positive for west nile. officials say the pesticides they're using is not dangerous to humans. >> i think it's an important part of living in this community. you keep the west nile down with the mosquito control and so forth. >> reporter: so far this year there have been no reported cases of west nile in humans. but in the last year, 36 people have been diagnosed with that disease and two have died. some tech start ups are upset that the port is evicting them from their offices. those folks put down their computers today and picked up protest signs. >> we filed the notice on september 6 saying you have to be out of here on september 30th. >> reporter: jason wong is one of about 20 people that work

here at the start up hub. >> it's really kind of crazy that san francisco would want to shut this down. >> reporter: last week the port of san francisco notified all tenants that inspectorred had found the building unsafe and ordered everyone to leave. >> kind of put us in a bind so we've been running all over the city trying to find new office space that we can move to immediately. >> reporter: tom brown says he had sublet the building. tom says he offered to make necessary repairs but the port has not responded. >> every city in this country and probably the world, if they called what i would call a jewel of job creation and tech invasion they would bend over backwards to say what can we do to help you. >> reporter: skeptics know that eviction comes just as the city

is preparing for the america's cup. we do know the governor has asked to meet to resolve the issue. university of california officials are preparing a plan that could dramatically increase tuition again. they need more money to maintain the quality of education. in the last five years, tuition has nearly doubled to $12,000. university is asking regents permission now to raise tuition by as much as 16% a year over the next four years. now about five years ago, tuition and fees cost undergraduate california residents nearly $6,100. since then tuition has risen steadily. if the regents approve the 16% hike next week, tuition in 2012 will be just under $14,000. then it could rise to $21,000 in 2015. four teenagers are facing

murder charges. police announce the arrest today. david lee hall and three juveniles who are 15, 16 and 17 years old are seen in this surveillance video running from the scene. the four are accused of killing antonio torrez to steal a gold necklace he was wearing an and an i pod. police say their break came after one of the teenagers bragged about the shooting. this is one of the men wanted for a botched robbery at home depot. an oakland s.w.a.t. team surrounded the store near san pablo. police say they have surveillance video of killin helping cantrell and that the gun cantrell was carrying was actually a fake. the stand off lasted for hours, all of the employees were able to get out safely. we're getting more information on more explosive found after a bomb scare this

afternoon. it started after lunch time. news chopper two was overhead as that scene unfolded. police say mark sublot kept explosives and firearms inside the home. officers detonated the explosives in the front yard around 6:40 this evening. just a short time ago, police told us bomb technicians found four additional devices inside the home. officers took sublot into custody. new information about a bizarre incident where a 4-foot grenade launcher was found in the backseat of an suv driven by a 15-year-old. we have more on what caught police' attention. >> reporter: it is a good question for police, how did a 15-year-old boy get his hand on a rocket propelled grenade. the teen driving this blue

dodge durango was blasting loud music. after the stop, officers saw something very unusual in the backseat. >> it's unusual to locate a device, a rocket launcher in the back of a vehicle. >> reporter: you can see it here standing vertically on the sidewalk. the device is a rocket propelled grenade. this you tube video shows it's destructive power. able to penetrate concrete bunker and even tanks. not taking any chances, police shut down busy nevado boulevard and evacuated near by businesses. >> now that you know what it was what do you think? >> i think i'm glad we evacuated. >> reporter: patients at this medical office building couldn't get to their appointments. >> i heard helicopters, all kind of sirens. i finally went downstairs, an officer came up and told me what was going on. and i was very surprised. >> that's a little scary.

little girl's story. >> reporter: this summer 9-year- old rachel beck's story made national headlines when she died. but her story lives on. she's given the remarkable gift of life to a man who lives right here. >> knowing that a child passed away and the family made available this organ available for me is too much emotionally. >> reporter: less than two months ago, mark says his kidneys were failing. he had been on the transplant list for five years, waiting for the perfect match. late march the call came, a 9- year-old had been taken off life support, the child was the perfect match. the identities of both the donor and the recipient were kept confidential. but a week later, he heard the story of a girl called rachel

