we speak with our panel of experts answering your questions. we'll have those answers next at six. >> always live abc seven news starts right now. >> and we begin with new developments. a 19 year old is under arrest for yesterday's shooting on southbound 880 in oakland. the chp shared this picture of the gun recovered from his oakland home and believes it was used in. the shooting. happened around 7:30 a.m. near 16th avenue. the driver was not hurt and later told investigators the suspect was possibly driving in his neighborhood. oakland police officers located the vehicle, which was parked and unoccupied, and staked it out. they moved in when two people returned and arrested, one on charges including attempted murder. good evening. i'm ama daetz. >> and i'm dan ashley. thanks for joining us. there was another east bay freeway shooting this morning, this time on highway 24. it is the second shooting on this road in two weeks. >> all westbound lanes were shut down for an hour, backing up traffic for miles. abc seven

news reporter suzanne fawn has a closer look at what happened. >> from sky seven. you can see the harrowing scene the back window of a white suv shattered by gunfire. the chp shut down highway 24 near orinda for more than an hour to look for shell casings. after someone fired several shots at a car around 1045 this wednesday morning. it happened on highway 24 in orinda, creating a traffic mess. sky seven saw one man forced to walk off the freeway carrying a young child, then hopping into a waiting car on surface streets. another woman walking off the freeway hauling a suitcase and drivers driving the wrong way on freeway onramps to escape the gridlock, according to the chp. no one was hurt. the 66 year old man, who was behind the wheel of the suv struck by bullets, managed to escape any serious injury. when we asked the chp about it. >> i don't believe that the person who called in was an intended target. >> abc seven stopped by the

driver's home. the man was unavailable to talk, but his wife told me he's okay. a closer look at the damage done by the shots fired. it's a startling reminder that the driver is extremely lucky he wasn't killed. we showed drivers in orinda pictures of the damage. >> it was amazing. >> we don't know why. >> it happened. it's hard to believe. >> lou reginato has lived in orinda for more than five decades and drives highway 24 often. >> whenever i drive, i always yield or whatever. i never challenge anyone. i just play it very safe. >> wednesday morning shooting is the second freeway shooting in two weeks on highway 24. >> two times in two weeks. that's ridiculous. >> last tuesday, someone fired several shots on highway 24 in oakland, striking a driver in the legs. investigators are now looking into both shootings. suzanne phan abc7 news. >> now to storm watch. this is the reason why it was a wet start to the day in san jose. as

you see. >> it was, and there's more rain on the way. abc7 newss more rain meteorologist sandhya patel is looking ahead for us. sandhya. >> yeah. don't ditch those umbrellas just yet. let me show you live doppler seven and we'll talk about why and what's happening. taking a look back at time, you will notice there was a lot of rain that steadily moved through the peninsula, the east bay, parts of the south bay. that's where the focus was. we even had some strong thunderstorms developing in santa clara county that moved through earlier this afternoon. so as we widen the picture here, you will notice this level one system is not done with us yet. the first part of this has already gone into southern california. the second part of it is still off the coast. and as we head into tonight, we will see some spotty showers developing at 9 p.m. going into tomorrow morning's commute. be prepared for not just some damp roadways, but some snow over mount hamilton. you will notice around 7:00 730 in the morning. 1030 you're still seeing some of those showers going through. there's even a possibility of more thunderstorms as we head towards tomorrow.

that we can keep our firehouses open long term. >> $2 million in funding from the coliseum sale will be used to reopen those firehouses, which includes stations 25 and 28, in the oakland hills. a third station, ten, has been closd for years for renovations. it should also reopen by july. >> today is the last day to file a claim to get settlement money from a class action lawsuit filed against the parking app, parkmobile. the atlanta company reached a nearly $33 million settlement for a 2021 data breach. users of the app who were impacted have until tonight to claim a small part of that settlement. anywhere from 1 to $25. parkmobile is used by private parking lots around the bay area. some cities use the app to allow drivers to pay for on street parking. >> voters are ready to give the san mateo county board of supervisors the power to remove the elected, embattled sheriff. ballots are still being counted, but measure a is passing overwhelmingly, with 85% of the

