news starts right now. >> the kidnaper at the center of a notorious crime is now accused of a never before reported home invasion in the east bay. matthew mueller, the man convicted in the vallejo gone girl case, is now accused of another crime around the same time. good evening. i'm ama daetz and i'm dan ashley. >> thanks for joining us. contra costa county prosecutors are filing charges against mueller over a kidnaping for ransom that left the victim so afraid, they

never told police. >> abc seven news reporter j.r. stone has been following this investigation for years and joins us live in studio tonight with the new details. j.r. >> dan, two charges were filed against mueller last week and now three this week. it's all new cases we're talking about. it's wild because mueller is already in prison for the vallejo case with denise huskins and aaron quinn. i still remember that night in 2015 when vallejo police called what happened in their city an orchestrated event and not a crime. they later apologized for that. mueller was arrested and convicted, and now he's linked to even more cases. 47 year old matthew mueller, who's currently serving a 40 year federal prison sentence for the 2015 kidnaping and rape of denise huskins in a case that started in vallejo, now faces three new kidnaping charges in contra costa county. those stemming from a separate case that happened in 2015, in unincorporated san ramon.

>> people thought this was a bizarre one off crime in the vallejo case that mueller obviously had mental health issues, but now it looks like he is a serial sexual predator, and that has prosecutors going after him very vigorously. >> that's legal analyst stephen clark commenting on mueller's latest charges. he was also in a san jose courtroom last week after being charged with two felony counts of committing a sexual assault during two home invasion cases in 2009. here's santa clara county district attorney jeff rosen. >> i think the message is that we don't forget about about rape, about murder, about any crime that's committed in this county. >> one of those cases was in mountain view and the other in palo alto. >> that victim is entitled to restitution. that victim is entitled to confront mr. mueller for how he changed her life. all of that is key. and why prosecutors are still going

after mueller, even though he is behind bars in the san ramon case that we've just learned about. >> the contra costa da says that mueller unlawfully held two men and one woman for ransom back in spring of 2015. he demanded that one of those three withdraw tens of thousands of dollars from their bank account to secure the release of the others. they did just that, and the victims never reported the crime over fears that mueller would come back for them. the da going on to say that mueller confessed to that crime during their correspondence with him last year. all of this coming after the netflix docu series american nightmare was released, where mueller's actions in vallejo against huskins and her now husband aaron quinn were profiled. when denise huskins was kidnaped, she was taken to south lake tahoe. now tomorrow, huskins and quinn will both be with the el dorado district attorney when he speaks out about some of these new cases. i was there in 2015 when huskins

and quinn spoke for the first time. it was emotional. emotional, that is, you could tell they wanted to get their story out. now the circumstances are a bit different. there are other victims out there. i'm sure they'll have quite a bit to say. amma. >> all right j.r. thank you so much. and of course tomorrow we will have a crew at the news conference. and we'll bring you updates on abc7 news and abc7 news.com. >> all right let's turn now to your accuweather forecast. with dangerous winds on the way for the entire bay area, looking live out at a foggy view from our mount tam camera. abc7 news meteorologist sandhya patel is here with a look at the powerful winds. the fog tonight, sandy. the winds coming tomorrow. >> yeah, they're already here, dan. and they're getting stronger as we speak. let me show you. the winds over the higher terrain. mount umunhum, 44 miles an hour. hood mountain and atlas peak, 29 miles an hour. those gusty offshore winds developing a wind advisory has expanded to include virtually all of the bay area until 10 a.m. wednesday. gusts 40 to 50 miles an hour will mean the potential for some downed tree

limbs and power outages as we go, hour by hour. those winds continue to increase. 40 at half moon bay 3 a.m. tomorrow morning. notice those winds picking up as we head towards the morning hours. latter part of the morning hours as well. here we've had the wedding rain and that's what's lessening our fire danger, but not the case in southern california. they are under a red flag warning beginning tomorrow morning until thursday evening. it's a particularly dangerous situation. extreme weather is expected in that area. life threatening and destructive wind storm with isolated gusts 80 to 100 miles an hour. as we go, hour by hour, the humidity will be dropping as well. look at the winds. they pick up in southern california, gusting close to 40 miles an hour there in los angeles, and then topping it as we head toward 725 wednesday morning. when you look at the rainfall averages, san diego and los angeles 1 to 4% of where they should be, so their situation is critical. i'll be back with a full look at our forecast coming up dan.

