news starts right now. >> a longtime san francisco business owner and marijuana pioneer shot four times in the street. tonight, we're learning more about the victims still in the hospital tonight. and what led up to the crime. good evening. i'm ama daetz. >> and i'm julian glover. several agencies are investigating last night's shooting in san francisco's soma neighborhood, but the motive remains a mystery. we know this all happened on the sidewalk at ninth and mission. in the same block as the victim's

dispensary. police later shot and killed that suspect. >> abc seven news reporter j.r. stone spoke with neighbors who are shaken up and demanding change from the city. >> i did hear the pop pop, pop pop. >> a window with a bullet hole in it. less than 24 hours after gunshots rang out in this soma neighborhood at ninth and mission. >> the way he did it, though, i mean, you walk. he he loaded, unloaded a lot of bullets and then when he was on the ground, he just pow, pow twice, you know, in the head. and then once all the way through the torso. >> the man who was shot is martin olive, the owner of vapor room, which is a longtime marijuana dispensary. according to friends, olive is still alive and currently recovering in the icu after being shot four times. they've set up this gofundme and already raised more than $60,000 to help him. >> i was really happy because that from all accounts, i thought that was a fatal shooting. >> we talked all the time. he's

just such a sweetheart, just a mellow, just a kind soul. >> hopefully he can rebound. >> i hope he does rebound. i only want the best. >> police say there was a standoff after olive was shot during that standoff. officers shot and killed the suspect. the circumstances of the original shooting are unknown, but those we spoke with in the neighborhood say city crews trying to fix the drug problem have just relocated it from other streets, including sixth, seventh and market street, to this area. they believe that has brought violence with it. >> everybody's pushing, pushing, pushing. this is the new hangout. this is the mini tenderloin we've seen. and i just hope that the mayor, daniel leary, can just bring resources. the promise that he's making this is neglected. >> i was out there in that ninth street neighborhood on tuesday afternoon, and many of the people that i spoke with heard the gunshots and are still shaken up over what happened.

going to be cold, obviously, with some dense fog, low 30s to mid 40s by morning. here's a look at the freeze watch that goes up thursday morning. covers virtually all of the bay area. temperatures down to 32 degrees. milder weather for the nights and mornings ahead as we are tracking with live doppler seven, the first in a series of storms. so here's a look at what you can expect. rain is back between friday and next monday, just over two inches in santa rosa. you could see about an inch and a half in san francisco, less in oakland and san jose. but it is certainly the start of the kind of pattern we want to see. i'll be back with a full timeline coming up. >> all right. sounds good. thank you. sandhya. in the east bay, alameda county chose its next district attorney. tonight, the board of supervisors selected judge ursula jones dixon out of seven finalists. she's a replacement for pamela price. voted out in a recall in november. jones dixon will take over a department struggling with a huge backlog of backlog of cases and facing criticism from families of crime victims. abc seven news reporter tim

johns spoke to her about what she hopes to accomplish. >> in a meeting tuesday night. the alameda county board of supervisors picking ursula jones dixon to be the next district attorney of the county. >> i'm just humbled. i'm happy and i'm humbled. and i just want to get to work for the people of alameda county in a different capacity. >> jones dixon is an alameda county superior court judge and former prosecutor. she was one of seven finalists the board of supervisors considered. she'll be the second black woman after her predecessor, to hold the district attorney job. >> i'm appreciative to miss price for opening a door. and so although our politics are very different and the way we view criminal justice, the criminal justice system is different. >> jones dixon will step into the d.a. role at a time when the office is facing heavy criticism. she says she'll work to restore trust and also strive to make public safety a top priority. >> we need to be charging cases in a timely manner. we need to have communication with victims on every case. we need to respect marsy's law and to make

sure that the prosecution is victim centered. >> the new da tells me that victim centered mentality also means improving morale within the da's office itself. jones dixon says she plans on hiring and training both new and old staff. >> serious crimes need to have consequences. not so serious crimes may need to have intervention. >> jones dixon's appointment has come as a relief to many in the county that includes carl chan, the co-founder of save alameda for everyone, the group that led the recall effort against pamela price. >> we believe she can perform the work that we've been asking for, and we're not asking for someone coming in to be changing from one extreme to another. we need someone who is balanced. >> jones dixon will be in office until the end of 2026, but she says she plans on running for reelection that year. and in the years after. >> if we can just get back to the basics, i believe that people will feel a little more comfortable with their justice system. >> jones dixon will officially take office next month in oakland. tim johns abc seven

news. >> a man in milpitas has been sentenced in what is believed to be santa clara county's first prosecution of a domestic violence case turned homicide of a transgender person. natalia lopez was stabbed to death in 2021 by her partner. natalia was a drag artist and beloved by the south bay community. elijah cruz segura was convicted of second degree murder and today sentenced by a judge to 15 years to life in prison. >> in the south bay. tonight, san jose city council officially replaced former district three councilman omar torres after a couple of hours of listening to the public and the candidates, the council voted on four of them. karl salas, an engineering executive and longtime san jose resident, was the top vote getter. salas is going to have a say when the council takes up the budget, and these are his priorities. >> it's real, straightforward, safe, clean, efficient. i mean, this city has got to have a reputation as the safest, the cleanest. it's got the best weather. let's make it the

