. complete bay area news coverage starts right now. this is ktvu, channel 2 news at 10:00. a peaceful end to the large protest in oakland on this, the eve of mehserle's release from jail in the bart shooting case. good evening everyone, i'm heather holmes. >> and i'm ken pritchett sitting in for ken wayne. well, the crowd was there, the emotion was there. protestors gathered in oakland on the release of mehserle. mehserle's fatal shooting of oscar grant touched off

numerous violent protests in the past. but tonight things remained peaceful. we have team coverage of today's events. deborah villalon monitored the crowd downtown. but we start with ktvu's eric rasmussen at the fruitvale bart station where the crowd heard from oscar grant's family. >> reporter: they did, ken. this is something of a symbolic sight after oscar grant was shot and killed up on that part of the platform there two and a half years ago. knowing that mehserle could now get out of jail in la in a matter of hours, people here were certainly angry but peaceful. >> protesting for who? >> oscar grant. >> protesting for who? >> oscar grant. >> reporter: 200 or 300 people took to the streets in oakland in the name of oscar grant once again. >> protest for peace. >> reporter: the i am meant release -- i am meant release of mehserle 11 months into a

sentence for shooting oscar grant. >> justice has not been done. that has to stop. >> reporter: his nephew was killed on new year's day 2009. demonstrators held signs that said justice for all. >> what happened to oscar is gone and it is history. but this is not history. >> reporter: but violence did not happen this night as the police kept watch over the crowd. >> she loved her father and i loved her father. and i am robbed of a husband and she of a son. i just want accountability. >> what do you do? >> pray. >> reporter: the department of justice is asked to look into possible civil rights violations in this case. the concern, of course, in the past has been for those who

weren't part of the actual protest causing problems like we saw last summer. so far we can tell you things here are quiet. live in oakland, eric rasmussen, ktvu, channel 2 news. and it is calm tonight, too, downtown where that march ended. a rally blocked broadway for a time. but when organizers called it a night, well, everyone went home. ktvu's deborah villalon is live now with what made the difference. deborah? >> reporter: well, they had free bus rides back to fruitvale bart that helped disperse the crime. so calm at this pizza restaurant here on broadway which had planned to close early and board up is open as usual. there has been only one arrest all night. that's vandalism during the march someone tagged a building. but tonight's rally just didn't have the heat of the past. hundreds of people poured on to broadway spreading a banner reading "justice denied." the police escorts stood by. officers made no move to clear the intersection.

and the opd perimeter stayed far away, out of sight. >> we are all oscar grants. >> reporter: for two hours an open mike opportunity for everyone to vent. >> it is really like a punch in the gut that this man is getting out tomorrow. >> reporter: organizers wonder what will happen when people actually see mehserle free. >> it won't surprise me if folks took to the streets tomorrow. >> reporter: the earliest demonstration came without planning spontaneously after the killing. later protests also evolved into street violence and vandalism. the shoe store looted so badly last summer it is boarded up tonight along with several other businesses. but monitors were on hand to nudge everyone home before dark. >> you can't come to our event and try to hijack it. or or organizers leaned on the so-called anarchist crowd to lay-off the spray-paint and window breaking. >> you can't control what they do tomorrow or next week or

just click on the mehserle tab near the top of our home page. the family of a missing nursing student refuses to give up hope despite police statements that michelle lee is dead. ktvu's paul chambers was with the family today as they made a new effort to find her and brought in some high profile help. >> reporter: friends, family members, even strangers went door-to-door today talking to residents and passing out these flyers. they are hoping to find something more about lee's disappearance. >> i asked people if they have seen anything. yes, maybe something might have come up. and in case they don't want to talk to the police. >> we still have so much hope in bringing her back. and we are going to keep fighting to bring her home. >> reporter: 2500 flyer willings were printed and now being passed out in different neighborhoods. they are not learning much about the investigation from the police. but they feel they need to take matters into their own hands. >> we're frustrated with the

fact that we don't have any evidence as to where the case is going or whether or not she, you know, we should stop our efforts. so until we get that evidence, we're going to fight for her. are. >> reporter: today mark came to show his support for the family. it is hard to believe that police have any solid evidence. he feels both sides are looking for different goals. >> law enforcement hopes to solve the case. hopefully they will solve it sooner or later. the family wants to bring michelle home. >> reporter: on friday they searched for lee in niles canyon. the family will pass out these flyers until they have proof that lee is dead. paul chambers, ktvu, channel 2 news. more details now on the michelle lee case. she was last seen may 27th when she left for a break from kaiser medical center in hayward. since that time, police have questioned about 40 people in the case. after evaluating the evidence on june 6th, hayward police

