this is the 10:00 news. >> dozens of arrests tonight on the streets of oakland as protesters react to the sentencing of johannes mehserle. >> good evening. >> two years in prison, that's the decision. a judge today sentenced former bart police officer, johannes mehserle to a 2-year prison term for the racially charged

shooting of oscar grant. when night fell, a crowd numbering between 300 and 500 took to the streets to protest the decision. a two-year term is at the low end of the sentencing scale and the protesters told us it's not nearly enough. in cortaid the judge threw out a gun enhancement that could have added ten years to the sentence. instead, the 28 year old mehserle should spend two years behind bars. the former bart officer has already served 10 movants in jail and he'll likely spend another 6 or 7 months behind bars before released on potential. >> we want to bring you a live picture, this shows us where police corralled the protestors. we've been monitoring the massive police presence here. officers tell us they detained more than 100 people. they have been processing the

detainees before taking them to the county jail in downtown oakland. we have a team of reporters covering the protests, ruling, and the reaction. rita williams is at the courthouse in los angeles, but we begin with ktvu's mike meback on the streets of oakland. >> reporter: the situation has calmed down a bit. there is a heavy police presence down here all across the bay area including the hayward police department. we are at 6 and foothill on what is a massive perimeter, within this perimeter about 3 blocks away, that is where some of the protesters continue to be arrested and processed. 14th and broadway downtown oakland, protesters blocked traffic and then it was time to go. hundreds of people angry with johannes mehserle's two year sentence march south towards

lake merit. along the way they jumped on park cars and chanted through streets, our streets. >> peaceful march to protest the outrage. this killing happens every day in the black and latino neighborhood. >> reporter: the crowd headed on to 10th street. it's here where police made the first appearance blocking in the protesters. the majority in the crowd slipped through a fence, making their way along 14th street, smashing bus windows on their way. >> once they broke off from 10 9-street we have tried to get field forces in front of the crowd to stop them. this is where we're able to do it. >> reporter: this is 5 9-avenue and 17th street. protesters once again blocked in. this time by hundreds of police officers. >> if they come after me, man,

i'm out here for the struggle, the people, i'm out here for oscar grant, for everybody in oakland. if they come after me, they'll have to come out for everybody else. >> we have a right to be here. >> the system is broken. we're not going to stand for it. >> they announced if the crowd did not leave, they'd be arrested. when they did, they were taken down, arrested, and placed inside jury. >> more time for shooting himself in the foot than a policeman gets for shooting someone in the back. >> reporter: last check police say about 100 people arrested, the majority of them continue to be processed in the city streets. those in custody will be taken to north county jail. reporting live, "ktvu channel 2 news." anthony vatts declared the protest an unlawful assembly. the chief said a protester

grabbed the gun and holster and pointed it at the police officer, other police officers promptly arrested the protester and no one was hurt. a police officer was injured when hit by a police squad car. oakland police chief described the crash as an accident. our crews were on the scene. as you can see, fellow officers quickly surrounded the injured officer. the officer suffered a leg injury and was taken to the hospital. emotions ran high in the los angeles courtroom where mehserle learned his fate. the trial was moved to l.a. because of tensions here. it was a judge there who handed down the two-year prison turn. ktvu's rita williams was in court today, she joins us live from los angeles with the details, rita? >> reporter: julie, in sentencing the former bart police officer, the judge said people see what they want to see, hear what they want to hear about this case. he said there are no winners,

only losers. former former bart police officer johannes mehserle came into court looking like this, hands shackled at his waist, this time in front wearing the orange jump suit. he stared straight ahead, not looking at the five relatives of the man he shot and killed last year as they told the judge the impact the killing has had on them. sofina, the mother of grant's now 6 year old daughter "mehserle can still see his child beyond bars, we have to go to the grave site. i live with a part of my heart dead." grant's mother "how can you explain this to the people of color who face police brutality?" then mehserle stood with his attorney and read a statement he held in his cuffed hands. "it's tough for me to admit failure, that's exactly what

