. complete bay area news coverage starts right now. this is ktvu, channel 2 news at 10:00. >> breaks news from san francisco. for the second night in a row a fire has chased residents from their homes. good evening, everyone. i'm frank somerville. >> i'm gasia mikaelian. in tonight for julie haener. an intense firefight is underway in san francisco's mission district at this hour as crews work to get the upper hand on a stubborn three alarm blaze in a mixed use buildings.

ktvu's janet katsuyama is there where a fire was reported tonight and so far it is not yet contained. >> reporter: that's right, let me show you these fire trucks are here with their ladders up to the tops of those buildings. the fire started at 3212 at a mission dental care. the chief spoke to me just a smart -- short while ago and told me that the fire is actually raging towards the back of the building where it started. they are trying to attack it but it has been very difficult with some strong winds. with the photographer allen can pan over you can see where all of the firefighters are there at the command center. that's where the chief is. over on the sidewalk you can see all of the people who have been standing out here in the cold for hours. they were evacuated from the building just second after this fire broke out. take a look at this video that we have. it is home video shot by sal who was here close to the scene. you can see how bad these flames were. obviously, a difficult situation in san francisco with these houses spaced so closely together. they say that the fire actually

has affected three of these victorian-style buildings here on mission street. we talked with one woman, the owner of the lotus garden restaurant who was in one of those buildings. here is what she told us seconds before they had to actually evacuate and leave the building. >> i was cooking noodle soup for delivery and i saw in the back a lot of fire. we don't know what was happening. oh, my god, what is happening? we run and the front of the dining-room we saw a lot of fire. i mean, we saw a lot of fire trucks around. so i wrapped all of my child, my kids to get out of there. >> reporter: what did you think when you started seeing that? >> oh, so scared and nervous. but we had to be calm and take all of my kids out of there. but i don't know what is happening, how we are going to do business. >> reporter: now, we understand that there was another restaurant there where they had to evacuate all of their patrons tonight. we also understand that there was one firefighter who was injured. he was taken to san francisco

general hospital tonight. the police or fire chief, rather, tells me that he was inside on a ladder when he fell about four or five feet. so he has been taken there. it looks like he will recover, which is good news tonight. but they expect to have mission street blocked off while they tried to get this situation under control. so just a word of warning try to avoid this area because it's a very intense situation. they don't want people getting too close. reporting live from the mission street in san francisco, janna katsuyama, ktvu, channel 2 news. following up on another fire in san francisco, this one we bright you last night involving a residential hotel at jones and ed in the tenderloin. the fire department tells us this blaze started somewhere in a basement trash area. the fire shot up through the trash chute and spread smoke throughout the 105 room san franciscoan towers building. the red cross is helping the 113 residents find a place to stay. 5 people were injured. police are investigating the death of a homeless man.

the man's body was found in a tire shed behind a pet boy's store on contra costa boulevard. police say other homeless people notified them about the body about 5:30 this evening. the police said it appeared that the man had been dead for sometime and it is likely he died of natural causes. back now to san francisco where a muni bus operator was caught driving while texting with a bus full of passengers. and we obtained cell phone video of the incident. new at 10, ktvu's heather holmes talk to the passenger who confronted the driver and was then kicked off the bus. >> reporter: take a close look at this distracted driver behind the wheel of a 24 muni bus. >> the bus is moving and she is texting while driving. >> reporter: passenger sean higgins recorded the one-minute clip back in february. watch and listen. as the driver sends and receives texts along her route. >> all of our lives are in her hands. so at any time we could wreck and all die. >> reporter: higgins confronted

