hundreds of people pack a school board meeting to learn if schools in their community will stay open or be closed. good evening everyone i'm frank somerville. >> and i'm julie haener. tonight is the night the council is expected to decide which schools it will close to bridge a budget gap.

healther holmes joins us now from the meeting in concord. >> reporter: this meeting was moved to this high school gym, as you can see some people have left but at the height of this meeting more than 450 people were gathered here. now right now they are mauling over the four different options. just minutes ago we learned that option number three has been removed. right now they're discussing closing homebrook elementary and homebrook middle school. most folks know schools will be closed here, the question which ones. there's several different options but no one likes any of them. from rallies to bake sales to t- shirt campaigns it has been a long night to keep schools over in the mount diablo school district, and tonight the final push. >> we understand your position, needing to con consolidate

that secoi elementary school, middle school and homebrook are safe. that is the latest. we will be here monitoring the situation. when there is a final decision we will bring it to you. more details now in addition to closing campuses the mount diablo school district is trying to negotiate $9 million savings throw employee furloughs and benefit cuttings. with more than 36,000 students, the district is one of the largest in california. it has a budget of almost $300 million this year. at this hour police in oakland are searching for four men in connection with a homicide. the shooting took place about 7:35 tonight. a man in his 30s was shot and killed outside of a grocery store. we have learned the four suspects were wearing dark hoodies. investigators remain at the

scene and at this point, police are investigating what happened. ktvu's amber lee is live on jackson street where an attack happened. >> reporter: frank, police tell us the suspect followed the woman as she entered this building and attacked her before she could get inside her apartment. tonight we saw police officer enter the building where a chinese woman in her 50s was sexually assaulted and beaten around this time last night. officers say the attack was brutal and the victim was sent to the hospital with nonlife threatening injuries. the victim's neighbors described to me what they heard from their apartments. mrs. yao and her husband said they heard two chilling screams

coming from the floor above hill. mr.yable yao ao says the scream scared him. the traumatized victim was only to provide a vague description of her attacker. they hope to interview her again to put together a sketch. this attack does not appear to be linked with crimes in lake merit. >> i think it's very important that people support her in any way they could. >> reporter: sarah young is with health services. she says victims usually take longer to heal because of cultural issues. >> a lot of sigma around any kind of sexual activities in the asian culture. and it's even worse because it was an assault. >> reporter: reporting live in

oakland china town, amber lee, ktvu news. an arbitrator has ordered -- rejected the woman's alleges of being raped by gresett. gresset gets his job back but is still facing rape charges. the widow of a contra costa firefighters is set to receive $15 million. scott desmond was one of four people killed in 2007 during a house fire in san pablo.

desmond widow sued a company because they called police and failed to include that there was a fire. detectives say jul iani's grandmother tried to block rodriguez from forcing his way through a garage into the family's home. rodriguez pushed her down, held her down with his knee and grabbed juliani while he yelled, no daddy, no daddy. rodriguez helped raise juliani since he was a child. ktvu cameras went inside the new death chamber last

hercules tonight where tonight's council meeting wrapped up about an hour ago. >> reporter: this would call the first recall in the city of hercules. residents turned over 6,000 signatures demanding two city leaders leave office. >> the citizens of hercules understand the problems that are occurring in our city and have overwhelmingly signed these petitions. tonight i'm the executive kpháe committee and all the volunteers that worked the last few days want to thank the city. >> reporter: the former major stepped down a few weeks ago but council members don keene and diane ward are fighting the recall. >> i would very much love to keep my seat till my term is

up. so it's you know, i should have until the end of 2012. >> i feel that they have made any false accusations and misrepresented my record. >> reporter: the recall leaders say they are being misrepresented and threaten to sue the councilman unless he retracts and apologized about what he said about retracts. >> have you had no sense of decency. at long last, have you no sense of decency. >> reporter: the city council didn't respond. once the petition signatures are verified, hercules voters can decide the fate of their council members in their june election. new numbers show jean quan became oakland's mayor despite spending less money during the final two weeks of the

campaign. don pereata spent twice as much as quan. p era ta spent over $970,000. >> the obama administration is trying to set up a new dial type of project that includes california. it's a high speed rail enterprise designed to create jobs and make the country more globally competitive. >> we cannot compromise in education, invasion or infrastructure. the rest of the world is not compromising on education, infrastructure or invasion. >> if congress approves the plan the first $8 billion would go to developing or improving trains that travel up to 250- miles-an-hour and to connecting existing rail lines to this project. during the state of the union

address, the president said he wants to give 200,000 people access to high speed trains this year. the newspaper report says scalen is the highest paid transit boss in california with a salary of more than $400,000. but the transit district says scalon's basal base salary is a little more than 240,000. nurses at stanford hospital and lucilee hospital is calling it a declaration of war. the hospital has announced they will implement a contract that the nurses rejected almost a year ago. negotiations and the effort of a federal mediator failed to reach an agreement. the nurse say they are upset about a plan including