declared the case a homicide, saying they had reason to believe that michelle lee was killed in a parking garage. the reward money in the case stands at 65,000. tonight the family plans to distribute flyers again next saturday. an elderly hiker is recovering from dehydration tonight after being lost for hours in an east bay park. 88-year-old alice weller became separated from her husband about 5:00 yesterday evening while hiking on a trail in the volume value cay be volcano hills. the volunteers and park police from the valley sheriff's office found her at about 10:00. another legal battle over the same-sex marriage ban is set to begin tomorrow in a federal courtroom in san francisco. the sponsors of proposition 8 want a previous judge's decision tossed out. they will argue before the appeal's court that because

u.s. district court vaughn walker was in a gay relationship, he had a conflict of interest in the case. they ruled the ban on same-sex marriage unconstitutional. he has since retired from the bench. it was a celebration of gay pride today in la. the 41st annual la pride parade drew more than 400,000 people. olympic figure skater johnny we're was wear was the grand marshall. it celebrates the gay and lesbian and brings awareness to injustice. officers arrested ramirez three weeks ago in the beating of bryan stow. investigators say they have strong evidence ramirez is responsible for the beating. ramirez' attorney says there are a dozen people ready to testify that his client was home at the time of the attack.

the office of congresswoman gabrielle giffords has released the first photo of here since a would-be assassin shot her in the head. one shot shows her with her mother. in the second she's by herself. but in both she's file -- smiling. the pictures were taken may 17th at the houston rehabilitation center where she's recovering. she's now speaking in full sentences. she's making remarkable progress. we are so proud of her. she's working so hard. she has a long way to go. but you can see just how beautiful she's and we are longing and looking forward to her coming back to work. gabrielle giffords is expected to leave rehabilitation this month from the january shooting in tucson killed six people and injured 13 in all. gunman jared loughner is held now and the judge says he will be until he is fit to stand

recovery is still happening. >> this is what the harbor looks like. >> it hit a lot of new boats. >> this is what the wooden fishing boat made it through. >> the dock is starting to be ripped away. >> the tsunami demolished this dock and pushed the vessel into the rocks. now sitting high and dry it took weeks to get into the harbor's only repair shop. >> there was such a backup for it, you know, we kind of just kept nagging until we got in. >> we have over 60 people on the list that are damaged vessels. >> reporter: those vessels fill up this yard. in fact, a year's worth of work awaits. >> we are doing more of a triage, really, fixing the absolute necessities and trying to get people to be understanding and possibly come back later for the things that aren't so necessary. >> reporter: a necessity for the shop was also ruined in the tsunami. >> normally if these were in safe and operable condition this time of year these would be full of boats. >> reporter: you -- but he says with the docks damaged no oil

repair or damage repair here. >> this is our busiest time. it is very difficult. >> reporter: so the owner of asquare i couldn't say boatworks has been working sundays. >> the boat owners and repairmen can work so fast and on overload. we have gotten the major claims taken care of now. >> he typically has one insurance claim a month. he has 58 on his desk right now he says because of the tsunami. reporting live in santa cruz, maureen naylor, ktvu, channel 2 news. words of optimism from the fire lines in eastern arizona tonight. for the first time since the massive fire started last month, firefighters said today they were making progress in their fight to put down the flames. in the meantime, about 7,000 residents who had been evacuated were allowed to return to their homes today. they expressed gratitude to the firefighters. >> when all of those firefighters out there spend

this time and putting their lives on the line for their community to save as much as they can. >> i don't know how they do it every day. >> to date the fire has scorched 693 square miles and burned two dozen homes. at last word, the fire is 6% contained. the plane that crash-landed safely in what has been dubbed the miracle on the hudson is now at the carolina's aviation museum. a reception was held this weekend in charlotte, north carolina for the passengers and crew members who were on u.s. airways flight 1549. the captain was on hand, as was the co-pilot who was flying the plane when it hit the flock of geese that knocked out both of the plane's engines. >> this is the first time i've seen this aircraft since i stepped off into the raft in the hudson river two and a half years ago. >> all 155 people onboard survived the water landing in january of 2009. the display is scheduled to open to the public on the third

