center in san francisco, but across the bay, oakland arena is hosting some of the lead up events, and the city and its community partners are trying over, trying to overhaul and beautify the area around the old coliseum. abc seven news reporter leslie brinkley checked out the changes. >> oakland's hegenberger corridor is putting out the welcome mat for the likes of steph curry, lebron james and kevin durant. >> it's one of those things where you know you got company coming over. so you want to make sure everything looks perfectly clean. i think that the community came together along with the mayor's office with pg and e with canna with even some of the wise guys motorcycle club, literally several community organizations came together and we did a full clean-up this saturday of the area surrounding the coliseum and up hegenberger. >> another cleanup is set for thursday to pull weeds and pick up litter. already 32 long burned out street lights along

hegenberger shine brightly with new bulbs. >> we lost the raiders. we lost the a's. we lost the warriors. but now we have we have this. the oakland is hosting the nba all star with celebrity game with the hbcu classic. the women right here. people are excited because we're showcasing now. >> over the last year, businesses have closed along hegenberger over safety concerns, and city officials are determined to turn it around. >> even this past week, i had another hotel that approached me about considering leaving, and so we want to make sure a hagenburg is a clean, safe street. but at the same time that the entertainment at the coliseum and at the arena returns to oakland. >> officials say oakland police teaming up with the sheriff's department, chp and bart should begin to make a difference. >> oakland is on the comeback. you people are proud.

>> i'm leslie brinkley, abc seven news. >> the bay area is also looking ahead to next year and taking center stage for a super bowl 60. the big game will be held at levi's stadium in santa clara next february. a ceremony was held in new orleans this morning to officially pass the reins to bay area leaders. abc seven news reporter lena howland has a look at that ceremony. >> with the pass of a ceremonial football from officials in new orleans, super bowl 60 is now in the hands of the bay area. >> from louisiana to levi's. now it's our turn to show what we've got. >> though it's only about 11 years old, levi's stadium is already undergoing a $200 million renovation to prepare, but it's no stranger to taking on an event of this magnitude. the last super bowl in santa clara was nine years ago, when the denver broncos defeated the carolina panthers. >> we had a great super bowl and super bowl 50. this is going to blow the doors off.

in our direction. and in the next 24 to 36 hours we should see some rainfall coming in. so here's the forecast animation starting at 9:00 tomorrow night, we'll get that first wave of rain coming in late tomorrow night. overnight into wednesday, snow levels may drop down to elevations of 2500ft. so along with the rain, there may be some snow over the higher bay area peaks. then late wednesday night, the next storm comes in that starts to move in. it's a stronger storm. it's mainly a thursday strong storm. it will produce a strong, potentially damaging wind gusts, heavy rainfall and snow over in the sierra. so this is going to be a level two storm on the exclusive abc seven storm impact scale. then after that, we get a little bit of a break on friday. going into saturday, we're hoping that break will last long enough to give us dry conditions for the chinese new year parade. but before we get to that, we've got more cold air coming in overnight tonight. so tomorrow morning, 1 a.m. to 9 a.m, we have a frost advisory in effect for the north bay interior. interior, mountains and valleys, east bay valleys, the santa clara valley and the eastern santa clara hills. and a freeze warning

22 states attorney generals, including california's rob bonta, filed lawsuits against the federal government. the trump administration ordered capping in direct payments to research grants at 15%. those in direct payments include administrative and facility costs linked to research. the attorneys general argued the cap will harm lifesaving research, eliminate hundreds of thousands of jobs, and cost the american economy billions of dollars. a federal court hearing has been scheduled for february the 21st over the matter. >> a new bill introduced by east bay state senator or assembly member mia bonta, bans health care providers from using ai to present themselves as licensed or registered health care professionals. the bill would also give state regulators authority to punish providers who are found in violation. bonta says patients should know and trust that the practitioners giving them care are real, qualified people, not ai. the bill is sponsored by the state medical association, and seiu.

