starts right now. >> busy night at live doppler seven as our first storm of the week moves into the bay area. this is just the warm up for the main event. a powerful atmospheric river taking aim just days from now could be pretty strong. good evening. thank you for joining us. i'm dan ashley. >> and i'm ama daetz. we are tracking rain and even some snow falling in the bay area tonight. looking live outside, we've seen the occasional raindrop on our cameras. >> let's go to abc seven news meteorologist sandhya patel with a look at the wet weather

returning. sandhya. >> yeah, it's a wintry mix tonight. dan, let's take a look at a live picture from our sfo camera. and it's a wet runway out there. we have seen some areas of rain. level one system moving in. as we zoom in a little bit closer, you can see that some of it is switching over to snow right over the summit. mount hamilton has seen snow. it is rain showers from daly city heading out towards san leandro. so far only a few hundredths to about 8/800 of an inch of rain. as we go into midnight. we're going to continue to see this wintry mix 2:00 in the morning in the southern part of our viewing area. and then here comes the heavier rain tomorrow night. that's when a flood watch goes up. for most of the bay area, flooding is possible on streams, creeks and rivers, especially as the ground starts to get saturated. a wind a high wind watch goes up for most of the region, and a wind advisory for lake and solano counties. those wind gusts 70 to 80 miles an hour means the possibility of downed trees and outages. as

this atmospheric river on live doppler seven heads our way. thursday we are going to see several concerns. flooding. it's a high likelihood. trees down. power outages between moderate to high and mudslides increasing possibility as the ground becomes saturated. dan. >> okay, sandhya, thanks a lot. a sonoma county has declared a local emergency following last week's storm. there were a number of landslides, including one that swept a house into the russian river in forestville. as we showed you at the time, it's estimated the storm did nearly $9 million in damage, with roads being hit the hardest. the county also took the step to freeze evictions all across the county. it will revisit that decision at the end of the month, and you can follow along as the forecast changes with the abc seven bay area app. it gives you the same. live doppler seven that our weather team uses every day will also send you alerts with important updates. >> new at 11 a tanker carrying liquid nitrogen is leaking outside a south san jose lab.

the truck overturned right outside the ibm research almaden facility around 730 tonight. san jose police have burnell and harry road blocked off as hazmat crews tries to try to contain the leak. firefighters say the truck is carrying 4000 gallons of liquid nitrogen, which can turn into a deadly gas on contact with the air. the driver of the tanker got out is not hurt. firefighters say there is no immediate danger to the public. >> nosebleeds, headaches and breathing problems all reported after the massive fire at the moss landing battery plant. tonight, attorneys heard from neighbors who are frustrated and they're afraid. and now leading the charge for answers. the woman whose fight against p-g-and-e's inspired a movie. abc seven news reporter lauren martinez has the story. >> none of this happens until you come forward and exercise your voice. >> renowned environmentalist erin brockovich is supporting the moss landing community weeks following a battery plant fire

there. the law firm singleton schreiber has filed a lawsuit against plant operator vistra and three other companies. on tuesday, the firm hosted a virtual meeting to answer questions. >> or have there been lawsuits regarding property values that have gone down because of an accident like this? >> yes. >> the lawsuit alleges some residents have reported health impacts after the fire, like difficulty breathing, nosebleeds or metallic taste. >> a lot of times when i see patients, they don't mention that they've had a nosebleed since the january 16th fire. but then i ask a question and then it's yes. and so then we need, you know, then to chart it. >> i was really sick during this thing when this thing happened. i was on a nebulizer for a couple of weeks. >> the lawsuit also claims the corporate entities failed to implement adequate fire safety measures. one of the major corporations they feel is liable is pg and e. >> we believe pg and e was involved in the design and

development and implementation and the day to day work at the vistra site. >> we reached out to pg and e to get their response to these claims. they were unable to answer tuesday night. pg and e has said in previous statements that the fire was not at their facility, nor was it their incident. vistra has maintained air quality and drinking water are safe. on their website, it states. additionally, based on data collected by epa and the third party consultant cta, no hazardous substances were found in the air during the event and there was no harm to the public since the battery facility fire. business owners and residents said vistra has offered gift cards or money to compensate for what happened. >> i'm suspicious of that in any community i work in, when a company is telling you we did nothing wrong and everything's fine, but we'll cover this and that. >> the firm expects the defendants to respond in court in the next 30 to 60 days in the south bay. lauren martinez, abc seven news. >> happening now, the city of

fremont is discussing whether to approve a controversial homeless ordinance. the plan would make it illegal to sleep outside. it also includes a clause prohibiting aiding or abetting homeless encampments. doing so could result in six months in jail, up to a $1,000 fine, or both. the city council has spent hours discussing it, and also heard from dozens of residents on both sides of the issue. >> like many others, i have felt unsafe and experienced dangerous situations while going to my grocery store and local atm. >> this is not a solution. we have no solution with this. all we are doing is moving them around and moving them from place to place. >> the city attorney says help like handing out food or water to homeless people would not result in arrests or fines. multiple council members and residents requested the ordinance language be updated to reflect that. >> there are some new developments tonight involving the killing of a cotati teenager. a rohnert park man has been convicted of murdering 18 year old kirk kimberly in 2016

