i-team asks the public defender why she asked for leniency in sentencing. >> always live. abc seven news starts right now. >> and as you see, live doppler seven is lit up by tonight's storm. it has brought rain and wind to the bay area today. they are dodging the raindrops durina downpour in walnut creek, and boats are getting bounced around amid waves and whitecaps. good evening. thank you for joining us. i'm ama daetz. >> and i'm dan ashley. today's storm ranks level two on the exclusive abc7 news storm impact scale. that makes it a moderate storm. >> yes, it does make it worthy of team coverage, of course. and to see what the weather is doing to the bay area and where the worst is hitting right now. we want to begin with meteorologist sandhya patel, who is trackingst the storm, but i can't wait to get to cornell and his shot with all that wind and rain. sandhya. >> yeah. i mean, it is coming down where cornell is. ama and dan. let's take a look at live

picture from the sierra. it is also coming down in the mountains right now. the snow is piling up. winter weather advisory. winter storm warning. excuse me. is going for the mountains. you can see it's a rain snow mix at this hour here. locally we are seeing quite a bit of wet weather here moving through. as we get you down to street level. radar, i'm going to show you where it is raining right around lagunitas. novato. you will notice lucas valley road, petaluma, penngrove. we do have an urban and small stream flood advisory for sonoma county until midnight tonight. they've already seen some minor flooding in the east bay from emeryville, heading in across parts of the claremont avenue area, there is steady rain falling, and from san francisco down the peninsula into half moon bay and the south bay, getting in on the action along with the santa cruz mountains. as we widen the picture here, much of california dealing with this level two storm as we get in and show you the timeline here. 8:00 you're still going to be looking at some scattered downpours going into 10 p.m, and then it starts to become more

spotty in nature. there is a flood watch until 1 p.m. for the north bay. we've already seen those streams and creeks run pretty high and they have flooded. we're going to continue to see that the winds are gusty. sfo 44 miles an hour. a wind advisory is up for much of the bay area until 4 a.m. tomorrow. those gusty winds could take down some trees and cause some outages. so watch out and be careful on the roadways. the golden gate bridge is slick tonight. this is a level two. as i mentioned through tonight's showers, brief downpours, gusty winds. the thunderstorm possibility is diminishing. minor urban flooding will continue. this is worth looking at one more time because the statewide snowpack is 75% of average. and dan, they need every snowflake they can get. >> sure do. sandhya, thanks very much. now in the north bay, a severe storms and flooding have now claimed the lives of two people. boh deaths happened in sonoma county, and there's still concern about an area where a landslide happened destroying a home. abc seven news reporter cornell bernard is live outside

sebastopol with more on the story. and as you can see, a cornell you are just getting pounded there with rain. >> yeah. hey, dan, really feeling it tonight. more rain falling across the north bay in an area that has seen too much rain already. simply nowhere for the water to go. lots of flooded roads across the county like the one behind me. sadly, this is where someone lost their life. the fire department says that person may have tried to ride a bicycle through the flooded road. >> yeah, it's a hard part going through those floods. you don't know what's down there. so, yeah, pretty sad. >> neighbors reacting to the tragic death of a man who drowned in deep flood waters on stanford road outside sebastopol. the road has been closed for several days. first responders getting assistance from the national guard using a high water vehicle like this one for the search. >> this person was. they were not in a vehicle. they they were on foot. it looked like. and there was a bike located near,

near that individual. >> on wednesday morning, sonoma county sheriff's and fire personnel found a deceased man stuck in a drain culvert on franz valley road in eastern santa rosa. at this point, authorities aren't sure how the man died. >> in the last 72 hours, we did ten swift water rescues. >> sonoma county fire swiftwater rescue teams busy coming to the rescue of stranded motorists and pedestrians after a week of epic rainfall. >> we try to close off roads, we put out our messaging, don't drive through flooded roadways, turn around, don't drown. and people still unfortunately don't don't heed the warnings. >> meantime, all eyes on a santa rosa hillside where a mudslide cascaded onto a home, trapping robert boyd's family for a time until rescue crews arrived. he got a call from his wife. >> she was obviously panicking. she didn't know if she could get out. but. very scary.

