wishes he had never bought the gun that killed her son. she thought it was locked away from her children. deborah is live now at the family home in antioch with a story you will see only on 2. deborah. >> reporter: well, julie take a look. this is where people have been leaving cards and candles and balloons to remember the child. while miles away in richmond, his mother is grieving. >> everybody knows, you know i am a good. >> reporter: she never stopped crying talking about what happened. she rushed home from her job with the city of pittsburg yesterday to fine her hub in custody and their two-year-old already gone to the hospital where he would later die. >> everyone tells me don't blame myself, but it is hard not to. >> reporter: she says she bought the gun legally more than a year ago because her neighbor is rough. and she was worried about assa and breaks in. >> i have to look out for me

and my family. >> she says the gun was always in a safe high in her closet so she was stunned to hear her two sons had found it loaded in a night stan drawer. at fir the older boy, scare told police he shot himself. >> he asked him again and my four-year-old says that he shot my two-year-old. >> the boy's father, eddie karr has a criminal record and is banned from guns. but admits retrieving the weapon, loading it and leaving it handy yesterday. why? his wife says she has no idea. >> it had to be a reason, he didn't just go get it for nothing. it has to be a reason. >> still she blames herself the most for bringing the gun into the home. >> if i didn't purchase it at least it wouldn't have been there and it wouldn't have happened. they could lock me up for years, i don't care. i am just worried about my kids. >> she says her four and ten- year-old sons have been placed

in foster care now, and she wants them reunite with family. more immediately, she and her husband make the first court appearances on monday on felony charges of child endangerment with death and reckless storage of a firearm. reporting live in antioch, deborah, ktvu channel 2 news. she also told us that the only time that gun has been fired was just once at a firing range. union city police late today released surveillance footage taken moments after an alleged sexual assault on ad to letter inside a store. these were taken wednesday in the dollar store from a camera installed in the front of the store. the man there passed the camera is identified as eugene ramos who attack a two-year-old girl separated from her aunt and brand mother for less than a minute. >> he is already a registered sex o fenimoreer convicted back

in 2005 of sexually assaulting a 7-year-old girl in hey war. he is now facing charges including mid committing a forcible lewd act on a child and attempt thed intercourse with a child under ten. the county da says they're confident he will be convicted. >> he's obviously a danger to society, he grabbed a little girl and tore her diaper off and try to rape her. >> the girl underwent a medical exam and is recovering but that's all they're saying. he faces up to 21 years in prison if convicted. he did not enter a plea. >> for the san francisco police department's crime lab. documents show that in 2008, a dna sample was accidentally mixed up with another sample which sparked at least two investigations. in july, 2009, a whistle blower said that dna sample used as evidence in the trial had been switched to cover up a mistake. but a spokesman for the police department says an investigation found that there was no cover up calling it a

witness it, and allow the community to hear our pain. >> judge perry said today he would not get bail because he said even if if errors were made in trial as claimed by the defense, it is unlikely any were serious enough to get his conviction overturned. and that is a requirement for bail. >> the order to allow bail penning appeal there has to be something really substantial to demonstrate that there's a real likely hood that his appeal would succeed. and the judge didn't see anything like that. >> his attorneys says because of safety concerns he wants him to serve the rest of his sentence of six months but the grant family wants him in state prison. >> he needs to go to prison. we knee to be clear about that. the city or la county for r the next six months is not being held accountable for the crime he committed. >> reporter: where ever he serves, his lawyer says it is unlikely that he will be free before the first brief in the

tonight family and friends are mourning a piedmont native kill in afghanistan. he was killed on thursday during combat operations ac coring to his family. the pentagon has not released details. he attended piedmont high school before moverring to fresno and graduated from buchanan high school which had eight former students killed in either iraq or afghanistan. he is survived by his wife and two-year-old son. >> a few showers around the bay area tonight, and bill martin is tracking more wet weather this week en. tomorr ten minutes. >> here in napa tonight, friends and family remember a man shot and killed by police. his relatives want answers. a surprise in

highway patrol officers arrested a suspected -- about 5:30 tonight and ended on intertait 880, two southbound lanes were shut down for about half an hour during the arrest and it caused quite a back up. there were no reports of any injuries. if in napa, they think authorities overreacted and tonight they're calling for an independent investigation. this is the first time we have hear from family members since the man was killed outside of

his home last weekend. we will go live this to napa. >> reporter: friends set up this memorial on meek avenue to remember a man they describe as a loving husband and father. tonight family members spoke out publicly about the fatal police shooting of richard. >> my dad was a very good person, he was a very good man and a lot of people knew him and cared about him. >> reporter: in san francisco tonight, 26-year-old gabrielle -- toll media that they have many unanswered questions about her father's death. family members say he worked as a registered nurse caring for aids patients as well as in the emergency room and intensive care. on sunday, napa police shot and killed the 60-year-old. >> it is sort of a dishonorable way to go. and he was dedicated to helping people that were sick and in the end, when he needed help,