happened. i wish i could bring mr. grant back. i hope someday they'll be able to forgive me" then he repeated part of what he told me in jail last week. >> i didn't want this at all. i know they didn't want this. i'll forever be sorry for what happened. >> reporter: the judge threw out the jury's verdict of a gun enhancement that could have added ten years to mehserle's sentence saying there was not enough evidence to show mehserle intended to use a gun and not his taser. he sentenced mehserle for two years in state prison for voluntary manslaughter, it could have been four. with credit for 292 days already served in jail, johannes mehserle could be released in 6 or 7 months. reporting live in los angeles, rita williams, "ktvu channel 2 news." we've also learned tonight that right now mehserle remains in the los angeles county jail. he's expected to remain there

for at least two weeks but could serve out his time in jail not in state prison. mehserle has accepted the judge's decision. >> he told me that he felt closer to maybe getting out and seeing his son and taking his son somewhere and that gave him great hope. >> alameda county district attorney nancy o'malley says she supported the jury's findings that johannes mehserle intentionally used his gun. the statement goes on to read "since he was found guilty of voluntary manslaughter, the people urged the defendant be sentenced accordingly. the ruling is appealable and she and her staff will evaluate all legal options." >> a wave of emotionings unfolded during the sentencing and immediately following.

some people left the courtroom in tears while members of oscar grant's family and friends were irate. claudine juan has that part of the story. >> reporter: protester gathered outside. today was a day when people seemed unable to contain their emotions. this man was kicked out of court from an out burst. a scuffle deputies ended up breaking up. tensions were so high. >> my son was abused. he walked off the courtroom. sad that a 22 and 23 year old young man has to be let down by a system supposed to protect him and at 22 or 23, he has no faith in that system. >> slap in a face. >> reporter: the sentence

itself brought no relief for the family of oscar grant. they say the system failed to deliver justice. grant's uncle also said mehserle's repeated apologies today meant nothing because mehserle never faced the family. >> it would have been easily said to the family of oscar grant, to the mother of oscar grant, to the daughter of oscar grant. fiance of oscar grant. i am, mehserle, truly sorry for what i've done. >> at the end of the day, no one wants to have a view that the system does not work, that it's not fair. when it's thrown in your face, you can only help to see the contradictions. they promised to keep fighting. they want to plead their case. that will have to be a battle

for another day. in los angeles, "ktvu channel 2 news." oakland mayor's monitored the jobbed. he held several briefings. the final briefing was at 9:30 tonight when the mayor thanked the vast majority who listened to his appeal for non-violence. >> clearly for the most part in the city slightly north of 400,000 people that was honored. >> at the bart station in oakland where mehserle shot and killed oscar grant, riders had strong reactions, many told them they were surprised the prison term is just two years given that a young man lost his life. >> shot and killed a person. accident or not, if i shot somebody by accident, they'd give me more time. >> i think he should have gotten more time. it is what it is. in my opinion, it's my thoughts he should have got more. i feel for the family, i do. >> to be executed like that is

a leader emerged late today in the oakland mayor's race. it's something for a surprise. not don, instead, a rank choice voting puts gene quan in the lead with 2,000 votes. while there are more votes to count, her lead maybe unsurmountable. amber lee joins us with this story. >> reporter: we spoke with her

before she left for tonight's protest. she's excited and optimistic the final count will be in her favor. this evening campaign workers popped open champagne, basking in the glow of optimism. quan's husband led supporters to chant a campaign slogan. the candidate expressed cautious optimism after learning the city's first use of choice voting put her in the lead this afternoon. >> it's not over. still 10,000 votes, but it looks like a trend that will be hard to change. >> it takes longer for election workers to count ballots when there is rank choice voting. only after the second choice votes were added in did she manage to take the lead. >> tonight's victory is a victory for about 1,000 people who hosted me at hundreds of house parties and walked blocks for me.