safest and the cleanest. >> salas won't hold the seat for long. there is a special election in april and a possible runoff in the summer. torres resigned last november amid a child sex abuse investigation. >> president trump's immigration policies fueled protests in the south bay today. sky seven overhead as demonstrators marched through san jose. joined at one point by students walking out of overfelt high school. the white house says ice's goal is to arrest 1800 people per day, well above the record set during the obama administration. officials insist they are focusing on violent criminals, but a dea special agent who oversaw one of the operations today told abc news that other undocumented people who have not committed crimes may also be caught up in these arrests. robert f kennedy jr senate confirmation hearing is set for tomorrow. president trump has nominated him for the role of secretary of the department of health and human services. kennedy, a known anti-vaccine activist, has suggested he'd

like to change the fda and take on food manufacturing. so far, no senators have vowed to vote no against kennedy. but some have said they are. they have remaining questions. he has faced opposition from the medical community and from some of his own family members. >> new at 11, we're getting our first close up look at the damage from the massive moss landing battery plant fire. new images shared by monterey county show part of the battery storage facility. gutted. if you look at this, the fire earlier this month in moss landing triggered air quality warnings in both monterey and santa cruz counties. it smoldered for days. tonight, the company that owns the facility says it's just beginning the cleanup and the future of the plant is unclear. abc seven news reporter lauren martinez has been covering the fire since the night it sparked and has the update. >> the fire at the battery storage facility at moss landing is generating a great deal of questions and concerns. >> i'm sure, like many of you, my tongue still taste like metal. >> on tuesday, the santa cruz county board of supervisors heard from alarmed residents and

received a presentation from monterey county on the event. the powerpoint contained photos of the damage, a first glimpse of what the facility looks like after it burned for days. a representative with monterey bay air resources district talked about the air quality. he said they feel fairly confident they did not see anything out of the ordinary after the fire. but he says they need to know more about what materials the batteries were made of. >> next time, i'll need more information on the quantity of materials and toxics that are there, because you can do a mass balance and look at the distribution of those materials into the environment. >> when it comes to what is in the ground after this battery facility, fire scientists have found unusually high levels of toxic metals in soils at elkhorn slough. the findings were released monday from a team of researchers at san jose state's moss landing marine laboratories. >> okay, so what i'm hearing is that there was no testing for heavy metals within the smoke. >> within the smoke. there was. >> testing? >> not necessarily. no.

>> a representative with vista energy was there to answer questions from supervisors. he said their next step in the process will be to remove batteries from the building. whether this battery storage facility will return to operation is to be determined. >> we haven't made any decisions yet. we're going to work through this investigation and consult with our teams in the area before any restart is considered. >> both supervisors and members of the public hope more conclusive testing results come quickly, especially questioning what the immediate impacts to the air, water and soil are. >> i'm not surprised that a texas corporation, that man that spoke on zoom, said what he said. i was born in texas, so i'd like more public debate and more accountability because we are all breathing this air together and eating the food and the effects. >> lawmakers and regulators are also analyzing the fire, looking to pass legislation to prevent further incidents in the south bay. lauren martinez, abc seven news. >> happening tomorrow. neighbors in the east bay will have a chance to weigh in on a plutonium plan. that's raising some concerns. the federal

government may expand the nuclear weapons research at the lawrence livermore national lab, which means storing more plutonium on the site. the laboratory complex on the eastern edge of livermore has run plutonium research since the 60s. some say expanded plutonium use is dangerous, especially at a lab that is so close to a major urban area. >> people are concerned about the potential health implications that might result from an accident, an intentional act. you know, god forbid, a terrorist attack or a disgruntled employee. >> in its statement, the government cites evolving international security concerns is one of the reasons behind its decision. there will be a virtual public comment for the community to weigh in. that's tomorrow night at 6 p.m. >> dramatic moments caught on camera. deputies raced to evacuate a 100 year old woman as a wildfire closes in. >> thieves ripped up a landmark to oakland's vibrant blues

rescuing seniors in altadena. this body cam footage was released by the los angeles sheriff's department, which added music to it. we're told the video was taken the morning after the eaton fire erupted. the power was out at the senior living complex, which is why it was so dark. deputies found residents who were disoriented and confused, including a 100 year old woman.