vote saying yes. abc seven news reporter monica madden has the response from the sheriff. >> it will be at least 40 days before the san mateo county board of supervisors can begin the unprecedented process of removing sheriff cristina corpus from office. but with the early results, it's looking like the board will soon be armed with the power to fire the sheriff. >> the results of this historic election send a clear message. >> in a wednesday press conference, supervisors ray mueller and noelia corzo explained what's next after san mateo county voters overwhelmingly approved measure a. >> we will move forward as quickly as possible. >> once the election results are certified, it will trigger the process of sheriff cristina corpus removal, and it will take time. >> soon after, county staff will seek direction from the board of supervisors and a public meeting regarding procedures that will be used to conduct a removal hearing. prior to a removal hearing, the sheriff will be served with a written statement

of grounds for removal. the sheriff will then be given a reasonable opportunity, both in writing and in person, to, prior to, and during the hearing, to be heard regarding any explanation or defense. >> supervisors corzo and mueller led the effort to get measure a on the ballot, and previously called for corpus to resign, but vow objectivity. going forward. >> the county will implement clear procedures to ensure a public, impartial and lawful process. >> the public controversy began in november after an independent report sustained several internal allegations that corpus abused her power, engaged in nepotism and retaliation. she denies all allegations and tells abc seven news that with such a low turnout, this is, quote, hardly a mandate to remove her from office. corpus goes on to say, quote, i now have the opportunity to formally challenge and disprove the politically motivated allegations against me. i

board of supervisors, as we've talked about here, the power to remove. sheriff christina corpus from office. >> she's been under fire since a scathing. audit report released in november. and now her legal team is calling into question the credibility of a key witness cited dozens of times in that report. >> and abc seven news i-team reporter dan noyes has exclusive information about the witness, called civilian employee number three. dan. well, dan. >> both sides are preparing for the legal battles ahead. one public official has already agreed to testify under oath at the proper time about threats he allegedly heard from civilian

employee number three that she wanted to take down the sheriff because she didn't get a promotion. it's been quite a turnaround for civilian employee number three. she worked at the san mateo county sheriff's bureau in millbrae when christina corpus was captain and chief there. >> hello, everyone. it's christina corpus, candidate for san mateo county sheriff 2022. >> and she took on a public role when corpus ran for sheriff, volunteering on the campaign, attending this kickoff rally and introducing corpus to voters online. it's a much different story now. employee number three campaigned on her social media for measure a to give the board of supervisors the power to fire the sheriff, saying corpus is unfit for duty. but a public official in millbrae tells the i-team he will testify under oath at the proper time that on 12 to 15 different occasions, employee number three told him she was going to get corpus. i obtained an interview the public official gave to the sheriff's legal team, in which he

identifies employee number three and says, quote, i have information that was conveyed to me directly by employee number three that she was out to get sheriff corpus after she was elected, and that she would do anything to bring her down. that public official said employee number three expected a promotion once corpus became sheriff after the work she did on the campaign. but it never happened. and employee number three was furious. again, a quote from the public officials interview. i remember she was, i'm going to get that a couple of different times and saying that she's going to go after her. and this is the way that employee number three talks. oh, it's going to come down on her. that type of language and communication. and that's to me directly. >> she's out for vengeance for me. she's out for vengeance. >> shortly after the release of the audit report in november, sheriff corpus told me a lawyer pressured her office for a promotion for employee number three. >> a prominent san mateo county female attorney. went to one of my captains and said that if i didn't give this person a

promotion, then i was going to regret it. >> when did that conversation happen? >> oh, probably about maybe a year ago or so. maybe a year ago. >> so shortly after you took office, or within the first year of you taking office. that attorney tells me she did inquire about a promotion for employee number three, but not as her lawyer, just as a family friend, and that she never made a threat like the sheriff will regret it. but that millbrae public official said in their meetings, employee number three, quote, would communicate her absolute displeasure with christina and the threat of going after her and, quote unquote, getting the sheriff. civilian employee number three was among 40 current and past sworn and civilian employees interviewed by retired judge ladoris cordell, who was paid $200,000 by san mateo county to investigate complaints against the sheriff. employee number three's accusations are cited dozens of times in the 400 page report, much more than any of the other witnesses. for