demotions in some cases. there are was an outpouring today for an elementary school principal that was shot last week. young students with their parents as well as former students all showed up to remember lacarr. they said that sam lacarr was more than just their principal, they said he was like a member of their family. pretty windy today, no wind advisories but on the bridges, the wind was blowing. this is the east side of the richmond san rafael bridge. winds are down to 11-miles-an- hour. the winds have died down this evening, that means it's going to get cold. as the wind dies down overnight lows tonight can easily get to near freezing in the north bay and east bay valley. a cool start to your weekend. this is out past the weekend just at the tail end of the weekend. looks like we can get to a very wet weather period. we start off tomorrow morning with some very cold overnight

the man and woman met earlier that day. a government investigation of run away toyotas has concluded and the bottom line, it found in evidence of software or electronic flaws. lloyd lacuesta tells us what did cause those vehicles to accelerate. >> reporter: this time last year toyota was very busy, not in the factory. a worldwide recall resulted over claims of sticky gas pedals. today the government released the findings of a 10 month

report the majority of the problems were human error. toyota has since installed a break system. lloyd lacuesta. toyota welcomed the government's findings saying quote we will continue to cooperate fully with the nhtsa and respect it outside experts in order to help ensure to make sure that our customers have the confident in the safety and reliability of our vehicles. gonan led the protesters in a chant. egypt above all. he was released yesterday after spending 12 days in custody.

an update now on tonight's top story. the mount diablo school district has made it's decision voting to close two schools -- its decision voting to close two schools. >> reporter: people have been on the edge of their seats waiting to find out the school's fate. just minutes ago the school board hear made it's decision. the two schools that will be closing are holbrook elementary school and glenbrook middle school. it's all in an effort to save $1.5 million. joining me now is one of those ho lbrook teachers, i know this

the original 700 feet that was first estimated. luna was struck early sunday morning on fontane road in san jose. her family has raised $5,000 for information that leads to a conviction of that hit d run drcrhed hip, and broken pelvis. but her brother says she did have a breakthrough moment. >> she tried to mumble with her lips, you know i love you. which is, it breaks my heart to see her like that. but you know i can tell that she's fighting. >> at this point police are looking for a silver or gray mini van. possibly a mini van. it is not a pleasant site. all kind of animals killed on california's highways. but now there is an effort to make things safer. in tonight's special report, health and science editor john fowler tells us some enthusiastic volunteers are at the heart of this effort.

>> reporter: sometimes drivers can't tell for sure. >> they feel like speed bumps. >> other times they can. >> quite an impact on the whole family and the vehicle. >> reporter: road kill is the leading cause of death for many common animals. in the bay area alone, an estimated thousands every day. experts say it's push some animals toward extinction. >> every quarter mile, half mile you see a dead animal. we can tell that it's a big deal. from a -- scientific point of view we need to measure that. >> reporter: and measuring it, , this man. he and his daughter sarah are the most productive volunteers.

we went along. as he dodged trucks for science. on busy highway 102 in yellow county. >> this is an animal we see quite often. >> there's been some close calls. i am worried if he's going to make it home. so that's when i decided to go with him. >> it can be done safely. but i think the information is so important. nobody has done this. >> reporter: they make an 80- mile loop through rural farmland about twice a month and log up to 150 new road kills each trip. >> i've always seen a lot of roberts and squirrels. the other thing that amazes me is the number of birds. looks like the bird, they suffer, the pain before they die, it's sad. >> that's a mud hen. >> let's put our heads together and figure out what we can do.

>> reporter: caltrans tells us it needs this information. >> how they're affected by the road and what can make it safer. >> reporter: on every single road, loggers find road kill, lots of it. he pointed to the 13, it runs through parks and wildlife. >> if they don't cross the road then those populations are separated and then the species will die. >> reporter: we examined a caltrans handbook with designs of roadway underpasseses and barrier breaks that can allow wildlife. >> if we followed arizona's guidelines, we would have one every quarter mile. >> reporter: that adds about 10% to highway construction costs. protecting birds may be as simple as clearing crash that

port of oakland. the port has regained some of it lost shopping business. last year the port increased 14% from 2009. the first increase in four years. 2010 turned out to be one of san francisco's busiest airports. more than 39 million travelers used the airport. that's an increase of more than 5% from the previous year. the airport says it benefited from an increase in flights to asian and the middle east. levy strauss is getting another chance to send abercrombie and fitch for their back design. that original case was decided

in texas a liquid pipeline exploded at a petroleum plant. one workers remains unaccounted for tonight but may have been away from the site.

workers reported there were problems before the explosion and the plant began shut down procedures. supervisors this evening ruled in favor of a quarry and against residents who are fighting its expansion. the quarry will be allowed to go on with their expansion. santa clara residents argued that the quarry should have to get a permit for the expansion. police said he recented the competition, wu's family defender says wu is being held in a segregated unit because authorities fear he may be a

around. 63 in morgan hill, 63 in san jose. you probably mentioned the visibility, i was up on the east bay hill system. you can literally see the sierra nevada range from grizzly speak. peak. a five day forecast that's going to bring rain. if this transpires we're going to be doing a lot of news of how much it would range if the long range models are correct. but they are converging on five or six days. bay area transportation officials are taking steps to combat soaring fraud. we've been telling you about this fraud since last year. some passengers are using a $2 card to take trips that cost more without adding more money.