>> oh, hi. okay, perfect. is there anyone else with you? no. okay. where were you at? what? which. which. which room were you from? >> i've been trying to find a way out. >> let's get you out of here. let's get you out. >> oh, goodness. the woman told deputies she couldn't hear them yelling because her hearing aids were charging. >> new here. at 11, someone stole dozens of plants off of oakland's blues walk of fame. the west coast blues society says replacing the 40 plaques on seventh street is going to cost up to $150,000. the west coast blues society says this theft is a huge loss to the walk, and those who have been honored by it. big names like aretha franklin and locals still around like tom bowden. they will be fundraising to replace the plaques as soon as possible. oakland police have not commented on this case. >> happening tomorrow. one of the cornerstones of san francisco mayor daniel lowery's campaign will face its first big test. there will be a hearing on his ordinance for a fentanyl state of emergency.

>> we have to treat this emergency like the crisis that it is, and we have to treat it with urgency. that's what this ordinance helps us do. it helps us build more mental health and drug treatment beds more quickly. it helps get people off the street. it helps us hire more public safety officials, more clinicians. >> lowery's proposal would also allow private sector donations. however, there is some pushback and it will likely be modified when it goes before the budget committee. >> we were voted to represent our constituents and to have, of course, the balance of powers. so there's no way in the world we should be giving the mayor dictatorship authority here in san francisco, especially without any plan that says what the mayor and his office intends to do. >> lowery says if the proposal doesn't pass, he would have to go to the board dozens of times to accomplish what he's trying to achieve. santa. santa clara based nvidia is beginning its wall street recovery after new competition in the artificial

intelligence industry wiped out hundreds of billions of dollars of value. nvidia stock rose 9% today after a 17% freefall yesterday. >> the cheaper but still high performing deep c had the world questioning whether silicon valley is still on top of the ai boom. which brings us to tonight's deep dive. headlines aside, the bay area is still playing a massive role in the future of ai. san ramon based chevron is getting into the business of selling electricity to power ai models. the company is working with a san francisco based investment firm to build natural gas power plants and provide energy to data centers. demand for power, of course, is soaring. >> a study by the lawrence berkeley national laboratory found data centers will use 12% of u.s. electricity by 2028, nearly triple what it was in 2023. in parts of the bay area, that number is significantly higher. silicon valley power says santa clara has so many of the energy guzzling facilities, they consume 60% of the city's

power. census data shows california is home to the highest share of data center jobs in the country. >> and we close out our deep dive with the vatican's new warning about the use of artificial intelligence. a vatican document released today offers wide ranging ethical guidelines for using ai from warfare to health care. it calls on technology to be used as a tool to complement, but not replace, human intelligence. >> human intelligence goes beyond simply reasoning and analysis and spotting patterns, producing solutions to determine problems. human intelligence also wants to think about what it is that gives purpose, meaning, and value to life. >> the paper was written over six months. a vatican team reviewed research and collaborated with various experts. the vatican also released a document this month with guidelines for the use of ai inside of its own walls.

level one system. rain arrives and it is going to get breezy. but i hear rain is supposed to be good luck in the lunar new year tradition and we have some rain chances, that's for sure. going right up on friday, saturday, sunday and even into monday early next week we could see more opportunities. so that is welcome news as well from our mount tam cam. marine layer is back. it is sitting over the city. high pressure is still going to keep us dry for a couple more days. that system in southern california brought anywhere between a half an inch to over two inches of rain between the weekend and early this week. right now on live doppler seven, we've got the fog that has pushed in across parts of the san francisco bay, as you can see, and the visibility at this hour is down to a quarter mile in santa rosa. so be careful during the morning commute. 30s and 40s. for many of you, it is 51 in oakland. san jose camera showing you the cloud cover overnight chilly areas of dense fog. tomorrow it's a cooler afternoon and

friday through early next week we will have periods of wet weather, which we obviously need. those spotty showers. saturday wasn't much, but some areas didn't get much. as a matter of fact, this time around friday i think it's going to be more widespread. rain. fog is going to be pretty prevalent tomorrow morning during the commute, and then in the afternoon it will hang around near parts of the coastline. the rest of you get sunshine. a chilly start with some areas of fog, 30s and 40s. you could see some of the coldest locations dropping below freezing around lakeport. ukiah. afternoon highs will look like this. low 50s to the low 60s. it's certainly a cooler day. now here comes the changes. so first, high pressure takes control. a couple more days and then friday the rain moves in. it's an atmospheric river in the pacific northwest. northern california is going to get slammed with quite a bit of rain. but you will notice here in the bay area that wet weather pattern continues right on through the weekend with sierra getting a rain snow mix and then even some more wet weather coming in early next week. now rainfall projections are

starting to come into line, about a half an inch in the south bay and parts of the east bay north bay. looking at over 3.5in of rain. this is taking you through tuesday night at 11 p.m. as far as the sierra goes, snowfall totals through tuesday night will range anywhere between eight inches at blue canyon to 27in at donner. accuweather seven day forecast the chill and the fog in the morning for lunar new year celebrations, but it will be a dry one. increasing clouds thursday, level one for friday, february. it's a wet start with scattered showers and level one for sunday. going into monday possibly we'll have to put that storm impact scale on tuesday, which we welcome.
