to choose her replacement? tracking the fog now and the windy weather that's ahead. i'm meteorologist sandhya patel will have an hour by hour forecast coming up here. >> they're big and they're back on the beach. why? elephant seals the size of cars have returned to the bay area. >> always live. abc seven news starts right now. >> tonight, the mix of money and values at $10 million. claim by the san mateo county sheriff over issues of discrimination and harassment. good evening. >> i'm ama daetz, and i'm dan ashley. thanks for joining us. an attorney for sheriff cristina corpus says, quote, there are some who unfortunately still believe that law enforcement is a white man's world. that's the basis for a $10 million claim. the sheriff has now filed against the county. >> abc seven news i-team reporter dan noyes has been covering the ongoing controversy. >> the claim is the first step toward a lawsuit. the sheriff and her lawyer announced a news conferencer this afternoon, but canceled it

overnight. looks like they are still building their case, but i've been in contact with both of them today. >> the peace officers bill of rights protects every peace officer, including a sheriff. >> brad gage is a los angeles based civil rights attorney now retained by sheriff cristina corpus. this $10 million claim, gage fillled, accuses the county of discriminating against harassing and defaming a dedicated public servant because the defendants did not want either a woman or a latinx person as the head of their sheriff's department. >> she's being treated differently than other employees that are male and not hispanic, specifically, having her individual records released to the media and the public is treating her differently than others. >> the county has 45 days to answer the claim. if they fail to do so or deny it. gage says a lawsuit is on the way. the claim cites several i-team reports that raised questions about an audit of the sheriff's office performed by retired judge

ladoris cordell. she allowed all witnesses to remain anonymous, did not require them to testify under oath, and made several important factual mistakes. >> we want the names of the witnesses. we want the complete report. it's a matter of fairness. >> judge cordell also left out 29 pages of the interview transcript with corpus chief of staff victor j. from the final report, including a section where he provides his most direct defense against claims of misconduct, i obtained a recording of the entire interview, including this section not included in cordell's report. >> and just for the record, because i want to make sure that it is understood, i never in any capacity or by myself, and i've never benefited from any deals or been representing myself as a broker or an agent at all whatsoever. >> sheriff corpus declined my request to comment today. you'll recall the county offered her $1 million plus four years of medical to resign. it's clear she's going nowhere, a defiance she showed in her first

interview on the scandal in november. will you step down? >> i will not, i am resolved. i have worked very hard to get here. i know what i've done. i can hang my head up high. >> the claim also criticizes the supervisors for calling a special election to remove sheriff corpus. she sent me a written statement late today saying in part, i won't let this power grab get me down. i'm posting her entire message on my social and at abc seven news.com. no comment from the county council, the county executive, the supervisors involved, or the judge. i emailed them all as well for the i-team. dan noyes, abc seven news. >> and if you have a story for dan in the i-team, just go to abc seven news.com slash i-team. >> new developments. the kidnaper at the center of the notorious 2015 vallejo gone girl case could face charges in a third bay area county. the contra costa county sheriff's office says it's linked matthew mueller to a never before reported home invasion robbery in san ramon. detectives say it

happened in early 2015. in march of that year, mueller broke into the vallejo home of aaron quinn and denise huskins. authorities say mueller drugged and tied them up before kidnaping and sexually assaulting huskins. vallejo police falsely accused the couple. remember this of making the whole thing up, but mueller was later linked to the crime and convicted. and just last week, he was charged in santa clara county for two 2009 home invasions and sexual assaults in mountain view and the other in palo alto. >> we're following the story of unprecedented challenges in oakland. three mayors in the past month. at a special city council meeting today, a new interim mayor, kevin jenkins, took over. abc seven news reporter leslie brinkley has all the action from oakland city hall today. >> motion passes with a vote of eight ayes. congratulations. >> a new interim mayor emerged from today's city council meeting in oakland. >> thank you so much,