the driver and that's when he said she got irate turning her cell phone camera on them. >> took out her iphone and started recording us on the bus and said i am going to show you. i am going to show you. i will never pick you up again you (bleep). >> that's absolutely un called for. >> they are looking into the operator's alleged threats. as for the texting while driving? >> it shouldn't happen. it shouldn't happen. >> reporter: rose could only shake his head as we showed him the video. >> it is absolutely against our rules and regulations. and any time something like this happens we try to take immediate action. >> muni says the veteran nine year driver was suspended without pay for three days for violating both state law and muni policy. that's not good enough for higgins. >> i am tired of these things going on. and it is just like, oh, no big deal. i think the driver should be terminated. >> reporter: that driver is now back on the job. in san francisco, heather

holmes, ktvu, channel 2 news. san jose has reached a verdict in the college rape civil case and is scheduled to announce the decision tomorrow morning. the young woman says she was gang raped at an off-campus party and suing two former baseball players for $7.5 million in damages. seven others were originally sued. one never showed up for trial. he now faces a default judgment. the others either settled or were dropped from the case. >> a richmond woman is behind bars tonight after she allegedly led the police on a high-speed chase crashing into four cars, including a police car and sending five people to the hospital. police say the chase started at sycamore avenue and hercules and ended with the crash on san pablo and oakridge in pinole where police say the suspect's car hit the police car. they identified the driver as java taylor. police say during the chase taylor hit four other cars all with people inside. five people were taken to the hospital but police said none of the injuries appeared

critical. police were first called out police employees suspected taylor was shoplitting. >> navy officials say it could take weeks to determine what caused the deadly crash of a fighter jet in the central valley. the two died when their hornet jet crashed outside of fresno county. it went down just after noon in a field half a mile from the base. the navy says the two-man crew was on a routine training mission. the victims are a pilot and a weapons systems operator. the navy has not yet released their names. >> more fall-out from last friday's mid-air scare when a gaping hole opened in the fuselage of a southwest airlines 737. the today the head of the faa ordered a review of the agency's oversight program for aging aircraft. he wants to determine if the faa is asking the right questions and using the best data to ensure that older aircraft are safe to fly. oakland police say a 31- year-old man accused of murder is in jail tonight. douglas yin surrendered to

police in fresno county early yesterday morning. he is accused of fatally shooting zen this passed saturday and wounding another man. he shot the two men following an argument in his home on the 3100 block of harriet avenue. a fundraiser in the south bay that just wrapped up a couple of hours ago raised an astounding amount of money for bryan stow, the giants' fan critically injured in an attack outside dodgers stadium. as ktvu's robert handa reports, today's bbq and silent auction raised over $100,000. >> reporter: it was an all-day tailgate party for bryan stow at his workplace today. the american medical response facility in san jose. 300 pounds of chicken, 200 pounds of fry tip, not to mention sausages and hotdogs was grilled up for friends, supporters, as well as companies and public safety agencies, a scene stow's girlfriend said he was hold. >> i know him so well. his words are going to be i am a rock star.

and he is just going to basic in the glory. is is. new information tonight about a deadly house fire in richmond. firefighters race today this afternoon's two alarm fire, but unfortunately they were not in time to save the life of a young man. ktvu's deborah villalon is at the home on highland avenue at south 59th street where neighbors say it all happened very fast. >> reporter: arriving fire crews heard there might be someone stuck on that second floor, so they put ladders up. and you can see the windows are broken and scorched. but that search had a tragic ending. >> i thought that i was hearing some pounding on the floor. >> reporter: one of the first neighbors to run to the fire thought he saw movement in this upper floor window. the garage, he says, was raging. and he heard at least one explosion. >> i was impressed by the fire guys. i mean, the garage was essentially engulfed in flames and they just went in with the hoses, right into the flames.

