light rain works in here after the sun goes down this evening, so closer to 8:00 9 p.m. the rain is back in the forecast, so it's a partly cloudy day early on. temperatures again in the mid 50s to the low 60s, but tomorrow we really have to prepare you for some really stormy weather. this will be a level three a strong storm on our thursday. we have heavy rain in the forecast. most certainly we will see areas of flooding. we have strong damaging winds on the way and some very dangerous surf along the coast. we'll talk about this next atmospheric river coming up in eight minutes. let's check in with gloria, see how the commute is going. >> good morning. so far things are looking pretty good out there. it is quiet. it is early in the morning, so we're not seeing as much traffic volume right now. you can see our map here a lot of green. but we do want to point to a sig alert that we are following. this is in castro valley. and you can see the map here on westbound 580 before castro valley boulevard. there's a big rig crash there and the right lane is shut down. this has been going on since last night. there was a diesel fluid spillage. and so they are cleaning it up.

but it's not causing any major delays right now because it is of course early. we're not sure yet when this is going to reopen. so we'll keep you updated on that throughout the morning. reggie. >> amanda new this morning a controversial plan to address homelessness in fremont is moving forward. >> after hours of debate and public comment. late last night, the city council voted to approve the proposal banning people from camping on public property. abc seven news reporter lena howland is live in fremont. and lena. the decision came after council members received some clarification about the most controversial part of the plan. >> yeah, amanda. that's right. and the meeting wrapped up just before midnight after the council got that clarification about a clause prohibiting aiding or abetting homeless encampments. some nonprofits worried they could be arrested just for handing out food or water. a few council members were on the fence about approving the proposal just because of that clause. after getting clarification from city officials who said the clause would only apply to people giving out camping supplies like a tent. more council members

were swayed to vote yes. >> that it says that you can't camp on public property, and that you cannot store your property on public property. so those are the violative acts. >> okay, now i get it correct. >> so if you aid and abet those acts, then you could be subject to penalty under this ordinance. >> this is not a solution. we have no solution with this. all we are doing is moving them around, moving them from place to place. >> and the pushback to this ban also came from nonprofits like adobe services, a homeless and housing services agency working across eight bay area counties. they say this is the most encompassing, strictest ban they've seen so far, giving police complete authority. now, any violations of this ordinance could result in six months in jail, a $1,000 fine, or both. live in fremont. lena howland, abc seven news. >> lena. thank you. new developments. the belmont city council voted unanimously in support of measure a. the ballot

initiative is part of a wave of action against san mateo county sheriff christina corpus. she's accused of corruption, nepotism and retaliation within the department. corpus denies those allegations. the council had held a meeting last night with public comment on the ballot measure. >> it's time for belmont to take a stand. sheriff cristina corpus has failed san mateo county, and her continued leadership threatens not just the integrity of the sheriff's office, but the safety and well-being of every resident in this county. >> measure a asks voters if san mateo county supervisors should have the authority to remove the sheriff from office. a special election will be held march 4th. three cities have cast votes of no confidence in sheriff corpus. san mateo, millbrae and san carlos. the sheriff's office provides law enforcement in each of those cities. sheriff corpus spoke directly and exclusively with abc7 news i-team reporter dan noyes about her fight to stay in office. her chief of staff also spoke with dan. you can see those exclusive interviews on our website. abc7 news.com slash i-team.

>> happening today, we are expecting to hear from former 40 niners dana stubblefield. gloria. he is set to speak for the first time since he was released from prison. >> that's right. dana stubblefield and his attorneys are planning a news conference later today, just days after he was released from prison. stubblefield had served about four years of a 15 year sentence for rape. the conviction was overturned in december. an appeals court ruled that prosecutors made racially racially discriminatory statements during the trial, a violation of california's racial justice act. however, stubblefield remained in prison because a lower court judge said he did not have jurisdiction to grant bail or release. that came last week, when a judge in santa clara county made the order for him to be freed. the santa clara county district attorney's office has said that it plans on refiling the charges against him. reggie. >> thanks, gloria. a hazmat situation in san jose last night. a tanker truck carrying liquid nitrogen overturned and started leaking outside the ibm

research almaden facility, near burnell road and harry road. firefighters say the truck carried 4000 gallons of liquid nitrogen, which can turn into a deadly gas when it makes contact with the air. no injuries were reported, and firefighters say there was no immediate danger to the public. concerning new details this morning about the recent fire at an east bay refinery. according to a new report from contra costa county health officials, the chemicals released during the massive fire at the martinez refining company earlier this month can be cancer causing. health officials say the chemicals in that massive smoke plume can also cause heart and lung disease. however, the county's health officer says the community was lucky that the wind blew most of the toxic smoke north and away from populated areas. martinez refining company has said they will also investigate the incident. renowned environmentalist erin brockovich is leading the charge for answers after the massive fire at the moss landing battery plant. law firm singleton schreiber filed a lawsuit against plant operator vistra

and three other companies. the lawsuit claims residents have reported health problems after the fire. the suit also claims the corporate entities failed to implement adequate fire safety measures. one of the major corporations they feel is liable pg and e. >> we believe pg and e was involved in the design and development and implementation and the day to day work at the vistra site. >> abc seven has reached out to pg and e for response. we have yet to hear back. pg and e has said in previous statements the fire was not at their facility, nor was it their incident. the law firm expects the defendants to respond in court in the next 30 to 60 days. >> we're tracking a school budget crisis in the bay area's biggest cities. school leaders in san jose and san francisco are facing multi-million dollar deficits with few easy solutions. first, san francisco unified has vowed school closures are off the table. at last night's board meeting, superintendent maria suh laid out her plan to cut almost $114