>> 16 homes near deer trail court are under evacuation warnings, while city and county crews monitor the hillside for stability. >> we're in communication with one another to make sure the community knows what's happening. they understand that, yes, monitoring is taking place and there's a plan in place in the event that something happens. that's why those warnings are in place, similar to what we do for a wildfire. >> okay, so fire marshal lowenthal says so far, that hillside is still stable. it is still holding. that is certainly the good news. but they say what they really need is dry weather, so they can work on a fix. so far as you can see, that is not happening. as for the two drowning deaths, no identification has been made yet. we're live in a very wet, very windy sonoma county tonight. i'm cornell bernard, abc seven news. >> yeah. all right. thank you so much, cornell. haven't seen that in some time. well, in marin county, officials say they've had to rescue at least one person who got stuck in the flood waters. abc seven news reporter tim johns continues our team coverage. he joins us live

with that story. tim. >> that's right. now, here in marin county, the rain has been on and off for most of today. however, earlier in the day, the marin county sheriff's office released some pretty powerful video of that water rescue from tuesday. i spoke to them earlier today to find out exactly what happened. >> hey, can you hear me? >> dramatic video released by the marin county sheriff's office showing the rescue of a woman early tuesday. the sheriff's office says the woman was driving to work on a rural road in near point reyes around 5 a.m. >> water was rushing off the hillside along the roadway and ultimately was filling up that creek and, as she was driving, hit a large puddle on the road and lost control of the vehicle, ending up in that flooded creek. >> after spotting the car in the creek, the sheriff's deputy immediately jumped into action. >> are you in there? where are you at? in the back. hey! >> he then breaks the car's back window and begins

removing items, trying to give the woman stuck inside the submerging car as much room to breathe as possible. >> i can get you out. oh, god. okay. just relax. okay. it's cold, i know. i'm not worried about the cold. i'm just worried about events. >> the deputy is able to pull the woman out of the vehicle. he then helps her walk through the rushing water to safety. >> they all crawl if i have to. i believe. >> the sheriff's office says the deputy likely got there just in time to save the woman's life. >> and you can see about half the license plate when deputy dawson arrives on scene. by the time he gets her out of the vehicle and onto the roadway, he turns around. at the very end of that video. the vehicle is almost completely submerged. >> on thursday, the marin county fire department said events like these can serve as a reminder for the public and with more rain ahead. they're urging everyone to exercise caution. >> when they see flooded areas. turn around. don't drown. if they see downed power lines, avoid them. call 911. we really just want people to be safe out there. >> fire officials say if you have to go out in these wet

conditions, you should exercise extra caution and go slowly on these roadways. they're also reminding folks that you should tell someone else when you leave, and also when you arrive at your destination. i'm live in marin county tonight. tim johns, abc seven news. >> all right, tim, thank you. and you can follow along as the forecast changes with the abc seven bay area app. it gives you access to the same live doppler seven our weather team uses. we will also send alerts with important updates. >> happening now. the oakland unified school district is giving people the final opportunity to weh in on how to solve its $95 million budget deficit. it's considering dozens of different ways to close that big budget gap. among the 30 differentet options being considered layoffs, reducing overtime for custodians, and revisiting benefit packages for staff. tonight is the budget and finance committee's last meeting on this issue before a vote in two weeks. and happening tonight as well, the san mateo city council will consider a vote of no confidence in sheriff christina corpus. millbrae and