colleagues. thank you. >> it's been quite the shuffle. mayor shang tao was recalled by voters in november, so oakland city council president nikki fortunato bass became interim mayor last month, but she stepped down today to take her new post as alameda county supervisor. so council voted today to make council member kevin jenkins the new president, which means he automatically becomes the new interim mayor. >> thank you. >> then former city council member rebecca kaplan was tapped to fill the district two vacancy created by bass's departure. >> oaklanders and bay area residents can expect over the coming months, as we're going to have a special election that will be held on april 15th to elect a new mayor, as well as to fill the district two vacancy. >> new interim mayor jenkins immediately walked into his new office. >> i think the first thing is meeting with staff, working with the city

administrator on the budget that it is first. that's primary. we have to get back to basics as a city. >> nominations for mayor and district two are being accepted now until january 17th. in the lead up to the april 15th special election. can you possibly run for mayor after april 5th for that election? that special election? >> i will not be the next mayor of oakland. >> so jenkins would serve only until a newly elected mayor is sworn in in early may. >> i do support council member jenkins as our council president and by default, our interim mayor. i believe you will do a fantastic job at oakland city hall. >> i'm leslie brinkley, abc seven news. >> fire station brownouts in oakland started today because of the city's budget cutbacks. fire stations 25 and 28, both in the oakland hills, are closed until at least july. the closures are expected to save $5 million to alleviate part of oakland's $129 million budget deficit. firefighter union officials warn

the consequences for brownouts could be catastrophic. >> cuts in emergency services don't mean these calls will go away. it means we will have to travel farther to reach those in need. increasing response times it also means that dispatchers will have to prioritize calls, which could further impact our response times. these cuts are a tragedy waiting to happen. >> the union called on the city to reverse the closures. four more fire stations are at risk of closure next month. >> a small landslide has closed the point bonita lighthouse in the marin headlands. you can see the landslide here in this photo. this is from the golden gate national recreation area that shows the landslide partially blocking the trail. the debris is being removed and the lighthouse is expected to reopen for its normal schedule on sunday. very foggy commute across the bay area. take a look at this. this video was taken this morning on the bay bridge. pea soup. as you can see, the fog also affected flights at sfo, where there were more than 250 delays. today you're looking

at a live view of the airport now. there are also a few dozen delays at oakland and san jose airports as well. well, fog today and windy weather ahead. >> let's bring in abc7 news meteorologist sandhya patel for what we can expect. sandhya. >> yeah, ama and dan. we're going to get rid of that fog and bring on the winds. let me show you a live picture right now. there is still some fog lingering from emeryville. you are looking at 80 right now. live doppler seven will show you the combination of fog and high clouds. look at the visibility. while most areas have seen an improvement. napa is still holding on to poor visibility just over a mile. half moon bay, three miles. clearly, you can see where the fog is now. the winds right now are not strong. hood mountain 13 miles an hour. that is going to change later on tonight, as we will notice the winds picking up and all areas shaded. there's a wind advisory 7 p.m. tonight until 10 a.m. wednesday. north northeasterly winds. that's an offshore wind gusting to 50 miles an hour. we go hour by hour. and you will notice those winds picking up over 30 by 10 p.m. notice

they're over 40 miles an hour and half moon bay. heading towards the morning hours and those gusty winds remain with us. we've had rain so we don't have the hh fire danger, but down south they haven't seen any significant rain. so they have a red flag warning that starts tomorrow morning. goes until thursday afternoon. isolated gusts 80 to 100 miles an hour. this could be a life threatening situation with the santa ana wind event. the water year clearly shows northern california has seen well above average. southern california barely anything. and parts of our north bay really doing well. >> all right, sandhya, thank you so much. a major migration in marin county. elephant seals are returning to drakes beach at the point reyes national seashore for breeding season, and many are making the trip to see them from a safe distance. abc seven news reporter cornell bernard has a look. >> at the roar of mighty elephant seals, staking their claim to drakes beach at point reyes for their winter breeding season. you really have to see