million from the budget. the budget issue stems from declining enrollment and loss of funding. district officials say it's focused on keeping the impact on students as minimal as possible. >> about 80% of sfusd $1.3 billion budget is staff, and so unfortunately, there will need to be some positions that are reduced for next year. >> teachers have protested the planned cuts. some educators say the district needs to prioritize the classroom and move away from focusing on administrative tasks and costs. sfusd officials say layoffs will all be in accordance with the law and contracts they have with teachers unions in the south bay. a decision on school closures was postponed overnight by two weeks. the franklin-mckinley school district in san jose is looking at a list of six schools. the district appears to have settled on three to close, but they are looking for a total of five, and it was clear there wasn't a consensus at last night's meeting. the debate at times was fiery.

>> if we don't do anything right now, by january we will be bankrupt. we will not be able to pay our teachers by next january. if we do nothing. >> the two weeks will give the board more time to reach a final decision. each closure could save the district around $1 million. >> 509 this morning we're tracking our next storm that is really going to bring us heavy rain and some really strong winds. tomorrow we have a warm front that is right along the coast this morning. it brought a couple of early morning showers just after midnight, and now that light rain is moving out. so much of today during the daylight hours, you'll notice on future weather it's a mix of sun and clouds. here's a look at noon today. it's pretty quiet once the sun goes down. light rain is back in the forecast. a look at 8 p.m. we will track some light showers crossing the region. it's closer to midnight and first thing tomorrow morning the rain really intensifies and we will track the chance for flooding. here's 130 tomorrow morning. that is when our next storm starts

to move on shore. so looking at the storm impact scale, it is a level three tomorrow for heavy rain, the potential for flooding, damaging winds and also some very rough surf along our coast. so we do have a flood watch posted. for most of us, it's around the bay shoreline, the north bay and along the coast. these are the areas that will likely see a couple of inches of rain over the next 36 hours, and that could create some issues on roads streams. we'll watch our rivers very closely, especially the russian river in the north bay. and there is the potential. we could see shallow landslides as well. widespread winds are going to be a huge concern tomorrow. we have a high wind. watch out where we could see isolated winds gusting 60 to 80mph. so that would certainly bring trees down as the storm moves through. and a surf warning for high surf goes into effect tomorrow, especially on friday, we could see waves upwards of 30 to 45ft along our coast, guys, so we'll take a close look at this storm. also, some heavy snow coming to tahoe. we'll have that in eight minutes. reggie aqui. >> sell your tesla or else.

impersonating firefighters during the l.a. wildfires, pleaded not guilty. the couple, from oregon, appeared in court yesterday. prosecutors claim they wore fake firefighting gear and tried to enter an evacuation zone near the palisades, and a fire truck they bought at an auction. both face misdemeanor charges. >> communities ravaged by last month's wildfires are preparing for the potential of flooding and landslides from the next round of storms. yesterday, governor newsom was in altadena,

where the eaton fire leveled homes and businesses, and he announced the beginning of the process to clear properties of hazardous materials. newsom touted having the support of president trump. >> i am resolved, as is the president of united states, to do this in unprecedented record breaking speed, and i'm confident that can be done if we all row in the same direction and we work across our differences in the spirit that's required at this moment. >> debris removal is also underway in pacific palisades, which saw thousands of homes destroyed by the palisades fire. state insurance commissioners have approved the california's fair plan request for a $1 billion bailout to pay consumers claims in the wake of the wildfires. the move will likely lead to higher costs for property owners across california, with the costs of private policies increasing by an estimated $60 a year per policyholder, according to an estimate by the san francisco chronicle. the fair plan provides basic fire insurance for high risk properties when

fremont is moving forward. it bans not only sleeping on the streets, but also helping people with their encampments. council members decided to approve that controversial proposal after hours of debate last night. abc seven news reporter lena howland is live in fremont with what swayed officials. despite their concerns.ficials. despite their >> reporter hey, reggie. last night, the city attorney clarified that the city does not give authority to arrest anyone giving out supplies such as food or water to the homeless, but it does give authority to arrest people, giving out things like camping supplies. that includes things like a tent or any makeshift shelter supplies. this clarification is what actually swayed some of the council members to accept the ordinance as written. it passed in a 5 to 1 vote just before midnight. this comes after dozens of people spoke up on both sides of this in public comment, sparking an hours long discussion among council members. >> i feel like a lot of people are confusing this because colloquially, you know, it's been called a homeless ban. but

getting underway. it's a level three here, a strong storm on our thursday for hy rain, damaging winds and some very high surf along our coast, especially tomorrow night. here's a look at the flood watch. we have this in effect because we will see several inches of rain coming our way tomorrow, so we will likely see some issues with flooding on our roads and areas. we're also watching for the potential of shallow landslides once we start seeing our ground get pretty wet throughout the day tomorrow, winds will be a big concern area wide with a high wind watch in effect where we could see winds upwards of 60mph. so that could bring trees down and also cause some isolated power outages along the coast. a high surf warning will be in effect tomorrow. some of our beaches could see waves in excess of 30ft through the day. on friday, we'll take a closer look at the timing of all of this rain and the wind, and some heavy snow coming to tahoe with better in as little as 2 weeks. so this is better. and this. dupixent is an add-on treatment