flu cases are on the rise in california and across the country. the bay area is reporting the highest rate of flu related hospitalizations in the state. that's according to the san francisco chronicle. the cdc estimates there have been at least 24 million illnesses nationwide this flu season alone. 13,000 of those cases turned deadly. about 31% of tests for flu are coming back positive. that's nearly double the peak from last season. >> these hospitalizations are lining up more with what we saw in the previously kind of historic levels of influenza season back in 2017 to 2018. >> and experts recommend getting vaccinated, but say vaccination rates have been very low this year. there's still time, though there are several weeks left before peak flu season ends. >> we have a lot more to come on abc seven news at four, including the new fallout from the nationwide egg shortage. the retailers now limiting how many eggs you can buy. that's if you're lucky. san francisco changes its tune on the

san francisco's mission. several people are hurt and two womenral are under arrest. abc7 news reporter luz pena went back to the area where many are questioning san francisco police's strategy and the safety of parklets. >> it was a san francisco police chase, the first minutes caught on camera by this driver on 19th avenue. minutes later, all ending here with the suspects crashing into the napper tandy sports park parklet with multiple people inside watching the super bowl. >> any time there's people in the parklet, we know there's going to be a certain amount of individuals involved and the severity because of the vehicle. >> san francisco fire confirming six people, including a minor, were injured. this, as many saw the parklets roof collapse. now many are questioning the safety of parklets like this one that were first allowed in san francisco in 2021 to help many businesses survive with outdoor spaces during the pandemic. >> the parklets are usually built out of two by fours, which is common lumber and a lot of

plexiglas for visibility for the patrons. >> according to the executive director of the golden gate restaurant association, the napper tandy parklet was in compliance with the city's improved safety guidelines. >> it was set back 33ft from the intersection, which is more than is required. actually, it's eight feet on the side that it is the exiting side for the daylighting, or 20ft if you're entering an intersection. so this parklet was set back like four x the required amount. >> shared spaces program a multi-agency program which approves the permits for these parklets, said safety remains the number one priority and added in light of the police chase, resulting in a tragic coalition over the weekend. agencies are working together to evaluate whether additional measures should be implemented to enhance safety. they are approximately 500 parklets in san francisco and many businesses still depend on them. this transportation advocate is

urging the city to focus on the safety of police chases instead. >> this is the unfortunate consequence of a policy, you know, that was approved with proposition e to allow police officers to chase people in cars that we know make streets less safe for people. >> sfpd confirmed the arrest of two suspects in this crash, a 32 and a 29 year old, both women. as to the pursuit, they said the wanted vehicle was reported stolen out of richmond in san francisco. luz pena, abc seven news. >> san francisco's mta has paused issuing citations for some drivers who violate the state's new daylighting parking law. that pedestrian safety law went into effect this year, making it illegal to park within 20ft of a crosswalk. the change has riled drivers in san francisco, though many were being hit with a $40 ticket for parking at curbs that are notor painted red. the sfmta says those drivers will get warnings

instead of fines. drivers who park in marked red zones, however, will still be ticketed. the agency has also promised to speed up the painting of red zones citywide to comply with the day lighting law. it could take 18 months to do that, down from the five years the agency thought it would take. given the financial shortfall they're facing. >> quite the remarkable sight taken by sky seven over san francisco bay a few hours ago. you're looking at the 80 year old philippine mars flying boat taking off from california on its retirement flight to arizona. the world war two era water bomber is one of only seven built for the navy. the bay area was the halfway point between its former home in british columbia and its future place at the pima air and space museum. that's where it's going to go on display. and look at this. an incredible view of the flying boats final trip out the golden gate, as the boat has done so many times before, flying troops and supplies across the pacific. the philippine mars overnighted at alameda's seaplane lagoon. it's the site of the former naval air