these creatures to believe them. >> this is incredible to get this close to them and how large they are. >> rangers say some bulls can weigh 5,000 pounds the size of a small car. drakes beach is now off limits to the public, but you can still view the giants from a safe distance. >> we started seeing some large bulls in december and now females and pregnant moms are coming back. so right now in front on drakes beach, we estimate over 30 with more on the way there. >> so extraordinary. comical. we were having a discussion in the car about where they ugly or not. i gather that there are a couple of cows that have come in that are pregnant and you know, will be giving birth any moment. >> some seal pups like this one have already been born nearby. rangers say the elephant seals journey to northern california is the largest marine mammal migration on earth. >> twice a year, these elephant seals make the migration from

the aleutian islands up in alaska down to where we are. and when they get there, they're pretty tired and they're looking to relax. and so they find, like a large expanse of beach to just kind of chill out for a little bit. and drakes beach has been one of those comfortable spots for them in years past. >> some of the elephant seals actually came up from the beach staging a takeover of this parking lot. that's why they built this fence to keep everybody safe. >> previous years, when the fencing wasn't so robust, they went right over ■and smashed it. >> the beach parking lot could close when seal pups are born to give them space. the national park service says check their website before you come, and don't forget to say hi when you get here. these guys are hard to miss. in marin county. cornell, bernard abc seven news. >> hard to miss. and they are fascinating to watch. all right. still to come on. abc seven news at six. a snapshot of the homeless situation in the bay area where it's gotten worse, where it's gotten better, and what's being done about it. also ahead, the team.

in state on thursday. the former president's funeral will be held at the washington national cathedral. his remains will then be flown back to georgia, where he will be buried next to his wife, rosalynn. and jimmy carter is being remembered fondly across the nation and certainly right here in the bay area. one south bay family is extremely grateful to him for the time, energy and dedication he showed to habitat for humanity. they actually live in a home he helped build physically helped build more than a decade ago. and abc seven news reporter zach fuentes is live in san jose with the family's story. and zach, this is such a wonderful story. >> i've absolutely loved getting to talk with this family, getting to tell this story. it was in 2013 that president carter visited that family, helping them build that home. this is when the home was still in process and being worked on. and that family, if you talk to them, they are still just as excited as if it were a day ago. and they are so grateful in that very home today that they say

has changed their lives. >> i'm going to make it now. so you're gonna drink? >> it's coffee time at the san jose home of. leo and mojito bar. but this isn't just any home. it was one provided by habitat for humanity and built in part by jimmy and rosalynn carter. he installed this door. >> i want to install it. >> abc seven news reporter david louie covered the construction of the home back in 2013, capturing the moments president carter worked on that door. the couple, who lives here now, came to the u.s. from ethiopia, initially living in a smaller south bay home. >> we still live in the same, you know, one apartment, right? >> a crowded place for their family of four. tiktok leo found out about habitat for humanity from a friend at work. >> one of my friends, she said they have a jimmy carter project, so why don't you apply this one? >> she was one of 200 people who applied for a home at the time. after a lengthy selection process, they were chosen. >> i just want to see it. i was so surprised. very nice. so we

accepted. look, who am i now? >> the surprises didn't end there. >> the team, they thought, hey, you know, jimmy carter is going to be in san jose and say what? yeah. and then i don't know how the chance he just. he picked our house. >> here's then 89 year old president carter in 2013, arriving with a bag full of tools. he was ready to take on any task. so ready. the secret service had to reel him in. >> he was 89 years old. i was cracking up because the only thing the secret service would not let him do is get on the roof. >> janis jensen is the president and ceo of habitat for humanity, east bay, silicon valley. she was there at that 2013 san jose build. >> i remember him hanging that front door and the precision, and he was not going to let it go unless it was perfectly right. >> she said the legacy he left behind will only continue to grow. >> we're going to miss both of them, but we will honor that legacy. we still we have been and we are, and we will go into the future. >> part of that legacy's growth will be through the children who