san carlos have already approved similar resolutions. although these votes have no official power, they are part of a growing chorus of calls for the sheriff to resign, something she has so far refused to do. an independent investigator's report details alleged corruption, nepotism and retaliation by sheriff corpus. she denies those allegations strongly. a special election is being held on march 4th, asking voters whether san mateo county supervisors should have the authority to remove corpus from office if measure a passes. that would begin the process. >> public safety is part of building a better bay area. san francisco's new mayor announced a plan to surge police to popular areas of the city, including moscone center, yerba buena gardens, and union square. abc seven news political reporter monica madden joins us live with the details. monica. this was something daniel lurie mentioned on the day he was sworn in and making good today. >> yeah, absolutely. and sfpd chief bill scott says that officers who will be patrolling this area will not be assigned

to radio calls and responding to other issues in other neighborhoods. so they're going to have to move around resources in order to make this work. but officials say increasing police presence downtown is something that is critical to the city's economic recovery. >> do you feel safe walking around san francisco? >> certain sections? yes. >> it's a perception problem that's plagued san francisco city leaders since the pandemic. >> in any big city, you should be cautious that i would say. >> this was the face of our city, a place that we can all admit is not what it used to be. >> mayor daniel lurie is hoping to change that through a surge of police resources into a so-called hospitality zone. >> downtown's public safety challenges have hurt our economy. >> it will cover prominent tourist areas like union square, the moscone convention center, and yerba buena gardens. >> it's important to the image of san francisco. these are some of the most traveled and the most visited streets and corridors in our city. and it's

very, very important, vitally important that we are pristine. >> areas that were previously split up between different police districts. >> you will see a noticeable difference with this task force. >> the new unit will operate 24 over seven with two police captains and two lieutenants. the number of sergeants and officers will depend on what's going on. chief scott says most importantly, this zone will be their sole focus. >> it's really hard when you're going from call to call to concentrate on problems. this effort will allow our officers to have the time they need to actually prevent problems from becoming problems. >> we asked how the city will measure the effectiveness of this task force. what are the specific benchmarks this task force will use to measure the success? >> occupancy rates. storefronts not being shuttered but actually being opened. we will look at all of those statistics in terms of measures of success. >> perhaps the best test how people are feeling. just ask a visitor. >> union square is definitely a tourist area. it's a tourist

days after he was shot multiple times in the face during a smoke break. we're hearing from the san francisco cannabis shop owner, who somehow survived this attack hit at least once in the face. his story is at times graphic and disturbing, no surprise given the nature of what happened. having been shot so many times. abc seven news reporter louis pena sat down with him to talk about what he remembers and his recovery. >> it's been ten days since martin oliver's life changed forever. he went outside his smoke shop, the vapor room in san francisco, when a stranger came out of nowhere and shot him. >> i thought it was like a like a tiktok prank, like a joke, like a water gun. like i didn't know, you know, i was like, in

my head to the logic. didn't register. i put my hands up when i saw that it was like a real thing happening. i had just two shots, bam, bam, and i think those are the ones that hit my cheek. i don't know, i just felt this searing pain that was like the worst pain i've ever felt in my life. >> martin says he turned around and tried to run. he fell and remembers the shooter standing over him, preparing to shoot again. >> and that's when he shot me a few more times. i have a bullet wound here above my collar, and then the two in my back, which caused all sorts of other injuries. i have a fractured jaw, fractured shoulder. i think in the hyperventilating. i pierced my lungs. i cracked like five ribs. >> what was going through your mind while you were laying there? >> and i just, i remember confusion and anger and fear. i thought i was going to die on ninth street. >> as he yelled for help and agonized on the sidewalk, a stranger ran towards him. a nurse that was in the area.