anniversary of the landing. apple is being sued for trademark infringement over its new icloud service. icloud communications based in phoenix says it has been using the name since 2005. they filed a lawsuit this week in arizona. just last month apple's ceo steve jobs introduced the new service in san francisco. the feature wirelessly synchronizes data between all apple compatible devices. apple has not yet commented on the lawsuit. well, shock has turned to outrage in alameda over the response to a suicidal man. ktvu's allie rasmussen was with a group of residents as they demonstrated how easy it would have been to save his life. >> can you hear us out on the water? >> reporter: the man with the bull horn was pretending to be a police officer. >> go out there and effect a rescue. >> reporter: the 11 people in the water on alameda's crown beach don't need to be rescued. this is all staged to be a

statement. >> the alameda fire department and the police department is not available to do their jobs. they are not properly trained. they don't seem to be able to respond correctly. and they are causing harm to the community. >> reporter: it was memorial day weekend when alameda fire were called to help rescue a man wading in the water trying to commit suicide. police and fire arrived but they stayed on the shore and never went into the water. 52-year-old raymond zack drowned. this woman watched it happen. >> we stormed up to them and said why doesn't somebody go in? well, they said our policy is we do not go into the water. >> reporter: alameda says their department water rescue certification had expired and they weren't equipped with cold water gear. the chief didn't return our calls for comment this morning, but city leader says 16 firefighters will receive water rescue training. the mayor has called for an investigation. but the group here says it is not enough. >> the only thing that will satisfy me and the others of us

who have organized this is a criminal investigation by the department of justice. something is very wrong in alameda. >> reporter: organizers say this event was supposed to show how different the outcome could have been. in alameda, al rasmussen, ktvu, channel 2 news. >> resident students from the uc san francisco dental school spent the day giving kids free screenings. it's all part of the city's family health and wellness fair at the bayview opera house. volunteers say the key to preventing tooth decay is early detection. and the screenings are important not just for the kids but for the parents as well. we're trying to reach out to people and tell them that their kids can get cavities and help them understand how to avoid it and how to prevent the cavities. and tell them that we are here as a clinic to take care of their community. >> the students also applied fluoride varnishes to the kids' teeth to help prevent cavities. well, the pain at the pump is easing just a bit. one of the fastest prices are

. pain at the pump is easing with another big drop in gas prices. prices have fallen 17 cents during the passed three weeks. across the u.s. a gallon of regular gas now costs $3.74 on average. according to aaa, san francisco drivers are paying $4.04 per gallon this weekend. the price has sunk to about $3.92 in oakland and $3.93 in san jose. today the president's job council offered a progress report on how to increase hiring and manufacturing,

construction, tourism and healthcare. as part of his agenda to push for job creation, president obama toured an auto factory class last week. but the council recommends improving factory training, as well as cutting the red tape for new projects and easing the visa entries so that more people travel in the u.s. mr. obama will meet with the jobs council tomorrow. a series of earthquakes hit christ church, new zealand, topping world of the news tonight. the first quake was a 5.2 that struck during lunchtime. the second struck an hour later and was recorded as a 6.0. so far, there are no reports of any deaths and only six people are said to be hurt. now the quake followed february's 6.0 quake that killed 181 people. well, the mayor of christ church says there is just everywhere following today's quake and that people are very shaken. from libya comes video

today from the outskirts. rebel fighters say they were able to capture ten of moammar gadhafi's troops. this has been the scene of heavy fighting since february. more than 1,000 people have been killed in that city since then. and that includes hundreds of civilians. and from syria tonight, new amateur video that reportedly shows syrian troops beating bound and blinded anti- government protestor it is. the video comes as the government regained control of a key northern town. the troops bombarded that town and burned the field. the government forces were responding to an uprising by defecting soldiers and civilians calling for the ousting of alasad. tomorrow the pentagon papers will be released 40 years after first published. the papers reveal government lies and mistakes in the vietnam war. portions appeared in the new york times on june 13, 1971. that triggered a constitutional

crisis over freedom of the press. a federal judge blocked further publication, but eventually the supreme court struck down that ruling. 7,000 pages will be released with only 11 words remaining secret. the intention was construction. the result was destruction. it seems a construction crew couldn't figure out how to get a hot tub around a home in shoreview, minnesota. so the crew tried to lift it over the home with a crane. but that plan had disastrous consequences when the crane smashed into the house, taking out much of the roof, the chimney and a fence. the homeowners were not talking. but the neighbors shook their heads in disbelief. i pray for them that their house gets fixed because i know they just moved in. >> the crane company says there was a computer malfunction. . governor brown said late tonight there is no deal yet for the state budget but a vote will happen tuesday. in a youtube video released tonight the governor says he is perplexed he has been unable to get a deal done but he will fight on for his plan which ultimately requires a controversial tax extension. wednesday is the deadline for legislatures to submit the budget to the governor. one idea to boost state coffers has to do with your dinner plate. ktvu's patty lee shows you the new push to get you to buy local. >> here you go. >> reporter: you probably know