beckwood who had started to raise money for a fund called clean water. when beck learned how she died he realized his kidney came from rachel. >> i received a gift that you can't even describe how big it was. >> reporter: mark donated to rachel's cause and wrote a thank you note to her family. >> i had my life returned to me and as repayment to rachel i plan to carry her charitable torch for the rest of my life. >> reporter: mark's tone struck a note on the public. >> rachel was an emotion girl and i got that part of her. >> reporter: now rachel's family says mark is a part of them. mark says he hopes the story and the nation's generosity will encourage others to become organ donors. rescue workers found joshua

rob in the san san bernardino mountains today about a mile from grand view elementary. the boy was taken to a los angeles hospital by helicopter. he doesn't speak much. he is tired but other wise in good condition. the child is believed to have left school monday morning by squeezing through the bars of a metal fence. and school officials say the boy has a history of running away. in a courtroom in hawaii today, a 38-year-old man from santa cruz pled not guilty for murder. ier ral galaway is accused of first degree murder -- gerald galaway is accused of first degree murder, attempted murder

funds to keep the board up. a class action suit was filed today in san mateo county superior court against natalie's salon. the suit charges that employees often work more than 10 hours a day but were never paid overtime. ktvu was unable to reach the managers of the salon for comment. prices are rising at the gas pump and bay area drivers are feeling the pinch. gas prices shot up 12-cents a gallon in just one month to an average price of $4. that's 5-cents higher than the state average. oakland, fremont and concord saw the biggest jump. high temperatures today a little cooler in some locations. it was still pretty warm in fairfield and antioch. highs tomorrow cooler still. a lot of fog at the coast is pushing into the bay. i think we'll see more fog tomorrow morning when we get

a very close race in new york tonight in that special election to replace congressman weiner who resigned in that sexting scandal. the city of san jose took a big step to dramatically reduce the number of medical marijuana clubs in san jose. the owners of those clubs are furious. what they're already threatening to do. >> reporter: the city council spent two years trying to figure out how to regulate medical marijuana clubs. during that time the number of

clubs exploded to 140. so some club owners and patients call today's ordnance outrageous. >> i don't flaunt it, i need it. i have pain. >> reporter: regardless the council decided to limit the number of clubs to 10. licensing will come on a first come first serve basis. clubs must cultivate marijuana on-site. >> the most unrealistic thing about cultivating on-site is that federal law conflicts with us being to do that. >> reporter: but the sheriff says it's the best way to keep track of the pot. no matter how much the city believes it will work, pot club owners are weighing their options. at the top of the list, a referendum to put it on a ballot. >> this is california, there

will be litigation. that's just the way life is. >> reporter: the final chance for voters to change the mind of the council will be next week. county supervisors approved a ban on a smoking ban in condos. the ban would be phased in on existing units and new units. one supervisor said he was concerned about regulating what people do in their own homes. some residents on a los angeles suburb are in a quandary against coyotes. several neighbors are against a proposal to trap and kill the coyotes while others worry the coyotes will become more aggressive. there is a chance the coyotes will move on their own when that damaged house is torn down. airport pat downs that

transportation officials are working on making airport security a little more kid friendly now. today homeland security secretary janet napolitano made the announcement that changes are comes and they will include letting children younger than 13 keep their shoes on at checkpoints. kids will also now go through body scanners or body detectors instead of being patted down. this all comes after outrage on

videos showing children being screened. napolitano says the new rules will be released in the next week. u.s. transportation secretary ray lahood and federal aviation administration randy babbit says millions of the dollars were wasted this past month when a political fight led to work stoppages all across the country. some 70,000 workers were laid off during that time including workers at oakland international. >> don't tie whatever your political agenda is to our jobs and run people out of work and break them town to nothing. >> today the house approved an agenda. new figures offer an alarming picture of poverty in america. the number of poor is 15% equal to the population of california

and colorado. poverty is defined as a family of four living on $22,000 a year. and the number of people with no health insurance is 49 million. ktvu's lloyd lacuesta is live now in san jose to show us how even in the state's most affluent counties residents are struggling to get by. >> san jose the capital of silican valley in the most affluent county in california, still go below street level and you will find poverty. on the banks and creeks the homeless make their homes. encampments in santa clara county, where the median price of a house is more than $700,000. the median household income is $85,000. >> the whole year maybe 4,000. >> reporter: you can't survive? >> i can't survive on that. >> reporter: you find poverty