>> we have confirmation that it was a young man, 24-year-old. >> reporter: the fire chief says the man's parents arrived and were told of his death. neighbors say this is a family home and that a younger sibling lived here, too. >> hearts go out to the family. it is very, very difficult when you find someone inside the home that didn't make it out. >> reporter: homicide detectives checked the scene but found no evidence of foul play. investigators have not said where the fire started, only that the victim was found on the ground floor. fire crews did find the family dog in the home and brought it out safely. friends and relatives came and comforted each other as they heard what happened. as the investigation stretched into the evening, they remained outside, too stunned to talk about the young life lost so suddenly. >> i felt bad because i looked at it and thought that maybe i could climb up there and try to do something. but it looked scary and there

was a lot of smoke and it was quite hot and i didn't. >> reporter: no identity released yet on the victim. his grandfather tells me he thinks the young man assay sleep with -- he was asleep when the young -- fire broke out. in the south bay where friends of the bay area marine killed in afghanistan honored him today with dance during a heartfelt memorial. break dancers performed at santa clara high in honor of lance corporal harry lou. he was an accomplished break dancer and a graduate of the school. he died sunday during combat operations. those who organized today's event say lou was like a member of their own family. >> he was like a parent. and then they taught us things that we will use later on which is dancing, tricking. >> and dedication. >> yes, and dedication. >> and students at the high school say he came back after he graduated to take part in

dance club activities and help others perfect their moves. a san mateo county jury today began deliberations in the sanity phase of convicted hillsdale high bomber alexander youshock who was convicted last week in the death of a former teacher and five other felonies for that attack in 2009. he had pleaded not guilty by reason of insanity. the defense attorney argued that he suffers from schizophrenia. >> two curve balls in the barry bonds trial. the defense rested its case without calling a single witness. rita williams has the latest developments and tells us what comes next. >> reporter: not only did barry bonds not testify in his perjury trial today, no one else did either. the defense rested after calling no witnesses. >> and the minute you start putting opinions witnesses on, you have accompanying risk. i think it would bring more attention to the fact that mr. bonds didn't testify. >> reporter: that wasn't the only surprise here today.

because of lack of evidence, the judge dismissed one of the five counts against bonds. count 4 charged that bonds lied when he said he didn't take balc's designer steroids the cream in the clear from his trainer greg anderson before 2003. bonds admitted taking them in 2003, but said he thought they were flaxseed oil and arthritis cream. still left, a count of obstruction and justice and three of lying, about not knowingly taking steroids or human growth hormone hgh or saying no one other than his doctors ever injected with anything. legal analysts say bonds' former personal shopper kathy hoskins was a credible witness about those last two counts. >> she says she actually saw mr. bonds being injected by anderson, which would suggest the hgh. >> reporter: both sides get their final chance to try to convince the jury here tomorrow with their closing argument. jurors could start deliberating by the end of the day.

in san francisco, rita williams, ktvu, channel 2 news. more details now in the bonds case. today the attorney for greg anderson filed a motion to free anderson from federal prison. anderson has been held in contempt of court since march 22nd when he refused to testify for the prosecution. the judge said she is inclined to grant the motion and free anderson, but held off after the prosecution argued anderson should be held until the jury finishes the deliberations and cited case law supporting their position. the headquarters of the burning man festival is moving into san francisco's mid-market neighborhood. the burning man festival is held in nevada's black rock desert. the arts foundation that runs it is now set to sign a lease at 6th and market. san francisco mayor ed lee applauds the decision saying it will help revitalize the area. twitter is also planning to move in nearby at 9th and market street. >> it happened after last night's newscast ended but we can now tell you the results of the richmond city council vote on a huge waterfront casino

project. palmo indians have proposed building a casino, hotels and homes at point malati but they decided to abandon the project at the end of a five-hour meeting. supporters argued that a casino would create jobs and revenue. san jose sysco led the stock market hire. dow jones picked up. nasdaq was up by 8. >> the price of gold hit a record high during trading today. analysts cited a weak dollar for pushing the price upward along with strong demand for gold in china and india. at the end of trading gold for june delivery stood at $1458 an ounce. silver, too, hit its highest mark settling at $39.40. >> they are hoping to get bankruptcy and buy blockbuster