yesterday the lead was 9,000, today it grew to 12,000. in the 11th congressional district the race is also extremely close. jerry exfebruaried his lead over harmer to more than 400 votes. yesterday the vote separation was 134. >> firefighters control a two alarm fire this afternoon at a small church in hayward just east of interstate 880. the fire started in the 7th day hispanic church of hayward after 4:15 this afternoon. no one was inside at the time. it appears a propane tank inside the church's annex exploded, sparking the fire. freemont police are looking for a hit and run driver that left an elderly man with life threatening injuries today. it happened at 6:20 this morning. freemont police provided us

this photo, they are looking for a driver of a 1995 toyota avalon the 83 year old was taken to the hospital in critical condition. we want to keep you updated on the situation in downtown oakland. a lot of concern about the area of 14th and broadway near city hall where tonight's protest began. paul chambers is live tonight and says it's a much-different scene compared to last summer. paul? >> reporter: very true, right now a few hours ago there were tons of police officers, now as you can see, there's only one protestor standing here right now, he's the last one here, earlier tonight there were hundreds of people at oakland city hall preparing for a peaceful protest. look at video here, this was the scene, roughly 200 officers and sheriff deputies from all over the bay area. as the protesters left the

area, law enforcement officials were standing side by side to maintain the peace. at one time, two armored police vehicles were brought in, it appears they were not needed in this area, there were no issues. the officers stood guard for several hours until they left the area just before 9 tonight. i also know there is a sold-out concert at the fox theater. there were extra security detail in that area, the security will stay by until the concert is over to make way to help people make their way to public transportation and safely get out of the area. there will be additional officers around, come back live once again, officers on every corner as you can see, none at this time, occasionally every once in awhile you'll see a police officer drive up and down the street, but right now, all fine, pretty safe, no problems happening out here. very peaceful protest without any major issues. live in downtown oakland, "ktvu channel 2 news."

all right, thank you, paul. from 14th and broadway, down broadway a little bit to very close to police headquarters, this is the detention facility. what you can see there are sheriff's vans inside those vans we believe are some of the protestors who were arrested this evening and about 100 people police say were arrested during the protest. they are being taken to this facility where they will be processed following their arrests earlier this evening. we have rain in the forecast. weekend is here, more clouds tomorrow, but dry. rain comes in on sunday. i'm going to get to the sunday in a minute. start with tonight, lows in the 40s, clouds out there. no rain in the forecast until saturday. this is a system i'm tracking out here. these are high clouds overhead. this is the system going to bring rain, perhaps as much as an inch and a half, so

gas leak to get inside her apartment last friday. the body of the 46 year old writer and publicist was found later that night. >> the investigation led, then we were able to put the pieces together and realize this is the person of interest we were looking for. >> police say they are investigating the motive behind the attack and holland was on parole for a prior conviction of attempted homicide. a poling inspector pleaded not guilty to stealing thousands of ballots on election day. the 53 year old was arraigned on charges. the ballots were found late tuesday floating in a pond. the motive is still not clear. nicolas is due back in court on november 19. house speaker nancy pelosi made an announcement through twitter. she said she was driven by the

urgency of creating jobs. the democrats lost control of the house of representatives in tuesday's election. pelosi's announcement comes after calls for her to step aside. the battle over the military's "don't ask, don't tell" policy has made its way to the u.s. supreme court, they called the law appeal the decision by the 9th circuit court of appeals. earlier this week the appeals court overturned a lower courts ruling requiring the military to allow openly-gay people to enlist and serve in the armed forces. justice anthony kennedy handles motions from the 9th circuit. an al qaeda faction based in yemen claimed responsibility for the airline bomb plot and the crash of the ups cargo plane two months ago. last week two bombs were intercepted on planes in dubai

and britain. the al qaeda groups said it will keep targeting civilian and cargo planes. investigators discounted the claim saying a fire on board was to blame. an upbeat employment report failed to spark a rally, gained only 9 points, nasdaq picked up 1, both raised 3% this week. investors shrugged off employment figures released today. the labor department says 151,000 new jobs were added in october, that's the highest number since april. analysts predicted only 60,000 new jobs would be created. the nation's unemployment rate held steady at 9.6%. the rate has remained unchanged since may. the number of people who signed contracts to buy homes fell in september, the dip follows two months of gains. its index of sales agreements

sentence of johannes mehserle. right now a couple of dozen people remain. a short time ago police updated the numbers telling us between 100 and 150 people have been detained. at this hour oakland police appear to have the crowds under control, that was not the case for an hour or so earlier tonight. ken witnessed it unfold starting about 6:30 this evening. he joins us now with a live report. ken? >> reporter: right now we are a few blocks away from where the march ended. it all started with a rally at frank plaza when people were leaving the rally. as they were leaving it seemed that a peaceful end was at hand, suddenly violence broke out. we were there, this is what we saw from the beginning. this was the first act of vandalism. several men started jumping up and down on a car with what appeared to be a family in a