one, a locavore who shops at local markets for the right reason. >> fresh products and they are organic and they are a small business. >> reporter: actually, it's big business. california's agriculture industry is valued at $35 billion and the concept of buying local has expanded from supporting the small farmers in your neighborhood to all farmers in the state. >> the movement is getting so large it is almost becoming a mandate, a resolution asking shoppers to make a conscious decision to buy california- grown products once a week. industry leaders rolled out a campaign to convince californians to dedicate one day a week to eating only california-grown foods. >> if everyone ate cam-grown food on sundays whether it's chicken or vegetables, it increases by billions the economy in california. >> reporter: that shift in shopping habits could pump $15 billion in sales a year into the local, that is the state's economy. >> it may cost $1 more or so.

but you know what that's what's going to keep california viable. >> if i am in the habit of doing it, i will try my best. but you know i don't always pay attention. >> reporter: at the village market in oakland, buyers say they are committed to stocking shelves with local products which help makes buying california grown less of a conscious choice than one of the only options. in oakland patty lee, ktvu, channel 2 news. san francisco police are looking for suspects in an overnight shooting that sent one man to the hospital. officers were called out to the scene around 2:30 this morning near a roundtable pizza restaurant on gary. one man was injured from the gunfire. his condition tonight is unknown. police track down four possible suspects on mesonic. still no word on what led to the shootings. bart service suffered an interception this morning after part of the transbay tube was shut down to investigate the report of a fire. a train operator reported what

looked like a small fire at 8:45 this morning near the embarcadero station. bart crews went out to look but didn't find anything. one passenger on her way to work took the matter in stride. >> i have an hour so i was hoping to get there early. and usually it is fine on a sunday, you know, very low-key and not crowded. >> bart says the incident caused delays of as much as 20 minutes. bart says normal service was restored at 10 to 10. current lieutenant governor and former san francisco mayor gavin newsom and his wife have a new addition to their family. hunter was born this morning in san francisco. he weighed in at eight pounds, four ounces and is 20 and a half inches long. this is the second child to the couple. their daughter montana is 20 months old. well, the creators of south park have stormed broadway with their musical "the book of mormon" winning nine tony awards tonight. ♪ i believe ♪

you on live stormtracker 2 things are stabilizing right now with mostly clear skies but also have some fog forming on parts of the shoreline closing in on san francisco. the fog will continue to re- group in the short term. right now santa cruz is reporting partly cloudy skies. earlier today in santa cruz actually had a camera out there showing you a beautiful day to be out on the water. the temperatures at least with the afternoon highs on land topped out in the lower 70s. and santa cruz over the next couple of days will be approaching the upper 70s, possibly 80 degrees. so it looks just great in santa cruz today. tonight we have fair skies and coastal fog out there tomorrow. clearing skies will warm things up inland. in the extended forecast more fog and a bit of a cooling trend. nothing major out there. as far as overnight lows, coolest locations in the lower 50s. san francisco is 53 degrees. san jose is 54. antioch in the mid-50s right around 55. high pressure continues to strengthen and push into the bay area. so as a result, we will warm things up for monday and tuesday. the warmest locations tomorrow

approaching the mid-80s. tuesday will be the day, that will be the day of the warmest inland neighborhoods could be in the upper 80s flirting with the 90 degrees mark. some patchy fog is showing up coastside clearing into the afternoon hours with the beaches in the 60s over the next few days. the anticipated picture first thing tomorrow morning at 6:00 some fog showing up coastside here. also into the bay. and then we will put this into motion into the afternoon hours. decreasing clouds with overall mostly sunny skies. we could have some partly cloudy observations near parts of the shoreline for tomorrow afternoon. here is tomorrow's forecast beginning at 7:00 coastal fog. 53 to 58 degrees. and then by 12:00 clearing skies 58 to right around 75. by 4:00 tomorrow afternoon, mostly sunny skies. but remember we could have some partly cloudy skies near parts of the shoreline. the temperatures the low 60s to the 70s. warmest locations approaching the mid-80s. here is a look at the numbers
