wiped out. she said heritresser her treasurer has stolen from her. how much she didn't know. ten days ago the political operative was arrested for fraud for allegedly taking hundreds of thousands of dollars from two other politicians. >> a developing story out of oakland where firefighters mopping up an apartment fire. it started at about 8:30 at a complex on newton. fire quickly went to two alarms. firefighters said thick black smoke was coming a third floor apartment. a viewer caught this picture of flames shooting out of the building. >> my apartment was right next to the one and grabbed my keys and my phone and ran. then, stood and watched as the flames were coming out of the window. >> one man was hurt in the tire but officials say his

didn't go onto the bart platform meaning no station shut downs and a hassle free commute. they faced off with police outside of city hall tonight but after officers blocked the entrance they headed back to bart. they stormed the civic center station but never went past the fair gate. >> i guess that's fine. as lock as it's not holding me back. >> reporter: bart said none of the stations had to be closed like during previous protests. >> we hate to close the station because we know that impacts the people who want want to get on the train and go home. >> reporter: these weekly protests have drawn the attention of the federal government. tonight we saw agents from the department of homeland security and bart said they have been working with the fbi. demonstrators don't understand it. >> they are treating this situation as if it's covert terrorism. it's freedom of speech.

we have the right. >> reporter: and a new bulletin said the online hacking group anonymous that organizes the protests is consider a potential national security threat. something mike grant disputes. >> it's kind of ridiculous to assume that the actions of one or two people on line doing it anonymously suddenly dictates that everybody else online agrees with them. >> reporter: for the 5th week in a row protesters focused their anger on bart but did it without angering passengers. and in the end no protesters were arrested tonight and bart said all the trains ran on time. we are live in san francisco, ktvu channel 2news. >> two men entered not guilty pleas in connection with the drive by shooting that killed a

child. the man was targeting two rival gang member when is he shot the 3-year-old. a 22-year-old is also charged with murder. authorities say he was driving the car during the shooting in oakland. they also face two counts of attempted murder for wounding the men. two men accused of killing a woman and burning her body pled not guilty to murder. her body was found in oakland's rock ridge neighborhood on july 14th. the men face additional charges for kidnapping. >> more than $50 million. that's the estimate for the cost of brian stow's medical care. that was used in court papers last friday. he and his children are suing the dodgers for the beating he suffered. his family said he is responding to some commands again. bank of america announced major job cuts today.

they said it'll eliminate as many as 30,000 positions in the next few years. the job cuts come on top of the six thousand layoffs they have put in since january 1st. some bay area customers said the layoffs just wrong. especially after the bank took a 45 billion-dollar tax pay bailout. >> it's a shame and people should go to other banks, maybe smaller ones. why should they get all the money and lay people off? >> the bank issued a statement saying it hopes to avoid laying off many through attrition. >> the president threw down the challenge to republicans in congress today and sent them his 447 billion-dollar jobs bill. >> this is the bill that congress needs to pass. no games, no politics, no delays. >> the president was surrounded by workers he said the bill would help. shortly after a representative went to the house and delivered

the bill. previously the house speaker said it would be considered but today he was critical saying it would increase taxes on job creators. the white house outlined what the bill would do for each state including california. it figures 710,000 businesses would be able to apply for a payroll tax cut for workers and california would get four billion in highway and transit money. it would extend unemployment benefits also. the administration also outlined how it would pay for the plan. about 400 billion would come from limiting deductions for those with high erin comes, 40 billion from closing loopholes for oil and gas, 3 billion for changing taxes on corporate jets and 18 million from requiring fund managers to pay more taxes. >> back mere we will talk about thunderstorms in the mountains and the fog that's returning. >> and for the second time in

has gone out at san jose alerting students about a sexual assault. heather holmes is live where police are increasing patrols. >> reporter: they certainly are. in fact we have watched as this police car has been parked here much of the night. we are outside the dorms known as campus village near the scene of the latest assault. fresh off her evening work out jill wasn't thinking about her safety but after seeing the had line in the paper of a second student sexually assaulted this week she started thinking about it. >> it's sort of scary since like i go work out at night and we walk around by myself. >> reporter: she is now considering changing her nightly routine. police say around 2 yesterday morning a female reported being assaulted off campus near 9th just two blocks from the university police station. >> it's terrifying to like see that happen. >> reporter: sunday's assaults after another female student

and is seven months pregnant. today's proceedings were put off until next monday. she is a ceus of murdering le. a football player has been release from jail and is not being charged for a violent hit during a game that put another player in a coma. he was seriously injuried in june suffering a brain injury. the 26-year-old patrick power was arrested thursday but released the next day. the da said it's still investigating the case. >> a charge construction project is now underway that will redo a major artery in south san jose. it's between blossom hill road and brannon. robert honda says while the improvements welcome the timing is less than perfect. >> reporter: the long awaited expressway improvement project is up and running. the federal funding finally in place crews started the eight