temperatures may drop down to or even below 30 degrees. so we're projecting lows of 30 at santa rosa overnight. napa 3332 in vallejo. fairfield 31 over in the inland east. bay 32 at livermore 33, concord south bay. lows 32 at morgan hill and even right around the bay shoreline. from fremont to san mateo to oakland. lows will drop into the 30s. only san francisco and half moon bay are not likely to have lows below 40 degrees. highs tomorrow not above 56 degrees anywhere, except maybe down in the south bay, where san jose may top out at a balmy 58 degrees. so here's the forecast into motion animation. that first storm starts to push into the bay area late tomorrow night and then into wednesday. it will bring rain and perhaps even some snow to the higher bay area peaks. then a stronger storm begins to push in late wednesday night, but it will be mainly a thursday event, producing strong, gusty wind, heavy downpours, lots of snow in the sierra and then we get maybe a little bit of a break going into saturday, hoping for dry conditions for the chinese new year parade, which will be seen right here on abc

>> the story behind how line dance came to be started with a rural village in china a long time ago, and they were being plagued by evil spirits. what the villagers did was they took papier mache bamboos, put it together to have it mimic the look of a lion. >> so the lions will kind of scare away bad spirits. >> they have put the mirror in the front so the evil spirits would see their own reflection and get scared. it also ties into how the music plays in with the lion. they bang pots and pans back then to create loud noise to scare away evil spirits. and today that's why we play the drums and the cymbals. >> we're bringing all the good luck getting rid of all the bad luck from last year. >> we have small dragons which are acrobatic dragons.

to prevent that. it's called mental health diversion. >> essentially, treatment is available for people with a mental illness who have committed a crime. it's relatively new, so it's still too early to tell how well it's working. >> yeah. abc seven news. building a better bay area reporter lyanne melendez, is here now with the pros and cons of this program. >> so this is law in california. it's been on the books since 2022. now, programs that get someone into the right treatment are not new, but it used to be that the person's attorney had to argue and argue and argue that there was a connection between the crime committed and the mental disorder. now it's the other way around. the prosecutor, meaning the da has to say to the judge, hold on a minute, judge. no no no no, no, the crime has nothing to do with this person's mental disorder. so what are we seeing? for better or for worse? more cases are being submitted. the department of homelessness and supportive housing estimates that more than half of the city's unhoused population

suffers from some kind of mental illness. some can be easily identified just by walking around parts of san francisco. you've seen them. a few end up committing crimes because of their mental disorder. so here's what happens next. rather than punish them by sending them to jail or prison, menlo park state senator josh becker came up with sb 1223. >> the reason it was done is because we've been warehousing mentally ill people in our jails, and our jails are not equipped to give them any kind of mental health treatment, really. and mental health rehabilitation. >> attorney neil hallinan is currently petitioning for mental health diversion for six of his clients. >> you've been doing the work for a long time. it gets easier to identify who has diagnosable mental issues. i mean, not that i'm qualified to diagnose it, but you can tell when something's going on. >> so who would be eligible for mental health diversion? the

courts typically use this book, called the diagnostic and statistical manual of mental disorders, typically known as dsm. now you would expect to find, of course, bipolar disorder, schizophrenia, ptsd. but also included is substance use disorder. >> addiction is a condition in which the person is literally unable to say no. >> to clarify, the medical community recognizes addiction as an illness rather than the result of bad judgment. but san francisco's district attorney believes some people are using an addiction diagnosis as a get out of jail free card because a person's felony charge goes away after the person completes a treatment program that could take up to two years. >> we are now seeing people who simply have a drug addiction be able to use that as the conduit to entry into mental health diversion for committing crimes

