from prison. >> i'm meteorologist sandhya patel. a level three storm is on the way. i'll have the warnings. plus a look at the hour by hour forecast coming up. >> always live. abc seven news starts right now. >> we are just hours away from the return of the rain, and what promises to be a strong storm that will lash the bay area with heavy rain, strong winds and dangerous surf. you see it there. thank you for joining us. i'm ama daetz. >> and i'm dan ashley. this upcoming storm ranks level three on the exclusive abc7 news storm impact scale. we're talking several inches of rain which could cause flooding. likely will conditions will be dangerous enough that watches and warnings have been issued. >> abc seven news meteorologist sandhya patel is looking at what's coming for us. sandhya, it is going to be stormy as we head into the overnight hours and going into tomorrow morning. let's take a look at live doppler seven. right now we have some gentle light rain showing up on our mount tam cam that is

going to be changing as we go to. live doppler seven i'm going to zoom in on where we are seeing some of that rain falling right now. mill valley, larkspur, paradise drive taking you into street level radar. the wider perspective showing you that atmospheric river. it's a strong level three storm that is moving in later tonight, and the rainfall intensity will be picking up by 10 p.m. some moderate pockets of rain move in, and then the downpours at 4:00 in the morning. this is going to continue at 6 a.m. for parts of the bay area and then scattered showers, but there will be brief pockets of heavier rain heading into the early afternoon hours. we do have a flood watch that goes up tonight at 10 p.m. runs until 10 p.m. saturday. flooding is going to be possible. shallow landslides. so these are things that you'll have to be concerned about. high wind warnings will go up for the coast and the city, and wind advisories elsewhere at 3 a.m. tomorrow until 10 a.m. friday. those wind gusts 55 to 80 miles an hour means there's potential for wind damage, like downed

trees and power outages. it's a level three on our storm impact scale. flooding. rain. thunderstorm chance, strong damaging winds and dangerous surf is coming our way. as we look at a very serene scene from zephyr cove, it's going to look a lot different as the snow starts to pile up. this will be one of the significant storms of the season so far, with 75in of snow expected by 11 p.m. friday at donner, 68 at kirkwood. and as we take a look at the snow levels tonight, snowfall level will be about 4500ft. so you will need to carry those chains if you're going up. blue canyon is just above that. at 4695ft. i'll be back with a full look at that timeline and the rain totals coming up. dan. >> all right, sandhya, this looks intense. thank you. as the next round of storms moves into the bay area, remember, you can track them using the same live doppler seven that sandhya and our entire weather team uses. it's available right now on the abc7 news bay area app. download it now for the very

latest forecast and updates on the conditions where you live. >> for the first time, we're hearing from former 40 niner dana stubblefield. he was released from prison last wk after an appellate court overturned his rape conviction last december. abc seven news reporter zach fuentes was there as stubblefield talked about this case and joins us now live. hi, zach. reporter. >> hey there. amy. dana stubblefield's attorneys did not let him answer any questions today because, as they put it, they're still not at the end of the road. now, the santa clara county da's office has doubled down, saying a jury unanimously found that stubblefield is guilty. but stubblefield himself today maintained his innocence. this is our first look at former 40 niner dana stubblefield, following his release from corcoran state prison friday. >> being back home with my family and my four after four long years is incredible. >> stubblefield serving those four years of a 15 year prison sentence following a guilty conviction in a rape trial. prosecutors say he raped an unidentified woman under threat of a gun in 2015 after luring

her to his home with the promise of a babysitting job. stubblefield said he's innocent. an appellate court overturned the conviction in december, saying prosecutors violated the racial justice act, which bars prosecutors from seeking a conviction on the basis of race, ethnicity and national origin. the appellate court said the act was violated by prosecutors using racially discriminatory language during their closing argument, saying they didn't search stubblefield's home for a gun because of concerns it would open up a, quote, storm of controversy amid civil unrest that was happening in the wake of the police killing of george floyd. >> throughout this tough ordeal, i always believe the truth will come out. there was a long nights when i sat in my cell, an innocent man wondering if things would ever be be right. but i held on to hope. >> in the bail hearing friday that eventually led to stubblefield's release. prosecutors said that calling stubblefield innocent is a misstatement. since the appellate court ruled on the racial justice act, not the charges the jury found him guilty on. his defense team says the judge blocked key evidence