>> of her shirt and started doing compresses and telling me that i was going to be okay. i remember my hands spasming. >> after a police standoff, san francisco police officers killed a man who shot martin and later found multiple firearms inside his san francisco apartment, the same building where martin has his smoke shop. >> i kept just screaming and thinking like, why me? i didn't do anything. why me? >> martin now wants to find the nurse who helped him and go back to the hospital to thank the medical team. >> they saved my life multiple times. i mean, it was. there were many moments where i was fading out, closing my eyes. >> we facetimed with doctor chris caldwell, the chief of emergency medicine at zuckerberg san francisco general hospital. >> they all deserve bonuses. they really work hard for what they're doing and they love what they're doing. every single one of them is an angel. so yeah. >> that that is so fantastic here. and i can't tell you how much i appreciate your taking the time to say that. we don't often get to hear back from

rain and snow, which is good to see as we get you into street level radar. we are tracking some scattered showers right now, so north bay is getting pretty wet from highway 101, santa rosa heading into south santa rosa. this is street level radar. we get you into the east bay. it's going to be hard to get across the bay bridge, emeryville, oakland, piedmont. right now, it's going to be a slow going ride. berkeley heading into the berkeley hills. and then scattered showers from san jose blossom hill road, heading down towards the santa cruz mountains. wider perspective, kind of showing you some of the storm reports. we've had about 19 reports, everything from flooding to wind damage, some debris flow as well. the winds have been gusty 64 miles an hour. about eminem right now 58 at pound pine mountain. at the lower elevations, winds will remain gusty. 7:00 tonight 46 at half moon bay. still windy at 8 p.m, but the winds start to back off as we head towards the late night hours. here's a live view from our emeryville camera and 80. you can see

all the raindrops on the lens so far. santa rosa airport has picked up close to an inch of rain. san francisco just under a half an inch less. in oakland and livermore, you will notice about a third of an inch in san jose. live views from our tower camera showing yoa slick runway and the golden gate bridge as well. emeryville is where the rain is coming down. and same thing for the sierra. you can see from zephyr cove chain controls. right now on most roads leading up to the mountains, it's a rain snow mix, so watch out. winter storm warning until noon tomorrow above 5000ft, blue canyon is at 5280ft. so you're basically dealing with the snow up to two feet over the peaks. gusts up to 75 will mean difficult travel conditions, 40s to 60s on your temperatures right now. this is a level two storm through tonight. moderate in strength showers with brief downpours. gusty winds, a slight chance of thunder. i'm going to have to remove that because that's pretty much diminishing. minor urban flooding expected 730 tonight. you will notice we

are still dealing with scattered light to moderate rainfall 10 p.m. across the east bay and the south bay and the peninsula. and then as we head towards tomorrow morning's commute, not as much in terms of coverage, but there will still be some pockets of moderate showers 830 in the morning, so your commute might take a little bit longer where you encounter one of those downpours by 4:00. this system is pretty much winding down. additional rain totals anywhere from about 13 hundredths of an inch in livermore to about a third of an inch in half moon bay, to 4/10 around santa rosa. your morning temperatures 30s and 40s. i would keep the umbrellas handy and definitely pack that extra layer tomorrow afternoon. it's still going to be on the cooler side. we're talking about 50s for your highs. here's your accuweather seven day forecast. it's a level one with scattered showers for your friday. saturday and sunday are going to start out really cold with frost in the morning, but by the afternoon you are looking at 50s and 60s, so you get a chance to thaw out and enjoy some sun. monday is still dry. tuesday there's a

it has disappointing first quarter results contributed to a down day for blue chips. the dow dropped 125 points, but the nasdaq went up almost 100 and the s&p 500 rose 22. three major surf and skateboard inspired clothing brands have announced they're closing all stores nationwide. quiksilver, billabong and volcom are shutting down more than 100 locations in the coming weeks. their operator, liberated brands, filed for bankruptcy. there are volcom outlets in gilroy, livermore, vacaville and milpitas. >> house lawmakers are proposing legislation to ban the chinese artificial intelligence app deep seac from federal devices. the legislation is set to be announced tomorrow. it would be similar to the policy already in place for social media app tiktok. the act would ban federal employees from using the app on government issued devices. lawmakers cite national