have been able to live and grow in this house, filled with reminders of the man who helped make it possible, including a picture of their parents with the carters that still proudly hangs in the living room. and of course, that front door. >> without him, we cannot get this house. look, this house. we have big house. we just he built for us. it's president. very nice guy. he has a good heart. i'm sad. >> yeah. so on the one hand, you heard her. they are sad. they are mourning president carter's loss, but they're also celebrating of the legacy that he left behind. and habitat for humanity said anybody who isfor inspired by that work can get involved. you can find out more at habitat. dot org. >> it is inspiring zach. and so moving. i think how wonderful it must be for them. every time they go through that front door they can think of the former president. now, i understand the family had heard of the great work the carter center had done. tell us how they're feeling now. >> it's really a full circle moment for them, because they had heard about the carter

center in ethiopia before they had come here. the carter center, of course, promotes mental health, health care, advancing democracy. so, so much great work that the carter center does in so many countries around the world. so for them to get that visit from president carter to that very house was just so exciting for them. and the family pointed out to, you know, this is so much more than a photo op for him back in 2013 or anytime he's done that, he wasn't running for anything. he didn't need that attention or anything. he was just there strictly to work, strictly to help people. and again, that is the legacy that he leaves behind. oh, absolutely. >> he did that for decades all over the country, in the world. zach, thank you very much. just a terrific story about the former president. >> absolutely. okay, let's turn to our weather. we have some changes coming. >> we do. with any luck, it won't be quite as cold. meteorologist sandhya patel is here with the forecast. >> yeah. no, it's not going to be quite as cold. you want to see cold, dan? and let's take a look at what's happening back east. they have been dealing with a historic snowstorm. they've seen a half a foot to over a foot of snow, along with freezing rain and sleet and arctic blast. now

going to come right into the picture. it's already very cold. i mean, we're talking 23 in detroit, 25 in new york right now. so our weather situation not quite as freezing cold and as dangerous, but we are going to have to deal with the winds. high pressure is going to build in behind a departing system that you're seeing over nevada right now. and that's going to lead to windy weather. but that will also help to get rid of some of the fog. right now on live doppler seven, we have the fog. we have the high clouds. earlier in the day, you probably remember it was like pea soup this morning. very thick. hard to see anything even into the early afternoon. and then eventually we had visibility improving most areas. but we still have some thick fog around tonight. one thing you want to watch out for if you're going to be at the coast, is the wave heights coming up breakers up to 20ft. the current wave heights are 5 to 11ft until 9 p.m. tomorrow. there is an increased risk of sneaker waves and rip currents. the winds are going to be coming

up beginning tonight. you will notice in the overnight hours going into tomorrow morning, gusty winds and that is going to lead to some drier air filtering in. so the fog that we're still seeing lingering. this is from the bay bridge toll plaza. we'll get wiped away. low to mid 50s from san francisco to oakland san jose 56 degrees a 54 in half moon bay, san jose a nice view right now. santa rosa, you're at 55. look at the chill there. 46 in fairfield, 52 napa and in livermore. and a live view from exploratorium camera. it's a great view. tonight through wednesday morning, gusty offshore winds along the coast, large breaking waves, and sunny and milder weather coming your way this week. possibility of records as well. we go hour by hour this evening. still some fog at 720. watch what happens as we head towards 10 p.m. that gets pushed away as the winds pick up going into tomorrow morning. not quite as cold as this morning, we're going to be seeing mostly 40s, and then in the afternoon it is going to be a milder day. temperatures soaring above average into the 60s. tomorrow evening you'll see some high clouds

