifted. repairs on the gas and water pipes continue. a frustrating and frightening day for christian. >> it was real scary. >> real nervous in san francisco. cornell, bernard abc seven news. >> happening now, there is a high surf advisory for just about all of the bay area's beaches through early sunday morning. check it out. this is what it looked like this afternoon at baker beach in san francisco. there were some people out, but just about everyone was avoiding the water. probably a good idea. all right. spencer christian joining us now from the weather center. spencer, i know you've been following that and also are really mild temperatures. >> that's true. diane. it was a bit chilly today, but we have mild weather ahead for the week ahead. as a matter of fact, let me give you a look at that surf. high surf advisory because all the weather conditions are getting calmer. the surf is still pretty rough out there. we

have elevated surf heights right now. wave heights. i should say this advisory is in effect until 3 a.m. this tomorrow morning. of course, breaking waves may reach heights of 18 to 22ft. that, of course, means dangerous swimming and surfing conditions. possibility of some localized beach erosion. now looking at the satellite radar picture, yoe a large area of high pressure, calmer weather building in despite the rain to our north up in the pacific northwest, winds are very calm here. wind speeds are generally not more than about five miles per hour in many locations around the bay area. right now, we don't even have measurable wind speeds. so here's a look at our weather headlines, and i'll give you the complete forecast a little bit later. tomorrow morning clouds followed by afternoon sun. beginning of the week it will be sunny and a little bit milder and into next weekend, warmer than average weather and dry. i'll have all the details a little bit later. diane. all right. >> sounds good. spencer. thanks. and a reminder you can always follow along with the forecast changes with our abc seven bay area app. it gives you the access to the same live doppler seven spencer and our entire

its formal farewell to the 39th president of the united states. he is lying in repose tonight in atlanta. a motorcade carrying jimmy carter's flag draped casket traveled along rural roads of south georgia, where he spent much of his life before heading to atlanta, where he will lie in repose ahead of a state funeral in washington next week. here's abc news reporter faith abubey with the details on this final goodbye to georgia's beloved son, former president jimmy carter, now lying in repose at the carter presidential center in atlanta, where the public can now pay their respects. >> his family accompanying their patriarch as the nation begins

its formal farewell to the 39th president. >> we will spend this week celebrating this incredible life and a life that i think we can all agree is as full and powerful as any life can be. as someone said, it's amazing what you can cram into 100 years. >> earlier in the day, he traveled from his hometown of plains, georgia. his casket, carried by current and former members of his secret service, detail present arms. the motorcade making a stop at his childhood home. a bell there ringing out 39 times in his honor. crowds lining the route as the late president traveled to atlanta. >> man that motorcade. there was a lot of love on the side of the road. every overpass had people on it. >> many just wanting the opportunity to say goodbye. >> he did a magnificent job. that's right. he served humanity. yeah. and that's what we should do for each other. it just meant a lot just to be here and be able to be at farewell and pay my respects to him. >> the procession then making a stop outside the georgia capitol

building, where state officials stood for a moment of silence to honor the former georgia governor and the only president to hail from the state. on tuesday, president carter will travel to washington, where he will lie in state at the u.s. capitol before a service at washington's national cathedral, where president biden will eulogize his longtime friend james earl carter jr. will then return home to plains, where he will be laid to rest next to his beloved wife, rosalynn, who died just over a year ago. the two were married for 77 years when she passed. chuck sivertsen, abc news, new york. >> on the peninsula, a famous donkey from palo alto that helped inspire the movie character shrek has died. perry was 30 years old and resided at cornelius bowl park and served as a support animal, paying for his care and for the other donkeys started adding up, though, and became a point of controversy. the city faced a budget deficit last year, and a city council member pushed back at paying tens of thousands of

dollars. a memorial will be held for perry at a later date. bird flu is impacting egg supply, driving up prices and leaving some grocery stores out of stock. the ventura county star reports between 10 and 14 million egg laying hens have been killed or have died from the virus in california. the u.s. department of agriculture says egg prices have jumped 70% from november to december, driving up the average cost to nearly $9 a dozen. >> it's psychological too. it's just like when covid hit and, you know, everybody was going out for like tons of water and tons of toilet paper because we think we're going to, you know, the world is coming to an end. psychologically, it's like, oh my gosh, am i in this fervor that i have to go find eggs somewhere and anywhere? i'll i will likely just do without. >> there's no quick fix in sight, and the egg supply is expected to be tight for at least the next few weeks. tomorrow, dungeness crab fishing