from being admitted, including the accuser's confession that she was a paid sex worker. >> trial judge. >> did not allow the fact that she committed perjury on multiple occasions to be heard by the jury. >> the da's office indicated it might refile charges against stubblefield. for now, the attorney general's office is appealing the overturned conviction to the california supreme court. a statement from the da's office reads in part, we remain focused on the sexual assault that occurred, the victim and the need for accountability and community safety. as for stubblefield, he says he's glad to be back home with family. >> now, i really want to focus on what truly matters is watching my son play football, coaching him a little bit and having dinner with my wife. >> so whether or not the california supreme court decides to review the appeal, or if the da's office decides to refile charges, remains to be seen. but stubblefield's attorneys say that if the charges are refiled, if they go back to trial, he will not be found guilty again. >> zach. are there any conditions attached to his release?

>> yeah. so right now he can't have any weapons. he can't have direct contact with the victim. and he also has a gps ankle monitor right now. and this is all pending that decision from the california supreme court. >> okay, zach. thank you. >> new at six. oakland police are investigating a shooting that happened in front of mcclymonds high school this afternoon. video shows evidence markers on the ground and several cars with bullet holes. investigators found no victims at the scene, but say a person who had been shot later showed up at the hospital. that person's injuries are not life threatening. and in san jose. sky seven was over the scene of a shooting this afternoon. this is the area of farm and dow drives just off hillsdale avenue. san jose police say the victim has life threatening injuries in this case, and the area will be closed off for some time as officers conduct their investigation. there is no word on a suspect or any arrests. >> san francisco police are investigating a shooting in the sunnydale district. it happened right where a p-g-and-e's crew was working. sky seven was over

the scene. the intersection of sunnydale avenue and sawyer street. police say one man was shot. he's now at the hospital with non-life threatening injuries. p-g-and-e's says the victim may be one of their contractors. sfpd says the investigation is still active, and it has not given any other information. >> we are learning some new details about the two women facing charges in a crash that injured several people at a parklet in san francisco's mission district. this happened on sunday. as we reported at the time, police were chasing the car when the crash happened. abc seven news reporter louis pena spoke with the district attorney about the charges that these suspects are facing. >> after an intense police pursuit that ended with multiple people injured, san francisco'se district attorney is announcing a long list of charges against two suspects. >> this is somebody who has a significant criminal history who it was very important for the police to pursue, to make sure that we stop the behavior that was occurring in san francisco at that time, given they were

driving a stolen vehicle. >> according to the da's office, the suspects were already known to law enforcement. the 27 year old accused driver is facing 17 counts, including hit and run, reckless driving and receiving stolen property. the 29 year old accused passenger is also facing charges. >> they don't stick to one county. they go from county to county committing these thefts and robberies. >> we confirmed multiple bay area law enforcement agencies had flagged these women hours before the crash. richmond police confirmed the vehicle they were in was reported stolen. also, berkeley police believed the vehicle had been used in a theft in their city, all ending in san francisco, with sfpd officers spotting the vehicle at stonestown galleria and beginning the pursuit. when the driver refused to stop. >> but it also tells us how out of control things have gotten. and so that's why we have to make sure that we're making these arrests. >> this chase is now raising questions about sfpd's strategy.