video. they bid $3820. blockbuster filed bankruptcy after losing ground to netflix. they are donating $12,000 to museums. the california academy of sciences and explore tore yum in san francisco will receive grant money along with five other museum it is. google's chief technology advocate posted on his blog that museums help influence many google workers to become engineers. there is word tonight that barns and noble is taking over operations at the san jose state university bookstore. the two sides announced a ten year contract today. barns and noble already operate stores on five other csu campuses. the university says barns and noble will also help pay for a bookstore expansion when the student center is remodelled. . this is video just into our newsroom of a police operation along 880 in hayward. one of their officers saw what appeared to be a gunman on the winteron avenue overpass at 7:00. they established a perimeter and closed the off and on ramps. after more than an hour of searching police haven't found any gunman and re-opened those freeway ramps. residents of antioch are taking to the streets with their crime concerns. today as our own rob roth was

talking to people about the drastic measures they are taking to protect their families he learned first-hand just what they are trying to escape. (honking). >> reporter: these antioch residents are so scared and fed up with shootings they stood along sycamore trying to rally support for the commune t was here on sycamore monday that a gun battle left a 19-year-old man paralyzed while the bullets whizzed through the bedroom of a little boy. this father says he won't let his daughter outside. >> i hardly go outside my house. i mean, come on, what kind of life is that? >> it's a dangerous time now we are in a 911 situation. >> reporter: residents have started moving out of sycamore and others who hope to soon follow. >> you know, right here in any one of those bullets would have come through here, you know, not the place you want to raise kids. >> reporter: just as we were talking to residents on sycamore we heard gunshots so we got in our car and drove towards the sound.

and sure enough, it came from there, just a block and a half from where we had been. semi-automatic gunfire knocked out a car window and at least one bullet pierced the wall of this house. the police said there were no injuries. less than a half hour before this shooting we talked with the woman on the left who lives nearby. she, too, wants out. >> people are running around shooting. and not hitting their target. and there is kids playing. >> reporter: the antioch police department has lost about 25 percent of its officers. residents say it's up to them to stand up and at least those still willing to stay. in antioch, rob roth, ktvu, channel 2 news. now to japan where operators of the fukushima nuclear plant tried to prevent hydrogen explosions like the one that damaged the plant after the tsunami. japanese officials are

considering expanding the evacuation zone around the nuclear plant. the government acknowledged residents are extremely worried about long-term radiation exposure. the nuclear crisis has overshadowed jap an's humanitarian disaster n town after town along the northern coast the cleanup is progressing very slowly. some salvage what they can the rest is being thrown away. there is an estimated 80 million to 200 million tons of debris. that is more than all of japan's annual amount of household waste. >> they should have been smarter. >> scammed out of thousands of dollars. up next the ktvu exclusive. we're talking with victims now warning others not to make the same mistake. and a new development to tell you about

. an update now to breaking news we are following in san francisco's mission district. firefighters there have now contained the stubborn three alarm fire. ktvu's janna katsuyama is live at the scene at 29th and mission with an update. >> reporter: well, i just spoke with the fire chief. she tells me that it was around 10:15 they got this under control. now, if you take a look up here you can see some of these ladder trucks that they are starting to pull back. but at one time they had she told me up to 100 firefighters here at the scene. take a look at this video that we have you can see why. this is home video shot by sal who was here at the scene. it started in one building and quickly spread to two adjacent buildings. they had to get everybody out of those buildings. fortunately, though, they were able to do the evacuation here. here is what the fire chief had to say about that. >> the good news, first of all, is that we have no civilian

injuries. we had assisted some civilians out. we do have firefighter that is injured. he fell from an extension ladder approximately four to five feet. >> reporter: now, i did talk to the red cross. they said that they are collecting names of the people who were evacuated. you can see back here live there are a bump of people who are out on the street. there are up to 100 people who are out there. not sure right now exactly how many people there are who were in the apartment building up above where the fire started. but they are working quickly to try to get shelter because it is very cold out here. the wind is definitely a factor both in the fire and for the people who are getting out tonight. but the good thing is no one was injured. just that one firefighter who has been season into sf general for a checkup. janna katsuyama, ktvu, channel 2 news. a story you will see only