and burying him near the sonoma state campus. the killer was a former high school classmate of kimberly's and was 16 at the time of the murder. he faces the possibility of life in prison when he is sentenced next month. there were numerous delays in the case, and the first time it went to a jury, it ended in a mistrial. >> tonight, we're tracking a school budget crisis in the bay area's biggest cities. school leaders in san jose and san francisco are facing multi-million dollar deficits with few easy solutions. san jose's franklin mckinley school district is putting off school closures. san francisco unified took them off the table. abc seven news reporter tim johns explains the other options. >> at a meeting tuesday night. the superintendent of the san francisco unified school district, laying out her plan to cut almost $114 million from the district's budget. >> if we make these cuts now, we will be in a much better place in two years time, where this district will be fully solvent. >> the district's budget crisis

has been years in the making. it stems mainly from declining enrollment and the loss of one time funds. >> so we're looking at all of our spending throughout the district to make sure that we can submit a balanced budget by june. >> laura dudnik is an sfusd spokesperson. she says the district is focused on keeping the impact on students as minimal as possible. >> about 80% of s.f. usd's $1.3 billion budget is staff, and so unfortunately, there will need to be some positions that are reduced for next year. >> superintendent su has vowed not to touch school closures back in 2024. the prospect of closing several schools in the district led to intense backlash among many in the community. the pushback was so strong that sfusd eventually decided to keep the schools open. >> we want to be very mindful about how we use our resources, and then we can provide the best educational experience for our students as possible. and so we want to look at what are the budget balancing solutions we can put in place now to make sure that our schools can operate. >> we are. >> ahead of tuesday's meeting. some teachers protested the potential cuts outside.

>> we can't wait. we have been dealing with underfunded schools, having support staff cut, and so we are working to say we need minimal things so that we can educate our students. >> darcy chan blackburn says it's the students who will be affected the most by potential cuts. she tells us she thinks sfusd leadership needs to be more transparent. >> this district needs to prioritize the classroom and not administrative tasks and costs. >> sfusd says whatever layoffs do occur will all be in accordance with the law and contracts they have with teachers unions in san francisco. tim jonze, abc seven news. >> in the south bay, a decision on school closures was postponed tonight by two weeks. the franklin-mckinley school district in san jose is looking at a list of six schools. the district appears to have settled on three for certain, but there they are, looking for a total of five, and it was clear there was not a consensus. the debate, though, was at times fiery.

>> if we don't do anything right now, by january we will be bankrupt. we will not be able to pay our teachers by next januar. if we do nothing. >> the two weeks will give the board more time to reach a final decision. each closure could save the district around $1 million. >> new details tonight in the fire at an east bay refinery. the chemicals released during the massive fire at the martinez refining company earlier this month, can be cancer causing. that is according to a new report from contra costa county health officials. health officials say the chemicals in that massive smoke plume can also cause heart and lung disease. however, the county's health officer says the community was lucky that the wind blew most of the toxic smoke north and away from populated areas. martinez refining company has said it will also investigate the incident. >> all right, brace yourself. home insurance across california will likely increase yet again, if you can believe it. that's because the state's home insurance plan of last resort is

threats to sell their vehicles by tomorrow, or else they'll be vandalized. police in the humboldt county city of arcata say several people found the threatening notes on their cars, including at least one that came with a brick. the group behind the threats calls itself students against nazi extremism and mailed a manifesto to the lost coast outpost. it claimed

responsibility for the brick as well as threatening tesla owners in roanoke park, hayward and seaside in monterey county. the lost coast outpost didn't release the manifesto, but summed up the group's goal. >> so this is obviously a vendetta against musk. and they're their goal, they say, is to create a big stigma around owning a tesla. so they want the value of tesla vehicles to plummet. >> we reached out to police in hayward and seaside, and they say so far they haven't received any reports of vandalism or threats. >> in the east bay, a really close call at a barbershop. a driver smashed into the building, barely missing the barber at work. this happened at mission barbershop in fremont. police say one driver t-boned another, sending the car flying into the business. the building is now red tagged. >> today, vice president jd vance took the trump administration's fight against ai regulation to the global stage. vance and other world leaders gathered in paris for the artificial intelligence action summit. he says instead of safety, the focus of ai should be about opportunity.

road. we are seeing a mix of rain and snow. believe it or not, sfo, burlingame, south city, san mateo, east third avenue, some showers and even the golden gate bridge has had some damp pavement. here's a look at temperatures there in the 30s and the 40s. so the chill is still with us. atmospheric river is moving in our direction, and that means we are in for a stormy thursday. the flood risk is going up. you can see increasing likelihood of flooding across our entire region for tonight's storm through tomorrow. it's a level one. areas of rain. snow on the higher peaks. breezy in spots. a level three comes our way on thursday and that is a strong storm. heavy rain, gusty winds, thunder chance, dangerous surf, flooding and wind damage is going to be likely as we go hour by hour. midnight tonight. still seeing the precipitation going into 230. still a mix of rain and snow over the hills. and then here comes another round of some rain. 6:00 tomorrow night, but the heaviest stuff holds off

until thursday morning, 4 a.m. it is going to be a nasty and stormy morning commute. 7:00 you will notice it is just coming down, and this is when we're most likely going to see all the flooding issues going into 9 a.m. flooding on the roadways, the streams, the creeks. but those winds will be picking up as well. so downed trees and power lines not out of the question. 4:00 in the afternoon, some pockets of downpours not quite as intense in terms of the rain as earlier in the morning. and this goes on through late thursday night, rainfall taking you all the way into friday morning. most of you will be between an inch and a half to over four inches there in ben lomond, some parts of the santa cruz mountains may pick up about a half a foot of rain or more. winds are coming up as we head into thursday, over 45 miles an hour there in half moon bay. higher terrain inland areas will be gusty as well. half moon bay picking up even stronger winds at 7:00 50 mile an hour winds. this is the time when you may