return. but some summer homes 20 miles northwest of tepachape have been evacuated the fire has burned some 100 square miles most of them sparse. some remarkable video now of people who risk their own safety to save a stranger. but even so they don't want to be called heros. it happened in utah. a motorcyclists became trapped under a car. a group of people rushed to help lifting the car and then pulling that man to safety. and it all happened while the motorcycle and the car were in flames. you see the man there being pulled to safety. that motorcyclists said today he is very thankful to everyone who stopped and saved his life. a paramedic who pulled off a daring rescue in walnut creek that is credited with saving the life of a woman is being recognized for his bravery. this video shows dave mencat as he pulled janet logan from the

walnut creek last year. a new report released today, the report commissioned by the state says san francisco's ocean beach will be the hardest hit. of particular concern the highway itself. a master plan for dealing with erosion is in the works now. the tracks on the california were damaged in several spots early this summer because of accidents and from flooding. one accident late last month happened in nebraska where a train hit a farm vehicle. eastbound service resumes this thursday with the train leaving from emeryville. westbound service begins friday out of chicago. california is looking with a critical eye at president

according to our exclusive new ktvu field poll, support for president obama in california is shrinking and his approval rating has hit historic lows in our state. alex savage tells us what's bringing him down. >> reporter: president obama seems to be losing ground in california. according to new numbers from the nonpartisan field research corporation, his overall job approval rating among likely voters is just 46% with 44% disapproval. this is the first time the president's job rating has dipped below 50% in california. just three months ago he

enjoyed 54% approval. >> they're down rating the president's handling of the economy and that's having this big effect on just how they view the president over all. >> reporter: on the issue of the economy, this new poll shows 40% of californians approve of the president' performance. one year ago that number was 48%. >> i think he's going to have a hard time getting reelected if those numbers don't get up. >> reporter: jay sullivan has been out of work for the past eight months. he believes the president is doing everything he can to create jobs. >> i don't believe he can be the one to take the blame for it all. i think it's up to congress to step up to the plate. >> reporter: some say frustrated job seekers are driving down the president's approval numbers. and if support of the president is slipping here in california, a traditional blue state, that could spell real trouble for his reelection. a trend he will try to turn

tomorrow. let's look at this one i was tracking. this one came down the river canyon up lake oroville. you can see it there there's some watches for it and it starts to fall apart as it moves down into paradise and down to chico. look at this from today. 24 hour loop and you can see along the spine of the sierra nevada. up near mount watson. tropical moisture not visiting the bay area but hammering the sierra nevada. weaver we're getting a lot of lightning and we're getting a lot of rain too. a similar pattern tomorrow. temperatures a little bit cooler around here: and thunderstorms getting sparked off on the west slope by 2:00 or 3:00 in the afternoon. tomorrow the fog is there. i have fog right now in the avenues. i have fog shooting across the mission district. we'll look at temperatures

tomorrow instead of in the upper 80s, i think we'll see low and mid-80s in the warm spots. so the computer model does this. here we are tonight. you see it, you have a couple of stray showers. we go through tomorrow afternoon and it starts again. not as severe, doesn't look. we're seeing less power in these storms. they're present tomorrow afternoon and again on thursday afternoon. right. and most of it is shifting east and shifting north a little bit. our constant player will be to the north. that cooling trend that we talked about is here. it's a subtle cooling trend that takes us to friday. and then for the bay area weekend the temperatures southerly go up. from 85 to 88. so not a big jump. 84 tomorrow in san helena. 84 in fairfield, not expecting any thundershowers around here. if you're headed to the lake tahoe area.

this year's north coast olive harvest is turning out to be a downer. growers say this year they are seeing less than half the amount of olives on the trees. one oil producer said the harvest is a quote disaster. this season has kind of been a disaster for the giants. they are hanging by one teeny little thread. >> but until they're mathematically, you're right. diamondbacks they played down in the desert so why not make them sweat a little bit down the stretch. that's all the giants have left to hope for. the only way they can make them