>> looking at the video, it is a miracle no one died. >> san francisco supervisor jackie fielder sent this letter to the police department questioning the city's new guidelines under prop e, which loosened restrictions on police chases of suspected retail and vehicle theft suspects. >> of course we need to apprehend suspects who are violating the laws, but we also have to weigh that up with the immediate threats. >> san francisco police commissioner kevin benedicto is planning to question the police chief wednesday during their scheduled meeting. >> we did add language saying that a more senior officer can assess all the facts and call off a pursuit based on risks to the public or based on a certain set of factors. i don't know if that was happened here. >> both suspects are set to be arraigned on thursday in san francisco. luz pena abc seven news. >> more to bring you. coming up next, the first new piece of legislation from new san francisco mayor daniel lurie. what it changes and whether it

bay area, san francisco mayor daniel lurie signed his fentanyl ordinance today. >> it's to address the homelessness and drug crises on the streets, and allows his office to forgo getting the board of supervisors approval for contracts and leases to address these issues. >> abc seven news political reporter monica madden has more on what will be laurie's first steps really with this new legislation? >> yes, absolutely. dan, a former retail building on geary street in the tenderloin, will

soon turn into a behavioral health crisis center. now, the city has owned this property for years, but it has sat vacant. now, previously, the mayor would have needed approval from the board of supervisors to lease the long vacant building. but now he says his office can help people on the streets faster. >> this is a first step. >> with the stroke of a pen. san francisco is saying goodbye to its lengthy approval process for getting more resources to address public safety. >> help is on the way. >> mayor daniel lurie says this new center will offer immediate medical and psychiatric care. >> it will accept patients dropped off by police, paramedics and street crisis response teams. this will free up essential hospital and first responder resources. >> it will treat roughly 25 people daily. we asked the mayor if that's enough, but he didn't say what the city's ultimate goal is. >> 25 a day is a start. it is not the end. we need more spaces

like this. >> the ordinance will also allow certain officials in his office to seek donations to help with projects related to homelessness and the drug crisis. lurie is promising transparency. >> and the board of supervisors will know it. the public will know who we are talking to and who donates. >> local advocates like tom wolf, who is in recoverytom himself, applaud the action. >> so this is a huge, huge step in the right direction for us to get resources out there on the street quickly to help reduce those open drug scenes. this ordinance allows the city to kind of filter through some of those would be bids and actually look at those orgs that can do that and get things going quickly. >> hoping more people can get access to the same level of intervention that saved his life. >> get people into recovery and get them clean and sober and on that path where they can reintegrate back into society. >> the city expects the vacant building will be open for treatment starting this spring. the center will be operated by

doctors and nurses, and will have things like on site detox and case management services. the big question that is yet to be answered is, what are the plans to continually help these people in the long term, as so many fall right back into addiction as soon as they are done with those detox programs? absolutely. >> all right, monica, thank you. >> by the way, mayor daniel lurie will be on gma3 tomorrow. watch it right here on abc seven at noon after midday live. seven >> it is going to be a busy weekend in san francisco. hopefully none of this is news to you. valentine's day is friday. the chinese new year parade is saturday, and it's nba all star weekend as well. most all star events are in san francisco, but not all. there are some in oakland, and today the town's police department discussed the preparations underway to make sure everyone has a fun and safe experience because security is a top priority. oakland has opened its emergency operations center that brings together police, fire, public works and the city manager's office. the nba is chipping in to help pay for police overtime as oakland

grapples with a massive budget deficit. >> there is going to be targeted enforcement. if you come into our city and you victimize any of our community members or businesses or people that are coming here to enjoy the festivities, we will arrest you. >> the chp will increase patrols along the freeways and oakland's busiest streets, and the alameda county sheriff's office will assist with security around the airport. >> right back to storm watch for a few moments. santa cruz county officials are telling people who live in the mountains to really hunker down, and they want the rest of us to stay away. felton grove in the mountains could see as much as eight inches of rain 60 mile an hour. wind gusts could take down trees and along the coastline. >> we're told in no uncertain terms that it won't be safe to be on the beach at all. i wouldn't be surprised if there are some beach closures. i think state parks is looking at that. we may be looking at that. i wouldn't be surprised if there are parks that are closed to. >> the county is expecting