car. they stopped at the light of 16th and broadway. just as the crowd was leaving what was a peaceful rally. police in riot gear were observing but not intervening. the crowd turned its attention to a taxicab, then a tow truck. the crowd blocked an intersection, taunting police officers nearby. then the mass of people started heading south on 16th towards lake merit. several men continued to damage cars along the way. here you can see the owner of one of the cars running and screaming for them to stop. very few in the crowd engaged in those acts of vandalism as they marched past each intersection police could be seen observing and redirecting traffic for at least a dozen blocks there was no traffic on the roads. the only cars damaged were

parked. we were with the crowd through much of their march through downtown. we did not witness any businesses being damaged, several car windows were broken. it appears most of the damage were done by the same small group of men. in oakland, ken pritchard, "ktvu channel 2 news." >> many has been made of the case, how did the judge arrive at 2 years? ktvu has been talking to legal experts. live with that part of the story, debra? >> reporter: attorneys might say the biggest surprise isn't the length, but how the judge admits mistakes and says jury instructions should have been more clear. >> it took a lot of guts for the judge to do it to say it didn't go down right. >> this former prosecutor and this law professor never thought the gun enhancement

with the verdict made sense. >> if a cop uses a gun to go in and get the liquor store he'll get the 10-year enhancement. >> that was intentional, this was involuntary. the maximum for voluntary manslaughter is 4 years. >> he felt he deserved jail time, i don't think it's worth the max, but i'm not giving him probation. he split the baby. >> it's still a harsh punishment, doesn't stack up in some people's minds though. >> michael vic received four years for brutality to dogs. >> sentences vary state to state, california is among the lightest on voluntary manslaughter, but a sense of inequity also stems from the makeup of the mehserle jury itself, no african americans. >> people will say wow, one more example cops get a different standard. if there had been african americans in the mix and joined

in the verdict, people would have said okay, i see it. i think that's a huge, huge terrible cost in this trial. >> here's a cop going to state prison, which was a tough place. they don't like cops. >> observers note mehserle will need to be isolated and protected wherever he does time. >> they may have to send him out of state. this record will follow him around. they'll know who this is. he's going to have -- it's a dangerous situation for him, very dangerous situation. >> even out of prison the notoriety will follow johannes mehserle forever. in that respect, a life sentence. a mehserle case tab right on the front page. later in this newscast we'll gauge reaction in mehserle's hometown, what his friends and supporters say, a live report from napa. authorities are investigating the death of a man struck by an amtrak train. it happened just after 6 this morning. official say the 20 year old was trespassing, amtrak says the train was carrying 52 passengers heading to san jose. the train tracks in both directions were closed for about 3 hours and service returned to normal by mid-day. no one else was hurt. the highway patrol identified the bicyclist killed yesterday. she was hit at about 3:40 in the afternoon by a semi truck. the chp says the truck driver stopped right away and didn't appear to be impaired. witnesses are asked to call the

[ ring [ tires screech while drunk driving rates have dropped greatly, negligent driving and speeding fatalities have skyrocketed. someone dies every 13 minutes from negligent driving, so keep your hands on the wheel, your eyes on the road, and your phone put away. prosecutors filed felony charges against the woman accused of abandoning her young son on wednesday. 40 year old sandra samuel is accused of felony child endangerment and abandonment. she was arrested yesterday after calling police herself. prosecutors say samuel abandoned her 18 month old son dominic. she said the reason was because she didn't think she could take care of him.

alameda police say one suspect has been arrested from stealing 5 little dog from an elderly woman. the yorkie is still missing. he said he told them he had sold the dog. a reward is being offered. the coroner's office said it may take awhile to identify the remains of a man found in a remote area yesterday. they were searching for a missing person when they found the man's remains. authorities say there were no signs of foul play and some drugs were found nearby. the same area between uc santa cruise and highway 9 was searched in august for a missing man from mountain view. hurricane tomas caused flooding in some of the camps where earthquake victims have been living, the storm mostly