on 2. scam artists who are in some cases winding up with thousands of dollars. lloyd lacuesta has been investigating and the phone calls often start with a phone call saying hey, grandma. >> reporter: the police are telling me tonight that this wealthy peninsula town is under siege. scam artists armed with telephones are trying to get money from residents. and in some cases they have succeeded. last week 87-year-old frank sebastian got a call from someone he thought was his grandson. >> the guy said: hey, grandma. and i said oh, hello, andrew, how are you? >> reporter: sebastian says the caller said he was in san diego and had got into a fight and sent someone to the hospital. the alleged grandson said a lawyer would call him for money to pay the medical bill. sebastian went to a safe way and sent $3,000 via western union. and then he learned he had been taken. >> it is just i should have been smarter. >> reporter: elmo sanders got a grandpa call on monday.

>> what is the name of your oldest grandson? and at that point i said, well, i know the name of my oldest grandson but what's your name? and with that he just hung up. >> the police say they have had eight of these reported scam calls this week alone. in one case, a man sent $12,000. atherton is one of the wealthier communities in the country. the medium price of a home is $4 million. police sent out a phone alert. >> there has been an increasing number of reports of residents receiving fraudulent calls seeking wired funds. >> reporter: just today, police say an atherton resident who had been scammed of $200,000 two years ago flew to atlanta after receiving a call from someone saying he could help get his money back. when he got off the airplane. >> the family members were able to meet him there and intervene before any sort of transaction could take place. the police tell me tonight that these scam calls could be coming from across the street

or from another country. live in atherton, lloyd lacuesta, ktvu, channel 2 news. another story tonight of an air traffic controller accused of sleeping on the job. today the faa said it plans to fire a controller who took a nap while working the midnight shift at mcgee tyson airport in knoxville, tennessee. seven planes landed as while the controller was asleep. last month a supervisor at reagan airport in washington, d.c. said he unintentionally fell asleep while working the overnight shift. that controller is on administrative leave. >> here in californian audit of the state prison found that workers there received $272,000 in pay for hours they never worked. this just during a three-month period. the state inspector general says its auditors can't say if the practice is widespread throughout the state prison system because mule creek is the only prison requiring employees to clock in and out. we are told it's close but tonight there is still no deal to avoid a federal government

shutdown. that word straight from the white house just about two hours ago. president obama invited fellow republic and democratic leaders to meet with him there this evening to try to hammer out their differences. the president says he expects both sides to continue meeting and that an agreement should be reached before friday's midnight deadline. >> it would be inexcusable, given the relatively their/differences when it comes to numbers between the two parties that we can't get this done. the white house is warning that a shutdown of the federal government would delay the pay of u.s. troops. the irs would also stop processing paper tax returns. but it would still enforce the april deadline and accept payments. plus congress and the federal court system would be affected. >> a shutdown of the federal government would also be felt here in the bay area. for example, alcatraz would be closed as the the landmark is

run by the feds. ktvu talked to some of them and they weren't pleased. >> i think any national park shouldn't be shut down, personally. it's something that we as americans should have and be able to see. >> in oakland a few workers at the social security office held signs against the shutdown. they and 8,000 federal employees could be furloughed if there is no deal to renew the plan. >> an infant girl is in protective custody after being reported missing earlier today by her mother in oakland. our ktvu camera was there as the child's father handed the baby over to police in east oakland. the mother reported that the father had threatened to kill the child as well as himself. the parents had joint custody. police say a mediator will now be brought in to try to resolve their differences. a san francisco teenager now stands charged with attacking a jogger in crocker amazon park lost week. today the district attorney charged 18-year-old kneel with several crimes including aggravated kidnapping and