particularly dangerous surf on friday. >> all right. and we are in for quite a decent storm coming our way. >> this thing looks intense. meteorologist sandhya patel is tracking it for us and is here with the very latest. >> yeah, this storm is going to pound the bay area, dan. and what we're getting is ahead of the storm. just some gentle rain. let me show you live doppler seven. it is an fabric river, a level three storm that is moving in our direction. and ahead of it. we are seeing some wet weather right around oakland macarthur boulevard heading into berkeley, grizzly peak boulevard into kensington. also some light rain around sfo, brisbane, colma area. so we are just getting started with this storm. but notice off the coastline we have some heavier returns and that is going to be heading in our direction. the flood risk tomorrow is increasing for the entire bay area. take a look at our flooding storm concerns. flooding is going to be pretty high. trees down will be high. power outages in that moderate category and shallow landslides becoming

a better likelihood as the ground becomes saturated. here's a live view from our emeryville camera. and the camera is not bouncing around. that will change later on tonight. your temperatures at this hour 40s and 50s. it's a level three storm on our storm impact scale. flooding. rain tomorrow. thunderstorm chance, strong damaging winds and dangerous surf heading our way. so 7:00 tonight. some pockets of moderate rain beginning to develop. 10:00 pm it will be light to moderate. but then here comes the heavier stuff. 2:00 in the morning. if you're a light sleeper, you're going to be woken up by the rain, the pounding rain, the strong winds. as we head into your commute time, 4 a.m. is going to be pretty stormy. at 6 a.m. it will continue. and then by 1:00 in the afternoon, just some scattered downpours, but the winds are still going to be going. 8 p.m. tomorrow night looking at some pockets of rain there that is heavier. and then at 11 p.m. it is starting to wind down, but some showers will continue into friday. rainfall projections. most areas will measure between

an inch and a half in san jose to almost four inches there. in ben lomond, isolated areas in the santa cruz mountains will pick up more. we're talking four to even eight inches of rain and up around the russian river. we will be looking at anywhere from 3 to 6in possible, so winds will be picking up as well. out of the south. 11 p.m. tonight getting stronger as we head towards the 3 a.m. hour, 43 miles an hour. point reyes, you will notice it's gusty across the entire region. tomorrow at noon. a high surf warning from 3 p.m. tomorrow until 3 a.m. saturday. large breakers 20 to 30ft up to 45ft, though for west facing beaches. so this is really dangerous and life threatening. just stay away from the coast if you can and not a good idea to travel. beginning 10 p.m. tonight going into 10 p.m. friday. that's when that winter storm warning goes up above 4500ft. we're looking at 2 to 5ft of snow above 6000, with gusts up to 60 miles an hour. your morning will start out stormy temperatures ranging from the 30s to the 50s. tomorrow

students are protesting possible school cuts. the santa rosa city school district could close or consolidate schools to help solve a budget gap that's estimated to hit $20 million in the next fiscal year. the board has spent months looking at different options. the district is the largest in sonoma county, with 13,000 students at 24 schools. it says it's struggling with declining enrollment and less funding. in addition to school closures, people will probably be laid off. the board expects to make a decision on cuts and closures one week from today. school districts all around the bay area are in the

same boat. san francisco unified says school closures are off the table, but does expect to lay people off to cut almost $114 million from the budget. the franklin-mckinley school district in san jose will decide in two weeks on closing six schools. oakland unified school district will vote on a budget later this month. it faces a $95 million deficit. school closures and consolidations are on the table, so is slimming down school staffing even more than it already is? >> happening tonight, another peninsula city will publicly pick a side in the saga involving san mateo coy sheriff christina corpus. she'sy accused of corruption, nepotism and retaliation within the department. corpus vehemently denies those allegations. south san francisco will vote tonight on support for measure, a measure a asks voters whether san mateo county supervisors should have the authority to remove the elected sheriff from office. a special election will be held on march 4th. and last night, belmont voted unanimously in support of measure a.