to. but now to a story new at six from the abc seven news i-team. >> we are dealing with a culture in our courthouse of judges being excessively lenient. >> he had no prior convictions, no record. >> it is perhaps the most important debate underway in san francisco right now. how to combat crime. the da is spotlighting yet another judge who she says is letting a dangerous criminal off easy. but the public defender argues the defendant deserves another chance. >> abc seven news i-team reporter dan noyes has obtained evidence in an armed robbery spree and covered the sentencing hearing this week. >> and he's here now with the latest dan. >> dan and ama. over the past few years, i've highlighted various judges facing complaints that their easy sentences don't do enough to deter crime. and the public defender's office has always given me written statements for those reports. but tonight, their first interview in this ongoing and important debate. the defendant, 25 year old gerardo saavedra, grew up in the east bay,

graduated from fairfield high. dreamed of playing professional soccer, but court exhibits obtained by the i-team show on a friday night in september 2023, he brought a ghost gun to san francisco, dropped his girlfriend at a bar, and went on a two hour armed robbery spree. >> san francisco 9-1-1. >> hi, we're at the paramount. eight 680 mission and we just got mugged. >> his victims, five women in their 20s, including some tourists, out for an enjoyable evening. they told police saavedra got their attention by racking his handgun. >> what do you do with the gun when you. when you first? >> he just, like, cocked it or like i heard the click. >> you hear like a. >> click sound. yeah, yeah. >> one of the victims had an app to track her phone and help police find saavedra. >> there's a gun. >> when they pulled over his car, they found the ghost gun. a magazine with ammunition and the victims purses, ids, keys and credit cards. >> you can sit down for one. all right. >> the evidence against saavedra

included a jailhouse call. >> i've been an armed robber. >> and you robbed somebody? >> yes. >> you pointed a gun at him? >> yes. >> a jury found saavedra guilty of five counts of armed robbery with a firearm enhancement. the district attorney's office asked for a sentence of 23 years. eight months in state prison. >> when you talk about armed robbery, we are talking about a type of crime that truly, truly puts lives at risk. >> the probation department's pre-sentence report recommended a 15 year sentence, but the public defender argued saavedra is a first time offender, that he was pressured to commit the robberies by an older adult and that he should get out on probation right away. no more jail time. >> he's the perfect person for that. they could come up with a plan. they could do what san francisco is pay him to do, which is give resources. right. uh- uh- set up a comprehensive plan. >> at the hearing wednesday, judge brian farrell gave saavedra four years, eight months in state prison. with time served, he could be back on

the streets in less than two years. >> so that's telling you that the courts are signaling that there's not much value being placed on even violent crime in san francisco. and so that serves as a lack of an incentive for people not to come here and commit those acts. >> public defender elizabeth camacho told the court she'll be appealing under the racial justice act, saying minorities receive harsher punishments. camacho also accused judge farrell of racial bias against both her, a mexican-american and her client, complaining about his skepticism and facial expressions and tone when making comments that can't be captured by the record. you told the judge right to his face that you felt as though he was making faces, using inappropriate tone with you that was indicative of racial bias. >> i don't want to talk about that specifically, because that is also a point that's being litigated. >> that's at the next hearing. now, jenkins argues this case could have turned out like ricky pearsall, the 49 ers shot last

in the trump administration. the senate has confirmed russ vought as the director of the office of management and budget. he was confirmed on a party line vote. a federal judge temporarily blocked the buyout offer made to nearly all federal employees. the deadline was midnight tonight. 60,000 have accepted so far. the u.s. agency for international development will be cut to fewer than 300

employees. it had 14,000 before trump took office. a federal judge in seattle issued a nationwide preliminary injunction against trump's executive order on birthright citizenship. the department of justice filed paperwork signaling its intent to appeal. president trump signed an executive order to impose sanctions on the international criminal court. the order says the u.s. will place financial and visa sanctions on anyone who assists the icc with investigating u.s. citizens, and the department of education will investigate san jose state over possible title nine violations because of a player's participation on the women's volleyball team. the spartas season was marred by forfeiting opponents protests and a lawsuit centered on one player's presumed gender identity. san jose state has not confirmed it has a transgender woman on the volleyball team. some of the headlines and here's another. hundreds of students from five high schools on the peninsula staged walkouts in support of