example, employee number three claimed corpus called former sheriff carlos bolanos a racial slur twice. on one occasion at the millbrae bureau, employee three says that you were looking over her shoulder at a zoom with bolanos on the screen, that you drop the n word twice. >> i don't use that word. i don't use that word. >> according to the report, employee three gave judge cordell a text message she claims came from the sheriff, using a derogatory expression for a gay council member. did you write those words? >> no, i had to look. what look that up because i was unclear as to what that was. >> right. that's not your text. >> no, it's not my text. i did not send that. >> but the majority of employee three's accusations cited in the report focus on an explosive allegation that sheriff corpus and her chief of staff, victor, may have a relationship that is far beyond professional and that as a result, he wielded considerable power in the office and that you've turned over control of the department to him. >> well, really. >> what do you say to that

garbage? >> i say it's false. i am not having an affair with him. i've known victor for 17 years. 17 years, and we are colleagues. i consider him a trusted confidant, a friend. is it because i'm a woman and i can't have a man next to me that i trust without having a sexual relationship with him? >> they both denied it in my exclusive interviews during all that time, did you and her ever become romantic? no. there's never been physical contact or a dating relationship. no. that public official told the sheriff's legal team, quote, my professional opinion of the report is that it isn't worth the paper it's written on. i don't think that that report has any merit at all. i think it has a lot of fatal flaws, and it's not a legitimate, true, independent investigation. charles stone is the lawyer for employee number three. he told me neither he nor his client would comment for this report. i also called judge cordell and

southern california where they're getting some rain. the second system is off the coast, and it's basically a cold, unstable air that's coming with it. so do expect some more showers. possibility of thunder. certainly thunderstorms across parts of northern california right now and chain controls on most roads heading up to tahoe. as the snow is falling in the sierra. looking at live doppler seven here, you can see some radar returns off our coastline, so we're clearly not done yet. here's a look at the unstable air that will be moving in later tonight going into tomorrow. it is windy out there. gusts to 37 at sfo, 33 in oakland and novato. a beautiful view though from our golden gate bridge camera. this is our break, if you will. low 50s san francisco, oakland, san jose, right now, 52 degrees in redwood city and from our east bay hills. camera. we are seeing the clouds gathering once again. 53, in santa rosa, fairfield, concord, 48, in petaluma, 51 in livermore. one other live picture from sutro tower. looking at san francisco through tomorrow. we'll call

it's an erroneous payment. so the net effect will be zero. but if they she doesn't report the 1500, there's going to be a matching error. and the irs is going to send her a notice. >> of course, identity theft, a common concern we see often. definitely this next one just in from reynaldo. she wrote us saying our cpa did not file our tax returns last year. every time she called the office, no call back. to this date, she has had no calls returned, not even an email or a text. she went to the local irs office in santa rosa yesterday to report it. they checked online and told her her taxes were never filed nor an extension. what should she do? >> well, do a couple of things. first, i would seek the assistance of a tax professional. if you'd like to find an enrolled agent, she can go to the csc.org website. there's on the home page, find an enrolled agent, put it in her zip code, and they'll get a list of uh- ese in her area. then i

fremont last month was considered to be one of the toughest laws in the country in tackling homelessness. >> but last night the city voted to consider revising the strictest part of the law. >> abc seven news reporter anser hassan explains that housing advocates say it is still not enough. >> in a61 vote tuesday night, fremont city council resolved to amend a controversial camping ordinance passed in february to clear homeless encampments. the revision seeks to remove the section around aiding and abetting.round aiding and >> our intention was aiding and abetting would be if you build large structures like tree houses or large wooden structures. but people were saying that it was if we give water or food or we help somebody, and that was never our intention. >> newly elected fremont mayor rod sullivan says the city has gone on record to clarify this, but thought it's important to

revise the language to remove any ambiguity in the law. >> remove this because we want people to feel confident that they can help their neighbors, and they can provide food, water services to everyone. >> fremont is estimated to have 800 homeless people. 700 of whom are unsheltered. the ordinance, passed in february, bans camping on any public property like sidewalks, parks and open space. the city could also criminally charge those aiding or abetting a homeless camp, which homeless advocates argued included providing tents or sleeping bags. the penalty? a fine of up to $1,000 and up to six months in jail. >> it was clear from last night's conversation that nothing short of the threat of jail would be acceptable to the city council. >> vivian wong is ceo of abode services, a homeless and housing agency. she's nt convinced, she argues, even ifnt the city removes language from the ordinance, the problem is that aiding and abetting is still a violation of fremont's municipal code, and nonprofits like hers that violate the law