they died. the crash happened the day before thanksgiving, now a cybertruck. they were in slammed into a retaining wall and a tree and then burst into flames. sean dixon, krista sugihara and jack nelson are the ones who died. a fourth person in the truck was injured. all were 2023 graduates of piedmont high school and were home for thanksgiving holiday. the standard also reports the autopsy report determined the cause of death as asphyxia and smoke inhalation ruled the deaths as an accident. police are still investigating what role the alcohol and drugs played. the driver, 19 year old sean dixon, had a blood alcohol level of 0.195%. dixon also had methamphetamine in his system. >> new at six from the abc7 news i-team san mateo county superior court judges are raising concerns about their personal safety after several incidents of deputies who should be watching potentially dangerous criminals. of course, falling asleep or otherwise failing to do their jobs. >> the i-team has obtained

correspondence between the judges and the sheriff who oversees the court. deputies. dan noyes is here with the story tonight. dan. >> dan. it gets worse. a deputy makes the mistake of escorting a female inmate with three males, and turns his back while she is sexually assaulted in an elevator. the sharp exchange of letters and emails between presiding judge stephanie garrett, judge elizabeth lee, and sheriff christina corpus from december is now coming to light after a public records request. the judges expressed concern for frequent lapses in security protocols, causing the potential for serious harm to other judges, court staff, attorneys, litigants and the public. the judges declined my request for an interview, but i spoke with longtime district attorney steve wagstaffe. >> how unusual is that for a presiding judge and a judge, actually, to send a letter to the sheriff over concerns for deputies. i've been here 50 years. it's the first time i ever heard of it. >> the judges list several instances of armed deputies falling asleep in court when

they were supposed to be monitoring murder. defendants. jurors complaining the bailiffs were on their phones, playing games and doing internet searches during trial. an unshackled murder defendant in plain clothes allowed to wander the back hallway near the judge's chambers. >> somebody charged with homicide, unshackled, wandering around in the back. that's a major cause for concern. >> the most shocking of all, a deputy ignoring protocol, escorting three male inmates and a female back to jail from court. the judge said he kept his back turned long enough for the woman to be raped twice in an elevator. >> that deputy was horrible in what he failed to do. >> we did release him immediately because of the egregiousness of, you know, his lapse in judgment. >> christina corpus says she's been beefing up court staff, hired 182 sworn employees in the past two years, many of them from other police and sheriff's departments, and that she responded quickly to the judge's letter by ordering new training.

>> i took immediate action and, you know, went back to the lieutenant and the captain to work directly with the judge. open the lines of communication so there's no lapses. >> i wanted to get the union's response to these issues, so i stopped by the deputy sheriffs association offices for an interview. but a spokesperson told me it's not going torson happen. sorry. they don't want to get involved in this. not worth it. the union has been funding the vote for measure, a campaign that would allow the board of supervisors to fire the sheriff. judge garrett placed responsibility for the courthouse. problems, with christina corpus writing, we never had these problems of this magnitude until this past year. >> i've worked in this office for 25 years, so i know when it's good and i know when it's bad. and so we have had bouts of different circumstances where our staffing levels are high or they're low. and so for it to be attributed just to me and my tenure, i don't think was i

uncommon in the bay area, but what happened to a san jose man's car caught him off guard. his air bag was stolen and that may be becoming a more popular crime. abc seven news anchor dion lim explains. >> it was friday morning. i went outside to take the kids to school and the window was smashed in. and, you know, i'm obviously in shock. >> it wasn't so much the broken glass and breaking itself that shocked real estate agent elias dea, but what was taken? >> the air bag was missing and that was weird. >> even more peculiar to elias, who had parked his car along the street in san jose's oak grove neighborhood, was that he wasn't the only target in recent days.

>> somebody else yesterday had had the same thing happen to them, and he told me he had a red honda, too. >> san jose police tell me they've had more than a dozen reports of stolen air bags in the last six months of 2024, but pointed out more thefts may have gone unreported. >> this is the most commonly stolen one because it's the most easily accessible, the least time consuming to steal and remove. >> aaron kessler of jp autobody in south san francisco, has seen a fair share of air bag thefts in the past. >> i saw it maybe once every 2 or 3 months. i would see it on hondas, toyotas, more common everyday people, cars. >> so the big question is why are air bags getting stolen? police didn't comment, but aaron believes stolen air bags could be a cheaper option for drivers looking for a replacement after a crash. >> to save themselves money. that's the most common one i see. most kind of insidious that i can think of would be organizations, businesses or people that purchase used totaled vehicles and have no scruples. they intend to try to