season finally begins in the bay area. the season usually starts in mid-november, but it's been delayed the past few years ton protect migrating whales and prevent them from getting tangled in crab gear. crews have already put hundreds of pots down on the ocean floor, and they'll start harvesting tomorrow morning. last year, dungeness crab season didn't start until january 18th. in san francisco, community groups rallied to call attention to what they call environmental racism in the bayview and hunters point neighborhood. we are unstoppable. >> a clean world is possible. >> we want it now. all things bayview and gray panthers are protesting the darling international rendering plant. the company turns meat waste into usable products. residents have been complaining for years, saying it emits noxious odors and the area reeks of death. >> my heart is full because we know that it takes everyone to get this done. not the

government agencies, not the mayor's office, not the board of supervisors. but it's our community partners and our allies. that's the reason why they're considering leaving, and we want to let them know that we want them to leave. >> now, the company responded to the protest, saying they strive to be a good corporate citizen and neighbor and have, quote, comprehensive processes and protocols that are part of their day to day operations. all right. once again, getting another check in in the weather center with spencer. and day to day. we're experiencing some relatively easy conditions outside. >> we are diana. as a matter of fact, the first full week of the new year looks like it's going to be a pretty mild and dry one. here's a look at what's happening on live doppler seven and the satellite. you can see clouds streaming onshore to our north, and it's raining up in the northern pacific northwest as well. but high pressure is building in around the central coast. and that's going to be the controlling feature in our weather for the next several days. look at how calm the wind is. wind speeds under

five miles per hour. in fact, not even measurable in most locations. although the atmosphere is calm, the surface rough right now. look at the 24 hour temperature change, which is pretty much a stalemate in some locations. a couple of degrees cooler than last night at this time. others are a couple of degrees warmer. so let's move along and take a look at the current conditions. 50 degrees here in san francisco, 48 apiece in oakland and hayward, 49 san jose, redwood city and half moon bay in the mid 40s. nice view from mount tam looking down onto san francisco. and part of the bay is 45 degrees in santa rosa. we've got 41in petaluma. mid to upper 40s at napa, fairfield, concord and 41 at livermore. and our forecast features are these tomorrow morning clouds followed by afternoon sunshine. it will be a little milder tomorrow than today. not a big warm up though. however, the beginning of the week will feature a continuation of this warming trend under sunny skies and into next weekend, look for warmer than average temperatures. now let's talk about that rough surf. it's the wave. heights are elevated. they're not as high as they had been earlier. they could

get up to about 18 to 22ft, which of course is dangerous, especially for swimming or surfing. it could also produce some localized beach erosion. this surf advisory in effect until 3 a.m. now here's the forecast animation. starting at midnight, we'll see a little bit of an increase in clouds with the cloud cover coming in that will hold the temperatures down. keep them from actually keep them from going down very low. there won't be much radiational cooling so that the heat from today won't escape as freely as it might under clear skies. but we will see some clearing as the morning approaches. overnight lows will be generally in the low to mid 40s. then high temperatures tomorrow right around 60 to 62 degrees in most locations, but a little bit warmer down in san jose with a high of 64 and a little bit warmer up north at santa rosa with a high of 64. by the way, this should be 65 at napa, not 56. on we go to the accuweather seven day forecast. as you can see, dry conditions, mainly sunny skies all the way through the seven day period. and look at that midweek warm up from tuesday into next weekend. high

seven news starts right now. >> the santa cruz wharf officially reopened today, less than two weeks after 150 foot section of the pier collapsed into the ocean. the wharf is a popular tourist destination near the santa cruz beach boardwalk, and engineers say it's structurally sound, even though there are some lingering

questions about how it will fare in the future. >> this is a wonderful, celebratory moment. we want to thank the wharf crew, the wharf crew, the wharf crew. >> god love them. santa cruz mayor fred keeley welcomed back business owners, locals and tourists to the wharf saturday morning. >> you can come out here for a meal, you can go fishing. you can enjoy the wharf. it is safe to be here. we are thrilled to have the wharf open again on december 23rd. >> powerful waves slammed. the piers already damaged south end breaking off 150ft of the structure. the dolphin restaurant and a restroom both fell into the ocean during the collapse. three construction workers had to be rescued. the area had already been closed to the public for nearly a year because of previous storms. the city was spending $4 million to repair the section when the collapse happened. >> how quickly could we get this wharf open safely? that's the most important economic development action we can take is get the wharf open so they