filtering the sky at times. so your morning numbers anywhere from the mid 30s at lakeport to the upper 40s around san francisco and oakland. tomorrow afternoon, it is going to be a beautiful day in terms of the temperatures. 66 san rafael, 67 santa rosa, san jose, mid 60s from san francisco to oakland to concord. and here's a look at what comes your way on wednesday. this mild pattern is going to continue 60s for you. thursday we'll see a few 60s and even up to our north, warmer weather as we head into friday. still a dry pattern. the accuweather seven day forecast is a dry week ahead, but we are going to have to deal with those gusty winds. certainly mild by january standards. we'llm it up for you thursday. we're going to be seeing 70s around parts of the bay. records are likely to occur around that time, and as we head towards the weekend, temperatures start to trend lower. the clouds will increase. >> ama and dan have a brother, lives in indiana. he told me it was six today. >> no, i know, it's so brutal. >> they're they're dealing with their first major winter storm

the first full week of trading for the new year, got off to a mixed start. nvidia, the santa clara based ai chip maker,

closed at a record high after reporting record revenue and a strong sales forecast. the dow lost 25 points to close at 42,706. the nasdaq gained 243. the s&p 500 added 33. a big merger today involving two major virtual content providers. disney, our parent company, will combine its hulu plus live tv service with fubo. under the agreement, disney will own 70% of the new company and fubo will create a new sports and broadcasting service that will feature disney's sports networks, including abc, espn, espn two and other espn networks. together, hulu plus live tv and fubo will have 6.2 million subscribers. >> incoming first lady melania trump is part of an upcoming documentary on amazon prime video. filming began in december, one month after president elect trump won a second term in the white house. a release date for the yet to be titled documentary has not been finalized, and it's expected to

classroom preparing for a cell phone ban. it officially takes effect next month, but they are being trained on the new rules starting today. for more than half a million students and teachers in the los angeles unified school district, devices have to be turned off and stored during class, but will be accessible during an emergency. last september, governor newsom signed the phone free schools act into law. it gives the state's public schools until the summer of 2026 to come up with a plan to implement a ban or other limits on smartphones. >> well, we all know it is expensive to live here and listen to this. the income required to keep home payments affordable has hit a record high, according to redfin. the california homeowners have have it the hardest. redfin compared the median household income to the monthly costs for a median priced home. experts advise housing costs should be no more than 30% of your income. that's at the highest end. the five least affordable areas are all in california. in and around los angeles, someone making the median income needs to be needs

to spend 77% of their earnings on housing. that's the worst in the country. the bay area is not far behind 76% for san francisco and san mateo counties, 74% for santa clara county. the east bay is somewhat more affordable, 58% for alameda and contra costa counties, but still well above that 30% goal. the national average is about 42%. remember, experts say housing should be no more than 30% of your income. well, new numbers show the local and state homeless crisis is getting worse. abc seven news south bay reporter dustin dorsey explains what one city is doing to try to get a handle on this crisis and to build a better bay area. >> addressing the humanitarian crisis on our streets is a top priority for bay area cities and counties. but despite efforts to house the thousands of unhoused, the numbers are increasing. the u.s. department of housing and urban development found a 3%

rise in the bay area's nine counties to nearly 39,000 homeless, like san jose's jon magne. >> for me, once i got unhoused, once you're out here unhoused, it feels like it's climbing up a hill to try to get back into the day to day work system of supporting yourself. >> homelessness is up nationwide and in california, where the total is more than 187,000 people. two thirds of them are on the streets unsheltered. the report found that san francisco has the highest number of unhoused per capita. about one in every 100 residents are homeless. alameda, santa clara, sonoma and marin counties round out the top five. here in the south bay, there are more than 10,000 unhoused residents, the most of any bay area county. san jose mayor matt mehan wants to help bring those staggering statistics down in 2025. >> we have an opportunity to really significantly bring down the number of people living outdoors in tent encampments, without any infrastructure, any supportive services. we need to end this era of encampments.