could lose city and state funding. >> again, by breaking the law is really, you know, sleeping outside now, then we could still be prosecuted through the municipal code. >> as it stands, the current ordinance takes effect next week. any revisions that are approved would still have to pass through a first and second reading, which could be months away. in fremont, anser hassan abc seven news. >> a scathing lawsuit accuses the san bruno park school district of failing to protect students from sexual abuse by a teacher. jeremy yee is a former elementary school teacher in the district. he was convicted last week of 17 felony counts of child molestation for abusing at least four students. the suit alleges that the district failed to act after receiving a number of complaints about yee's behavior. as far back as 2017. >> but because that student was called a liar and was directed to recant, that didn't flow up the chain the way it was

the bay area home of legendy entertainer bing crosby has hit the market for the first time in decades. crosby passed away in the late 1970s. his wife died this past september. today, abc seven news reporter zach fuentes got a rare tour of the home on jacqueline drive in hillsborough. >> with each step closer to this historic estate, you move further away from the present and closer to the past. >> welcome. >> this was the home of the legendary bing crosby. situated in lower north hillsborough on more than five acres. >> being raised his three children here with his wife catherine. and they lived their lives here. catherine lived here up until just a few months ago. >> listing agent jennifer gilson says the family made the tough decision to sell following catherine crosby's passing in september at 90 years old. >> there's a lot of love that has gone into this home and has continued. >> seen throughout the more than 18,000 square foot estate are countless photographs of crosby with family and fellow stars. gold records and plaques are on

today. doctor jay bhattacharya is a professor of medicine, economics and health research policy at stanford. he's a harsh critic of many covid policies, like the mandatory lockdowns and vaccine mandates. he told the senate today that if he's confirmed, he plans to bring free speech back to the nih. >> dissent is the very essence of science. i'll foster a culture where nih leadership will actively encourage different perspectives and create an environment where scientists, including early career scientists and scientists that disagree with me, can express disagreement respectfully. >> doctor bhattacharya also addressed the current measles outbreak, saying he supports vaccines and does not believe they cause autism. >> a california man got the surprise of a lifetime last night during president trump's address to the nation. >> i am pleased to inform you that your application has been accepted. you will soon be joining. >> the high school senior jason hartley dreams of going to west

>> well, dan, we're back with chris housh with house tax law. and chris, this next question is an interesting one. i, of course, continues to become a big part of our society. are there concerns with how it's being implemented within the tax industry? >> yes. like with any other item, you need to be able to double check how it's being used. so you want to make sure that your tax preparer is doing a follow up question on anything that's unusual, rather than just allowing the software to auto populate the information in from something that was input, and also with other tax professionals. there have been cases where tax lawyers have been getting hit by the judges for going and using ai answers of cases that didn't actually exist, that the ai made up and nobody did the double checking. so always double check the information you're getting from the ai from a reputable source. >> yeah. sign of the times. well, this next question from mary asking whether the irs has a payment plan option so you don't have to pay the full amount right away. and she does note this is not about taxes

that are delinquent. >> which is a very good question. so as you're filing your tax return, if the amount on the return is more than what you can afford to do, still file it. so because you have penalties that will start april 16th even and with the payments is that the irs is required to accept if your balance is $50,000 or less and you're proposing the amount that will pay it off in five years or less, they are required to say yes and accept that proposal and they can do it online. you don't need to pay a tax professional to do that part for you. if it's that you're needing to resolve a larger balance or you need more time to pay, that's when you want to get a tax professional and that can negotiate to get those other arrangements for you, but always follow the return first. >> good tips. one last question quickly from peter. we're seeing more people required to be back in office, which is great. but for those who are still working from home, what items qualify as a business expense? >> so there is a difference between if you're an employee or a self-employed person, a

away from breaking the all time goal scoring record held by the great one, wayne gretzky, but his pursuit for greatness stretches far beyond the ice, starting tomorrow night. ovechkin will be donating money for every goal scored during the remainder of his career. the money will go towards a partnership aimed at funding pediatric cancer research. the initiative is called the great, the great chase for victory over cancer. it's a joint effort between ovechkin, the capitals hockey fights cancer and the v foundation for cancer research, a push that ovechkin says makes breaking the record so much sweeter. >> i want people to remember me as a very nice person. i tried to do my best and like i said, i was very lucky to be able to do not by myself with the all the players who i played with and the whole organization. >> well, ovechkin's donations will be matched by monumental sports and entertainment, and fans can also support the donations and honor as he