christmas season they have to pull back and not be working in front of the major commercial outlets. >> reporter: officials acknowledge it'll be a tough balancing act. reminding the public shops will will be open during construction. in san jose. >> the 10th anniversary of the 9/11 attacks has passed but thousands have spent the day remembering the lives lost. the memorial site at ground zero opened to the public today. the names of almost 3,000 victims are in bronze panels that surround twin pools where the towers once stood. visitors say the monument is a fitting way to remember the tragedy. >> i'm honored to be here today. it didn't affect us, but the whole country. >> the place to come and honor and remember their loved ones but it's also a place to be filled with hope. >> reporter: those who planned

west slopes, thunderstorms popping up in the late afternoon. that will continue the next couple days. we look like we are in the clear for thunderstorms but we have fog reforming at the coast and temperatures edging their way up. it was warmer today than yesterday. 87 and antioch, 86 fairfield. highs tomorrow about two or three degrees, along the coast we had clearing today. i expect a little bitl bit of clearing tomorrow. that will put you maybe in the mid60s out at the golden gate park near the whipped mills. temperature across the bay in the berkeley area in the upper 60's. 70's and 80's in to the valley. it's not a real hot day tomorrow but slightly warmer than today. right now tracking the fog. when i come back i will show you where it is now and also what you can expect for a daytime high in your neighborhood. i will see you back here. >> mosquito fogging is scheduled for parts of concord tomorrow because of the west nile virus. the area is a round oak grove

fish population is increasing. a record spawning of minnows led to the salvage of 7 million fish returned to the waterways. >> i think it may be a grossly over stated number. with that many out there there should be evidence of that. >> reporter: fish and game say because they are so small it's possible fishermen may not have noticed. >> i had no idea what they are talking about president the bottom line is that none of us know where the fish are. >> reporter: one thing they agree on is that the delta pumps aren't good for the fish. >> there would be more fish without the water -- these pumps kill a lot of fish and change habitats. >> reporter: up to 75% of fish die before they make it to the screens meaning if 11 million were saved this year up to 100 million were sacrificed. fish and game admitted that the pumps kill millions of fish but

just because it's legal doesn't make it right. at least that's the position of the ones we talked to. they hope that two lawsuits filed last year will help tip the scales in their favor. >> three teams of firefighters from the north bay are on the fire lines in kern county battling several fires there. are three, twoo southeast of bakersfield. officials say lightning sparked owl of them offer the weekend. fires now cover about 87 square miles. firefighters have evacuated several hundred homes and one school district canceled classes. in texas some residents of the wildfire areas were allowed to return this their neighborhoods today outside austin. many found there was nothing left but ashes. more than 1500 homes were destroyed. as of today the largest fire was 60% contained there is one

big business in more ways than one. >> cable cars, the barry building and city hail, famous landmarks in san francisco that often end up in movies. possibly the most famous of them all, the golden gate bridge. they were seen throughout the movie rise of the planet of the apes. pictures were filmed on location but no actors were ever on site. >> the general public doesn't know that. they will still come looking for the locations where the film was shot. >> i went to the park the first thing. >> san francisco is very beautiful. i wanted to see it in person. i took a trip up here. >> reporter: since january there have been eight movies including temptation filmed in part or totally here. it think itself will bring in more than $56 million this fiscal year.

and korean pastries and speciality foods. >> and let's go to the live storm tracker. there was a flash flood watch for the lake tahoe area. thunderstorms popping up throughout this area. the good news was there was so much rain they had the flash flood watch but also helping firefighter was the cloud to ground lightning. you still have all the activity up near redding. we aren't expecting any thunderstorm activity but the next few days, the next 48 hours more of the same on the west slope. i bring that up because we are in the height of fire season and there will be lightning strikes again tomorrow. there were several today and will be again tomorrow and on wednesday. the west slope we should be clear. 65 fairfield. the fog is not quite back at the coast. it's still clear out the avenues but the fog will be next in the next hour or so, start to push in at the coastt.

will set along the coastal sections, it won't have the big inland coast. many of us will be clear and then the coast will be foggy, the sun will come out for most of us and temperatures will warm just a bit. there will still be mountain thunderstorms, you will see a few high clouds lue -- this high pressure setting up doing what it would normally do this time of year. the nights getting longer, days getting shorter -- with that we are looking at overnight lows in some areas like tonight. up in have the i bet down to 49 degrees. the computer model verifies the activity on the west slope. thunderstorms like the heat to 3, 4, 5, they start to develop. most of the activity down south to the white mountains. you get the idea firefighters are watching this. wednesday afternoon, look at this. little bit of wrap around stuff