took over. jenkins is oakland's third mayor. in the last month, after voters recalled shengtao. he replaces interim mayor nikki fortunato bass, who will be sworn in as an alameda county supervisor tomorrow. jenkins will hold the office until the city's special election in april. and today we learned about one possible candidate in that race, former east bay congresswoman barbara lee. she filed paperwork today with the city and a sign that she's planning a potential run. representatives for lee were not immediately available for comment about this. >> this week, the city of san jose will start clearing out rv encampments. the city will mark some areas as towaway zones, forcing people in their rvs or cars to leave or risk punishment. the plan is to clean those areas while they're car free. this year, the city also plans to open its second and largest safe parking site, which can take up to 85 vehicles. city data shows there are more than 2000 parked rvs and lived in vehicles in san jose. this week's cleanup will focus on

chenowith avenue. >> tens of thousands of lgbtq veterans will soon be eligible for honorable discharges. the department of defense has agreed to settle a lawsuit over don't ask, don't tell under this decades long policy, lgbtq service members were separated from the military under other than honorable discharges. now they'll be able to have their discharge papers updated. this will enable them to receive veterans benefits. a judge still has to sign off on this settlement. >> we're following the story of the turmoil in the antioch police department tomorrow. the city is announcing a new interim chief as the current interim chief retires. the new leadership comes as the department deals with multiple shootings already this week and new federal oversight. abc seven news reporter tim johns explains in a recently released memorandum of understanding the department of justice, highlighting its agreement to provide oversight for the antioch police department as a part of the agreement. >> apd will hire a consultant to review and update its policies,

procedures and training efforts. all of it stemming from a series of scandals in recent years involving both racism and corruption among officers. >> it took the doj to come in and discover some of these unfortunate text messages, and obviously all the federal indictments that are a scar, really, on the city's past. >> lamar hernandez thorpe is antioch's previous mayor who helped negotiate the agreement. he says he's hopeful it will produce results. >> police department has to be in relationship with every single segment of our community and for a long time, blacks and browns, black and brown people were victims of police violence. >> creating change will be difficult, though, says civil rights attorney john burris. burris is representing 26 people who are suing the police department for alleged misconduct. >> and we're trying to change that culture. and that's a task because you have officers who were trained on a certain culture, and then you're trying to change that culture. >> burris says while the agreement between the police department and the doj is a good step, there's still a lot of work that needs to be done. he tells me he wants to see more

saying? i go through that every day. >> ward will become a free agent in march and will have to see what he decides to do. also today, 40 niners wide receiver ricky pearsall spoke about that shooting that put him in the headlines this season. pearsall says he doesn't want to judge the teenage suspect based on one thing that he did. pearsall was robbed at gunpoint last summer in san francisco's union square. police say that pearsall and the teenager struggled for the gun and both ended up shot. the teen has been charged with attempted murder. >> i have to be able to forgive him or have that weight off my chest, you know what i mean? and you know, at some point, i do want to talk to the kid and, you know, make sure that, you know, if i can create an impact on him in any way, i think, you know, that would be really big. >> pearsall missed the 49 ers first seven games of the season because of his injuries. we'll have more from the 40 niners locker room today. coming up a little later in sports. >> a man was arrested after allegedly trying to break into one of stanford's premier laboratories. deputies say a call came in sunday night about a person with bolt cutters near

the slack national accelerator laboratory. the man ran from deputies when they arrived, but a police dog found him hiding in the bushes. investigators say they found numerous burglary tools in the area and a damaged security fence. three people have been hospitalized after eating death cap mushrooms in east salinas. officials say the trio bought the mushrooms from a truck vendor outside a supermarket. they then took the mushrooms home and cooked them. after a few days of stomach illness, they started showing signs of liver failure and went to the hospital. they are currently being treated at stanford medicine. health officials are urging people to only buy mushrooms from reputable sources. >> it can be so dangerous, obviously. all right. let's talk about the weather forecast and the wind. >> yes. abc7 news meteorologist sandhya patel has that for us. sandhya. >> yeah, we are expecting some strong, gusty winds here in the bay area. let me show you the windy pattern that is setting up. we have an advisory until wednesday morning. so what you need to know is those gusty winds will cause the possibility

of some tree limbs going down, power outages. so be aware of it and watch out for things blowing around. right now. winds are gusting to 45 mile. eminem. you will notice 25. mount diablo, big rock ridge 36. so the gusty offshore winds are developing down south. they have a red flag warning until 6 p.m. thursday, and that is because they are expecting damaging winds. they haven't had much rain. you look at many parts of southern california and they're still dealing with a drought. we've had our first significant rain and we've had a pretty rainy season so far, so we're doing okay from the fire danger perspective. but high pressure is going to build in behind the departing trough, and that's what's going to set the stage for this windy weather that we are in. and it's going to get even stronger tomorrow morning 45 mile an hour winds at 7 a.m. notice how gusty it is as we head towards the afternoon 25 to 35 miles an hour. picking up in calistoga tomorrow evening over 40 and then close to 50 mile an hour winds late tomorrow night.