sexual assault with the intent to commit rape. the victim says the attack happened at 4:30 last friday afternoon. police said the woman was jogging near the park's basketball courts when she was grabbed and assaulted. well, they want to make sure it worked so they did their best to break it. which device at sfo was pushed to the limit today in hopes of keeping passengers safe? tell you about now. alameda county sheriff's deputies are on the scene of a fatal motorcycle accident in castro valley. according to the deputies, they spotted the motorcycleist driving wrecklessly and tried to pull him over just before 9:00. but they said the rider took off, turned down redwood road and then tran two spot lights. the motorcycleist was then hit by a coca cola truck and pronounced dead at the scene. they are testing security features at sfo's newly renovated terminal 2. the terminal opens next week and dozens of black and red pieces of luggage lined the terminal waiting for a high-tech inspection. they need to be able to find every weapon and explosive no matter how busy. >> tsa wants to sort of run an extra stress test on it, almost try to break the system to see if it's possible just to make sure that there aren't any hiccups on opening day. the 400 million terminal is scheduled to open next

children. their life appears idyllic, but looks can be deceiving. >> i was in the hospital for a week. and the doctors came back and said that i have cancer. >> reporter: 35-year-old off and on was diagnosed with inoperable lung cancer that is now in her bones. doctors have given her a year to live. >> we are just very blessed, you know. it has been a rollercoaster. >> reporter: her children are 1- year-old emma, 3-year-old ellen and 4-year-old ethan. they are old enough perhaps to understand that mommy is sick, but certainly not old enough to fully grasp this harsh reality. >> i truly love them. and i hope that at some point that when they are older that they can understand. >> reporter: so on this day we watched as off and on sat down with a santa barbara organization called life chronicles which will help her

express herself to her children in the future. >> this is a great way for me to say that mommy will always be there for them. and that i didn't just leave them or abandon them. >> reporter: kate carter from life chronicles who had had never before met off and on and her family started with the basics. she heard how off and on and rick met through a friend. she was introduced to their pride and joy. >> this is i am if a. >> reporter: and she learned that the illness came out of nowhere for the marathon runner. >> during the whole weekend i had enormous chest pains. couldn't breathe. couldn't really stands. couldn't really pick up my kids. >> reporter: when off and on is looking to the left side of the screen she is speaking with us. when she is looking 209 to the right she talking to the video for her children. >> i was diagnosed on february 14th with advanced stage lung cancer and was told that there was no cure. and that i don't know how much

time i have left. not surprisingly off and on sometimes had trouble. kate carter stepped in to offer words of encouragement. >> take a second. it's going to be fine. >> reporter: carter says she has done this for 700 mostly terminally ill people and their families over the passed 13 years. crying is a common occurrence for life chronicles. tissues are always at the ready, even for the volunteers who run the cameras. but they say it's extremely rewarding work. >> through these videos i learn something every single time, whether it's how to take care of a family, how to be a better woman, how to love better. >> reporter: perhaps off and on's children will pick up those kinds of lessons. but her message for them is imminently clear. >> i did everything that i could to fight, to be there for them. >> reporter: although off and on and rick hope their kids won't ever have to watch the video because she beat the odds and long outlive its relevance.

[ music ] >> well, we have been advertising a big change in the weather pattern all week long. it is still set to move in. it will move in as we do head into your thursday. right now the maps on live stormtracker 2 you can pick out the coverage and even the snowfall showing up in the white. i am watching this activity up to the north up moving into mendocino county. the wind speeds have been cranking up. you can pick right up around oakland winds gusting to 26 miles per hour. even inside the bay itself wind gusts to 26 sustained at 17. here is a look at the overall weather story for tonight. we do have mostly cloudy skies and gusting winds like we just showed you. tomorrow some cool showers. tomorrow is not a rain-out but still off and on showers throughout the day. mostly for the morning hours. winds will continue to be out there right around 40 miles per hour. aisled mix and the temperatures begin to warm up.