authorities are now warning law enforcement agencies across the country to be on alert for copycat attacks. abc news reporter christiane cordero is following the investigation. >> just days after that terrifying truck attack in new orleans, bourbon street is showing signs of returning to normal. the music is back, but the victims of that new year's day tragedy have not been forgotten. the street, now lined with flowers, crosses and photos to honor those who were killed, including 21 year old hubert guthro, whose family visited the memorial. 25 year old bill demayo from new jersey, who was in town for the sugar bowl game, and 18 year old aspiring nurse nikki ricciardo. >> i don't understand why somebody could do something like this. we were all out on new year's eve having a great time. we were celebrating. we're celebrating life and this happens, right? it's horrible. >> investigators are now looking into the international travel of shamsuddin jabar, the 42 year old man suspected of carrying out that deadly attack, his half brother abdullah tells abc news.

jabar traveled to egypt for about a month in 2023, telling his family he was going because it was cheap and beautiful. sources tell abc news crucial to the investigation is whether he was radicalized prior to the trip, or if the travel marked the start of his radicalization. >> what i can tell you right now is that he was 100% inspired by isis. >> the atf also searching a house the suspect rented ahead of the attack. investigators say he tried to set a small fire in the hallway in his effort to destroy the house and other evidence of his crime, but officials say evidence has been recovered, including bomb making material. sources also tell abc news the fbi found bomb making materials inside the suspect's north houston home. new orleans city officials were warned in a 2019 confidential security assessment that broken blockades made bourbon street vulnerable to a vehicle attack. the city began installing new barriers, but that work hadn't yet been completed. crews are now working to get those barriers installed. officials say getting the bollards fully functional is an

[vo]: of a child. starlight exists to bring happiness to hospitalized children when they need it most. because happiness matters. he. no. 40 niners starting quarterback brock purdy is out for tomorrow's season finale in arizona, as he's going to rest his injured elbow. josh dobbs going to get his first start for the 40 niners this season. it was a season to forget for san francisco. and now plenty of key decisions await for a team trying to get back to the postseason. so what do they need to do? i talked with our analyst mike pulaski on after the game. all right, 40 niners season finale. josh dobbs is the starting quarterback against arizona. but a lot of off season decisions for kyle shanahan and john lynch. let's just start with the offensive line. what would you do there mike. >> you got to go big guys. first you have to find a way to complement trent williams. he's getting towards the end of his career. so you have to get a guy

who can become his replacement eventually. but you got to be solid at both tackles. i would love to be solid across the board. you're going to sign brock purdy to a big contract coming up. you want to protect him and you want to develop a running game. so big guys are essential. get big, get good. get burly up front and you win a lot more football games. >> the wide receivers, they got plenty of playmakers. but you had aiyuk injured. deebo didn't have his greatest year is do you keep all of them. is one of them get traded. what can you get any sort of value for any of those guys? >> well, you drafted ricky pearsall as your first round guy last year. and so i think somebody in that receiver room is going to be your pivotal guy. he's going to be the guy that you can make a decision with. and to me, jauan jennings is a guy that you have to keep. you clearly have chemistry with purdy. he's been a big time playmaker. and so i would make him my number two guy at least. and then pearsall could fill in at three, which means i think deebo might be the odd man out. he's older and he's had some issues, although he provides a lot of opportunities in terms of

being a utility guy. but i think deebo is probably the odd man out there. >> i think we got about 30s here. jake moody, do you keep him? does he go? what happened to him this season? >> it was tough kickers. once they get off that mental game they affect your team. and so you have to be able to hit the ball and be consistent every time your team has to believe in you. i think the niners will probably make a move in that kicking department this year. he's the third round pick and so you hate to lose a pick like that, but they're going to go somewhere else i think in the kicking game. and the look on kyle shanahan's face after his missed that last game tells the story. >> one more game and then an offseason full of questions before they lace it back up training camp in the summer. all right. in a game you saw right here on abc seven bengals steelers bengals needing a win to keep their playoff hopes alive. first quarter joe burrow jamaar chase 12 yards for the touchdown seven nothing. cincy in a hurry. third quarter now pittsburgh getting to burrow. and this is a hard hit. they'd settle for a field goal. joe would head to the blue tent but return i mean he went down hard. looks scary for a moment. fourth quarter steelers staying alive.