trees. this was a 17th christmas tree throwing world championship in germany over the weekend. the event is inspired by a scandinavian tradition called nut fest. it focuses on three disciplines distance, height and slinging. that person did pretty well. well, today, canadian prime minister justin trudeau resigned as leader of the ruling liberal party. he will remain prime minister until a new leader is chosen. trudeau has led the liberal party for 11 years and has been prime minister for nine. you're looking at footage of some of his visits to california and the bay area over the years. trudeau was asked to resign publicly by his own party members. >> this country deserves a real choice in the next election, and it has become clear to me that if i'm having to fight internal battles, i cannot be the best option in that election. >> the public has been unhappy with the prime minister's handling of the budget and immigration issues. trudeau says parliament will be suspended

until march 24th while a new leader is chosen. the next election is scheduled for october 20th, but could be moved up. >> happening now san francisco's newest police academy class is graduating. here's a photo the department sent out. there are 12 graduating recruits, seven are bilingual, six have a bachelor's or associate's degree, and one is a former member of the u.s. navy. congratulations and good luck. well, this week, san francisco will swear in a new mayor. london breed lost reelection to daniel lurie in the november election. today, as one of her last official acts, she held a ceremony to honor longtime reporter kevin fagan. fagan wrote for the san francisco chronicle and also authored a book on homelessness. his last day at the chronicle will be wednesday, which the mayor has declared kevin fagan day. wednesday will be the day daniel lurie is sworn in as mayor. abc seven news was at city hall today, where banners are already hung and the stage is being set up for the big ceremony. the inauguration is set for 1130 in

angeles has more. >> when you say red flag warning and fire prone areas of ventura county, the fire department mobilizes personnel and equipment. with the santa ana winds forecast to start blowing through here tomorrow. ventura county fire and other southern california fire departments have already put resources in place to protect people and property, just in case. >> we know things are really dry. we know this is this. if there is a fire, it has a potential to be wind driven and wind driven. fires are of great concern. that's the type of fire that we had for the mountain fire and for the franklin fire. so pre-positioning equipment, as we are planning to do, is going to allow us to have resources more quickly to the need. >> recent franklin fire in malibu and the mountain fire here in camarillo were driven by the strong winds. still a santa ana wind event in january. that's unusual. >> we haven't gotten any rain or precipitation this year. our weather for our rain season starts in october. we have not gotten any any rain at all. so

destructive and life threatening. look at the water here and how much rain they have really received. los angeles 1% of average. only two hundredths of an inch. san diego 4%. obviously the bay area and northern california doing much better. so taking a look at rainfall, percent of normal here in the bay area. santa rosa 198%, san francisco 115. but oakland, san jose, sfo still lagging behind the sierra snowpack better in the northern part of the state at 150%. not as good down south. and as you look at the statewide snow pack, 103% of average. so we'll have some fog on live doppler seven that is going to get pushed out of here tomorrow afternoon, a milder day. we're going to see plenty of sun. but that wind advisory does go up tonight and runs through wednesday morning. accuweather seven day forecast. gusty winds, milder weather and that mild to i'd say even warm when you have 70 uh- pattern continues through much of the workweek before it cools off. ama and dan. all right. >> thanks, andy. >> all right. chris alvarez is

the players cleaned out their lockers, met with the media for the final time this season. kyle shanahan and john lynch are going to hold their end of the year availability at a later date. the thought is they still need to make some key decisions on personnel and coaching staff before any of that happens. it was a year to forget for the reigning nfc champs season. plagued by so many injuries and fourth quarter collapses, ended in a 4724 loss to the cardinals. and as the offseason looms, players reflecting today on a very disappointing year. >> the team went through a lot this year and you know, we weren't able to, you know, get through some of those games. and you know it's unfortunate we're not happy about it. but that's the reality that we're in and our names are stamped on that. and so i think as an organization we'll do everything we can to right the ship and get more wins next year. >> i'm all about winning. like that's all i care about. i promise. it hurts my heart. even yesterday when nothing was on the line just to even finish that way. so yeah, i'm looking to try to bring everybody else along with me. not the ideal year. we want to win every year, but i think more than anything that we can learn from this and