immigrant rights. students marched to downtown redwood city, where they held a rally in front of the county superior courthouse. >> i didn't really think that redwood city was really this close, but at the end of the day, we're all family, even though we're strangers. >> student led walkouts were held at woodside, menlo, atherton, sequoia, redwood and summit prep high schools. >> in san jose. city leaders voted unanimously to reaffirm support for undocumented immigrants, and also started the process of taking the support further. abc seven news south bay reporter zach fuentes has a breakdown of what was voted on and local reaction. >> sounds of celebration from the packed city council chamber at san jose city hall this week. the council voting unanimously in support of a resolution first introduced last month by council member peter ortiz to reaffirm the city's support for its undocumented immigrant community and to commit to not collaborating with the federal

administration and the ice department as it relates to undocumented and immigrant deportation enforcement. the resolution comes as many immigrants in the community say deportation fears are at an all time high among those documented and undocumented. >> everybody is scared to get out of their house, to go out and do their their normal things. >> moments before the unanimous vote tuesday, san jose mayor matt mehan called on police chief paul joseph to clarify what type of circumstances might lead local law enforcement to work with the federal agency. >> so there could be an occasion in which somebody has a criminal warrant for their arrest, a warrant for their arrest. they've committed a robbery or a murder or a sexual assault, something like that. and then they also happen to have some sort of immigration issues. it would be kind of an absurd result to say that their immigration issues prevent them from being accountable for their criminal behavior. so if working with a federal agency helps us to arrest them for the crime, that is something we would still

do. but it has nothing to do with immigration. >> the resolution was passed to reaffirm those rules, but it also looks into the possibility of providing $2.5 million in funding to the rapid response network, which identifies ice activity in the area. the resolution also looks into funding for legal services, legal defense for members of our community who may be stuck in deportation enforcement limbo. there are a lot of people who get stuck in there and they get lost in that system. and so we want to make sure that if san jose is home, that you get resources from the city. mayor mehan and chief joseph have planned a virtual town hall meeting for wednesday to take questions from community members about the city's immigration policies and resources in san jose. zach fuentes, abc seven news. >> we face more stormy weather tomorrow, but there are dry days in the seven day forecast. sandhya has that for

paradise burned in november of 2018. abc seven news reporter dustin dorsey has a look at what state lawmakers are doing to make sure firefighters have the tools and the resources that they need. every month of the year. >> the january southern california firestorm highlighted a chilling truth and the daetzed of other cal fire wildfire declarations. hammer it home. there is truly no longer a wildfire season here in california. >> in southern california, it is year round now. when you look at their graphs and their data, their long term data in northern california, it's getting longer and longer. it's not quite year round yet, but maybe if we have some sort of extended extreme drought, it could become even longer. >> state senator dave cortese says as the fire season lengthens, the help needs to expand as well. the fight for firefighters act, cortese coauthored would do just that. >> seasonal firefighters that are home watching the super bowl this weekend will suddenly have a job again. >> the proposal would allocate $175 million annually to make

more than 3000 seasonal cal fire firefighters full time, providing protection to all corners of the state. >> there's nothing worse than, you know, having a fire break out in in a place, you know, 25 miles, you know, from an urban area, and be right in the middle of cal fire's jurisdiction, you know, only to have no personnel in that station. >> vegetation management crews would also go full time. and assistant professor kate wilkin, with san jose state's wildfire interdisciplinary research center, says this could allow for more prescribed burns to prevent fires from growing or even starting. by restoring prescribed fire in the landscape. it could be really vital to our future in terms of resilience to climate change and fires. >> cal fire 2881 president tim edwards said seasonal firefighters can only watch fires burn in the three months they are off. at a press conference tuesday with california senate democrats, edwards said they can now make a difference. >> in the months that our seasonals are laid off. we have burnt over 507,000 acres. we have burnt down 38,000 homes and