that have nothing to do with their substance abuse. >> many disorders listed in thee for diversion, even adhd. so adhd. so explain a potential nexus between adhd and criminal behavior. >> it's not unfathomable that you can have someone who's had adhd. maybe it's an extreme form, maybe it's never been treated and the person has all sorts of particular impulses that they never learned how to control. >> the only people excluded from pursuing mental health diversion are those who committed a murder or rape. brooke jenkins says she's seen a spike in the number of attorneys pursuing mental health diversion for their clients, even in a recent case of child abuse. last september, a 22 year old man was charged with severely beating this four year old with a belt so badly. we can only show you these two evidence photos to illustrate the harm inflicted, jenkins and

her team argued against mental health diversion. still, behavioral health services evaluated the man and found that he met the diagnostic criteria necessary for participation in mental health diversion. because he was diagnosed with post-traumatic stress disorder and adjustment disorder. the judge in the case, michael benkhert, approved the treatment. here's what the public defender's office had to say about the program. quote, the courts continue to take extreme caution, time and effort to make weighted and careful decisions about what is going to be the most effective route to promote public safety. senator becker says the program isn't perfect. >> and if there are cases where it's not working, we want to adjust it and get it right. >> but despite some controversial cases, an analysis by the rand corporation found people who go to diversion programs are doing much better than those who go to jail. >> 91% of the people that have

graduated from l.a. counties court diversion program have not had new filing case filings since graduation. >> the problem is that in many cases, the process is not as speedy as 1st may want. take william eaton, who has been in court several times for burglary, destruction of property, setting things on fire and violating a restraining order. we've been following the case since last october. a counselor recently found eaton was eligible for mental health diversion. the legal system, however, has been slow to provide access to the treatment eaton needs. and in the more severe cases in which a person is not mentally competent, the person may be referred to a state hospital. mental health diversion obviously is not for them. but you know, not everybody completes this treatment. it's really challenging. i mean, but let me say this the judges work really hard to make them try to succeed at it. they give them a second

safeway. the store, located in the appian 8-80 shopping center, is now set to close april 4th. in a statement released today, a spokesperson for safeway says all employees will be transferred to stores in the surrounding area. the city says the owners have not put the property on the market and are planning for it to remain a supermarket. pinol says it will update the public on next steps

as details become available. >> the south bay is getting a new chick-fil-a this week. it will open thursday in san jose on silver creek road, and it will be locally owned and operated with about 120 full and part time team members. it will be open monday through saturday from 6:30 a.m. to 10 p.m. you know the drill. they are closed on sunday. more grocery stores are cracking down on egg sales as bird flu spreads. trader joe's is now limiting customers to one dozen per customer and all of its locations nationwide. i hope you don't have a large family. the company says they hope this ensures, as many of their customers are able to buy eggs. costco and sprouts are also limiting how many eggs customers can buy. more than 150 million poultry birds have been killed in an attempt to combat the bird flu, which has caused prices to soar and supply to be limited. don't we know that to be true? >> i know it's really hit a lot of people hard. okay. we are enjoying a dry day today, but guess what? it won't be long before that rain comes back.

>> yeah. find that rain gear now. we check back in now with spencer christian. >> it's going to be wet, but before that happens, we have more cold weather to contend with. it's going to be another cold morning tomorrow here in the bay area, as we have a frost advisory that will be in effect from 1 a.m. to 9 a.m. for the north bay interior mountains and valleys, the east bay interior valleys, the santa clara valley and the eastern santa clara hills. low temperatures in those areas may drop to about 31 degrees, and we have a freeze warning that will be in effect from 10:00 tonight to 7 a.m. tomorrow for solano county and the carquinez strait and the delta lows down to about 30 or even below. then the rain starts to move into the bay area late tomorrow night. as you look at the forecast, animation continues into wednesday. a very brief break, followed by another storm, a stronger one that starts to push in late wednesday night into thursday. it will be mainly a thursday event with heavy downpours, strong gusty winds and snow in the sierra. so we've got some stormy days coming our way. as you can see here on the accuweather seven day forecast, but we're hoping for a break. it looks like we may get one on saturday to give us dry conditions
